FLORES, ASSOCIATE PLANNER SUBJECT: PLN -14 -00020 (SIGN) — A REQUEST FOR A PLANNED SIGN PROGRAM FOR AN EXISTING MULTI- TENANT COMMERCIAL BUILDING LOCATION: 11400 -11438 OLD RIVER SCHOOL ROAD ZONING: C -2 (GENERAL COMMERCIAL) REPORT SUMMARY On January 28, 2014, Mr. Alberto Alonso with New Signs and Printing, submitted an application (hereinafter referred to as PLN -14- 00020), seeking the Planning Commission's approval of a planned sign program. After reviewing the Applicant's request, staff recommends the Planning Commission adopt the following resolution: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN -14 -00020 (SIGN) — A REQUEST FOR A PLANNED SIGN PROGRAM FOR AN EXISTING MULTI- TENANT COMMERCIAL BUILDING AT 11400 -11438 OLD RIVER SCHOOL ROAD, ZONED C -2 (GENERAL COMMERCIAL) BACKGROUND The subject site is a rectangular- shaped lot measuring 76,860 sq. ft., with a length of 384.26 ft. fronting along Old River School Road and a depth of 200.11 ft. along Burns Avenue. The property is zoned C -2 (General Commercial) with a General Plan Land Use Designation of GC (General Commercial). It is developed with a multi - tenant shopping center composed of three buildings as follows: 1) Building A, a one - story, 6,000 sq. ft. restaurant, 2) Building B, a one - story, 13,350 sq. ft_ multi- tenant building that includes a take -out restaurant, retail and office uses, and 3) Building C, a one -story multi- tenant building that includes service uses and a liquor store. The property is in an area with similarly -zoned properties and commercial developments; to the north is a used car dealership, to the south is a multi- tenant building, and to the west is a gas station and multi- tenant shopping center. Single- family residentially zoned and developed properties abut the east property line, while one, multi - family development abuts the southern property line. SITE PHOTOGRAPH PLN -14- 00020 is a request to approve a planned sign program at 11400 -11438 Old River School Rd. Currently, each tenant space has a "can" sign for business identification. In addition, a freestanding sign is located within an existing landscape planter, visible from Old River School Road and identifying the property as "Old River Plaza ". AERIAL PHOTOGRAPH — SUBJECT PROPERTY The proposed sign program will provide standards and specifications to assure consistent quality, appearance, and size for all signs installed at the center, The program will allow staff approval of future signs, subject to the development standards outlined in this report. These standards address location, placement, size and the tenants' responsibilities for obtaining permits. The sign program also provides criteria for sign copy„ logos, and specifies allowed PLN -14 -00020 11400 -11438 Ofd River School Rd. June 18, 2014 - Page 2 colors and fonts, while prescribing the methods of fabricating and installing the signs. In addition to providing standards for wall signs, the Applicant is advancing standards for an "Old River Plaza" identification monument sign, and a multi - tenant freestanding sign providing identification for up to sixteen (16) tenants. DISCUSSION Chapter 6 of the Downey Municipal Code establishes uniform sign regulations for the City. It describes the intent and purpose of the Code, its policies and the general provisions that apply to all signs within the City. Code Section 9610.04 states that a Planned Sign Program shall be required for any site having three (3) or more nonresidential tenants and shall be approved by the Planning Commission before any sign permit is issued. The Old River Plaza and its tenant signs have been in existence longer than the current Zoning Code standards; therefore, the signs are legal nonconforming signs that may exist without a sign program if left unchanged, subject to Section 9626 of the Code. However, the owner of the Old River Plaza wants to provide additional identification for the tenants by installing a freestanding sign, which constitutes an expansion of the existing signs, changing the nonconforming status of them, and triggering the Applicant's request for the planned sign program.. ANALYSIS Staff reviewed the sign program PLN -14 -00020 proposes in light of Chapter 6 (Signs) of the Downey Municipal Code and determined the following: A. Maximum Allowable Sign Area Subsection (1) of Section 9618.02 (a) of the Code describes the maximum allowable sign area for on -site signs as follows: "(1) The maximum sign area shall be calculated Based on the lineal feet of building frontage or as otherwise provided below. A maximum of one (1) building frontage shall be used to determine the total maximum sign area allowed for building signs except that two frontages may be counted for buildings located on lots or parcels with more than one (1) street frontage. Where a building has multiple frontages, the City Planner shall determine which frontage shall be used to calculate the maximum building area. The maximum sign area for building signs may be allocated to any building frontage as determined by the applicant. " Downey Municipal Code Section 9124 defines Building Frontage as, "That portion of a main building most nearly parallel to a street or parking area. Table 9.6.2 of Code Section 9618.02 states: "The maximum allowable sign area of all permit signs for each individual business shall not exceed two and one quarter (2.25) square feet of area for each lineal foot of building frontage. " Staff has created Table 1 to illustrate maximum allowable sign area for each building. That data is summarized as follows: PLN -14 -00020 11400 -11438 old River School ad. Ft. of Signs on -Site 1084.5 The maximum allowable sign area for all permit signs at the subject site shall not exceed 1,084.5 sq. ft. (based upon 2.25 of sign area x 482 ft. of building frontage facing Old River School Rd. and the parking lot). The maximum allowable sign area reflects the total sign area for all primary signs, secondary signs, and additional signs allowed on site by the Sign Code (i.e. monument signs, freestanding signs, window displays, and projecting signs). B. Wall - Mounted Signs PLN- 14- 00020 is a request to approve a planned sign program for the Old River Plaza; however, almost all of the signs it illustrates, exist in the form of wall- mounted signs for the individual tenants of the center. (A copy of the proposed sign program is attached to this report). The existing signs are "can signs" consisting of aluminum boxes with acrylic faces. They display a variety of font styles and background colors, which the sign program seeks to control. The wall signs on Building A are located on the fapade, while the wall signs for Building B and Building C are located on a mansard. Section 9618.04 of the Code allows wall signs on a mansard or parapet, provided the sign area does not exceed the height of the mansard or parapet. It also requires them to be architecturally integrated with the roof. The proposed sign program for the Old River Plaza provides standards and specifications to assure consistent quality, appearance, and size for all signs installed at the center. These standards Include general requirements and the tenant's responsibilities for obtaining permits, and specify the location, placement, and general size of the signs. The sign program provides criteria for sign copy and logos. It calls out the allowed colors and fonts, while also describing the methods of fabricating and installing the signs. The applicant proposes that all wall signs shall be internally illuminated cabinet signs, with black cabinets. Tenants shall use "Helvetica ", "Book Antiqua" or "Cooper Black" fonts in Oracal Red, Oracal Brill Blue, or Oracal Black. Maximum height is 30 inches tall for the cabinet, with the length of the cabinet depending on the maximum allowable sq. ft. of the wall sign and desired height. Copy shall not exceed 75% of the sign area and supplemental copy and/or logos on the same sign shall not constitute more than 25% of the copy area. June 18, 2014 - Page 5 ;'VW, I �I Building C Table 2 shows the standard of 1.5 sq. ft. of sign area per tenant frontage for primary wall signs as illustrated in the proposed sign program and as permitted by DMC Section 9618.04(i )(A) through 9618.04(i)(F). The applicant proposes to follow these standards, but only allows secondary wall signs to two tenants: 1) Building "A" tenant with an address of 11404 Old River School Rd., and 2) Building "C" end tenant with an address of 11432 Old River School Rd. Ft. of All Wall Signs 842.25 C. Freestanding Sign PLN -14 -00020 proposes one freestanding sign at the northwest corner of the property where 0 I River School Road and Burns Avenue intersect. The height of the proposed sign would measure 24 ft. above grade, if approved. The sign program places the freestanding sign within an existing 288 sq. ft, landscape planter that runs parallel to Burns Avenue, immediately adjacent to the front property line. The proposed freestanding sign will consist of an aluminum cabinet painted black, on a base that is to be stucco and painted Dunn Edwards Almond to match the existing buildings; sign retainers will also be painted black. According to the Sign Program, the post measures 10 ft. from the ground to the bottom of the cabinet, and 3 ft. wide. The applicant requests the freestanding sign display 16 tenant panels within a square cabinet box that measures 10' -0" x 12' -6" (125 sq. ft.). The sign is proposed to have an aluminum top that is to be stucco and painted Dunn Edwards Burnt Almond to match Building "A' "s trim. June 18, 2014 - Page 8 The following photograph depicts the existing freestanding sign that is proposed to be demolished and replaced with a monument sign: Existing Freestanding Sign to be Removed D. Monument Sign PLN -14 -00020 proposes a monument sign along to the west property line, visible from Old River School Rd. As proposed, the height of the new monument sign will be 8 ft, above grade. The sign program places the sign within an existing landscape planter that runs perpendicular to Old River School Rd. The proposed monument sign will consist of an aluminum cabinet painted black, on a base that is to be stucco and painted Dunn Edwards Almond to match the existing buildings; sign retainers will also be painted black. The applicant requests the freestanding sign identify the center with the words "Old River Plaza" within a square cabinet box that measures 7 ft. x 6 ft. (42 sq. ft.). The sign will have a white acrylic face and blue vinyl letters. Table 4 reflects DMC requirements as compared to the proposed monument sign. PLN- 14 -00020 proposes a sign that is 125 sq. ft, in size; however the maximum sign area for a freestanding sign at an intersection is 80 sq. ft. 2. PLN- 114 -00020 proposes sixteen (16) panels to advertise the tenant names. The maximum quantity of tenants the Planning Commission has previously approved as part of a planned sign program is six (6) panels. Sixteen (16) signs would be difficult to read and offer minor identification for the tenants. 3. The proposed 2 ft, setback from property line for the monument sign may create a visual obstruction for cars exiting the property onto Old River School Rd; the minimum required setback is 7 ft. from property line. As stated earlier in this report, Downey Municipal Code Section 9610.04 (a) requires the Planning Commission's approval of a Planned Sign Program for any site having three (3) or more nonresidential tenants, prior to the issuance of any sign permit. It is also worth noting that Section 9610.04 (b) states that a Planned Sign Program may include deviations from the standards of the Sign Code, but the total sign area shall not exceed the area otherwise permitted, which applies to this case. The Applicant proposes a total of 1,009.25 s% ft. of sign area and the maximum allowed is 1,084.5 sq. ft. These provisions provide flexibility to the Commission to resolve the issues stated above. The Commission may also note that conditions of approval have been included to mitigate all of the staff concerns mentioned above. P N -14 -00020 11400 -11438 old River School Rd. June 18, 2014 -'Page 10 ENVIRONMENTAL ANALYSIS Staff has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA). Upon completion of this review, it has been determined that this request is categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing Facilities). Categorical Exemptions are projects, which have been determined not to have a significant effect on the environment and have been exempted from the requirements of the California Environmental Quality Act. Class 1 consists of projects that involve no or negligible expansion of the existing use. The planned sign program is proposed at an existing multi- tenant shopping center; thereby staff feels that this request qualifies for this exemption. FINDINGS Section 9610.06 of the Downey Municipal Code (Planned Sign Program) outlines the following six conditions the Planning Commission's must make before approving a Planned Sign Program: 1. The proposed sign is permitted within the zone and it complies with all applicable provisions of this chapter, the General plan, and any other applicable standards. The subject property is zoned C -2 (General Commercial) and was developed as a shopping center in 1968. The C -2 Zone permits the use of wall, freestanding, and a monument signs. Code Section 9610.04 states requires a Planned Sign Program for any site having three (3) or more nonresidential tenants. The Planning Commission shall approve the planned sign program before any sign permit is issued, The owner /applicant of the fled River Plaza is attempting to comply with this requirement by obtaining the City's approval of the sign program PLN -14 -00020 proposes, However, it is staff's opinion that the proposed freestanding sign cabinet is too large at 12.5 sq. ft. and proposes too many tenant panels (16). Staff is recommending conditions of approval that limit the size of the freestanding sign to 80 sq. ft., limit the number of tenant panels to six (6), and requires a 7 ft. setback from the property line for the proposed monument sign. It is staff's opinion that with the recommended conditions of approval, the proposed signs are permitted within the zone and comply with applicable provisions of Article IX of the Downey Municipal Code, the General Plan and other applicable standards. 2. The sign is in proper proportion to the structure or site on which it is located. The proposed freestanding sign cabinet will contain approximately 125 sq. ft. of sign area, which is 45 sq. ft. greater than the maximum sign area allowed for freestanding signs at this location. It is staff's opinion that with the recommended conditions of approval limiting the freestanding sign area to 80 sq. ft., the proposed sign will be in proper proportion to the buildings that comprise the shopping center. All other signs are in proportion to the site. 3. The sign materials, color, texture, size, shape, height, and placement are compatible with the design of the structure(s), property, and neighborhood of which it is a part. The applicant proposes that all wail signs shall be internally illuminated cabinet signs, with black cabinets. Tenants shall use "Helvetica ", "Book Antiqua" or "Cooper Black" fonts in Oracal Red, Oracal Brill Blue, or Oracal Black. Maximum height is 30 inches tall for the cabinet, with the length of the cabinet depending on the maximum allowable sq. ft. of the wall sign and desired height. As such, it is staff's opinion that the proposed wail signs will be compatible with the design of the structures, property and neighborhood of which they are a part of. The proposed freestanding sign will consist of an aluminum cabinet painted black, on a base that is to be stucco and painted Dunn Edwards Almond to match the existing buildings; sign retainers will also be painted black. The applicant requests the freestanding sign display sixteen (16) tenant panels within a square cabinet box that measures 1U-U" x 12' -6" (125 sq. ft.). Each panel would measure 19 inches high by four ft., nine inches in length with white acrylic faces and black vinyl lettering. The sign is proposed to have an aluminum top that is to be stucco and painted Dunn Edwards Burnt Almond, materials and colors compatible with the buildings' design. Conditions of approval that limit the size of the freestanding sign to 80 sq. ft. and limit the number of tenant panels to six (6) tenants, have been included to assist in the compatibility of this sign with its surrounding vicinity. As such, with the recommended conditions of approval, it is staff's opinion that the proposed freestanding sign will be compatible with the design of the structures, property and neighborhood of which it is a part of. The proposed monument sign will consist of an aluminum cabinet painted black, on a base that is to be stucco and painted Dunn Edwards Almond to match the existing buildings; sign retainers will also be painted black. The applicant requests the freestanding sign identify the center with the words "Old River Plaza" within a square cabinet box that measures 7' -0," x 6'- U " (42 sq. ft.). The sign is to have a white acrylic face and blue vinyl letters. Staff is recommending a condition that requires a 7 ft. setback from the property line for the proposed monument sign so as to not obstruct visibility for traffic exiting onto Old River School It is Staff's opinion that, with the recommended condition of approval, the proposed monument sign will be compatible with the design of the structures, property and neighborhood of which it is a part of. 4. The sign's illumination is at the lowest reasonable level as determined by the City Planner, which ensures adequate identification and readability, and is directed solely at the sign or is internal to it. The sign program includes construction details for illumination of all proposed signs. However, Staff recommends a standard condition of approval to include provisions for the use of internal LED strands to illuminate the signs. These lighting sources are set at the minimum standards needed to ensure that there is adequate readability of the signs. 5. The sign is not detrimental to the public interest, health, safety, or welfare. With the recommended conditions of approval, it is staff's opinion that height and placement of the wall, freestanding, and monument signs will not create a detrimental impact to the public interest, health, safety, and/or welfare. 6. The sign complies with Section 9624, Lighting and Design Standards. All proposed on -site signs will comply with Downey Municipal Code Section 9624. CORRESPONDENCE As of the date that this report was printed, staff has not received any correspondence regarding this matter. PLN -14 -00020 11400 - 11438 old River School Rd. June 18, 2014 - Page 12 CONCLUSION Based on the analysis contained within this report, staff is of the opinion that the proposed Planned Sign Program will create aesthetically pleasing identification for the building and the proposed signs will not create a significant adverse impact to the surrounding area. Furthermore, as noted above, staff bekeves that all six (6) findings required to approve a Planned Sign Program can be made in a positive manner,, if the staff- recommended conditions of approval are implemented. As such, staff recommends that the Planning Commission approve PLN- 14- 00020, subject to the recommended conditions of approval. PLN -14 -00020 11400 -11438 Old River School Rd. A RESOLUTION' OF THE PLANNING COMMISSION OF THE CITY OF DOWNEY APPROVING PLN -14 -00024 (SIGN) — A REQUEST FOR A PLANNED SIGN PROGRAM AT AN EXISTING MULTI- TENANT COMMERCIAL BUILDING LOCATED AT 11400- 11438 OLD RIVER SCHOOL ROAD, ZONED C -2 (GENERAL COMMERCIAL) THE PLANNING COMMISSION OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS. SECTION 1, The Planning Commission of the City of Downey does hereby find, determine and declare that: A. On January 28, 2014, Alberto Alonso, New Signs and Printing (authorized agent for the property owner Janet Alstrom, Robert M. TRB Livingston Decd. Trust and Marshall) and hereinafter referred to as "Applicant "), filed a Land Use Permit Application requesting approval of PLN -14- 00020 regarding a planned sign program for the Old River Plaza located at 11400 -11438 Old River School Rd. B. Notice of the pending public hearing was mailed to all property owners within 500' of the subject site and a public notice was published in the Downey Patriot on April 24, 2014. C. The Planning Commission held a duly public hearing on May 7 and May 21, 2014 and continued the item at the request of Staff and the Applicant. D. The Planning Commission held a duly noticed public hearing on June 18, 2014, and after fully considering all oral and written testimony, facts, and opinions offered at the aforesaid public hearing, adopted Resolution No._, approving PLN -14- 00020, subject to conditions of approval (Exhibit A). SECTION 2. The Planning Commission further finds, determines and declares the environmental impact of the proposed development has been reviewed and has been found to comply with the California Environmental Quality Act (CEQA) and is categorically exempt from CEQA, pursuant to Guideline Section No. 15301 (Class 1, Existing Facilities). Tenants shall use "Helvetica ", "Book Antiqua" or "Cooper Black" fonts in Oracal Red, Oracal Brill Blue, or Oracal Black. Maximum height is 30 inches tall for the cabinet, with the length of the cabinet depending on the maximum allowable sq. ft. of the wall sign and desired height. Copy shall not exceed 75% of the sign area and supplemental copy and/or logos on the same size shall not constitute more than 25% of the copy area. As such, it is staff's opinion that the proposed wall signs will be compatible with the design of the structures, property and neighborhood of which they are a part of. The proposed freestanding sign will consist of an aluminum cabinet painted black, on a base that is to be stucco and painted Dunn Edwards Almond to match the existing buildings; sign retainers will also be painted black. The applicant requests the freestanding sign display sixteen (16) tenant panels within a square cabinet box that measures 10' -0" x 12' -6" (125 sq. ft.). Each panel would measure 19 inches high by four ft., nine inches in length with white acrylic faces and black vinyl lettering. The sign is proposed to have an aluminum top that is to be stucco and painted Dunn Edwards Burnt Almond, materials and colors compatible with the buildings' design. Conditions of approval that limit the size of the freestanding sign to 80 sq. ft, and limit the number of tenant panels to six (6) tenants, have been included to assist in the compatibility of this sign with its surrounding vicinity. As such, with the recommended conditions of approval, it is staffs opinion that the proposed freestanding sign will be compatible with the design of the structures, property and neighborhood of which it is a part of. The proposed monument sign will consist of an aluminum cabinet painted black, on a base that is to be stucco and painted Dunn Edwards Almond to match the existing buildings; sign retainers will also be painted black. The applicant requests the freestanding sign identify the center with the words "Old River PLN -14 -00020 — 11400 -11438 Old River school Rd. Jane 18. 2014 -- Page 2 Resolution No. Downey Planning Commission Plaza" within a square cabinet box that measures 7' -0" x 6' -0" (42 sq. ft.). The sign is to have a white acrylic face and blue vinyl letters. Staff is recommending a condition that requires a 7 ft. setback from the property dine for the proposed monument sign so as to not obstruct visibility for traffic exiting onto Old River School It is Staff's opinion that, with the recommended condition of approval, the proposed monument sign will be compatible with the design of the structures, property and neighborhood of which it is a part of. 4. The sign's illumination is at the lowest reasonable level as determined by the City Planner, which ensures adequate identification and readability, and is directed solely at the sign or is internal to it. The sign program includes construction details for illumination of all proposed signs. However, Staff recommends a standard condition of approval to include provisions for the use of internal LED strands to illuminate the signs. These lighting sources are set at the minimum standards needed to ensure that there is adequate readability of the signs. 5. The sign is not detrimental to the public interest, health, safety, or welfare. With the recommended conditions of approval, the height and placement of the wall, freestanding, and monument signs will not create a detrimental impact to the public interest, health, safety, and/or welfare. 6. The sign complies with Section 9624, Lighting and Design Standards. All proposed on -site signs will comply with Downey Municipal Code Section 9624. SECTION 4. Based upon the findings set forth in Sections 1 through 3 of this Resolution; the Planning Commission of the City of Downey hereby approves PLN -14 -00020 subject to conditions of approval attached hereto as Exhibit A, which are necessary to preserve the health, safety and general welfare of the community and enable the Planning Commission to make the findings set forth in the previous sections. The conditions are fair and reasonable for the accomplishment of these purposes SECTION 5. The Secretary shall certify the adoption of this Resolution. The intent of this Master Sign Program is to produce uniform standards for oll onsite signage. APPROVALS 1. The design and construction of Tenant's exterior sign MUST receive written approval by Landlord prior to fabrication and installation. Landlord has the specific right to refuse approval of any sign which does not conform to the specific criteria set forth herein. 2. To secure Landlord's approval, Tenant agrees to confirm to the following procedure: A. Two copies of Site plan and building elevation(s) showing proposed sign location(s), size(s) and dimensions. B. Final drawings must be submitted to the landlord or its designee for approval. 5. Each tenant upon removal of Signage, wall shall be restored to original condition. COMPLIANCE REQUIREMENTS No person shall erect, re- erect, construct, enlarge, move, improve, remove, convert or equip any sign or structure, or cause or permit the some to be done contrary to or in violation of any of the provisions of this Master Signage Program. Conformance will be strictly enforced by the landlord and the City of Downey. All such non - conforming or unapproved sign(s) must be brought into conformance at the expense of the tenant responsible for the instillation of said sign(s). DESIGN CRITERIA SIGN CONSTRUCTION AND MAINTENANCE All signs and their installation shall comply with all applicable City standards and codes, and bear the UL label. Signs shall be mounted without visible means of attachment. All penetrations of exterior fascia are to be sealed watertight, and finished to match adjacent material. Letter fastening and clips are to be concealed and be galvanized, stainless steel, aluminum, brass or bronze metals. All signs should be kept in good condition, free of corrosion, be legible, adequately repaired, maintained, and pointed by the landlord at all times. All repairs shall be equal in quality and design to the original signs. The standards for maintenance and repair of signs shall be that which will assure the highest visual quality.
