LIVAS , Executive Director, Downey Successor Agency SUBJECT: RESOLUTION APPROVING ROPS 14-15B FOR THE PERIOD OF JANUARY 1 , 2015 THROUGH JUNE 30 , 2015 RECOMMENDATION That the O vers ight Board adopt the following Reso lution : A RESOLUTION OF THE OVERSIGHT BOARD TO THE DOWNEY SUCCESSOR AGENCY APPROVING THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE FOR THE PERIOD OF JANUARY 1 , 2015 , THROUGH JUNE 30 , 2015 BACKGROUND I DISCUSSION The Downey Su ccessor Agency is tasked with winding down t he redevelopment affairs of the f o rmer D owney Community Development Commission (C D C), including the admini st ra t ive tasks of preparing t he recognized debt payment sched u les re qu ire d u nder Assembly Bill x1 26 . Pursuant to the time l ine in the Legislation , the ROPS for the next six-month period m ust be s u bmitted to the Oversight Board for its review and approval. The ROP S must a lso be submitted to the Departme nt of Finance (DOF), the State Co ntrolle r , and the Los Angeles County Aud itor-Controller by October 3 , 2014 . T his ROPS c overs th e six-mo nth period f ro m J a nu a ry 1, 2015 through J une 30 , 20 15 , a nd o nly debts l is t ed on an approved RO PS may be paid with fun d s received by t he Su ccessor Agency from t he Redevelopment P roperty T ax Trust Fund (R PTTF). T he S uccessor Agency is requesting app roval for $286 ,310 in RPTTF fo r e nforceable debt obligations due in the app l icable six-month period . Below is a brief description of the debt obligations listed in the attached ROPS 14-15B . 1997 Tax Allocation Bonds -In 1997, the CDC issued $9 ,925 ,000 in Refunding Tax A ll ocation Bo nds to defease outstanding balance on the 1990 Bonds and to repay accrue d prin ci pa l and interest on note obligations to the City of Downey . T he ROPS in cl udes $161 ,310 for the next schedu led bond payment which is due Resolutio n Approvi ng the Recognized Obligation Payment Schedule (ROPS) September 18 , 2 01 4 Page 2 i n January 2015 . The outstanding balance of the Bonds as of June 30 , 2014 was $8,97 7 ,748. A d ministrative Cos ts -The ROPS includes $125 ,000 to offset administrative expenses incu rre d by the Successor Agency. Per AB x1 26 , the Successor Agency m ay receiv e an "administrative allowance " for certain admin istrative expenses inc urre d by the Successor Agency. The maximum amount the Successor Age ncy can receive is $250 ,000 per fiscal year. The Successor Agency is requestin g half of the allowed allocation for every six month ROP cycle . FISCAL IMPACT Approval of ROPS 14-158 would provid e a sufficient distri bution of RPTIF fun di ng to enab le the Downey Succ essor Agency to fu lf il l its obligations under ABx1 26 Attach me nts : "A "-Resolution , with ROPS 14-158 OVERSIGHT BOARD RESOLUTION NO. __ A RESOLUTION OF THE OVERSIGHT BOARD TO THE DOWNEY SUCCESSOR AGENCY APPROVING THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE FOR THE PERIOD JANUARY 1, 2015 THROUGH JUNE 30, 2015 WHEREAS, as a result of the passage of Assembly Bill 26 from the 2011 -12 First Extraordinary Session of the California Legislature ("ABx1 26" or the "Dissolution Act"), the redevelopment functions of the Downey Community Development Commission (CDC) were dissolved on February 1 , 2012 ; and WHEREAS, pursuant to Assembly Bill 1484 of the 2011-12 Legislative Session ("AB 1484"), the Successor Agency to the d issolved redevelopment functions of the Downey Community Development Commission ("Successor Agency") is a separate public agency now charged with winding down the CDC's redevelopment affairs, including making payments due for enforceable obligations (as defined in the Dissolution Act}, and perform obligations required pursuant to enforceable obligations ; and WHEREAS, the Oversight Board to the Successor Agency to the dissolved redevelopment agency functions of the Downey Community Development Commission has been appointed pursuant to the provisions of Health & Safety Code Section 34179; and WHEREAS, pursuant to Health and Safety Code sections 34177(1) and 34180(g), the Oversight Board must approve a Recognized Obligation Payment Schedule for it to become established , valid , and operative for the applicable six-month fiscal period. NOW, THEREFORE, BE IT RESOLVED by the Oversight Board as follows: SECTION 1. The foregoing Recitals are true and correct and are incorporated herein. SECTION 2. The Recognized Obligation Payment Schedule (''ROPS") covering the period of January 1, 2015, through June 30, 2015, attached hereto and incorporated herein by reference as Exhibit "A ", is hereby approved pursuant to Health and Safety Code Sections 34177 and 34180, and any other law that may apply to the approval by the Oversight Board of the identified ROPS for the identified periods. SECTION 3. The Secretary or authorized designee is hereby directed to post this Resolution and the identified ROPS for the identified periods on the Successor Agency's website, and to provide a copy of the identified ROPS for the identified periods to the State Controller's Office, State Department of Finance , and the County Auditor-Controller.
