HEARINGS: None CONSENT CALENDAR Agenda Item IV-E-6, Street names for frontage road along I-105 Freeway and Rancho connector road, was removed at the request of Council Member Boggs. Agenda Item IV-F-1, Lighting Maintenance District AD 121 - Zone Rates, was removed at the request of Mayor Santangelo. It was moved by Council Member Cormack, seconded by Council Member Boggs, and passed by the following vote to approve the Remainder of the Consent Calendar as recommended: Minutes: Adjourned Regular Meeting, May 12, 1987; Regular Meeting, May 12, 1987; Adjourned Regular Meeting, May 18, 1987; and Adjourned Regular Meeting, May 20, 1987: Approve. Cash Contract No. SS-406 - Citywide Street Resurfacing: Award unit price contract totaling $212,483.00 to Shawnan Corporation: Approve. Cash Contract No. 549 - Tree Trimming, Citywide: Waive the bid bond irregularity and award a unit price contract to V & E Tree Service, Inc. in the amount of $91,735.00. Approve. Council Minutes 5/26/87 (Adj.) -1- City of Downey Budget for Fiscal Year 1987-88: Set Public Hearing for June 9, 1987, 6:00 p.m., in the Council Chamber of the Downey City Hall for consideration and adoption of the City 1987-88 Budget and the use of Revenue Sharing Funds. Workers' Compensation Claims Administrator - Contract Renewal: Authorize renewal of the contract with Colen and Lee, Inc., for 1987-88 at monthly service fee of $2,500: Approve. Application for Permissive Conditional Use Permit, 7749 Florence Avenue - Assistance League of Downey: Grant permission to file an application for a Permissive Conditional Use Permit for property located at 7749 Florence Avenue: Approve. Specific Plan Amendment SP85-IA for Property (Parcel A) Southwest of Imperial Highway - Rives Avenue Intersection: Set Public Hearing for June 9, 1987, 7:30 p.m., in the Council Chamber of the Downey City Hall. Contracting for the Firestone Boulevard Corridor Market Analysis: Authorize City Manager to sign Professional Services Agreement with economic firm of Stanley R. Hoffman and Associates and to request $7,500 additional appropriation for economic study: Approve. Donation of Surplus Vehicle to Ensenada Fire Department: Approve the donation of the 1974 Ford Battalion Chief's car to the Ensenada Fire Department: Approve. RESOLUTION NO. 4873 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING A TWO-HOUR PARKING RESTRICTION FROM 9:00 A.M. to 4:00 P.M. ALONG BOTH SIDES OF MARBEL AVENUE N/O FIRESTONE BOULEVARD, AND RESCINDING RESOLUTION NO. 4513 RESOLUTION NO. 4874 (ADOPT) A RESOLUTION OF THE CITY OF DOWNEY APPROVING THE APPOINTMENT OF GLORIA HEER AS A MEMBER OF THE RECREATION AND COMMUNITY SERVICES COMMISSION FOR COUNCILMANIC DISTRICT NO. 3 RESOLUTION NO. 4875 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, DENYING CONDITIONAL USE PERMIT NO. 243 AND UPHOLDING THE ACTIONS OF THE PLANNING COMMISSION AS SET FORTH IN ITS RESOLUTION NO. 1006 RESOLUTION NO. 4876 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING THE APPEAL BY DENYING CONDITIONAL USE PERMIT #246 AND REVERSING THE DECISION OF THE PLANNING COMMISSION AS SET FORTH IN RESOLUTION NO. 1002 AYES: 5 Council Members: Boggs, Cormack, Barb, Paul, Santangelo ORDINANCES: None RESOLUTIONS: None (see Consent Calendar above) ADMINISTRATIVE REPORTS Voting Policy for Traffic Committee: Council considered a Voting Policy for the Traffic Committee along with a staff recommendation that the makeup and voting rights of the Traffic Committee remain as they currently are. Council Minutes 5/26/87 (Adj.) -2- It was moved by Council Member Boggs, seconded by Council Member Cormack, and failed 1-4 (Council Member Boggs voting yes) to approve the staff recommendation. Council Members voting no, stated the need for staff input but felt the Committee should have the final vote. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried to instruct the City Attorney to prepare an Ordinance which gives voting rights to committee members only. Dart Program Promotional Funding: Council considered the Dart Program Promotional Funding along with staff recommendation for approval of financial assistance for the DART program via an ongoing transfer from Account No. 10-3-1850 of $5,000 of the funds generated by the program into a special promotional account and match or surpass the number of DART barrels being purchased by community donations (not to exceed $3,000) and to authorize the purchase of stickers (not to exceed $2,500). It was moved by Council Member Boggs, seconded by Council Member Paul, and unanimously carried to approve the foregoing recommendation. Civic Light Opera Association - Discussion Regarding Future Planning: Council considered the Downey Civic Light Opera Association staff report. It was moved moved by Council Member Boggs, seconded by Council Member Paul, and unanimously carried to receive and file. Discussion followed regarding the fact that the Association is now current with financial obligations, and also to the process of building office space for the Association. It was determined that plans and specifications for said office space would be returned for Council consideration. It was moved by Council Member Paul, seconded by Council Member Cormack, and unanimously carried to clarify that the building, when completed, is to be offered on a lease option to the Association for office space and is not a box office. ITEMS REMOVED FROM CONSENT CALENDAR Street Names for Frontage Roads Along the I-105 Freeway and Street Name of the Rancho Road for the Rancho Los Amigos Properties: It was moved by Council Member Boggs, seconded by Council Member Cormack, and failed 2-3 (Council Members Boggs and Cormack voting yes) that the staff report be approved except for the street going into the Rancho Los Amigos properties, set forth on Exhibit B, to allow County input. Staff explained that Hidalgo Street has been set forth on maps. It was moved by Council Member Paul, seconded by Council Member Cormack, and unanimously carried to approve the staff report as recommended. Lighting Maintenance District AD 121 - Zone Rates: Mayor Santangelo clarified with the City Attorney that there would not be conflict in voting on the Lighting Maintenance District. RESOLUTION NO. 4870 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESCRIBING IMPROVEMENTS WITHIN LIGHTING MAINTENANCE DISTRICT A.D. 121 FOR THE FISCAL YEAR 1987-88 AND ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Boggs, and carried by unanimous vote to waive further reading and to adopt. Council Minutes 5/26/87 (Adj.) -3- RESOLUTION NO. 4871 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE ENGINEER'S REPORT FOR ASSESSMENTS WITHIN LIGHTING MAINTENANCE DISTRICT A.D. 121 FOR THE FISCAL YEAR 1987-88 This Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Boggs, and carried by unanimous vote to waive further reading and to adopt. RESOLUTION NO. 4872 (ADOPT) A RESOLUTION OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN LIGHTING MAINTENANCE DISTRICT A.D. 121 FOR THE FISCAL YEAR 1987-88 (Sets Public Hearing for 7:30 p.m., June 9, 1987) This Resolution was read by title only. It was moved by Council Member Cormack, .seconded by Council Member Boggs, and carried by unanimous vote to waive further reading and to adopt. ORAL COMMUNICATIONS - Items not on Agenda: None OTHER BUSINESS - Staff Members: None OTHER BUSINESS - City Council Council Member Boggs: Asked for a staff report regarding feasibility of a second location for a Toy Loan Program. Requested staff research regarding County Mosquito Abatement Program. Council Member Paul: Request for support as RTD Board Director, Corridor "A". Council Member Boggs and Mayor Santangelo explained a prior commitment to Mr. Jay Price. It was moved by Council Member Cormack, seconded by Council Barb, and passed 3-2 (Council Member Boggs and Mayor Santangelo voting no) to instruct Downey's delegate to cast Downey's votes for Roy Paul. Mayor Santangelo stated that the City Council is recessing to closed session for the purpose of considering attorney -client matters, employee negotiations matters, and pending litigation pursuant to the provisions of Section 54956.9 - Government Code, Subdivision (a), Kim vs. Downey.
