Artist Niles Palmer did the artwork for the Second Century Foundation and the City Council. Mayor Boggs acknowledged appreciation to Ms. Lillian Ashton and Mr. Stan Senate for suggesting designs before the City Seal design was selected. She also thanked Ms. Lois Buchanan and the Second Century Foundation who sponsored the Design '86 when the City was deciding what to hang on the wall. Mrs. Connie Sziebl of the Second Century Foundation asked Mayor Boggs and the following representatives from Downey schools to participate in the Recitation of 'Americans' Creed': West Middle School - Charles Gugliuzza; Thuy Nguyen East Middle School - Jeffrey West Griffith Middle School - Kimberly Yusem; Ryan Higman St. Mark's Episcopal School - Chris Turner; Kristin Griffin St. Raymond's School - Rola Ann Esguerra; Virgilio Gagalang Mayor Boggs made presentations of prizes to the following people who were Winners of the "Focus on Freedom" Constitutional Photography Contest. Mayor Boggs thanked the Donors for all of the above prizes and for their support. Mayor Boggs announced the below Bicentennial Window Decoration Contest Award Winners and Participants: Saywell Florist was the Area and Grand Prize Winner. The Mayor presented Delores Bacus, Owner, and Bill Lee, Manager, a silver Bicentennial coin; Downey National Bank, The Headshop, and Downey Florist were Area Winners. Mayor Boggs expressed appreciation for participation to Home Savings of America; Johnny Co.; Buffa Company, Inc.; and a Donor of Prizes Certificate to Ernie Lackey, President of the Downey Jaycees. Mayor Boggs presented to Mr. Harry. Polgar, General Manager, Mr. Ted Chandler, Director of Advertising, and Mr. Robert Coperstone, Managing Editor of the News Tribune Newspaper, a Proclamation in Commemoration of its First Anniversary in the City of Downey. Mayor Boggs presented a Proclamation to Michael Alan Spieler on having won the 1st Annual Downey Toyota Northwest Downey Little League Scholarship. Mr. Tom Watts, Jr., President of Downey Toyota, was present with the recipient. Mayor Boggs presented a Proclamation declaring the month of October 1987 as Toastmasters Communications Month to Mr. John Duncan, Area Governor of Toastmasters. Mayor Boggs acknowledged a Proclamation declaring October 15, 1987, as White Cane Safety Day. Mayor Boggs acknowledged a Proclamation declaring October 24-31, 1987, as National Higher Education Week. Mayor Boggs presented to Ms. Peggie Reyna, Services Manager of Su Casa Family Crisis and Support Center, a Proclamation proclaming the month of October 1987, as Domestic Violence Awareness Month. Mayor Boggs acknowledged a Proclamation declaring the month of October 1987 as National Lupus Month. Council Member Barb introduced Dr. Edward Sussman, Superintendent, Downey Unified School District, Mr. Mark Morris, President, Downey Unified School District, Pete Stone, Acting Police Chief, and Mrs. Jodi Barb, Downey Police Officer and the Dare Program Instructor. Mayor Boggs read in full and presented to the above individuals a Proclamation declaring the City of Downey supports the Red Ribbon Campaign and the proclamation of October 25-31, 1987, and Council Minutes 10/13/87 -2- lbz3o encourages its citizens to participate in drug awareness activities and to demonstrate to the youth of our community its commitment to a healthy -drug -free life. Mayor Boggs acknowledged a Proclamation declaring October Escrow Month. Mayor Boggs acknowledged a Proclamation declaring October 8, 1987, as Firefighters Appreciation Day. The meeting recessed at 8:20 p.m. to the regular Community Development Meeting and reconvened at 8:30 p.m, with all Council Members present. HEARINGS Mayor Boggs opened the Public Hearing on Downey Improvement Project No. 718, Sites 1 and 2, West Side of Tweedy Lane between Vista Del Rosa and Blandwood Road. City Clerk Young affirmed the Affidavit of Posting and Notice of Mailing. City Clerk Young stated there were no written protests or objections filed. Mayor Boggs called for those in the audience who wished to speak for or against Downey Improvement Project No. 718. There were none. It was moved by Council Member Santangelo, seconded by Council Member Barb, and unanimously carried that the Public Hearing be closed. RESOLUTION NO. 4939 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENTS FOR CHAPTER 27 PROCEEDINGS FOR DOWNEY IMPROVEMENT PROJECT NO. 718, SITES 1 AND 2, WEST SIDE OF TWEEDY LANE BETWEEN VISTA DEL ROSA AND BLANDWOOD ROAD The Resolution was read by title only. It was moved by Council Member Santangelo, seconded by Council Member Barb, and unanimously carried to waive further reading and to adopt. Mayor Boggs opened the Public Hearing on Zone Change No. 239 for Property Located at 7190 - 7244 Firestone Boulevard. City Clerk Young affirmed the Proof of Publication. Community Director Cutts submitted the staff report on this request to reclassify the dual zoning classifications of the property located at 7190-7244 Firestone Boulevard from Light Manufacturing (M-1) and Parking Buffer (P-B) to General commercial (C-2). Mr. Cutts also presented a short slide presentation showing various businesses on and around the subject property. City Clerk Young stated there were no written protests or objections filed. Mayor Boggs called for those in the audience who wished to speak in favor of or against Zone Change No. 239. There were none. It was moved by Council Member Barb and seconded by Council Member Santangelo that the Public Hearing be closed. Hearing no objections, so ordered. Mayor Boggs clarified with staff that this area will be considered during General Plan amendments. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE CITY'S OFFICIAL ZONING MAP ADOPTED BY SECTION 9106.06 OF THE DOWNEY MUNICIPAL CODE (ZONE CHANGE CASE NO. 239) The Ordinance was read by title only. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried to waive further reading and to introduce. Council Minutes 10/13/87 -3- 13337 Mayor Boggs opened the Public Hearing on Zone Variance No. 525 for Property Located at 7676 Firestone Boulevad - Appeal. City Clerk Young affirmed the Proof of Publication. Community Development Director Cutts presented this requested Zone Variance to Section 9150 of the Downey Municipal Code to reduce the number of required parking spaces for a banquet room facility in a C-2 Zone, and stated that the Planning Commission heard and denied the subject Zone Variance on August 19, 1987. The applicant appealed this Planning Commission decision on August 31, 1987. It is staff's recommendation to deny this appeal. City Clerk Young stated there no written protests or objections filed. Mayor Boggs asked that the applicant come forward and present his case. Mr. Richard Jennings, applicant's representative, 7435 Stewart & Gray Rd., presented the Council Members with briefs and maps for discussion. He challenged that this is a special circumstance since there is an existing building with storage, restroom, and aisle areas not conducive to the galleria use. He asked Council to grant the Zone Variance by reversing the 2-2 vote of the Planning Commission. Mayor Boggs asked if there was anyone else who wished to speak in favor or in opposition of Zone Variance No. 525. There were none. It was moved by Council Member Santangelo and seconded by Council Member Paul to close the Public Hearing. Hearing no objections, so ordered. Council discussed if businesses are under one building or individual buildings, parking would not be different, that aisles can be defined as shopping areas, the possibility of applicant lease of railroad property, the need for more banquet facilities, and support of the Parking Code to insure future adequate parking. Council thanked Mr. Jennings for his meaningful presentation and complimented the applicant on work done in converting the old bowling alley. It was moved by Council Member Santangelo, seconded by Council Member Paul, and carried 3-2 (Council Members Cormack and Barb voting no) to approve the Appeal on Zone Variance Case No. 525 and bring back a Resolution with findings from staff at the Council Meeting of October 27, 1987. ORAL COMMUNICATIONS - Items not on Agenda Mrs. Joyce Lawrence, 9627 Cheddar St., commented re founding of Downey community 114 years ago. Ns. Soozie Villa, 8342 Adoree St., advised of Title 24 of the State Building Code which provides that public facilities be designed for access to people with disabilities. She submitted a summary of areas within the City of Downey which are unaccessible. CONSENT CALENDAR Agenda Item VI-C-3, Cash Contract No. S.S. 416-Traffic Improvements/Signalization of Davis St. at Brookshire Ave. and Davis St. at Downey Ave., was removed at the request of Council Member Barb. RESOLUTION NO. 4940 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING A LOCAL APPEALS BOARD TO CONSIDER APPEALS AS TO ACCESS TO PUBLIC ACCOMMODATIONS BY PHYSICALLY HANDICAPPED PEOPLE RESOLUTION NO. 4942 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROPOSING TO ANNEX A CERTAIN AREA INTO THE LIGHTING MAINTENANCE DISTRICT NO. A.D. NO. 121 AND ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT PURSUANT TO THE LANDSCAPE AND LIGHTING ACT OF 1972 (ANNEXATION 87/65- CHEROKEE DRIVE BETWEEN DOLAN AVENUE AND LAKEWOOD BOULEVARD) RESOLUTION NO. 4943 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE ENGINEER'S REPORT FOR THE ADDITION TO LIGHTING MAINTENANCE DISTRICT A.D. 121 OF ANNEXATION 87/65 (CHEROKEE DRIVE BETWEEN DOLAN AVENUE AND LAKEWOOD BOULEVARD) RESOLUTION NO. 4944 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ANNEX A CERTAIN AREA INTO THE LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC PLACES (ANNEXATION 87/65-CHEROKEE DRIVE BETWEEN DOLAN AVENUE AND LAKEWOOD BOULEVARD) (Public Hearing set for November 11, 1987) It was moved by Council Member Barb, seconded by Council Member Santangelo, and carried by the following vote to approve the remainder of the Consent Calendar as recommended: AYES: 5 Council Members: Barb, Cormack, Santangelo, Paul, Boggs ORDINANCES Administrative Services Director Powell advised that this was the second reading for adoption of an Ordinance that was introduced at the City Council Meeting of September 22, 1987, concerning our water improvement bonds. He further related that the City Council is required to approve the forms of these legal documents by way of Ordinance because our Charter requires that agreements that extend beyond ten years be in the form of an Ordinance. Council discussed keeping surplus well property; location of our water basin; keeping abreast of water quality, and the latest technology for purification. Public Works Director Ralph responded to questions and advised that water quality is evaluated on a daily basis. Council Minutes 10/13/87 -5- 8339 Mayor Boggs asked that staff bring back to Council a water purification status report. Before the below vote was taken, Council Member Santangelo clarified with the City Attorney that this Ordinance has no special benefit to him over that of any other citizen. Staff responded negatively to Council Member Paul's inquiry whether in addition to water movement, these funds would be used for treatment. ORDINANCE NO. 860 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APROVING FORMS OF AND AUTHORIZING THE EXECUTION OF A TRUST AGREEMENT AND AN INSTALLMENT PURCHASE AGREEMENT RELATING TO AN INSTALLMENT PURCHASE FINANCING AND APPROVING CERTAIN ACTIONS IN CONNECTION THEREWITH It was moved by Council Member Santangelo, seconded by Council Member Cormack, and carried 4-1 (Council Member Paul voting no) to waive further reading and to adopt. RESOLUTIONS Director of Public Works Ralph presented a summary of the staff report and related that the 25% rate increase put the City of Downey in the middle of what average consumer pays in the surrounding areas and affirmed that water rates had not been adjusted in two years. Council Member Santangelo clarified that he could vote on this issue because any action taken at this time would be for the rates to cover the water bonds. Any further action on water improvements that might affect his property would take a separate action. It was moved by Council Member Barb, seconded by Council Member Paul (and failed due to the following amendment) to amend the Resolution to provide for an increase but that all zones be equalized. Mr. Powell advised that the official statement shows the actual rate structure as it exists at the time the documents are printed up and this is what the rating agencies will use when rating the bonds next week. It was moved by Council Member Cormack, seconded by Council Member Santangelo, and carried 3-2 (Council Members Barb and Paul voting no) to amend the foregoing motion to introduce the Resolution as submitted, and that staff be directed to return before the effective date with a resolution that would equalize the zones. RESOLUTION NO. 4945 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING THREE (3) WATER SERVICE ZONES FOR SEPARATE WATER RATES AND RECINDING RESOLUTION NO. 4661 It was moved by Council Member Cormack, seconded by Mayor Boggs, and carried 3-2 (Council Members Barb and Paul voting no) to waive further reading and to adopt. ADMINISTRATIVE REPORTS Residential Refuse Rate Adjustment Public Works Director Ralph presented a summary of the staff report and recommended that Council approve the new refuse rates of $6.82 per month for single-family residences and $5.88 per unit per month for multiple -unit residences. Council Member Cormack expressed concern that multiple -unit residences pay less than single-family residences for refuse collection. Mayor Boggs related she is a Director on the Los Angeles County Sanitation District, that the rates in Southern California are low, and that there are problems relating to trash and water that will have to be solved. Council Minutes 10/13/87 -6- 8340 After further brief Council discussion, it was moved by Council Member Paul, seconded by Mayor Boggs, and unanimously carried to approve the residential refuse rate adjustment as recommended. ITEMS REMOVED FROM CONSENT CALENDAR Cash Contract No. S.S. 416, Traffic Improvements/Signalization of Davis Street at Brookshire and Davis Street at Downey Avenue Staff clarified Council concern relative to desirability of this study and commented on the need for a consultant. It was moved by Council Member Santangelo, seconded by Council Member Cormack, and failed (0-5) to continue to the next Council Meeting and have staff bring back additional data regarding information on traffic accidents in the area. It was moved by Council Member Barb, seconded by Mayor Boggs, and carried 4-1 (Council Member Santangelo voting no) to authorize the transfer of funds in the amount of $10,000 from Account No. 26-16412 to Account No. 26-16416 to be used for project planning and traffic studies on the anticipated traffic improvements on Davis Street. Extension of the Motel Moratorium It was moved by Council Member Cormack, seconded by Council Member Paul, and carried 4-1 (Council Member Santangelo voting no) to set the Public Hearing for November 10, 1987. Exchange of $400,000 of Prop A Funds with Commerce Staff clarified that the agreement before Council is the one previously authorized and not a request for additional funds. Council differed on feelings of an adequate transportation system within the community - with Council Member Paul opposing the exchange of any funds. It was moved by Council Member Cormack, seconded by Mayor Boggs, and carried 4-1 (Council Member Paul voting no) to approve staff recommendation to execute the Agreement. Resolution to Support Pet Population Control Effort Acting Police Chief Stone advised that funds from all members of SEAACA would be combined for a common educational process. RESOLUTION NO. 4941 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY IN SUPPORT OF THE COALITION FOR PET POPULATION CONTROL It was moved by Council Member Barb, seconded by Council Member Sanatangelo, and unanimously carried to waive further reading and to adopt. OTHER BUSINESS AND ITEMS FOR FUTURE AGENDAS Staff Members: Mr. Ralph, Director of Public Works, clarified Council direction regarding revised Water Rates to provide equalized rates in the three zones for all sizes of meters. Council Member: Council Member Cormack: 1. Will meet with City Manager regarding formation of a Disaster Preparedness Committee. 2. Requested report from the City Attorney regarding recently passed State Law on porno newsracks. Council Minutes 10/13/87 -7- M4 i 3. Suggested Council be provided with lapel pins to share at City functions. 4. Asked about status of Shuttle Memorial. Council Member Barb: I. Asked that the Mayor direct the Public Works Department to resubmit consideration of Street Sweeping contract bids - Citywide for next Agenda. Council Member Santangelo: 1. Requested staff report on graffiti removal and noted new graffiti at Northeast corner of Paramount Boulevard and Florence Avenue. 2. Suggested a higher fine for litter thrown from automobiles. Council Member Paul: 1. Suggested a graffiti spray can ordinance. 2. Asked that the City respond to recent news article regarding disability retirement, pointing out procedures as provided by State Law. Mayor Boggs: 1. Reported on worthwhile sessions while attending League of California Cities seminar in San Francisco.
