Boggs presiding. PRESENT: Council Members: Diane P. Boggs Mayor Robert G. Cormack Mayor Pro Tem Randall R. Barb Roy L. Paul James S. Santangelo ALSO PRESENT: Lee Powell, Acting City Manager Carl K. Newton, City Attorney Jenny Young, City Clerk -Treasurer James R. Cutts, Director of Community Development Ronald Irwin, Fire Chief James R. Jarrett, Director of Community Services Pete Stone, Police Chief William A. Ralph, Director of Public Works Charles Baptista, Motor Officer Scot Yotsuya, Assistant to the City Manager Joyce Baker, Executive Secretary PRESENTATIONS Mayor Boggs presented to Ms. Maureen May, Reentry Specialist for Cerritos Community College District, a Proclamation declaring November 7, 1987, as Adult Reentry Day. Mr. Jim Clairmont, District Manager, Community Relations, GTE of California, presented to Members of Council a new booklet re Safety for Seniors. He further advised that 3,000 copies of this booklet are available through Community Services for distribution to the senior citizens of Downey. Mayor Boggs presented to Ms. LaVerne McWilliams, Board Member of Family Service of Los Angeles and Chairman of Southeast Advisory Council and Ms. Cynthia Ibrahim, Regional Director, a Proclamation declaring November 22-28, 1987, as Family Week in Downey. Mayor Boggs announced the Battle of the Badges on November 7, 1987, and said that the money raised from the ticket sales will be used for a fund in memory of one of our Firefighters who died of cancer. Mayor Boggs at this time introduced Pete Stone as Downey's new Chief of Police. HEARINGS Mayor Boggs opened the Public Hearing of Protests on Lighting Maintenance District A.D. 121, Annexation 87/64 - Sandy Lane. City Clerk Young affirmed the Affidavit of Posting and Proof of Publication. City Clerk Young stated there were no written protests or objections filed. Mayor Boggs called for those in the audience who wished to speak in protest to the Annexation. There were none. It was moved by Council Member Cormack, seconded by Council Member Santangelo, and unanimously carried that the Public Hearing be closed. Council Minutes 10/27/87 -1- am I RESOLUTION NO. 4946 A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS (ANNEXATION 87/64 - SANDY LANE FROM 100 FEET SOUTH OF DEVENIR SOUTHERLY TO THE FREEWAY FRONTAGE ROAD) It was moved by Council Member Cormack, seconded by Council Member Santangelo, and unanimously carried to waive further reading and to adopt. ORAL COMMUNICATIONS - Items not on Agenda Reverend Joe Grana, 8718 Alameda St., referenced Assembly Bill 711, effective January 1, 1988, which will allow greater screening of "Harmful Material" from minors. Approximately fifty people in the audience stood in support of Council action to provide an Ordinance to accomplish all that is permitted under this new law. City Attorney Newton stated an Ordinance will be prepared for Council consideration at the next regular meeting. Mr. Jim Smith, 619 Pine Ave., Long Beach, Los Angeles Newspaper Guild, Local 69, AFL-CIO, spoke regarding "Union Busting" by the Long Beach Press Telegram. Fliers were submitted. Mr. Mike Manicone, 10400 Gaybrook Ave., complained that although he paid his dog license, he has received notices of delinquency at his home. Mayor Boggs requested staff follow-up on this matter. Ms. Soozie Villa, 8432 Brookshire Ave., inquired as to the status of her earlier concern regarding street access for disabled persons. Staff was asked to direct a copy of the current study to Ms. Villa. The meeting recessed at 8:00 p.m, and reconvened at 8:05 p.m. with all Council Members present. CONSENT CALENDAR Agenda Item VI-8-1, Request from Ioan Ghitea for refund of appeal fee, was removed at the request of Council Member Santangelo. Agenda Item VI-E-2, Approve appraisals, appropriate funds, and authorize acquisition of 8544 and 8556 Firestone Blvd, for parking purposes, was removed at the request of Council Member Paul. Agenda Item VI-F-1, Granting Zone Variance #525, 7676 Firestone Blvd. (Downey Galleria), was removed at the request of Council Member Cormack. Minutes: Adjourned Regular Meeting, October 13, 1987; and Regular Meeting, October 13, 1987: Approve. Cash Contract No. 541 (Phase II), Water Mains - Century Freeway Corridor, Bellflower Boulevard to Downey Avenue: Approve extra work in the amount of $16,734.92. Cash Contract No. 552, Ball Courts at Independence and Golden Parks: Reject bids and grant authority to readvertise: Approve. General Warrants #34370-34731, $1,116,545.38: Approve RESOLUTION NO. 4947 (ADOPT) A RESOLUTION OF THE CITY OF DOWNEY APPROVING AN AMENDMENT TO THE JOINT EXERCISE OF POWERS AGREEMENT BETWEEN THE CITIES OF DOWNEY, NORWALK, PICO RIVERA, BELL GARDENS, LYNWOOD, MONTEBELLO, PARAMOUNT AND SOUTH EL MONTE TO ADMIT THE CITY OF SANTA FE SPRINGS Christmas Parade Permit: Approve. Council Minutes 10/27/87 -2- It was moved by Council Member Barb, seconded by Council Member Santangelo, and carried by the following vote to approve the remainder of the Consent Calendar as recommended: AYES: 5 Council Members: Barb, Cormack, Santangelo, Paul, Boggs ORDINANCES ORDINANCE NO. 861 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE CITY'S OFFICIAL ZONING MAP ADOPTED BY SECTION 9106.06 OF THE DOWNEY MUNICIPAL CODE (ZONE CHANGE CASE NO. 239) The Ordinance was read by title only. It was moved by Council Member Santangelo, seconded by Council Member Barb, and unanimously carried to waive further reading and to adopt. RESOLUTIONS Adjustment of Water Rates Public Works Director Ralph presented the staff report and stated that per Council direction, staff had prepared a Resolution which would establish a single water rate schedule for the entire City. The City would no longer be divided .into three zones for the purpose of paying for water, and the rate schedule has been equalized so that the Water Fund revenues would increase an average of 25%. Mr. Mike Manicone, 10400 Gaybrook Ave., addressed the Council about the water system, and specifically about the proposed bond issue. He urged a pay - as -you -go -method. Council discussed at length the need to upgrade the water flow system; a consensus as to the need for water quality; the possibility of a pay -as -you -go - project; whether a higher increase should be levied to avoid a long-term debt service; and, for the record, that although at least one area would have an increase of over 25%, equalizing rates would decrease costs in at least two zones. Council Member Cormack responded to questions relative to the original formation from independent water systems and Council Member Paul urged a quality water master plan be provided along with the improved water flow system. Public Works Director Ralph indicated upon Council inquiry that it would be preferable to complete construction within three years due to the deteriorating state of the City's water system, and estimated that if we construct on a cash receivable basis, construction might take as long as seven to ten years. It was moved by Council Member Cormack, seconded by Mayor Boggs, and failed 2-3 (Council Members Barb, Santangelo, and Paul voting no) to delay action until the next regular meeting. RESOLUTION NO. 4948 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING WATER RATES FOR THE CITY OF DOWNEY AND RESCINDING RESOLUTION NO. 4945 The Resolution was read by title only. It was moved by Council Member Santangelo, seconded by Mayor Boggs, and carried 3-2 (Council Members Cormack and Paul voting no) to waive further reading and to adopt. Water Improvement Bonds As discussed in the previous Agenda Item, Council indicated that we are dealing separately with water quality, and all agreed upon the importance of daily monitoring of the experts' data. Administrative Services Director Powell advised by report dated October 27, 1987, that Water Improvement Bond bids had beed received this date. He noted expenditure of funds to date in preparing for this bond issue. A Resolution approving $11,510,000 of Water Bond Certificates was presented but rejected by the following motion. Council Minutes 10/27/87 -3- I It was moved by Council Member Cormack, seconded by Council Member Santangelo, and unanimoulsy carried to reject all bids for Water Improvement Bonds. ADMINISTRATIVE REPORTS Contract Street Sweeping/Citywide (reconsideration of original bid/Council action September 22, 1987) Public Works Director Ralph presented the staff report and related that at the Council Meeting of September 22, 1987, a bid was presented that was received for street sweeping. Council suggested that staff readvertise. At the Council Meeting of October 13, 1987, Council requested that staff bring the matter back to Council so that it could be discussed more fully. — Council discussed at length, the process of advertising for Contract Street Sweeping; whether the bid was consistent with other cities fees; the number of street sweeping services who are qualified to meet the standards of our contract; the problem of exposing the one bid received by Dixon Company; and whether this contract is prorated for the actual months to be swept this fiscal year or a long-term contract with the right to terminate. Mr. Lennie Whittington, 8542 Manatee St., questioned the City's obligation to broadly advertise to secure the best contract price and advised of his telephone calls to several street sweeping contractors. He stated to his knowledge there were no falsified letters of interest from contractors, and later stated that it is his understanding that Universal Sweeping Service is capable and interested in the contract. Mr. Steven Finley, 7857 Baysinger St., urged the open bid process. Mr. Don Dixon, 12524 Clark Ave. (only bidder), stated it was not unusual that there is one bidder for a contract of this nature. It was moved by Council Member Santangelo and seconded by Mayor Boggs (vote pending next meeting) to reject the bid from Dixon Company and to readvertise. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried to postpone action on the street sweeping contract to the next regular City Council Meeting and that Council be provided a copy of the contract. Mr. Don Dixon, 12524 Clark Ave., stated that he would agree to this delay and affirmed his continued interest. ITEMS REMOVED FROM CONSENT CALENDAR Request for Refund as it Relates to Conditional Use Permit No. 246-City Council Resolution No. 4876 Council Member Santangelo pulled this item from the Consent Calendar so that he could abstain from voting due to a possible conflict of interest. It was moved by Council Member Cormack, seconded by Council Member Paul, and carried 4-0 (Council Member Santangelo abstaining) to deny the request for refund of appeal fee. Approve Appraisals, Appropriate Funds, and Authorize Acquisition of 8544 and 8556 Firestone Blvd. for Parking Purposes It was moved by Council Member Paul, seconded by Council Member Barb, and unanimously carried to receive and file. Zone Variance No. 525 for Property Located at 7676 Firestone Blvd., Planning Commission Resolution No. 1051 - Appeal to City Council. Council Member Cormack pulled this item from the Consent Calendar in order to present a motion for denial. Council Minutes 10/27/87 -4- RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, GRANTING ZONE VARIANCE NO. 525 AND REVERSING THE ACTION OF THE PLANNING COMMISSION AS SET FORTH IN ITS RESOLUTION NO. 1051 It was moved by Council Member Cormack, seconded by Council Member Barb (vote pending at next meeting) to deny approval by denying the Resolution. It was moved by Council Member Barb, seconded by Council Member Cormack, and failed 2-3 (Council Members Santangelo, Paul, and Boggs voting no) to amend approval of the variance by restricting the variance approval to the present owner - to terminate upon sale or transfer by the present owner. Council Member Barb asked if a condition could be added which would preclude any nightclub operation. It was moved by Council Member Barb and seconded by Council Member Cormack (vote pending at the next meeting) that Condition #5 be added to provide that the facility shall not be used as a nightclub or other facility open to the general public. Chief Pete Stone advised of the Police Department's ability to regulate one night entertainment with the permit process. It was moved by Council Member Cormack, seconded by Council Member Barb, and carried 4-1 (Council Member Santangelo voting no) to postpone a decision on this item until the next regular meeting. OTHER BUSINESS AND ITEMS FOR FUTURE AGENDAS Staff Members: Director of Public Works Ralph asked for Council direction on Water Quality Control. Council Members: Council conveyed birthday wishes to Council Member Cormack.
