Santangelo presiding. PRESENT: Council Members: James S. Santangelo Mayor Diane P. Boggs Mayor Pro Tem Robert G. Cormack Randal R. Barb Roy L. Paul ALSO PRESENT: Don Davis, City Manager Carl K. Newton, City Attorney Jenny Young, City Clerk -Treasurer James R. Cutts, Director of Community Development James R. Jarrett, Director of Community Services Lee Powell, Director of Administrative Services William A. Ralph, Director of Public Works William Makshanoff, Building Official Bill Martin, Police Chief Bruce Robinson, Battalion Chief Ronald Yoshiki, City Planner Scot Yotsuya, Assistant to the City Manager Joyce Baker, Executive Secretary PRESENTATIONS City Clerk Young introduced the new Executive Secretary/Recording Secretary Joyce Baker. Mayor Santangelo read into the record a Proclamation recognizing the 77th birthday of the National Camp Fire Organization on March 17, 1987. The Proclamation was presented to the Camp Fire girls in attendance and they in turn gave Mayor Santangelo candy to express their appreciation to the City of Downey. HEARINGS Mayor Santangelo opened the public hearing on Appropriation of Revenue Sharing Funds - 1986-87 Fiscal Year to Help the General Fund Pay for the Fire Department. City Clerk Young presented proof of publication. It was moved by Councilwoman Boggs, seconded by Councilman Paul, and so ordered to receive and file the proof of publication. Mr. Powell reported on the request to transfer funds from Revenue Sharing to the General Fund, designated for use by the Fire Department. Mayor Santangelo asked if the City Clerk had received any correspondence, and the response was no. There being no one present to speak in favor or in opposition, it was moved by Councilman Barb, seconded by Councilwoman Boggs, and so ordered to close the hearing. It was moved by Councilwoman Boggs, seconded by Councilman Barb, and passed by unanimous vote to appropriate $123,863 in Revenue Sharing Funds to help support the Fire Department. ORAL COMMUNICATIONS - Items not on Agenda Dr. Ada Steenhoek of the California Education Arts Foundation submitted a proposal entitled "Project Kaleidoscope," which was written as a partnership between the City and School District to support a live concert for cultural enrichment. She indicated a tentative date of April 27th - May 1st. There being no objection, this item was referred to the Recreation and Community Services Commission for review and recommendation. Council Minutes 3/10/87 _1_ Mr. Mike Rajiah, 8503 Cleta, Downey, complained of harassment and the inability to have his questions satisfied by the Police Department. He was asked to speak with Chief Martin. Mr. John Emmi, 12342 Brock, Downey, spoke in support of Councilman Roy Paul's Letter to the Editor, published in the Herald American, and in rebuttal of the correspondence submitted against that letter. Mr. Lennie Whittington, 8542 Manatee, Downey, requested enforcement of the Downey Municipal Code relating to political signs. Signs are posted all over the City for the March 17th State Senatorial election. Referred to the Director of Public Works. CONSENT CALENDAR Agenda Item VI-G-1, Resolution accepting Final Parcel Map #17027, was removed at the request of Councilwoman Boggs. It was moved by Councilman Barb, seconded by Councilman Paul, and passed by the following vote to approve Remainder of the Consent Calendar as recommended: Minutes: Adjourned Regular Meeting, February 24, 1987; and Regular Meeting, February 24, 1987. General Warrants #27858 - 28244; #27507 - 27510: $1,182,305.61. Firestone Project - Public Improvements: Appropriate $236,500 in Community Development Grant Funds. $33,863 Appropriation for Small Parks: Treasure Island Park Improvements, Wilderness Park Lighting, and Furman Park Improvements. Cash Contract No. 541 (Phase II), Water Mains - Century Freeway Corridor, Bellflower Boulevard to Downey Avenue: Award to Valverde Construction,Inc. in the amount of $246,998.00. RESOLUTION NO. 4846 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION NAP OF PARCEL MAP NO. 17457 APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTANCE OF AN ASSIGNMENT OF A SAVINGS ACCOUNT PASSBOOK IN LIEU OF SURETY BOND (8457 ORANGE STREET) AYES: 5 Council Members: Boggs, Cormack, Barb, Paul, Santangelo ORDINANCES ORDINANCE NO. 848 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING ORDINANCE NO. 679 REGARDING CABLE TELEVISION The Ordinance was read by title only. It was moved by Councilwoman Boggs, seconded by Councilman Cormack, and passed by unanimous vote to waive further reading and to adopt. RESOLUTIONS RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY DOWNEY ESTABLISHING FEE SCHEDULES FOR PLANNING CASES The Resolution was read by title only. In an effort to amend this Resolution with regard to fees for appeals, the Council made several motions which were later rescinded and this Resolution was returned to staff to be placed on a future agenda. It was moved by Councilwoman Boggs, seconded by Councilman Barb, and passed by the following vote the appeal fee be $150.00 or 50 percent of the original fee. AYES: 3 Council Members: Cormack, Paul, Santangelo NOES: 2 Council Members: Boggs, Barb It was moved by Councilman Barb, seconded by Councilwoman Boggs and defeated by the following vote to increase the fees annually, with the CPI not to exceed a maximum of four percent in one calendar year, and the inflating provision would expire at the end of five years. AYES: 2 Council Members: Boggs, Barb NOES: 3 Council Members: Cormack, Paul, Santangelo It was moved by Councilwoman Boggs, seconded by Mayor Santangelo and defeated by the following vote to set the appeal fee at 50 percent of the original fee. AYES: 2 Council Members: Boggs, Santangelo NOES: 3 Council Members: Cormack, Barb, Paul It was moved by Councilman Cormack, seconded by Mayor Santangelo and defeated by the following vote that the appeal fee be a flat $150.00. AYES: 2 Council Members: Cormack, Barb NOES: 3 Council Members: Boggs, Paul, Santangelo It was moved by Councilwoman Boggs, seconded by Councilman Barb and defeated by the following vote to rescind all previous amendments passed by the Council and charge a fee of 60 percent of the original fee for any appeal. AYES: 2 Council Members: Boggs, Santangelo NOES: 3 Council Members: Cormack, Barb, Paul It was moved by Councilman Cormack, seconded by Councilman Barb and defeated by the following vote to delete the percentage and make the appeal fee a flat fee of $150.00, with the Council having the power to waive it at any time. AYES: 2 Council Members: Cormack, Barb NOES: 3 Council Members: Boggs, Paul, Santangelo It was moved by Councilman Barb, seconded by Councilman Cormack and defeated by the following vote to set appeal fees at $85.00 or 60 percent, whichever is higher. AYES: 1 Council Member: Barb NOES: 4 Council Members: Boggs, Cormack, Paul, Santangelo It was moved by Councilman Cormack, seconded by Councilman Barb and defeated by the following vote to amend the previous motion to read 75 percent instead of 60 percent. AYES: 2 Council Members: Cormack, Barb NOES: 3 Council Members: Boggs, Paul, Santangelo It was moved by Councilwoman Boggs, seconded by Mayor Santangelo and defeated by the following vote that no fee shall be more than 100 percent of the original fee charged, and the appeal fee be set at 60 percent and $85.00 minimum. AYES: 4 Council Members NOES: 1 Council Member: Boggs, Cormack, Paul, Santangelo Barb Council Minutes 3/10/87 -3- ADMINISTRATIVE REPORTS Lease Agreement between City of Downey and the Downey PTA Thrift Shop for space at Apollo Park It was moved by Councilman Paul, seconded by Councilwoman Boggs and defeated by the following vote to waive fees paid by the PTA Thrift Shop. AYES: 1 Council Member: Paul NOES: 4 Council Members: Boggs, Cormack, Barb, Santangelo It was moved by Councilwoman Boggs, seconded by Councilman Cormack, and passed unanimously to accept the staff report and approve the rental agreement with the Downey PTA Thrift Shop as presented. Mr. Dave Oertell, representing the Downey City Employees Association, presented a $1,000.00 check to Ms. Antha Mouck as a contribution to the Thrift Shop. Ms. Antha Mauck thanked the Downey City Employees Association and advised that commencing April 20th, the Thrift Shop will be opened Monday, Wednesday, and Friday mornings. ITEMS REMOVED FROM CONSENT CALENDAR RESOLUTION NO. 4845 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF PARCEL NO. 17027 APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTANCE OF A LETTER OF CREDIT IN LIEU OF SURETY BONDS (12060 PATTON ROAD AND 8618 CAVEL STREET) Council Member Boggs asked Mr. Ralph if the result of the proposed parcel map would create a substandard lot, and he replied no. The Resolution was read by title only. It was moved by Councilman Cormack, seconded by Councilwoman Boggs, and passed by unanimous vote to waive further reading and to adopt. OTHER BUSINESS - Staff Members: - None OTHER BUSINESS - City Council Councilwoman Boggs asked that vacant lots on Firestone Boulevard be checked for illegally parked trucks; and also suggested possible seeding of these vacant lots for beautification. Mr. Bruce Robinson, newly appointed Fire Department Batallion Chief, was introduced. Past Mayor/City Council Member Lyell Swearingen who was seated in the audience was introduced. Councilwoman Boggs announced the birth of her first granddaughter, Heather Nicole Boggs, who is now residing at Downey Community Hospital.
