SPECIAL CALLED MEETING
APRIL 7, 1987
A Special Called Meeting of the Downey City Council was called to order at
6:15 p.m., April 7, 1987, in the Council Chamber of the Downey City Hall, Mayor
James S. Santangelo presiding.

Mayor Santangelo announced that the Council is recessing to closed session
for the purpose of Labor Negotiations.
The Meeting was reconvened at 7:15 p.m. with all Council Members present
and recessed immediately to a meeting of the Community Development Commission.
The Meeting reconvened at 7:30 p.m. with all Council Members present.

PRESENTATIONS
Mayor Santangelo read in full a Proclamation proclaiming April 26 - May 2,
1987 as American Home Week. Mayor Santangelo presented the Proclamation to Mr.
George Gordon, President of the Downey Board of Realtors. Pictures were taken.
Mayor Santangelo read in full a Proclamation proclaiming April 5 - 11, 1987
as National Library Week. Ms. Marilyn Evans, Chairman of the Library Advisory
Board, Ms. Joyce Lawrence, President of Friends of the Downey Library, and Mr.
Paul McCance, Downey's Representative to the Metropolitan Corporative Library
System Facilities Board, were present. Pictures were taken.
Councilman Barb presented Certificate of Appointment to Mrs. Julie Gaston,
Traffic Committee - District 4. Pictures were taken. Councilman Barb also
acknowledged and expressed appreciation to Mrs. Gaston's husband Brad, who is an
Appointee of the County Board of Supervisors to the Downey Cemetery District,
for his involvement in the community.
Mayor Santangelo read in full a Proclamation proclaiming the month of
April, 1987 as Earthquake Preparedness Month. Councilman Cormack invited the
— public to attend the Earthquake Preparedness Seminar at the Downey Civic
Theatre, 7:00 p.m., April 22.
Mayor Santangelo read in full a Proclamation proclaiming the week of April
26 - May 6, 1987 as The Days of Remembrance of the Victims of the Holocaust.

CONSENT CALENDAR
Agenda Items VI-G-1, Underground Utility Dist. No. 12 & Lighting Dist.
Annexation 87/01, Firestone Blvd.; and VI-G-2, Lighting Maint. Dist. Annexation
87/02, Cheyenne St., were removed at the request of Mayor Santangelo.
It was moved by Councilwoman Boggs, seconded by Councilman Cormack, and
passed by the following vote to approve the Remainder of the Consent Calendar:
Minutes: Special Called Meeting, March 24, 1987, Adjourned Regular
Meeting, March 24, 1987, and Regular Meeting, March 24, 1987: Approved.
Rejection of Legal Claim: Ref. #852, Pearl Agnes Broderick, Sean
McClanahan, and Beverly McClanahan: Rejected.
Cash Contract No. SS-406 - Citywide Street Resurfacing: Plans and
Specifications and grant authority to advertise for bids: Approved.
Cash Contract No. SS-400, Gallatin Road - North Side Widening, Paramount
Blvd., to +400 feet Westerly: Award unit price.contract totaling
$45,787.75 to Nobest, Inc.: Approved.

Report on Policy for Overnight Parking Restriction: (1) Approve policy
similar to that of street sweeping posting whereby the owners on a block
can decide by petition if they want posting of restrictions of overnight
parking; and (2) Direct Engineering staff to develop a permit system for
the purpose of exempting from the restriction handicapped persons and
residents of high density, multiple -family dwelling areas or similar
areas lacking adequate off-street parking facilities: Approved.

ORDINANCES
ORDINANCE NO. 849
AN ORDINANCE OF THE CITY OF DOWNEY AMENDING
ARTICLE IV, CHAPTER 2, SECTIONS 4227 AND 4228
OF THE DOWNEY MUNICIPAL CODE RELATING TO
THE VACCINATION OF DOGS
The Ordinance was read by title only. It was moved by Councilman Cormack,
seconded by Councilwoman Boggs, and passed by unanimous vote to waive further
reading and to adopt.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
REPEALING CHAPTER 1 OF ARTICLE VII CONSISTING OF
SECTIONS 7100-7175.8 OF THE DOWNEY MUNICIPAL CODE, AND
ADDING TO ARTICLE VII, CHAPTER 1, CONSISTING OF
SECTIONS 7100-7194, ALL RELATING TO PUBLIC WORKS
ACTIVITIES IN CITY STREETS
The Ordinance was read by title only.
Harald Henriksen, City Engineer, summarized this proposed amendment.
After further discussion regarding possible scaled -down insurance
requirements for homeowners, and upon the advice of the City Attorney that if a
change is made to the Ordinance it would have to be reintroduced, it was the
unanimous vote of the City Council to introduce this Ordinance on April 28, -
1987.

ADMINISTRATIVE REPORTS
A report was submitted with attached letter from the Downey Civic Light
Opera Association dated March 30, 1987, requesting a waiver of rent and labor
fees for their upcoming "Evening of Stars" performance at the Downey Theatre.
Marsha Moode, Public Relations Representative for the Downey Civic Light
Opera, thanked the Council and City for previous assistance to the Association
and stated that they are aware of the need to be fiscally sound and financially
responsible.
Councilman Paul recognized Commissioner Art Johnson and thanked him for all
the time and work he has dedicated to the City.
It was moved by Councilwoman Boggs, seconded by Councilman Cormack, and
carried by the following vote to approriate and authorize a grant in the amount
of Twelve Hundred Dollars ($1,200) to cover the request of the Downey Civic
Light Opera Association.
It was moved by Councilman Barb, seconded by Councilman Cormack, and
carried by the following vote to amend the foregoing motion to insert the word
"loan" and remove the word "grant."

It was moved by Councilman Barb, seconded by Councilman Cormack, but
defeated by the following vote that the loan approved above not be granted until
financial statements for previous performances have been submitted by the Downey
Civic Light Opera Association.

Mr. Scot Yotsuya, Assistant to the City Manager, submitted a Legislative
Work Program for Professional Lobbyist.
It was moved by Councilman Cormack, seconded by Councilwoman Boggs, and
unanimously carried that the proposed Legislative Work Program be approved with
additions as follows, and that it be transmitted to Mr. Joe Gonsalves for his
immediate action:
1. Seek funds for the construction of a soundwall on the South side of the
Santa Ana Freeway;
2. Advise the lobbyist that we may need his assistance to facilitate the
resolution of problems generated by the construction of the Century
Freeway;
3. Seek funds for the rehabilitation of the City's existing water system.
Mr. Joe Lubin, 7820 Allengrove, Downey, expressed concern that a lobbyist
is being substituted for qualified legislators.
Council directed that the lobbyist be instructed to first concentrate on
those items directly related to the City of Downey.
Councilman Barb requested a staff report regarding AB 339 (Cortese) and SB
407 (Campbell) which relate to Property Tax Revenue for "No" and "Low" Property
Tax Cities and to include the possibility of action by Downey's Lobbyist.
A report was submitted regarding the Santa Ana (I-5) Dollison Drive
Soundwall and the Lakewood/I-605 Soundwall with attachments over the signature
of Mrs. Hazel Scotto.

It was moved by Councilwoman Boggs, seconded by Councilman Paul, and
unanimously passed that this report will be received and filed.
Those citizens addressing the Council urging action with Caltrans for the
Soundwalls were:
Mrs. Hazel Scotto, past Mayor and former Council Member of Downey, 9203
Cord, Downey, reiterated the items in her letter dated March 31, 1987 and
strongly urged the Council to take action to solve this problem as soon as
possible. She pointed out Assembly Bills 917 and 1267 (Grisham).
After discussion, City Council advised that the two Assembly Bills
referenced will be sent to Downey's Lobbyist as part of the "Legislative Work
Program."
Dr. James Anderson, 9583 Gallatin, Downey, expressed concern regarding the
loud noise large trucks shifting gears make and the dirt that comes from the
freeway.
Mr. Dave Shubin, 9520 Casanes, Downey, expressed concern about safety due
to flying rocks and debris from the freeway.
Mr. Steve Pendleton, 9102 Eglise, Downey, also expressed concern over loud
noise from the freeway.
Mr. Phineas Danner, 9117 Haledon, Downey, stated he has done a survey and
the area between the 605 Freeway and Lakewood, South side of the freeway, is the
most severe area for noise as the soundwall is low in this area.
Another group of persons in attendance in support of this issue, who did
not address the Council, raised their hands (approximately twenty people).
