Santangelo presiding. PRESENT: Council Members: James S. Santangelo Mayor Diane P. Boggs Mayor Pro Tem Robert G. Cormack Randall R. Barb Roy L. Paul ALSO PRESENT: Don Davis, City Manager Carl K. Newton, City Attorney Jenny Young, City Clerk -Treasurer James R. Cutts, Director of Community Development Lyle Wilkinson, Battalion Chief James R. Jarrett, Director of Community Services William F. Martin, Police Chief Lee Powell, Director of Administrative Services William A. Ralph, Director of Public Works Vernita Anderson, Traffic Engineer Mark Huebsch, Community Development Counsel William Makshanoff, Building Official Laura Nash, Administrative Assistant Brice Russell, GRC Redevelopment Consultant Mark Sellheim, Principal Planner Jake Wager, Redevelopment Manager Ronald Yoshiki, City Planner Scot Yotsuya, Assistant to the City Manager Joyce Baker, Executive Secretary PRESENTATIONS Mr. Floyd Tooley, President of the Rio Hondo Men's Club, presented a check in the amount of $500 on behalf of the Rio Hondo Men's Club, and a $300 check on behalf of the Nissei Wednesday Club, to the City as donations to the Golf Course for the purchase of additional trees. Mayor Santangelo accepted on behalf of the City. Council Member Cormack presented a Certificate of Appreciation to Ms. Gloria Heer (see Resolution No. 4874) on her appointment to the Recreation and Community Services Commission for District No. 3. Council Member Cormack also thanked Mr. Joe Ferris for his service. HEARINGS A Public Hearing on Downey Improvement Project No. 720, Elm Vista Drive - North side, East of Bellflower Boulevard. City Clerk Young affirmed the Affidavit of Posting and Mailing. It was moved by Council Member Boggs, seconded by Council Member Cormack, and unanimously carried to receive and file. It was moved by Council Member Boggs, seconded by Council Member Paul, and unanimously carried to accept the Engineer's Report. City Clerk Young stated there were no written protests or objections filed. Mayor Santangelo called for those in the audience who wished to speak in Favor of or Against Downey Improvement Project No. 720. There were none. It was moved by Council Member Paul, seconded by Council Member Barb, and unanimously carried that the Public Hearing be closed. Council Minutes 5/26/87 -1- RESOLUTION NO. 4877 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENTS FOR CHAPTER 27 PROCEEDINGS FOR DOWNEY IMPROVEMENT PROJECT NO. 720, SITES 4 AND 5, NORTH SIDE OF ELM VISTA DRIVE, EAST OF BELLFLOWER BOULEVARD The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Boggs, and carried by unanimous vote to waive further reading and to adopt. A Public Hearing on Downey Improvement Project No. 721, Sites 1, 2, 3, 4 _ and 7, South side of Bellflower Boulevard. City Clerk Young affirmed the Affidavit of Posting and Mailing. It was moved by Council Member Paul, seconded by Council Member Cormack, and unanimously carried to receive and file. It was moved by Council Member Cormack, seconded by Council Member Boggs, and unanimously carried to accept the Engineer's Report. RESOLUTION NO. 4878 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENTS FOR CHAPTER 27 PROCEEDINGS FOR DOWNEY IMPROVEMENT PROJECT NO. 721, SITES 1, 2, 3, 4, AND 7, SOUTH SIDE OF ELM VISTA DRIVE, EAST OF BELLFLOWER BOULEVARD — The Resolution was read by title only. It was moved by Council Member Boggs, seconded by Council Member Cormack, and carried by unanimous vote to waive further reading and to adopt. A Public Hearing on Underground Utility District No. 13, Firestone Boulevard to Second Street and Downey Avenue to Embassy Suites property line. City Clerk Young affirmed the Affidavit of Mailing. It was moved by Council Member Cormack, seconded by Council Member Boggs, and unanimously carried to receive and file. City Clerk Young stated that there were no written protests or objections filed. Mayor Santangelo called for those in the audience who wished to speak in Favor of or Against Formation of Underground Utility District No. 13. There were none. It was moved by Council Member Cormack, seconded by Council Member Barb, and unanimously carried that the Public Hearing be closed. RESOLUTION NO. 4879 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING THAT AN UNDERGROUND UTILITY DISTRICT BE FORMED PURSUANT TO RESOLUTION NO. 4860 (DISTRICT NO. 13 - ALLEY EAST OF DOWNEY AVENUE) The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Boggs, and carried by unanimous vote to waive further reading and to adopt. Council Minutes 5/26/87 -2- A Public hearing on the Housing Element of the City's General Plan. City Clerk Young affirmed Proof of Publication. It was moved by Council Member Cormack, seconded by Council Member Barb, and unanimously carried to receive and file. Director of Community Develoment Cutts presented the staff report and recommendation of the Planning Commission (Resolution No. 1019) to approve the Negative Declaration and the Housing Element as submitted. City Clerk Young stated that there were no written protests or objections filed. Mayor Santangelo called for those in the audience who wished to speak in Favor of or Against this Housing Element. There were none. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried to close the Public Hearing. It was moved by Council Member Boggs, seconded by Council Member Cormack, and unanimously carried to Adopt the Negative Declaration. RESOLUTION NO. 4880 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING THE HOUSING ELEMENT OF THE CITY'S GENERAL PLAN The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Barb, and unanimously carried to waive further reading and to adopt. A Public Hearing on General Plan Amendment 87-2 and Zone Change No. 237, for Properties Located at 111027-29-33-43-49-53 and 11105-11-13 Old River School Road, to Establish a General Plan Land Use Designation of Medium Density Residential and to Rezone said Properties from R1-5000, HFB, R-3 PUB and C-1 to R-3-0 (Medium Density Multiple Family Residential) or R-2 (Two -Family Residential) - (Continued from May 12, 1987). Mayor Santangelo stated that there had been a request that this item be delayed until the end of the meeting. The next Public Hearing ended at 12:30 A.M. (Wednesday, May 27, 1987) and the Mayor advised that the attorney for the applicant had requested continuance to June 23, 1987. There were no objections. A Public Hearing as a Joint Hearing with the Community Development Commission re Proposed Redevelopment Plan and Draft Environmental Impact Report on Proposed Woodruff Industrial Project. Mayor Santangelo relinquished the gavel to Mayor Pro Tem Boggs and abstained from taking part in this Hearing. Note from the City Clerk: This Public Hearing is set forth in full in the minutes of the Community Development Commission dated May 26, 1987. Those minutes are attached hereto for reference. The Hearing was not closed this date, but was continued in Joint Session with the Community Development Commission on Wednesday, June 3, 1987. City Planner Yoshiki called the meeting of the Planning Commission to order and adjourned it for lack of a quorum. The meeting recessed at 11:50 p.m. (The Community Development Commission adjourned at this time to Wednesday, June 3, 1987 at 6:30 p.m. in Joint Session with the City Council). The meeting reconvened at 11:58 p.m. with all Council Members present. Mayor Santangelo presiding. Council Minutes 5/26/87 -3- ORAL COMMUNICATIONS - Items not on Agenda Council Member Cormack: There were none from the Public. Mentioned a report by Dr. Wayne of the Downey Community Hospital regarding the effects of smoking. Council discussed the Chamber of Commerce Governmental Affairs Committee's interest in this. Council Member Cormack asked that Anti Smoking Legislation be prepared. Mayor Santangelo stated that the City Council is recessing to closed session for the purpose of considering attorney -client matters, employee negotiation matters, and pending litigation pursuant to the provisions of Section 54956.9 - Government Code, Subdivision (a), Kim vs. Downey. The meeting recessed at 12:10 a.m. (May 27th) and reconvened at 12:25 a.m. with all Council Members present. ADJOURNMENT: 12:25 a.m. The meeting was adjourned to 6:30 p.m., Wednesday, June 3, 1987, in Joint Session with the Community Development Commission in the Council Chamber of the Downey City Hall.
