FLORES, ASSOCIATE PLANNER SUBJECT: PLN-14-00020 (SIGN) – A REQUEST FOR A PLANNED SIGN PROGRAM FOR AN EXISTING MULTI-TENANT COMMERCIAL BUILDING LOCATION: 11400-11438 OLD RIVER SCHOOL ROAD ZONING: C-2 (GENERAL COMMERCIAL) BACKGROUND During its regular meeting on June 18, 2014, the Planning Commission held a public hearing to discuss PLN-14-00020, a request for a planned sign program for an existing multi-tenant commercial building. The applicant sought the Commission’s approval of the colors, size, and location of multiple wall signs, one freestanding sign, and one monument sign. The Planning Commission considered all of the information it received during the public hearing of PLN-14-00020. With that, they continued the item to a date uncertain, and requested the applicant redesign the sign program while emphasizing the following items: • The quantity of tenants proposed on the freestanding sign; • An excess of 45 sq. ft. of sign area at the freestanding sign; • The minimum setback requirement for a monument sign; and, • The quality of the proposed signs. DISCUSSION After considerable communication and a meeting with the staff, the applicant submitted the attached redesigned sign program. In regards to the concerns of the Planning Commission, the applicant revised the sign program as follows: • The applicant reduced the number of tenant signs displayed on the freestanding sign from 16 signs to eight, while increasing the number of tenant signs displayed on the monument sign from zero to eight; • The applicant reduced the sign area of the freestanding sign from 125 sq. ft. to 96 sq. ft. thereby still exceeding the allowable sign area of 80 sq. ft. by 16 sq. ft.; • The applicant proposes to meet the minimum 7 ft. setback from property line for the monument sign; • The applicant did not make any changes to the proposed can wall signs; • The applicant redesigned the freestanding sign to add a plaza identification component with push-through lettering, and changed the proposed colors of the can, return and cap Agenda Page 1 while reducing the quantity of tenants; however, the applicant did not change the original can design; and, • The applicant redesigned the monument sign to add a plaza identification component with push-through lettering, changed the proposed colors of the can, return and cap, increased the quantity of tenants and incorporated river rock veneer to the base of the sign. ANALYSIS The Planning Commission continued its review of PLN-14-00020, to allow the applicant time to redesign the sign program and address the concerns of the Commission. In addition to the sign area discrepancies between the proposed signs and the Sign Code, the Planning Commission sought higher quality sign designs for the center. The applicant introduced new materials and design enhancements for the freestanding and the monuments signs; otherwise, the primary difference between the sign program reviewed by the Planning Commission on June 18, 2014 and the revised sign program is the applicant reduced the number of tenant signs displayed on the freestanding sign from 16 signs to eight, while increasing the number of tenant signs displayed on the monument sign from zero to eight. Staff reviewed the sign program PLN-14-00020 proposes in light of Chapter 6 (Signs) of the Downey Municipal Code and determined the following: A. Maximum Allowable Sign Area Subsection (1) of Section 9618.02 (a) of the Code describes the maximum allowable sign area for on-site signs as follows: “(1) The maximum sign area shall be calculated based on the lineal feet of building frontage or as otherwise provided below. A maximum of one (1) building frontage shall be used to determine the total maximum sign area allowed for building signs except that two frontages may be counted for buildings located on lots or parcels with more than one (1) street frontage. Where a building has multiple frontages, the City Planner shall determine which frontage shall be used to calculate the maximum building area. The maximum sign area for building signs may be allocated to any building frontage as determined by the applicant.” Downey Municipal Code Section 9124 defines Building Frontage as, “That portion of a main building most nearly parallel to a street or parking area. Table 9.6.2 of Code Section 9618.02 states: “The maximum allowable sign area of all permit signs for each individual business shall not exceed two and one quarter (2.25) square feet of area for each lineal foot of building frontage.” Staff has created Table 1 to illustrate maximum allowable sign area for each building. Building A 100 225 Building B 257 578.25 Building C 125 281.25 Maximum Allowable Sign Area for all Signs On-Site 1,084.5 The maximum allowable sign area for all permit signs at the subject site shall not exceed 1,084.5 sq. ft. (based upon 2.25 of sign area x 482 ft. of building frontage facing Old River School Rd. and the parking lot). The maximum allowable sign area reflects the total sign area for all primary signs, secondary signs, and additional signs allowed on site by the Sign Code (i.e. monument signs, freestanding signs, window displays, and projecting signs). B. Wall-Mounted Signs PLN-14-00020 is a request to approve a planned sign program for the Old River Plaza; however, almost all of the signs it illustrates, exist in the form of wall-mounted signs for the individual tenants of the center. (A copy of the proposed sign program is attached to this report). The existing signs are “can signs” consisting of aluminum boxes with acrylic faces. They display a variety of font styles and background colors, which the sign program seeks to control. The wall signs on Building “A” are located on the façade, while the wall signs for Building “B” and Building “C” are located on a mansard. Section 9618.04 of the Code allows wall signs on a mansard or parapet, provided the sign area does not exceed the height of the mansard or parapet. It also requires them to be architecturally integrated with the roof. The proposed sign program for the Old River Plaza provides standards and specifications to assure consistent quality, appearance, and size for all signs installed at the center. These standards include general requirements and the tenant’s responsibilities for obtaining permits, and specify the location, placement, and general size of the signs. The sign program provides criteria for sign copy and logos. It calls out the allowed colors and fonts, while also describing the methods of fabricating and installing the signs. The applicant proposes that all wall signs shall be internally illuminated cabinet signs, with black cabinets. Tenants shall use “Helvetica”, “Book Antiqua” or “Cooper Black” fonts in Oracal Red, Oracal Brill Blue, or Oracal Black. The maximum height for the cabinet signs shall be 30 inches, with the length of the cabinet depending on the maximum allowable square footage of the wall sign and its desired height. Sign copy shall not exceed 75% of the sign area and supplemental copy and/or logos on the same size shall not constitute more than 25% of the copy area. The following photographs depict the existing wall signs at the center. Agenda Page 3 BUILDING “A” BUILDING “B” – Southeast View Agenda Page 4 BUILDING “B” – Northeast View BUILDING “C” Table 2 shows the standard of 1.5 sq. ft. of sign area per tenant frontage for primary wall signs as illustrated in the proposed sign program and as permitted by DMC Section 9618.04(i)(A) through 9618.04(i)(F). The applicant proposes to follow these standards, but only allows secondary wall signs to two tenants: 1) Building “A” tenant with an address of 11404 Old River Agenda Page 5 School Road., and 2) Building “C” end tenant with an address of 11432 Old River School Road. Ft. of All Wall Signs 842.25 C. Freestanding Sign PLN-14-00020 proposes one freestanding sign at the northwest corner of the property where Old River School Road and Burns Avenue intersect. The height of the proposed sign measures 22.42 ft. above grade, if approved. The sign program places the freestanding sign within an existing 288 sq. ft. landscape planter that runs parallel to Burns Avenue, immediately adjacent to the front property line. The proposed freestanding sign will consist of an aluminum cabinet painted BEHR Dark Burgundy, on a base that is to be stucco and painted Behr Ivory; the sign retainers and cap will be also be painted Behr Dark Burgundy. According to the Sign Program, the post measures 10 feet from the ground to the bottom of the cabinet, and is two and a half feet (2.5 ft.) wide. The applicant proposes eight tenant sign panels within a square cabinet box that measures 12’-0” x Agenda Page 6 8’ (96 sq. ft.). Each panel would measure approximately 18 inches high by 8 feet in length with white acrylic faces and vinyl lettering in Oracal Red, Oracal Brill Blue or Oracal Black. The proposed sign has an aluminum top that is also to be painted Behr Dark Burgundy. The freestanding sign will include one identification cabinet with “Old River Plaza” written in Oracal Brill Blue, with push-through lettering on an ivory background. Table 3 reflects DMC requirements as compared to the proposed freestanding sign. Minimum Setbacks 50 ft. from any interior side property line and 75 ft. from any residential zone 187 ft. from both PROPOSED FREESTANDING SIGN The proposed freestanding sign with 96 sq. ft. of sign copy area, exceeds the maximum allowable sign copy area for freestanding signs at a street intersection (80 sq. ft.). As such, the proposed freestanding sign does not comply with the applicable provisions of Article IX of the Downey Municipal Code. The following photograph depicts the existing freestanding sign that the applicant proposes to demolish and replace with a monument sign: Agenda Page 7 Existing Freestanding Sign to be Removed D. Monument Sign PLN-14-00020 proposes a monument sign along the west property line, visible from Old River School Rd. As proposed, the height of the new monument sign will be 8 ft. above grade. The sign program places the sign within an existing landscape planter that runs perpendicular to Old River School Road. The proposed monument sign will consist of an aluminum cabinet box that measures 7’-0” x 6’-0” (42 sq. ft.). It will display eight (8) tenant sign panels that measure approximately 15 inches high by 2’-11”in length, with ivory acrylic faces and vinyl lettering in Oracal Red, Oracal Brill Blue or Oracal Black The plan proposes river rock veneer at the base of the monuments sign as an accent material. The sign cabinet and retainers will be painted Behr Dark Burgundy. The sign will have an aluminum top that is also to be painted Behr Dark Burgnudy. The sign will include one identification cabinet with “Old River Plaza” written in Oracal Brill Blue push-through lettering on an ivory background. Staff Concerns After reviewing the Old River Plaza sign program, staff has a few concerns with the proposal: 1. The freestanding sign exceeds the maximum allowable sign area for its location. PLN- 14-00020 proposes a sign that is 96 sq. ft. in size; however, the maximum sign area for a freestanding sign at an intersection is 80 sq. ft. It is worth noting that Section 9610.04 (b) states that a Planned Sign Program may include deviations from the standards of the Sign Code, but the total sign area shall not exceed the area otherwise permitted, which applies to this case. The Applicant proposes a total of 980.25 sq. ft. of sign area and the maximum allowed is 1,084.5 sq. ft. These provisions provide flexibility to the Commission to resolve the issue stated above. Agenda Page 9 2. The materials, colors, and size of the proposed freestanding sign are not consistent with the structures located on the subject property or the site. The proposed base, cabinet, and cap colors are not compatible or consistent with the subject property’s existing color scheme. Additionally, the materials of the proposed sign are not harmonious with the architectural style of the existing structures on the property being that the sign is proposed to be an aluminum finish and not a stucco finish. Finally, the size of the proposed sign is out of proportion with the one-story commercial buildings that exist on- site. 3. The materials, colors, and size of the proposed monument sign are not consistent with the structures located on the subject property or the site. The proposed cabinet and cap colors are not compatible or consistent with the subject property’s existing color scheme. Additionally, the material finish of the proposed sign is not harmonious with the architectural style of the existing structures on the property being that the sign is proposed to have an aluminum finish and not a stucco finish as previously proposed. ENVIRONMENTAL ANALYSIS Staff has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA). Upon completion of this review, it has been determined that this request is categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing Facilities). Categorical Exemptions are projects, which have been determined not to have a significant effect on the environment and have been exempted from the requirements of the CEQA. Class 1 consists of projects that involve no or negligible expansion of the existing use. The planned sign program is proposed at an existing multi-tenant shopping center; thereby staff feels that this request qualifies for this exemption. CORRESPONDENCE As of the date that this report was printed, staff has not received any correspondence regarding this matter. CONCLUSION Based on the facts contained within this report, staff is of the opinion that the objective of Planning Commission’s actions were not met through the redesign of the proposed sign program, being that the Commission was looking for a higher standard of sign design. As such, staff recommends denial of the planned sign program, being that it does not comply with: all applicable provisions of the zoning code; the proposed freestanding sign is not in proper proportion to the site; and the proposed freestanding and monument signs’ materials, colors, and size are not compatible with the architectural design of the structures on the subject property. Thus, staff recommends the Planning Commission adopt the following resolution: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY DENYING PLN-14-00020 (SIGN) – A REQUEST FOR A PLANNED SIGN PROGRAM FOR AN EXISTING MULTI-TENANT COMMERCIAL BUILDING AT 11400-11438 OLD RIVER SCHOOL ROAD, ZONED C-2 (GENERAL COMMERCIAL) Agenda Page 10 RESOLUTION NO. ________ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY DENYING PLN-14-00020 (SIGN) – A REQUEST FOR A PLANNED SIGN PROGRAM AT AN EXISTING MULTI-TENANT COMMERCIAL BUILDING LOCATED AT 11400-11438 OLD RIVER SCHOOL ROAD, ZONED C-2 (GENERAL COMMERCIAL) THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The Planning Commission of the City of Downey does hereby find, determine and declare that: A. On January 28, 2014, Alberto Alonso, New Signs and Printing (authorized agent for the property owner Janet Alstrom, Robert M. TRB Livingston Dec'd. Trust and Marshall) and hereinafter referred to as “Applicant"), filed a Land Use Permit Application requesting approval of PLN-14-00020 regarding a planned sign program for the Old River Plaza located at 11400-11438 Old River School Rd. B. Notice of the pending public hearing was mailed to all property owners within 500’ of the subject site and a public notice was published in the Downey Patriot on April 24, 2014. C. The Planning Commission held a duly public hearing on May 7 and May 21, 2014 and continued the item at the request of Staff and the Applicant. D. The Planning Commission held a duly noticed public hearing on June 18, 2014, and continued the item so that the applicant may redesign the proposed sign program. E. Notice of the pending public hearing was mailed to all property owners within 500’ of the subject site and a public notice was published in the Downey Patriot on August 21, 2014. F. The Planning Commission held a duly noticed public hearing on September 3, 2014, and after fully considering all oral and written testimony, facts, and opinions offered at the aforesaid public hearing, adopted this resolution denying PLN-14-00020. SECTION 2. The Planning Commission further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to comply with the California Environmental Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing Facilities). SECTION 3. Having considered all of the oral and written evidence presented to it at said public hearings, the Planning Commission further finds, determines and declares that: 1. The proposed sign is permitted within the zone and it complies with all applicable provisions of this chapter, the General Plan, and any other applicable standards. The subject property is zoned C-2 (General Commercial) and was developed as a shopping center in 1968. The C-2 Zone permits the use of wall, freestanding, Agenda Page 11 Resolution No. _________ Downey Planning Commission PLN-14-00020 – 11400-11438 Old River School Rd. September 3, 2014-- Page 2 and a monument signs. Code Section 9610.04 states requires a Planned Sign Program for any site having three (3) or more nonresidential tenants. The Planning Commission shall approve the planned sign program before any sign permit is issued. The owner/applicant of the Old River Plaza is attempting to comply with this requirement by obtaining the City’s approval of the sign program PLN-14-00020 proposes. However, the proposed freestanding sign copy area is too large at 96 sq. ft., being that the maximum allowable sign copy area is of 80 sq. ft. for freestanding signs located at an intersection. As such, the proposed freestanding sign does not comply with the applicable provisions of Article IX of the Downey Municipal Code. However, the wall and monument signs comply with the applicable provisions of Article IX of the Downey Municipal Code and the General Plan. 2. The sign is in proper proportion to the structure or site on which it is located. The proposed freestanding sign copy area proposes to contain approximately 96 sq. ft. of sign area, which is 16 sq. ft. greater than the 80 sq. ft. maximum sign area allowed for freestanding signs at a street intersection. As such, the freestanding sign is not in proper proportion to the structures on the site. All other signs are in proportion to the site. 3. The sign materials, color, texture, size, shape, height, and placement are compatible with the design of the structure(s), property, and neighborhood of which it is a part. The applicant proposes that all wall signs shall be internally illuminated cabinet signs, with black cabinets. Tenants shall use “Helvetica”, “Book Antiqua” or “Cooper Black” fonts in Oracal Red, Oracal Brill Blue, or Oracal Black. Maximum height is 30 inches tall for the cabinet, with the length of the cabinet depending on the maximum allowable sq. ft. of the wall sign and desired height. Copy shall not exceed 75% of the sign area and supplemental copy and/or logos on the same size shall not constitute more than 25% of the copy area. As such, the proposed wall signs will be compatible with the design of the structures, property and neighborhood of which they are a part of. The materials, colors, and size of the proposed freestanding sign are not consist with the structures located on the subject property or the site. The proposed cabinet and cap colors are not compatible or consistent with the subject property’s existing color scheme. Additionally, the proposed freestanding sign copy area proposes to contain approximately 96 sq. ft. of sign area, which is 16 sq. ft. greater than the 80 sq. ft. maximum sign area allowed for freestanding signs at a street intersection. Finally, the materials and shape of the proposed sign are not harmonious with the architectural style of the existing structures on the property being that finish of the sign is to be painted aluminum and not stucco. As such, the proposed freestanding sign will not be compatible with the design of the structures, property and neighborhood of which it is a part of. The materials, colors, and size of the proposed monument sign are not consist with the structures located on the subject property or the site. Additionally, the material finish of the proposed sign is not harmonious with the architectural style of the existing structures on the property being that the sign is proposed to have an aluminum finish and not a stucco. As such, the proposed monument sign will not be compatible with the design of the structures, property and neighborhood of which it is a part of. 4. The sign’s illumination is at the lowest reasonable level as determined by the City Planner, which ensures adequate identification and readability, and is directed solely at the sign or is internal to it. The sign program includes construction details for illumination of all proposed signs. The specified lighting sources are set at the minimum standards needed to ensure that there is adequate readability of the signs. 5. The sign is not detrimental to the public interest, health, safety, or welfare. The proposed planned sign program is not detrimental to the public interest, health, safety, and/or welfare being that if built, it would conform to California Building Code 2013 and any other applicable building, safety, engineering and fire codes and regulations. Additionally, the freestanding and monument sign are set-back a distance of approximately 187 lineal feet and as such, the illumination of said signs does not affect the public interest, health or welfare. 6. The sign complies with Section 9624, Lighting and Design Standards. All proposed signs must comply with Downey Municipal Code Section 9624. SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution, the Planning Commission of the City of Downey hereby denies PLN-14-00020. SECTION 5. The Secretary shall certify the adoption of this Resolution. The intent of this Master Sign Program is to produce uniform standards for all onsite signage. APPROVALS 1. The design and construction of Tenant’s exterior sign MUST receive written approval by Landlord prior to fabrication and installation. Landlord has the specific right to refuse approval of any sign which does not conform to the specific criteria set forth herein. 2. To secure Landlord’s approval, Tenant agrees to confirm to the following procedure: A. Two copies of Site plan and building elevation(s) showing proposed sign location(s), size(s) and dimensions. B. Details, materials, finishes and colors. 3. For City approval, submit sign plan approved by the landlord to the Downey Planning Division for review and approval. Obtain sign permit from Downey Building and Safety Division. 4. Final Color, Size and Location of all signs shall be approved by the landlord or its designee prior to installation of the signs. Final drawings must be submitted to the landlord or its designee for approval. 5. Each tenant upon removal of signage, wall shall be restored to original condition. COMPLIANCE REQUIREMENTS No person shall erect, re-erect, construct, enlarge, move, improve, remove, convert or equip any sign or structure, or cause or permit the same to be done contrary to or in violation of any of the provisions of this Master Signage Program. Conformance will be strictly enforced by the landlord and the City of Downey. All such non-conforming or unapproved sign(s) must be brought into conformance at the expense of the tenant responsible for the instillation of said sign(s). Agenda Page 15 SIGN CONSTRUCTION AND MAINTENANCE All signs and their installation shall comply with all applicable City standards and codes, and bear the UL label. Signs shall be mounted without visible means of attachment. All penetrations of exterior fascia are to be sealed watertight, and finished to match adjacent material. Letter fastening and clips are to be concealed and be galvanized, stainless steel, aluminum, brass or bronze metals. All signs should be kept in good condition, free of corrosion, be legible, adequately repaired, maintained, and painted by the landlord at all times. All repairs shall be equal in quality and design to the original signs. The standards for maintenance and repair of signs shall be that which will assure the highest visual quality. Landlord shall be responsible for sign maintenance. TENANT SIGNMax. 30” Seventy five (70) percent of the sign area. It is the responsibility of Tenant’s sign contractor to verify all conduit and transformer locations and service prior to fabrication. No wall signs shall be permitted on the rear of the building. Building Frontage Sign has to be installed at designated place, as shown on the elevation drawing. Location. As shown on sign plan.
