Boggs presiding. PRESENT: Council Members: Diane P. Boggs Mayor Robert G. Cormack Mayor Pro Tem Roy L. Paul James S. Santangelo ABSENT: Randall R. Barb (excused) ALSO PRESENT: Don Davis, City Manager Carl K. Newton, City Attorney Jenny Young, City Clerk -Treasurer James R. Cutts, Director of Community Development Ronald Irwin, Fire Chief James R. Jarrett, Director of Community Services Pete Stone, Police Chief Lee Powell, Director of Administrative Services William A. Ralph, Director of Public Works William Makshanoff, Building Official Robert Mason, Communications Intern William McCulloch, Motor Officer Ronald Yoshiki, City Planner Scot Yotsuya, Assistant to the City Manager Joyce Baker, Executive Secretary PRESENTATIONS Mayor Boggs acknowledged a Proclamation regarding Drunk Driver Awareness during the holiday season. Mayor Boggs acknowledged a Proclamation declaring November 22-28, 1987, as California Family Week. Mayor Boggs acknowledged a Proclamation declaring November 30-December 5, 1987, as Winter Storm Preparedness Week. Mayor Boggs announced the Earthquake Preparedness Seminar on Wednesday, December 2, 1987 in the Downey Civic Theatre. An exhibit of supplies, as well as literature, will be available at 6:30 p.m. in the lobby of the Theatre. The program will start at 7:00 p.m. HEARINGS Mayor Boggs opened the Public Hearing on Appeal to Conditional Use Permit No. 252, a request to construct a motel at 7862 Firestone Boulevard, which was continued from the meeting of August 25, 1987. Mayor Boggs stated that inasmuch as a moratorium is in effect on motel development in the City, staff is recommending the hearing be continued to February 9, 1988. It was moved by Council Member Santangelo and seconded by Council Member Paul to continue the Public Hearing to February 9, 1988. Hearing no objections, so ordered. ORAL COMMUNICATIONS - Items not on Agenda Mr. John Gonzalez, 12350 Orizaba Ave., regarding Building Department inspection on his residence. Mr. Gonzalez was requested to take a seat for improper accusations toward a staff member. Mr. Joel Lubin, 7820 Allengrove St., regarding Smoking Ordinance; use of 8 1/2 x 11-inch paper within City of Downey; and a full-time City Attorney. Council Minutes 11/24/87 -1- EM CONSENT CALENDAR Agenda Item VI-E-1, Appeal, Plot Plan No. 428 for Property located at 12516 Dolan Avenue, was removed at the request of Council Member Paul. Minutes: Adjourned Regular Meeting, November 10, 1987; and Regular Meeting, November 10, 1987: Approve. General Warrants #35178 - 35389 and #35401 - 35590, $1,430,704.29: Approve. Change in Authorized Manpower Levels in Police Department: Upgrading Lieutenant Position in Police Administration to Captain: Approve. Contract for Administrative Assistant/Fire Education Specialist: Approve contract for six months (contract rate for this period is $22.00 per hour). Construction of Room Addition at the Downey Theatre: Reappropriate funds in amount of $19,000, approve construction plans, and authorize staff to solicit bids: Approve. RESOLUTION NO. 4951 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF PARCEL MAP NO. 18140 (9371 FLORENCE AVENUE), APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTANCE OF A TIME CERTIFICATE OF DEPOSIT IN LIEU OF SURETY BONDS It was moved by Council Member Santangelo, seconded by Council Member Paul, and carried by the following vote to approve the remainder of the Consent Calendar as recommended: AYES: 4 Council Members: Cormack, Santangelo, Paul, Boggs ABSENT: 1 Council Member: Barb ORDINANCES ORDINANCE NO. 863 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, AMENDING PART II OF CHAPTER 5 OF ARTICLE VI OF THE DOWNEY MUNICIPAL CODE RELATING TO THE REGULATION OF PUBLICATION VENDING MACHINES The Ordinance was read by title only. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried (Council Member Barb absent) to waive further reading and to adopt. Prior to the above vote, Council again urged the City continue to work for stronger laws regarding pornographic material. RESOLUTIONS: None (see Consent Calendar) ADMINISTRATIVE REPORTS: None ITEMS REMOVED FROM CONSENT CALENDAR Appeal, Plot Plan No. 428 for Property located at 12516 Dolan Avenue Council Member Paul pulled this item from the Consent Calendar so that he could abstain from voting due to a possible conflict of interest. It was moved by Council Member Santangelo, seconded by Council Member Cormack, and carried 3-0 (Council Member Paul abstaining; Council Member Barb absent) to set the Public Hearing for Appeal, Plot Plan No. 428, for December 8, 1987. Council Members: None The meeting recessed at 8:01 p.m. and reconvened at 8:07 p.m. with Council Members Boggs, Cormack, Paul, and Santangelo present (Council Member Barb absent). The meeting recessed to closed session at 8:10 p.m. with Mayor Boggs announcing the Council is recessing to closed session for the purpose of discussing a personnel matter and property transactions pursuant to Government Code Section 54956.8, as follows: 8544 E. Firestone Boulevard, Owned by Nick Collaro and Nancy Ringo; and 8556 E. Firestone Boulevard, Owned by Veraphand and Rosario Ty Yongvanich The meeting reconvened at 8:40 p.m. with Council Members Boggs, Cormack, Paul, and Santangelo present (Council Member Barb absent).
