Boggs presiding. PRESENT: Council Members/Commissioners: Diane P. Boggs Mayor Pro Tem/Vice-Chairman Robert G. Cormack Randall R. Barb Roy L. Paul ABSENT: James S. Ralph, Director of Public Works Alta Duke, Social Services Division Manager Mark Huebsch, Community Development Counsel Laura Nash, Administrative Assistant Jake Wager, Redevelopment Manager Ronald Yoshiki, City Planner Scot Yotsuya, Assistant to the City Manager Joyce Baker, Executive Secretary Mayor Pro Tem/Vice-Chairman Boggs stated that the Council/Commission will be recessing to closed session for the purpose of discussing a matter of potential litigation, pursuant to Section 54956.9 (b) of the Government Code. The meeting was recessed at 6:36 p.m. and reconvened at 7:00 p.m, with all Council/Commission Members present (Mayor/Chairman Santangelo). Mayor Pro Tem/Vice-Chairman Boggs stated the following action of the Council/Commission: "The City Council received a late proposal from the County of Los Angeles regarding proposed Amendment No. 4. The City Council approves in principle the basic elements contained in the proposal, although certain specifics need to be worked out to the mutual satisfaction of the parties. We appreciate your indulgence during this unexpected closed session. However, according to County personnel, the agreement in principle will eliminate the need for lengthy testimony this evening." The Invocation was delivered by Council/Commission Member Cormack. The Flag Salute was led by Council/Commission Member Barb. It was moved by Council/Commission Member Barb, seconded by Council/Commission Member Paul, and unanimously carried (Mayor/Chairman Santangelo absent) to approve a correction to the Minutes to the Commission of June 9, 1987 relative to A Joint Public Hearing on Proposed Amendment No. 4. Page 2a approved in place of Paragraph 6 of page 2. HEARINGS A Joint Public Hearing of the City Council and the Community Development Commission Re: Proposed Redevelopment Plan and Draft Environmental Impact Report on Proposed Amendment No. 4. City Council/Community Dev. Comm. Minutes 7/6/87 -1- Mayor Pro Tem/Vice-Chairman Boggs advised that this is a continued Public Hearing from June 9, 1987. She outlined procedures for addressing the Council/Commission. Staff presentation was made by Mr. Jim Cutts, Director of Community Development. Mr. Cutts stated that based upon discussions that have taken place with a number of individuals, interest groups, and Downey CARES, staff is recommending some changes to Proposed Amendment No. 4 to the Redevelopment Plan. They are as follows: 1. To eliminate eminent domain from the Redevelopment Plan. 2. That the Project Area Committee be continued for the life of the plan, which is thirty (30) years. 3. Elimination of certain controls for rehabilitation and conservation efforts while retaining controls over redevelopment and new development projects in the Project Area. 4. Establish certain procedures for amending the Redevelopment Plan. Mr. Cutts responded to issues brought up at the June 9, 1987 portion of the Public Hearing. He rebutted a statement that 20% of the City is in the Redevelopment Area, clarifying that the existing Project Area and Amendment No. 4 would encompass 430 total acres or 5.3% of the City. With Woodruff Industrial Project Area the total would equal 6.7%. Mr. Cutts referenced letters received from nearby lending institutions confirming that they would lend funds for property within the Redevelopment Area. He also touched upon reference to strength of the Code Enforcement Program for improvement in an area, pointing out the inability to create financing capabilities. Reports and data included in this hearing were: 1) Downey Redevelopment Project -Redevelopment Plan Amendment No. 4; 2) Report to City Council for the Downey Redevelopment Project -Amendment No. 4; 3) Amendment No. 4-Revisions as proposed by Downey CAREs; 4) Response to Downey CARES Report; 5) Project Area Committee Report re: Certificates of Conformance; 6) Amendment No. 4 response to the report prepared by Mr. Paul Sarvis. Letters of recommendation of GRC (Gunn Russell, Copenhaver & Co.) received from the cities of Baldwin Park and Claremont were placed into the record. City Clerk Young stated that written correspondence received in her office was copied and distributed to the Council/Commission prior to the meeting. There being no objections, that correspondence and correspondence received at this hearing are placed into the record. PROPONENTS: Proponents urged approval referencing comparative city income statistics of those with and without redevelopment, a need to upgrade services, aesthetics and blight, increased sales tax benefits and increased value to existing businesses, opportunity of new jobs, tax benefits of eminent domain and that eminent domain may be the heart of redevelopment. Downey, CA The meeting recessed at 8:10 p.m. and reconvened at 8:21 p.m. with Council/Commission Members Boggs, Cormack, Barb and Paul present (Mayor/Chairman Santangelo absent) Mayor Pro Tem/Vice-Chairman Boggs asked for those in the audience who would like to testify in opposition of the Proposed Redevelopment Plan and Draft Environmental Impact Report for Amendment No. 4 to the Downey Redevelopment Project. OPPONENTS: Many of the opponents expressed that if eminent domain were removed they would not be opposed or as opposed to this Redevelopment Plan. Some spoke of approval with inclusion of a three-point plan stated by the Woodruff Everest Benedict Property Owners' Association, endorsed by Downey CAREs. One question was to the procedure of obtaining a Certificate of Compliance as provided in this proposed plan. Others were opposed, citing fear and hardship of relocation and increased rents, objection to blight finding, lack of trust in the process, and pro private enterprise without redevelopment. Another question was to the filing of conflict of interest pursuant to 33130 of the Health and Safety Code. Legal counsel responded to the question of the conflict of interest filing stating that only those with conflict in the area need to file. City Clerk Young referenced correspondence received both before and during this hearing. Those letters are referenced above under Correspondence Received. Council comments followed: Council/Commission Member Paul affirmed his position to revitalize, rebuild, and redevelop. He stated that he would heed the voice of the community to remove eminent domain. Mr. Paul stated that he had not filed a conflict of interest statement because he has no conflict. Council/Commission Member Cormack stated that he would vote with the majority in eliminating eminent domain, but felt that a more informed public would have seen that it is not the threat it seems to be. Council/Commission Member Barb compared feelings versus facts as they relate in this instance to eminent domain. He pointed out the tax benefits to property owners when eminent domain is in place. He would like to see an opportunity for those wanting to be under eminent domain to request that. Council/Commission Member Barb asked for clarification and City Attorney Newton clarified that if there is no property owned within the proposed Project Area there is no need to file a statement pursuant to Section 33130 of the Health and Safety Code. Mayor Pro Tem/Vice-Chairman Boggs stated that she has no conflict to report within the Project Area. She commented on this plan without eminent domain and urged that we go forward keeping in mind the statistics presented this evening by Mr. Miller and that 100% tax increment increment has been lost due to a change in County Policy over the years. City Council/Community Dev. Comm. Minutes 7/6/87 -6- 08271 AMENDMENT TO PLAN: It was moved by Council/Commission Member Paul, seconded by Council/Commission Member Cormack, and unanimously carried (Mayor/Chairman Santangelo absent) that the Redevelopment Plan for Amendment No. 4 be amended pursuant to staff recommendation and that all areas of the proposed Plan be amended to reflect those recommendations. The following Resolutions and Ordinance reflect the Plan as amended. The City Council recessed during the following Community Development Commission actions: Commissioners Boggs, Barb, Cormack, and Paul in attendance (Chairman Santangelo absent). RESOLUTION NO. 191 A RESOLUTION OF THE DOWNEY COMMUNITY DEVELOPMENT COMMISSION APPROVING ITS REPORT ON THE REDEVELOPMENT PLAN FOR DOWNEY REDEVELOPMENT PROJECT AMENDMENT NO. 4 AND TRANSMITTING THE REPORT AND THE REDEVELOPMENT PLAN TO THE CITY COUNCIL OF THE CITY OF DOWNEY The Resolution was read by title only. It was moved by Commissioner Cormack, seconded by Commissioner Barb, and unanimously carried (Chairman Santangelo absent) to waive further reading and to adopt. RESOLUTION NO. 192 A RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF DOWNEY FINDING THAT THE PROVISION OF LOW -AND MODERATE -INCOME HOUSING OUTSIDE THE DOWNEY REDEVELOPMENT PROJECT WILL BE OF BENEFIT TO THE REDEVELOPMENT PROJECT The Resolution was read by title only.
