SA 14 -0003 RESOLUTION OF THE BOARD OF DIRECTORS OF THE DOWNEY SUCCESSOR AGENCY AUTHORIZING THE PROCESSING OF DOCUMENTATION TRANSFERRING OWNERSHIP OF FORMER REDEVELOPMENT AGENCY PROPERTY TO THE CITY OF DOWNEY WHEREAS, the Downey Successor Agency ('Successor Agency ") pursuant to Health and Safety Code ( "HSC') sections 34191.4 and 34191.5(b), submitted a Long -Range Property Management Plan ( "LRPMP ") on October 24, 2013 and a revised LRPMP on June 23, 2014 to the California Department of Finance ( "DOF "). WHEREAS, the LRPMP addresses how the Successor Agency will dispose of non - housing property assets formerly owned by the Downey Community Development Commission. WHEREAS, the LRPMP addresses the property located at 9062 -68 Firestone Blvd., Downey, California, more particularly described in Exhibit "1" attached hereto and incorporated herein by reference ( "Property'). WHEREAS, the LRPMP proposes the transfer of the Property to the City of Downey ( "City') pursuant to HSC section 34191.5(c)(2). WHEREAS, the LRPMP indicates that the Property will be used for future development and that staff will search for a developer with the experience and financial capacity to initiate and complete an approved development on the Property. WHEREAS, the DOF issued to the Downey Successor Agency, pursuant to HSC section 34179.7, a Finding of Completion on May 15, 2013. WHEREAS, in a letter dated July 9, 2014, the DOF approved the Successor Agency's use or disposition of all the properties listed on the LRPMP, including transfer of the Property to the City. WHEREAS, pursuant HSC section 34191.3, the approved LRPMP shall govern and supersede all other provisions relating to the disposition and use of real property assets of the former redevelopment agency. WHEREAS, in accordance with the LRPMP, the Successor Agency desires to transfer the Property to the City, with no payment to be made by the City for the transfer, in compliance with the LRPMP. WHEREAS, the City desires to accept ownership of the Property in compliance with, and in furtherance of, the LRPMP. WHEREAS, this Resolution has been reviewed with respect to applicability of the California Environmental Quality Act ( "CEQK) and the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.); and, WHEREAS, per Section 15301 of the State CEQA Guidelines, the transfer of real property is exempt from environmental review under CEQA because the transfer will result in a continuation of an existing facility involving no expansion of use and is therefore exempt from environmental review, and any future development of the real property will require separate environmental review; and, RESOLULTION NO. SA 14 -0003 PAGE 2 WHEREAS, all of the prerequisites with respect to the approval of this Resolution have been met. NOW THEREFORE, THE BOARD OF DIRECTORS OF THE SUCCESSOR AGENCY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The foregoing recitals are true and correct and incorporated herein. SECTION 2. The Successor Agency hereby authorizes the processing of documentation via quitclaim deed(s) or other appropriate instrument(s) in order to transfer the ownership of the Property from the Successor Agency to the City. SECTION 3. The Executive Director of the Successor Agency, or designee, is hereby authorized to take such actions and execute such documents as are necessary to effectuate the intent of this Resolution on behalf of the Successor Agency. SECTION 4. This Resolution shall take effect upon the date of its adoption. SECTION 5. The Secretary shall certify to the adoption of this Resolution.
