Henriksen, City Engineer William Makshanoff, Building Official Jake Wager, Redevelopment Manager Ronald Yoshiki, City Planner Scot Yotsuya, Assistant to the City Manager Judy McDonnell, Deputy City Clerk PRESENTATIONS Connie Hernandez, President of the Downey Sister Cities Association, presented a plaque to Karen Nobrega, the principal person responsible for the collection of toys at Christmas and their donation to children in Downey's Sister City of San Quintin. HEARINGS Mayor Santangelo opened the hearing on Zone Change Case No. 236, 8613, 27, 29, 31, 35, 35-1/2, 37, 41, 49, 51, 8701, 03, 09 Firestone Boulevard. He inquired if the City Clerk had the Proof of Publication, and the response was yes. It was moved by Mayor Pro Tem Boggs, seconded by Councilman Paul, and so ordered to receive and file the Proof. Mr. Cutts reported on the Planning Commission's approval of the zone change, excluding 12 residential properties on Marbel Avenue, to rezone pro- perties on Firestone Boulevard from R-2 (two-family residential) to C-3 (Central Business District). He mentioned that the original study area on Firestone Boulevard was expanded to include 14 individual parcels and a portion of two other properties, and he commented on zoning of surrounding properties. This would bring the zoning map into conformance with the General Plan. Mr. Cutts narrated a slide presentation on the subject properties. Mayor Santangelo inquired if the City Clerk had received any correspondence on this matter, and the response was no. There being no one present to speak in favor, Mayor Santangelo asked if anyone wished to speak in opposition. Mr. Lennie Whittington, 8542 Manatee, said the Planning Commission Agenda of January 7th listed Zone Change 236 with only one address at 8635 Firestone Boulevard, but at the Commission hearing 28 other parcels were added, including 15 properties on Marbel Avenue. He said he is not against the zone change but noted the agenda only listed one piece of property and according to the Govern- ment Code an agenda must be posted containing a brief description of the item of business to be transacted or discussed at the meeting. Mr. Whittington feels Council Minutes 2/11/87 -1- &\rAs there was a violation of the Government Code, that the Commission meeting was not legal because it was not properly posted as required by law, and that the Council should send this back to the Commission for proper hearing and have all the addresses listed on the agenda. He also noted a discrepancy in the posting of the January 7th Agenda, which only had the first page visible. Mr. Newton explained this matter set forth in a letter by Mr. Whittington is under consideration. He said the Planning Commission action is advisory and the action to effect a zone change is only carried out by the Council. The Council agenda for this meeting does show all of the addresses that are the subject of the recommended action to be taken by Ordinance. It is his opinion there is substantial compliance with the provisions of the Brown Act as amended effective January 1, 1987, and he believes the Council is able to act on this matter this evening. There being no one else to speak, it was moved by Councilman Barb, seconded by Councilman Paul, and so ordered to close the hearing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE OFFICIAL ZONING MAP ADOPTED BY SECTION 9106.06 OF THE DOWNEY MUNICIPAL CODE (ZONE CHANGE CASE NO. 236) The Ordinance was read by title only. It was moved by Mayor Pro Tem Boggs, seconded by Councilman Paul, and passed by the following vote to waive further reading and to introduce. AYES: 4 Council Members: Boggs, Barb, Paul, Santangelo ABSENT: 1 Council Member: Cormack ORAL COMMUNICATIONS - Items not on Agenda Ms. Pat Rosker, Director of the Placement Service for Older Workers, which is housed in the Apollo Center, distributed literature regarding the service and commented regarding its location, which has been donated by the City. She discussed funding of the service, noted the increase in full-time employees to accommodate the number of clients they serve for job placement, and stressed the need for additional space. Reverend Joe Grana, 8718 Alameda, expressed concern about the sexually oriented material sold from coin -operated machines on sidewalks in Downey at 19 different locations throughout the City, which are strategically located to schools. The concern is that the material is available to minors. He submitted petitions containing 2,868 signatures of people concerned about this issue and asked people in the audience who were present on the matter to stand. Reverend Grana recommended and encouraged the Council to eliminate this type of material from the streets of Downey. Mayor Santangelo mentioned the Council took action in 1985 by adopting an ordinance requiring the glass on vending machines to be opaque. He assured everyone that the Council does find the material objectionable and that the City Attorney has indicated he will come back at the next meeting with a report set- ting forth what can be done to find a way of taking the material off the street. Councilman Paul feels there is something that can be done to regulate the material and said the Council is 100 percent behind the request. Councilman Barb said the City is being asked to take a risk, similar to what it has done in the past on the nativity scene. He asked that the Council look at some sample ordinances, enforce the current ordinance, and explore what the Council's position might be. Mr. Richard Moon, 10700 Downey Avenue, said he is working towards his Bachelor of Arts Degree in cinematography, and he requested that the people of Downey underwrite the operating expenses of a Music Video Production by his company, Moonbeam Productions. He hopes in the future to help the youth of Downey and start a fund for people who wish to get a start in visual arts. A total of $3,500 is needed for the production. Mayor Santangelo indicated the City cannot participate or help Mr. Moon produce his film and suggested he attempt to reach out to the community through the newspaper or mail -outs. Council Minutes 2/1�_7/87 -2- Councilman Barb said there may be some things Mr. Moon can do in the area of audio visual work for the community that would benefit the youth. He would be willing to meet with him to see what his interests might be. Mayor Pro Tem Boggs mentioned that a gift of public funds is against the law and suggested he contact one of the community colleges in the area. CONSENT CALENDAR Agenda Items VI-A-1 and VI-A-2, Minutes of Adjourned and Regular Meetings of January 27, 1987; and VI-F-2, Redesignation of Roberti-Z'Berg Grant Funds, were removed at the request of Mayor Pro Tem Boggs. Agenda Item VI-G-2, Resolution regarding Increase in Dog License Fees, was removed at the request of Councilman Paul. RESOLUTION NO. 4843 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF PARCEL MAP NO. 17892 APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTANCE OF AN ASSIGNMENT OF A PASSBOOK SAVINGS ACCOUNT IN LIEU OF SURETY BONDS (8033-41 ORANGE STREET AND 8034 ALAMEDA STREET) AYES: 4 Council Members: Boggs, Barb, Paul, Santangelo ABSENT: 1 Council Member: Cormack ORDINANCES ORDINANCE NO. 846 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY CALIFORNIA, RELATING TO THE REGULATION OF VENDORS ON PUBLIC STREETS SECTION 3161 (a) The Ordinance was read by title only. It was moved by Councilman Barb, seconded by Councilman Paul, and passed by the following vote to waive further reading and to adopt. Mayor Pro Tem Boggs said she has received complaints regarding push carts soliciting in apartment buildings and asked if they can be included in the Ordinance. Mr. Newton replied this only relates activities on public streets and not private property. Council Minutes 2/10/87 -3- S\ `1'1 Report regarding Contracting with a Professional Lobbyist was continued to the meeting of February 24, 1987. Downey Art Museum Air Conditioning was continued to the meeting of February 24, 1987. ITEMS REMOVED FROM CONSENT CALENDAR It was moved by Councilman Barb, seconded by Councilman Paul, and passed by the following vote to approve the Minutes of Adjourned Regular Meeting, January 27, 1987, and Regular Meeting, January 27, 1987. AYES: 3 Council Members: Barb, Paul, Santangelo ABSENT: 1 Council Member: Cormack ABSTAIN: 1 Council Member: Boggs Redesignation of Roberti Z'Berg Funds Mayor Pro Tem Boggs said it has been recommended that the funds allocated for a new shelter at Furman Park be used for play equipment at Furman Park. She mentioned touring the parks this summer with three of her grandsons and found parks in the southern end of the City to be lacking in play equipment. Mayor Pro Tem Boggs cited the need for park funds in her District and requested the park in District Two be placed on the priority list for some updated equipment. She requested a report on play equipment at the parks. Mr. Jarrett explained the Recreation Commission and staff have been con- ducting a City-wide inventory and study of all play equipment in the parks, and it has been learned that much of the equipment is old and needs replacement due to safety conditions. Equipment is being replaced and updated at Golden and Treasure Island Parks. He pointed out that the oldest equipment is at Furman Park, it does not meet current safety standards, and it is recommended that it be replaced. It was moved by Councilman Barb, seconded by Councilman Paul, and passed by the following vote to approve redesignating funds previously approved for a Furman Park shelter to Furman Park playground renovation and equipment replacement. AYES: 4 Council Members: Boggs, Barb, Paul, Santangelo ABSENT: 1 Council Member: Cormack RESOLUTION NO. 4844 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOMNEY SETTING FEES FOR DOG LICENSES & RESCINDING RESOLUTION NO. 4841 Councilman Paul reiterated his previous opposition to the increased dog license fees, particularly for senior citizens, and suggested reexamining the fees based on what the actual increased costs are of continuing the service. He requested the Council to vote against the increase. The Resolution was read by title only. It was moved by Councilman Barb, seconded by Mayor Pro Tem Boggs, and passed by the following vote to waive further reading and to adopt. AYES: 3 Council Members: Boggs, Barb, Santangelo NOES: 1 Council Member: Paul ABSENT: 1 Council Member: Cormack OTHER BUSINESS - Staff Members: None OTHER BUSINESS - City Council Councilman Paul said it is refreshing to see a group of citizens come to a Council Meeting with constructive recommendations for change rather than destructive comments of attack. Mayor Pro Tem Boggs mentioned that for six months the Monkey List has contained her request to change the Ordinance on Garage Sales to allow more than one a year. She particularly noted that someone who has lived in their home for Council Minutes 2/10/87 -4- CDII 1 many years would need more than one garage sale to get the job done, and she requested an ordinance be brought back to take care of this situation. Mayor Pro Tem Boggs also noted an item on the Monkey List concerning Political Signs, and she would like to see this accomplished before the elec- tion in 1988. Mayor Pro Tem Boggs requested an update report on status of the abandoned house on Orange Avenue which has been boarded up and is for sale. Mayor Santangelo complimented the City Clerk on the conformed Agenda of the January 27th Council Meeting in carrying forward items of Council's concern. He asked that the Clerk's office continue to carry these items forward until they are resolved.
