Ralph, Director of Public Works Charles Baptista, Motor Officer Sylvia Garcia, Communications Specialist William Makshanoff, Building Official Jake Wager, Redevelopment Manager Ronald Yoshiki, City Planner Scot Yotsuya, Assistant to the City Manager Joyce Baker, Executive Secretary PRESENTATIONS Mayor Boggs presented to Mrs. Barbara Rosenberg, Regent of Santa Gertrudes Chapter, Daughters of American Revolution and Mrs. Clara Miller, Bi-Centennial Chairman, a Proclamation declaring September 17-23, 1987, as Constitution Week and September 17, 1987, as United States Constitution Day. Mayor Boggs read a Proclamation declaring September 17, 1987, as the day for Bells Across America - A Ringing Tribute to the Constitution. Mayor Boggs presented to Mr. Larry Mitchell, Veterans Administration Benefit Counselor, a Proclamation declaring September 18, 1987, as National POW/MIA Recognition Day. Mayor Boggs presented plaques to Mr. Jim Graham, General Manager of Downey Auto Center and Mr. Robin Edmond, Program Coordinator of the Los Angeles Chapter of the Muscular Dystrophy Association, and also presented a Proclamation declaring September 12, 1987, as Muscular Dystrophy Awareness Day. Also present was Amanda Van Deusen, Muscular Dystrophy State Poster Child. A video presentation on "911" Emergency Reporting was presented by Fire Chief Irwin. The film was written by Marc Stirdivant of 8532 Dacosta Street and both the Downey Fire Department and Downey Police Department are featured in the film. The film will be distributed nationally to schools, libraries, fire departments and police departments. HEARINGS Mayor Boggs opened the Public Hearing of Protests on Lighting Maintenance District A.D. 121, Annexation 87/63 - Dinsdale Street. City Clerk Young affirmed the Affidavit of Posting and Proof of Publication. City Clerk Young stated there were no written protests or objections filed. Mayor Boggs called for those in the audience who wished to speak in protest to the Annexation. There were none. Council Minutes 9/8/87 -1- 832® It was moved by Council Member Santangelo, seconded by Council Member Paul, and unanimously carried that the Public Hearing be closed. RESOLUTION NO. 4923 A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A' CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN - THOSE AREAS (ANNEXATION 87/63 - DINSDALE STREET FROM 150 FEET EAST OF POMERING ROAD EASTERLY TO THE CUL-DE-SAC The Resolution was read by title only. It was moved by Council Member Santangelo, seconded by Council Member Cormack, and unanimously carried to waive further reading and to adopt. ORAL COMMUNICATIONS - Items not on Agenda Mr. Cliff Maldonado, 7358 Neo St., complained of noise from helicopters all hours of the night and pointed out the growing problem of noise from teens' auto radios. Mr. Lennie Whittington, 8542 Manatee St., re statement of recess to closed session did not point out a Government Code section and complained he felt the Brown Act was violated when Council did not announce Davis lawsuit settlement in open session. City Attorney Newton clarified that the only decisions that are required to be announced following a Brown Act session are the decisions to hire or discharge a City employee. Mr. John Gonzalez, 12350 Orizaba St., re call to home of Director of Public Works regarding permits to finish his home and referenced September 1984 meeting when he felt he was discussed in closed session. Mr. H. J. Mattenberger, 9051 Gotham St., re complaint of City's policy in adding trash service to the water bill and in crediting payment first to trash and remainder to water charges. CONSENT CALENDAR Agenda Item VI-C-1, Cash Contract No. 553 - Proposed Bus Shelters at Various Locations, was removed at the request of City Manager Davis. Agenda Item VI-E-2, Acquisition of 8350 Firestone Boulevard for Public Parking, was removed at the request of Downey resident Lennie Whittington. Agenda Item VI-F-1, Granting Approval on Permissive Conditional Use Permit 87-1, 7749 Florence Avenue, was removed at the request of Council Member Paul. Agenda Item VI-F-S, Owner Participation Agreement - 12006 Regentview Avenue, Barry and Bonnie Murdock, Developers, was removed at the request of Community Director Cutts. Cash Contract No. S.S. 415 - Florence Avenue @ Rives Avenue - Upgrade and Modify Traffic Signal Capital Improvement Budget Amendment: Approve proposed amendment to the Capital Improvement Budget for Fiscal Year 1987-88, to include upgrading of detection and physical equipment including modifications to provide protected turn movements, and signal phasing for a proposed driveway on the north side of Florence Ave., providing access to the historical site known as the Johnson property. RESOLUTION NO. 4924 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE APPLICATION FOR PEDESTRIAN FUNDS FOR FISCAL YEAR 1987-88 AUTHORIZED UNDER SENATE BILL NO. 821 (S.B. 821) RESOLUTION NO. 4925 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING THE INTERSECTION OF VISTA DEL ROSA AND MAKES AVENUE AS A THREE-WAY STOP INTERSECTION RESOLUTION NO. 4926 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING GNEISS AVENUE A THROUGH STREET AT ITS INTERSECTION WITH CERTAIN STREETS BETWEEN ADOREE STREET AND GARDENDALE AVENUE RESOLUTION NO. 4927 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING ADOREE STREET A THROUGH STREET AT ITS INTERSECTION WITH GNEISS AVENUE RESOLUTION NO. 4928 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING DEVENIR AVENUE A THROUGH STREET AT ITS INTERSECTION WITH GNEISS AVENUE RESOLUTION NO. 4929 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWDY DESIGNATING CHEYENNE AVENUE A THROUGH STREET AT ITS INTERSECTION WITH GNEISS AVENUE RESOLUTION NO. 4930 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING ADOREE STREET A THROUGH STREET AT ITS INTERSECTION WITH PARROT AVENUE RESOLUTION NO. 4931 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING DEVENIR AVENUE AND BROCK AVENUE AS A FOUR-WAY STOP INTERSECTION It was moved by Council Member Cormack, seconded by Council Member Santangelo, and carried by the following vote to approve the remainder of the Consent Calendar as recommended: AYES: 5 Council Members: Barb, Cormack, Santangelo, Paul, Boggs ORDINANCES: None RESOLUTIONS: None (see Consent Calendar) ADMINISTRATIVE REPORTS Traffic Committee recommendation on Crossing Guards at Ward Elementary School Public Works Director Ralph submitted a Traffic Committee recommendation, along with a street map, for: Council Minutes 9/8/87 -3- 8322 1. Approval of three (3) additional crossing guards to be assigned at various locations surrounding E.W. Ward School on a temporary basis. 2. Approval of an additional appropriation of funds, approximately $26,400; and Staff recommendation for approval of one (1) additional crossing guard to be located at the intersection of Barlin Ave. and Devenir St., and review of additional assignments of crossing guards, contingent upon the findings of a traffic study to be conducted by Engineering staff and law enforcement officers. Those addressing Council in support of added crossing guards to protect the safety of children during the Century Freeway Construction Project were: Mrs. Barbara Samperi, 12817 Dolan Ave. Mrs. Penny Wright, 8402 Conklin St. Mrs. Judy Wolfe, Principal, E.W. Ward School, 8851 Adoree St. Council asked questions of the above persons and discussed the possibility of school bussing of those students on the construction side of the freeway. Council Member Barb indicated his understanding that Caltrans may pay for some of this cost during the construction period. Crossing Guards were suggested at: Blodgett Ave. and Gardendale St. (transfer from Airpoint and Gardendale) Devenir St, and Brookshire Ave. Barlin Ave.and Adoree St. Devenir St. and Barlin Ave. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried to authorize the added three crossing guards on a temporary basis as recommended by the Traffic Committee, to direct a review as recommended by staff, and to contact Caltrans to request assistance in the cost during freeway construction. The meeting recessed at 8:55 p.m, and reconvened at 9:06 p.m. with all five Council Members present. ITEMS REMOVED FROM CONSENT CALENDAR Cash Contract No. 553 - Proposed Bus Shelters at Various Locations City Manager Davis requested this item be continued to a future meeting. Hearing no objections, so ordered. Acquisition of 8350 Firestone Boulevard for Public Parking Dr. Michael Sullivan, 11116 Rives Ave., stated opposition to the acquisition of the property at 8350 Firestone Blvd. for public parking and believes that Denny's Restaurant is a fine addition to the community. He further stated that the possible acquisition costs, loss of sales and property tax, loss of jobs, and perhaps high legal fees, would be detrimental to the citizens of Downey. He asked that Council reject the recommendation by staff. Mr. Lennie Whittington, 8542 Manatee St., stated that Denny's Restaurant, formerly King's Restaurant, has been completely renovated inside and remodeled and has just opened for business. He further said he does not feel it is appropriate for the City to acquire this property for public parking and does not feel this will solve the Civic Center parking problems. Mr. Whittington suggested this problem should be handled by a Blue Ribbon Citizen Committee and have the Citizen Committee decide how to solve the parking problems at the Civic Center. It was moved by Council Member Barb, seconded by Council Member Cormack, and unanimously carried to authorize staff to obtain title information and real Property appraisals on 8350 Firestone Blvd. Prior to the above vote, Public Works Director Ralph discussed a proposed procedure that after appraisals and title search, a written offer will then be made and presented to the property owners. If negotiations are completed, Council Minutes 9/8/87 -4- 8323 Council can decide at that time whether or not to open escrow. In the event the property can not be acquired through negotiations, then as stated in the written recommendation, the Council could consider whether or not it wished to go �6'ri'her. Council Member Paul commented that this would be an appraisal and a title search, not a decision in regards to eminent domain. Mayor Boggs pointed out she was not voting for eminent domain, but voting to give staff the authority to pursue looking into this matter. Granting Approval on Permissive Conditional Use Permit 87-1, 7749 Florence Ave. (Appl.: Assistance League) Council Member Paul stated that he pulled this item for discussion, indicating support of this philantrohic organization and asking that Section 3, number 5 of the Resolution be amended. Motion failed: It was moved by Council Member Paul, seconded by Council Member Cormack, but failed 2-3 (Council Members Barb, Santangelo, and Boggs voting no) that Section 3, number 5 be amended to read: The Dinsdale Street vehicular entrance and gate may be used by the applicant only. A personnel gate is permitted for access to the area between the wall and Dinsdale. Motion failed: It was moved by Council Member Santangelo, seconded by Mayor Boggs, but failed 2-3 (Council Members Barb, Cormack, and Paul voting no) to amend this Resolution to provide that there will be no retail sales on the premises. Council clarified that annual garage sales as provided by code will be allowed. RESOLUTION NO. 4917 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DONNEY GRANTING PERMISSIVE CONDITIONAL USE PERMIT 87-1 The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried to waive further reading and to adopt. Owner Participation Agreement - 12006 Regentview Avenue - Barry and Bonnie Murdock, Developers Community Development Director Cutts asked that this matter be continued to the September 22, 1987 meeting. Hearing no objections, so ordered. OTHER BUSINESS AND ITEMS FOR FUTURE AGENDAS Staff Members: None Council Members: Mayor Boggs: Pursuant to a letter received from a citizen, clarified that the City of Downey is not included in the Medfly spraying and has not been found to have a problem.
