The City Council of the City of Downey held a regular meeting at 7:37 p.m.,
March 22, 1988, in the Council Chamber of the Downey City Hall, Mayor Pro Tem
Robert G. Cormack presiding.

PRESENTATIONS
Mayor Pro Tem Cormack presented to Mr. Ron Irwin, Fire Chief, a
Proclamation declaring the month of April, 1988, as Downey Earthquake
Preparedness Month.
Mayor Pro Tem Cormack presented to Mrs. Connie Sziebl, Chairman, Keep
Downey Beautiful Committee; No Mess Mouse and Recycle Rabbit; and Miss Downey
and her Court, a Proclamation declaring the month of April, 1988, as Keep Downey
Beautiful Month.
HEARINGS
Mayor Pro Tem Cormack OPENED THE PUBLIC HEARING ON PROPOSED AMENDMENT TO
DOWNEY MUNICIPAL CODE REGARDING SITE PLAN AND DESIGN REVIEW.
City Clerk Young affirmed the Proof of Publication and stated that no
correspondence was received for or against this proposed amendment. There being
no objections, the publication was received and filed.
Community Development Director Cutts summarized the staff report and
recommended that the City Council adopt the enclosed Ordinance which amends
Section 9162 of the Downey Municipal Code as said Section pertains to Site Plan
and Design Review.
Mayor Pro Tem Cormack asked for those in the audience who wished to speak
for or against said amendment.
Ms. Soozie Villa, 9228 Stewart & Gray Rd., asked if there would be
handicapped persons included on the Design Review Board.
It was clarified that this is a separate board from the recently formed
Handicapped Appeals Board.

OPPOSED!
Mr. Norman Horney, 9102 Angell St., who is a member of the Design Review
Board, stated opposition to a portion of the Ordinance as submitted. He
suggested the Licensed Landscape Architect requirement be expanded to include
Landscape Contractor and retired persons having held such a position as a
Landscape Architect or Landscape Contractor. He asked that the Council have
some authority in appointment list and suggested that members should be
residents or business owners in the City of Downey.
Mr. Stanley Wantuch, 6377 Florence Ave., Bell Gardens, commented it was not
appropriate to pay hourly salary to any Board/Commission; that there may already
be an existing list of possible appointees; and meeting should be held during
evening hours for working people.
There being no further speakers, it was moved by Council Member Paul,
seconded by Council Member Santangelo, and unanimously carried (Council Members
Boggs and Barb absent) that the Public Hearing be closed.
Council discussed the Ordinance and made changes to the proposed Ordinance
as follows:
It was moved by Council Member Santangelo, seconded by Council Member Paul,
and unanimously carried (Council Members Boggs and Barb absent) to change
Section 1 - 9162.06(a), number 2 to read:
2. One Licensed Landscape Architect, or one Licensed Landscape Contractor,
or one person qualified by experience.
It was moved by Council Member Santangelo, seconded by Council Member Paul,
and unanimously carried (Council Members Boggs and Barb absent) to change
Section 1 - 9162.06(a), last paragraph, first line to read:
The City Manager shall and City Council Members may...
It was moved by Council Member Paul, seconded by Council Member Santangelo,
and unanimously carried (Council Members Boggs and Barb absent) to change
Section 2 - 9162.06(b), last sentence to read:
by a three -fifths (3/5) vote of the Council.
It was moved by Council Member Santangelo, seconded by Council Member Paul,
and carried 2-1 (Council Member Paul voting no; Council Members Boggs and Barb
absent) to change Section 3 - 9162.06(g) by deleting the last two words (per
month).
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 9162 OF THE DOWNEY MUNICIPAL CODE
(CHAPTER 1, ARTICLE IX) AS SAID SECTION PERTAINS TO
SITE PLAN AND DESIGN REVIEW
The Ordinance was read by title only. It was moved by Council Member
Santangelo, seconded by Council Member Paul, and unanimously carried (Council
Members Boggs and Barb absent) to waive further reading and to introduce.
Mayor Pro Tem Cormack OPENED THE PUBLIC HEARING ON APPEAL TO ZONE VARIANCE
NO. 550 FOR PROPERTY LOCATED AT 13101 - 13113 LAKEWOOD BOULEVARD.
A written request was made by the Appellant that the Public Hearing be
continued to May 10, 1988.
It was moved by Council Member
Santangelo that the Public Hearing be

Mr. John Gonzalez, 123bO Orizaba Ave., regarding request for building
permit pertaining to block wall fence at his residence. Mayor Pro Tem Cormack
asked Mr. Gonzalez to be seated when his comments were considered out of order.

Mr. John Drayer, 13331 Lakewood Blvd. #A-2, questioned why two Council
Members were absent. He also questioned the process regarding a February 10,
1988 petition for a lighting district.
Mr. Stanley Wantuch, 6377 Florence Ave., Bell Gardens, spoke regarding
miscellaneous comments on Council actions.
Mr. Tony Gabel, 7158 Adwen St., requested Downey Municipal Code Section
3185(b) be amended regarding parking of commercial vehicles. He feels the
citation he received is unfair. Mr. Gabel was going to meet with Council Member
Paul after the meeting to discuss this matter.

The Ordinance was read by title only. It was moved by Council Member
Santangelo, seconded by Council Member Paul, and unanimously carried (Council
Members Boggs and Barb absent) to waive further reading and to introduce the
Ordinance and to set the Public Hearing for April 12, 1988.

ADMINISTRATIVE REPORTS
ADMINISTRATION REPORT: DOWNEY MUNICIPAL CODE SECTION 9114.06(a), AS IT
PERTAINS TO GARAGE SALES WITHIN THE R-3 MULTIPLE FAMILY RESIDENTIAL ZONE
It was moved by Council Member Santangelo, seconded by Council Member Paul,
and unanimously carried (Council Members Boggs and Barb absent) to receive and
file this report and retain the existing Ordinance regulating garage sales as
amended and adopted by the City Council on December 8, 1987.
CASH CONTRACT NO. S.S. 386 - LAKEWOOD BOULEVARD - MEDIAN LANDSCAPING
AMENDMENT TO CONSULTANT AGREEMENT
It was moved by Council Member Santangelo, seconded by Mayor Pro Tem
Cormack (withdrawn) to approve the recommendation to authorize staff to modify
the consultant agreement with Kobata Associates, Inc., for the landscaping of
the median islands on Lakewood Boulevard by increasing the not -to -exceed amount
for Task 4 by $2,238.00 and adjusting the schedule of hourly rates by an amount
equivalent to a 4.2 percent annual cost of living adjustment.
The above motion was withdrawn with the consent of the second to respond to
Council Member Paul's desire for information relative to the cost of living
agreement.
There being no objections, this item was continued.
CHANGE ORDER NO. 1 - CASH CONTRACT NO. 558 - GLASS SAFETY FILM
Council questioned the amount of this recommended change order as it
relates to additional cost of tinted material and as to appearance if it should
be the "mirror image" type covering.
There being no objections, this item was continued and staff will present a
sample of the recommended covering.

1. Report on Sound Wall Hearing in Sacramento continued to the next
meeting since Mayor Boggs is absent due to illness.
Mayor Pro Tem Cormack:
1. Asked that a future agenda contain an item relative to establishment
of a Disaster Preparedness Committee. No objections from Council.
ADJOURNMENT: 9:12 p.m.
The meeting was adjourned to 6:30 p.m., April 12, 1988, in the Council
Chamber of the Downey City Hall.
