Boggs presiding. PRESENT: Council Members: Diane P. Boggs Mayor Robert G. Cormack Mayor Pro Tem Roy L. Paul James S. Santangelo ABSENT: Randall R. Barb (excused) ALSO PRESENT: Don Davis, City Manager Carl K. Newton, City Attorney Jenny Young, City Clerk -Treasurer Ronald Irwin, Fire Chief James R. Jarrett, Director of Community Services Pete Stone, Acting Police Chief Lee Powell, Director of Administrative Services William A. Ralph, Director of Public Works Sylvia Garcia, Communications Specialist William McCulloch, Motor Officer Jake Wager, Redevelopment Manager Maxine Woerner, Associate Planner Ronald Yoshiki, City Planner Scot Yotsuya, Assistant to the City Manager Joyce Baker, Executive Secretary PRESENTATIONS Mayor Boggs presented a plaque Southeast Area Animal Control Authority Commissioner from 1986-87. HEARINGS to Council Member Santangelo from the in recognition of dedicated service as a Mayor Boggs opened the Public Hearing of Protests on Lighting District Annexation 87/03, Boyson Street between Birchdale Avenue and Blodgett Avenue. City Clerk Young affirmed the Affidavit of Posting of Notice and Proof of Publication. City Clerk Young stated there were no written protests or objections filed. Mayor Boggs called for those in the audience who wished to speak in protest to the annexation. There were none. Mayor Boggs called for those in the audience who wished to speak in favor of the proposed annexation. The following person came forward: Ms. Kristine Cerone, 8619 Boyson St., stated she is the resident who carried the petition asking that Boyson St. be annexed into the Lighting District. She said she and the other residents who signed the petition are in favor of the annexation as a safety factor for their neighborhood. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried (Council Member Barb absent) to close the Public Hearing. Council Minutes 7/28/87 -1- 8 aJ5 RESOLUTION NO. 4910 A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS (ANNEXATION 87/03 BOYSON STREET BETWEEN BIRCHDALE AVENUE AND BLODGETT AVENUE) The Resolution was read by title only. It was moved by Council Member Santangelo, seconded by Council Member Cormack, and unanimously carried (Council Member Barb absent) to waive further reading and to adopt. Mayor Boggs opened the Public Hearing of Protests on Lot Cleaning Program. City Clerk Young affirmed the Proof of Publication. City Clerk Young stated there were no written protests or objections filed. Mayor Boggs called for those in the audience who wished to speak in protest or in favor of the Lot Cleaning Assessments. There were none. Mayor Boggs hearing no objections, so ordered the Public Hearing closed. It was moved by Council Member Santangelo, seconded by Council Member Cormack, and unanimously carried (Council Member Barb absent) and noting no protests, to affirm the assessments. Mayor Boggs opened the Public Hearing on Permissive Conditional Use Permit No. 87-1, 7749 Florence Avenue. It was moved by Council Member Santangelo, seconded by Council Member Cormack, and unanimously carried (Council Member Barb absent) to continue the Public Hearing on Permissive Conditional Use Permit No. 87-1, 7749 Florence Avenue, to August 25, 1987. Mayor Boggs opened the Public Hearing on Appeal to Conditional Use Permit - No. 252, Property Located at 7862 Firestone Boulevard. It was moved by Council Member Paul, seconded by Council Member Santangelo, and unanimously carried (Council Member Barb absent) to continue the Public Hearing on Appeal to Conditional Use Permit No. 252, Property Located at 7862 Firestone Boulevard, to August 25, 1987. ORAL COMMUNICATIONS - Items not on Agenda Mr. John Gonzalez, 12350 Orizaba Ave., re complaint data submitted some months ago (92 pages) and to an application taken out in City of Bell Gardens by Cn. Paul. He handed the City Clerk, for the record, miscellaneous building permits from the City of Bell Gardens. Mr. Gonzalez was asked to take a seat in the audience and he did so. RESOLUTION NO. 4911 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROPOSING TO ANNEX A CERTAIN AREA INTO THE LIGHTING MAINTENANCE DISTRICT NO. A.D. 121 AND ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 (ANNEXATION 87/63- DINSDALE STREET FROM 150 FEET EAST OF POMERING ROAD EASTERLY TO THE CUL-DE-SAC) RESOLUTION NO. 4912 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE ENGINEER'S REPORT FOR THE ADDITION TO LIGHTING MAINTENANCE DISTRICT A.D. 121 OF ANNEXATION 87/66-(DINSDALE STREET FROM 150 FEET EAST OF POMERING ROAD EASTERLY TO THE CUL-DE-SAC) RESOLUTION NO. 4913 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ANNEX A CERTAIN AREA INTO THE LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC PLACES (ANNEXATION 87/63- DINSDALE STREET FROM 150 FEET EAST OF POMERING ROAD EASTERLY TO THE CUL-DE-SAC) (Public Hearing set for August 25, 1987) RESOLUTION NO. 4914 (ADOPT) - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING A COST -OF -LIVING WAGE ADJUSTMENT FOR PART- TIME HOURLY CLASSIFICATIONS AND RESCINDING RESOLUTION NO. 4286 RESOLUTION NO. 4915 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING A CONFLICT OF INTEREST CODE WHICH INCORPORATES BY REFERENCE THE FAIR POLITICAL PRACTICES COMMISSION'S STANDARD MODEL CONFLICT OF INTEREST CODE AMID RESCINDING RESOLUTION NO. 4750 It was moved by Council Member Santangelo, seconded by Council Member Paul, and carried by the following vote to approve the Consent Calendar as recommended: AYES: 4 Council Members: Cormack, Santangelo, Paul, Boggs NOES: 0 Council Members: None ABSENT: 1 Council Member: Barb ORDINANCES• None RESOLUTIONS: None (see Consent Calendar) ADMINISTRATIVE REPORTS Result of Community Survey Relating to Secondary Uses in Transmission Line Right -Of -May Mr. Jake Wager, Redevelopment Manager, presented the staff report and also stated that the attachment to the staff report has been forwarded to Los Angeles Department of Water and Power and Southern California Edison Company. The report contains background information, survey results, five alternatives that have been listed for Council consideration, a map of the area involved, and a copy of the questionnaire used. Staff recommended adoption of Alternative No. 1 or Alternative No. 5. Council Minutes 7/28/87 -3- 82 Mr. Carl Newton, City Attorney, asked Mr. Wager to clarify that the purpose of the adoption is a policy of the City as pertaining to the area in question. The answer was affirmative by Mr. Wager. Before the below vote, Mayor Boggs confirmed that this does not affect current uses, but would stop any future use if it was not accepted by the neighborhood. It was moved by Council Member Cormack, seconded by Council Member Santangelo, and carried by unaninmous vote (Council Member Barb absent) to approve Alternative No. 1. ITEMS REMOVED FROM CONSENT CALENDAR: None OTHER BUSINESS AND ITEMS FOR FUTURE AGENDAS Staff Members: 1. Mr. Don Davis, City Manager, complimented Mr. Bill Ralph, Director of of Public Works, and his staff on the landscaping around the perimeter of the Council Chamber. Council concurred. City Council Members: 1. Council Member Cormack re Status of Space Shuttle Monument to be placed in Downey Civic Center. 2. Mayor Boggs reported on good Mayor/Council Member Executive Forum Conference in Monterey and as a result of that meeting indicated interest in serving on committee which would coordinate joint use of school facilities for child care.
