NOVEMBER 22, 1988
The City Council of the City of Downey held a regular meeting at 7:30 p.m.,
November 22, 1988, in the Council Chamber of the Downey City Hall, Mayor Robert
G. Cormack presiding.

PRESENTATIONS
Mayor Cormack read in full a Proclamation declaring November 21-27, 1988,
as 1988 California Family Week. There was no one present to accept the
Proclamation.
For continuity of reporting, this item was placed in Agenda order. Council
Member Hayden presented a Certificate of Appointment to Frank J. Beckner on his
appointment to the Parking Place Commission.
HEARINGS:
Mayor Cormack OPENED THE PUBLIC HEARING ON PROPOSED AMENDMENT TO DOWNEY
MUNICIPAL CODE AMENDING BUILDING REGULATIONS: SECTION 8217 OF THE DOWNEY
MUNICIPAL CODE REGARDING "PROTECTION OF ADJACENT PROPERTIES AND THE PUBLIC WAY",
AND SECTION 8407 OF THE DOWNEY MUNICIPAL CODE REGARDING BASIC PLUMBING
REGULATIONS FOR SWIMMING POOLS.
Deputy City Clerk McDonnell affirmed the Proof of Publication. Hearing no
objections, it was so ordered to receive and file.
Deputy City Clerk McDonnell advised no correspondence had been received on
this matter.
Mayor Cormack called for those in the audience who wished to speak in favor
of.or in opposition to the proposed amendment. No one came forward.
It was moved by Council Member Barb, seconded by Council Member Boggs, and
unanimously carried to close the Public Hearing.
Building Official Makshanoff clarified for Council that prior to 1982 there
were provisions in the Uniform Plumbing Code which addressed the disposal of
swimming pool water. He added that in the 1982 Uniform Plumbing Code the
provisions were deleted because a Uniform Swimming Pool Code was written and it
was left as an option of the jurisdictions to adopt that code. Mr. Makshanoff
said the City has been enforcing the same regulations that were in effect prior
to the 1982 Uniform Plumbing Code, not realizing that section has been deleted
from the Code, and that this Ordinance would put into writing what the City has
been enforcing.

ORDINANCE NO. 871
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING ARTICLE VIII, CHAPTERS 2 AND 4, OF THE DOWNEY MUNICIPAL
CODE PERTAINING TO BUILDING REGULATIONS AND THE UNIFORM PLUMBING CODE
The Ordinance was read by title only. It was moved by Council Member
Boggs, seconded by Council Member Paul, and unanimously carried to waive further
reading and to adopt.
Mayor Cormack OPENED THE PUBLIC HEARING ON APPEAL, TENTATIVE PARCEL MAP NO.
20196, FOR PROPERTY LOCATED AT 7532-50 FIRESTONE BOULEVARD, ZONED C-3
(APPLICANT: DCH INVESTMENTS); APPELLANT: WESTERN CENTER ON LAW AND POVERTY,
INC.
Pursuant to staff's recommendation, it was moved by Council Member Boggs,
seconded by Council Member Hayden, and unanimously carried that the Public
Hearing be continued to January 10, 1989.
ORAL COMMUNICATIONS - Items not on Agenda
Mr. John Gonzalez, 12350 Orizaba Ave., spoke regarding his objection to
interference of Police removal of citizen from Council Meeting on November 22,
1988; and possible replacement of appointee on the Cemetery Board.
Mr. Al Wantuch, 7240 Granger St., Bell Gardens, commented regarding
incident involving his son at last meeting.
Mr. Miles Mallory, 10214 Woodruff Ave., spoke regarding a newspaper article
on After -School Child Care and the City spending money on this program. He also
complained of the treatment his father received at Kaiser Hospital.
Mayor Cormack advised him that Kaiser Hospital was not in the City of
Downey's jurisdiction. Council Member Boggs mentioned to Mr. Mallory he might
contact the State Board of Hospital Accreditation to register a complaint.
CONSENT CALENDAR
Agenda Item VI-C-1, Cash Contract No. 557/560A - Physical Services Yard
Modifications - Phase I, Storage Building/Emergency Generator Room; Community
Theatre - Multipurpose Room, was removed at the request of Council Member Boggs.

RESOLUTION NO. 5085 (ADOPT)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE APPOINTMENT OF MR. RICK SANCHEZ TO THE CABLE TV
CITIZENS ADVISORY COMMITTEE FOR COUNCILMANIC DISTRICT FIVE
It was moved by Council Member Barb, seconded by Council Member Boggs, and
carried by the following vote to waive full reading of the Resolution and to
approve the remainder of the Consent Calendar as recommended:

ADMINISTRATIVE REPORTS
ROSE FLOAT ASSOCIATION - REQUEST FOR BUILDING AT INDEPENDENCE PARK
Community Services Director Jarrett presented the staff report pursuant to
the Agenda Memo dated November 22, 1988, and advised it is staff's
recommendation to approve the conceptual plan presented by the Dowey Rose Float
Association for the construction of a building at Independence Park in
accordance with the recommendation and stipulations of the Recreation and
Council Minutes 11/22/88 -2-
Community Services Commission. He narrated a slide presentation showing a
progression of slides with pictures of the park and adjacent properties. Mr.
Jarrett said that representatives from the Rose Float Association were present
to answer questions.
Council Member Boggs discussed the following The Residential property
abuts the park; the storage building to be built a minimum of 46 feet from the
rear property line (per City code) and moved more westerly, so as not to disturb
nearby residences; requested for scale map of location; and expressed concern
that this 46 feet setback might invite crime due to the lack of visibility.
Council in general discussed: That as many trees as possible be left at the
-- park; important to keep neighborhood disturbances minimal from night work done
on the Rose Float; and provide access to storage building face away from
residences.
Mr. Frank O'Neil, Past President of the Downey Rose Float Association, 8810
E. Imperial Hwy., mentioned that the Rose Float would exit the west side of the
storage building; discussed the dimensions of the building as well as the permit
process required to move the Rose Float down the highway from City to City; want
to adopt a plan that is the best function for the site, but wanted to wait until
they have a site first because of expense involved.
It was moved by Council Member Barb, seconded by Council Member Paul, and
unanimously carried to approve the staff recommendation in concept; and direct
staff to assist the Rose Float Association in working with adjacent property
owners relative to their concerns.
Prior to the foregoing vote, the following persons spoke:
Ms. Cel Kimberly, President of the Rose Float Association, 6779 Dos Rios
Rd., asked for clarification from Council how far they should go in contacting
the adjacent property owners.
Council responded they could use their own discretion and also obtain
assistance from City staff in how they would like to contact the property
owners.
Mr. John Gonzalez, 12350 Orizaba Ave., said the storage building will be an
improvement to this area and further commented on several other items. He was
advised that his time was up and was asked to take his seat in the audience.
Mr. Gonzalez become very critical at this time.
The meeting recessed at 8:19 p.m. and reconvened at 8:22 p.m. with all
Council Members present.
NORTHWEST LITTLE LEAGUE - REQUEST TO BUILD NEW SNACK SHACK AT FURMAN PARK
It was moved by Council Member Barb, seconded by Council Member Hayden, and
unanimously carried to accept the recommendation of the Recreation and Community
Services Commission to approve in concept that N.W.D.L.L. be permitted to build
a new snack stand at Furman Park, that it will be built and paid for by
N.W.D.L.L. and deeded back to the City. Further, that N.W.D.L.L, must meet all
City Construction Codes and Standards and be responsible for the building being
completed in a timely manner.
CITY BUDGET POLICY
Council Member Barb requested this item be continued. Hearing no
objections, it was so ordered to continue this item.
ITEMS REMOVED FROM CONSENT CALENDAR
CASH CONTRACT NO. 557/560A-PHYSICAL SERVICES YARD MODIFICATIONS/
MULTIPURPOSE ROOM-DOWNEY THEATRE
Council Member Boggs clarified with Community Services Director Jarrett
that the Multipurpose Theatre Room has been done according to plans. She
requested a visual inspection walk through of the Multipurpose Room of the
Theatre.

It was moved by Council Member Boggs, seconded by Council Member Paul, and
unanimously carried to assess Liquidated Damages in the amount $800.00, accept
the improvements constructed, and accept maintenance responsibility for the
improvements.
OTHER BUSINESS AND ITEMS FOR FUTURE AGENDAS
STAFF MEMBERS:
APPEAL, REVOCATION OF MASSAGE PERMIT - 8726 IMPERIAL HIGHWAY
1. Police Chief Stone advised that the Appellant Wol Ki Kim is withdrawing
her Appeal. A written confirmation from Attorney Davis will follow.
CITY COUNCIL:
Mayor Cormack:
1. It was moved by Council Member Barb, seconded by Council Member Paul,
unanimously approved for City of Downey to purchase ad and table at Del
Clawson Boy Scout Recognition Dinner on January 5, 1989.
Council Member Hayden:
1. Regarding request of Mr. Slabodnik concerning traffic and parking
problems on Dolan Avenue. Council Member Boggs will share her
information on this.
2. Regarding whether Council will conduct second meeting in December in
view of Christmas holiday. This will be decided at the December 13,
1988 meeting.
Council Member Boggs:
1. Requested update on Smoking Ordinance. She also referenced a letter
from Supervisor Antonovich regarding the use of curfews to help curb
gang activities and asked that staff obtain further information on
this.
ADJOURNMENT: 8:32 p.m.
The meeting was adjourned to 4:00 p.m., December 6, 1988, in the Council
Chamber of the Downey City Hall.
