The City Council of the City of Downey held a regular meeting at 7:43 p.m.,
June 10, 1986_, in the Council Chamber of the Downey City Hall, Mayor Bob Davila
presiding.

INVOCATION AND FLAG SALUTE
The Invocation was delivered by Reverend John Bratun, First Foursquare
Church of Downey. The Flag Salute was led by Robert Shand, City Clerk.
PRESENTATIONS
Mayor Davila commented on establishment of the Red Ribbon Anti Drug Abuse
Program, which was started by citizens in the cities of La Mirada and Norwalk.
He noted the Red Ribbon is passed from one city to another with the hope that
each city in the southeast area will eventually participate. He then presented
a Proclamation to Chief Martin proclaiming June 9-16 as Red Ribbon Week.
Mayor Davila introduced Detective Pete Novakoff, who assisted in presenta-
tion of Certificates of Appreciation to Dominic DiMario, representing Mr.
Bowermaster President of the Downey Rotary Foundation; Ms. Jeanne English,
President of the Downey Chapter of Tough Love; Jimmy Woo, student government
representative, East Middle School; Ann Colnic, student government representa-
tive, Griffiths Middle School; and Sandy Murphy, representing Patti Steenhoek,
student government representative, South Middle School.
Mayor Davila then introduced Mayor Joseph E. Cvetko of Bellflower, who
received the passing of the Red Ribbon to display as Bellflower's participation
and support of the anti -drug program.
Mayor Davila introduced and presented certificates to Mr. Angelo Cardono,
co-sponsor of the Redevelopment Art Contest; faculty members who provided
gui ;, ,., xpertise to the stu�ent artists: Teresa 3rlUCk, representing
Shirley Ludwig of Downey High School; Tom Stoner of Warren High School; Joann
Watson, representing Kathy Succa of Columbus High School; and students Todd
Forcade and Alan Hovey from Downey High School, who submitted the winning entry.
Councilman Cormack introduced his brother, Russell.
HEARINGS
Mayor Davila opened the hearing on Zone Change Case No. 228, General Plan
Amendment No. 86-1, Paramount Boulevard between Stewart and Gray Road and
DePalma Street. A letter has been received from the applicant requesting
continuance to the July 8th meeting.

It was moved by Councilman Cormack, seconded by Councilwoman Boggs, and so
ordered to continue the hearing to 7:30 p.m., July 8, 1986, in the Council
Chamber of Downey City Hall.
Mayor Davila opened the hearing on Lighting District Annexation 86/08,
Stoakes Avenue. He inquired if the City Clerk had the Affidavit of Posting of
Notice and Proof of Publication, and the response was yes.
It was moved by Councilwoman Boggs, seconded by Councilman Cormack, and so
ordered to receive and file the Affidavit and Proof.
Mayor Davila asked if the City Clerk had received any written protests or
objections, and the response was no.
There being no one present to speak in protest, it was moved by Council-
woman Boygs, seconded by Councilman Cormack, and so ordered to close the
hearing.
RESOLUTION NO. 4761
A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A
CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO
MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING
FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS
(ANNEXATION 86/U8 - STOAKES AVENUE BETWEEN GALLATIN ROAD AND SUVA STREET)
The Resolution was read by title only. It was moved by Councilwoman Boggs,
seconded by Councilman Cormack, and passed by the following vote to waive
further reading and to adopt.

Mayor Davila opened the hearing on Lighting Maintenance District AD 121,
Assessment Levy, pursuant to provisions of the Landscaping and Lighting Act of
1972. He inquired if the City Clerk had the Affidavit of Posting and Mailing of
Notices and Proof of Publication, and the response was yes.
It was moved by Councilman Cormack, seconded by Councilman Santangelo, and
so ordered to receive and file the Affidavit and Proof.
Mr. Ralph commented regarding the Council's recommendation last meeting of
a 25 percent fund balance in all zones and noted after review, it is staff's
feeling that because of cash flow problems in Zone I, a 40 percent fund balance
is necessary. He distributed two Appendix B's, labeled "I" and "II and
.explained "I" reflects the transfer of $35,000 from Zone -IV to Zone I, resulting
in a substantial increase for Zone IV, and he recommended the Council direct
staff to put off that transfer for one year, levy assessments based on Appendix
"B", and to increase the levy in Zone IV from $70 to $85.
RESOLUTION NO. 4762

Mayor Davila opened the hearing on 'Downey Improvement Projects No. 717,
west side Tweedy Lane from Brookpark Road to Blandwood Road; No. 718, west side
Tweedy Lane from Blandwood Road to Vista Del Rosa; and No. 719, west side Tweedy
Larne from Birchcrest Road to Telegraph Road. He inquired if the City Clerk had
the Affidavit of Posting and Mailing, and the respnse was yes.
It was moved by Councilman Cormack, seconded by Councilman Santangelo, and
so ordered to receive and file the Affidavit.
Mr. Ralph said this hearing was continued to allow staff time to meet with
Councilman Cormack and the property owners. A meeting was held, and it was
concluded that all of the owners affected were not in favor of Downey Improve-
ment Projects 717 and 719. However, the affected owners were in favor of Downey
Improvement Project 718 and have requested the City not only to pay for
engineering and incidental expenses but also the costs for street paving. The
City's contribution would be approximatley $3,000, and $2,600 would be assessed
to the property owners.
Mayor Davila inquired if the City Clerk had received any written protests
or objections.
Mr. Shand replied correspondence was received from Gary and Susan Crowley
in favor of the improvements under conditions outlined; Mary I. Sousa requesting
inclusion of additional improvements under D.I.P. 717 and 719; Mr. and Mrs.
Charles Kreider protesting D.I.P. 717; Mary and Maurice Levick protesting D.I.P.
717 and 719; and Louise Watson protesting D.I.P. 717-719. Letters were pre-
viously received from Mr. and Mrs. Kreider, Mrs. Sousa, and Mr. Briesemeister.
It was moved by Councilman Cormack, seconded by Councilman Santangelo, and
so ordered to receive and file the correspondence.
Mayor Davila inquired if there was anyone present to speak in favor.
Susan Crowley asked if the City can meet the conditions requested in her
letter, and she was told the tree and other items will be taken care of, but
anything on private property will have to be worked out since it is not part of
the project.
There being no one else to speak in favor and no one to speak in opposi-
tion, it was moved by Councilman Cormack, seconded by Councilman Santangelo, and
so ordered to close the hearing.
It was moved by Councilman Cormack, seconded by Councilwoman Boggs, and
passed by the following vote to abandon Downey Improvement Projects 717 and 719.

Mayor Davila opened the hearing on Appeal to Permissive Conditional Use
Permit No. 4 to operate a commercial farm for the purpose of raising produce for
sale off -site on property at 10403 Sherry Avenue. He inquired if the City Clerk
had the Proof of Publication, and the response was yes.

It was moved by Councilman Santangelo, seconded by Councilman Cormack, and
so ordered to receive and file the Proof.
Mr. Cutts reported the property is zoned R1-7500 single family residential
and contains 4.27 acres. A number of concerns were raised at the Planning
Commission hearings regarding noise emanating from use of a tractor on the
property; dust; use of chemicals and pesticides; and air quality. Staff has
recommended the applicant wet the soil prior to tilling; provide a driving
surface of gravel along the east boundary of Sherry Avenue and the planting of a
hedge row of oleander type bushes; and that pesticides be sprayed with a hand
pump used primarily during the months of August and September once a month of a
type that would be biodegradable and absorbed into the soil within 15 days. Mr.
Cutts commented further on staff's recommendations regarding use of chemicals
and pesticies and that vehicular access to the property be from Florence and not
from Sherry. He narrated a slide presention on the subject property.
Mayor Davila inquired if the City Clerk had received any correspondence,
and the response was no. It was noted, however, that a petition was previously
received and is on file.
The applicant was asked to come forward and present his case.
Mr. Quang Diep, 2323 E. Harding, Long Beach, distributed photographs of the
property and said he has let the weeds grow since the Planning Commission
hearing, which are now about three feet high. He noted the location of the
complainants to the subject property and indicated an Air Quality Consultant and
County Agricultural Inspector are present to answer any questions.
Norma (inaudible), 7208 Via Amorita, said she has not witnessed any dust or
other problem and favors allowing farming use on the property.
Mr. Warren Moore, said he lives north of Florence on Guatemala Avenue, and
that the petition he submitted does not concern this issue. There was a peti-
tion containing 81 signatures signed by a majority of the neighborhood, filed by
a Mr. Martinez. He indicated that planting a hedge on the property would take
many years to grow and mentioned the applicant began farming in 1984 without
approval of the Council but was informed by letter to file a permit or be forced
to stop his operation. Mr. Diep did not file the permit until after seven
months and more complaints were received. Mr. Moore also indicated that if the
applicant had kept the parkway along Sherry Avenue free from trash and weeds,
kept down the dust from plowing, restricted the hours of spraying pesticides,
and restricted the working hours so as to not disturb the residents there would
not have been a problem. He feels there has been no provision for monitoring or
enforcement of this matter by City forces and that commercial farming will
create declining property values.
Mr. Jose Colon, 7202 Irwingrove Drive, commented on the dust created by
farming use of the property.
Cheryl Van Rensselaer, 7309 Via Amorita, said there is nothing separating
the homes from the field, and the field is a dust bowl. She does not feel it is
appropriate to have farming activity so close to homes.
Jan Tannyhill, 11919 Pomering Road, mentioned that as a consultant for a
company that warehouses Chevron Ortho products, she is familiar with problems of
pesticides and their potential dangerous effect to people in an area.
Frank Martinez, 7214 Florence Avenue, said the dust blows over his hedge,
which is over ten feet tall. The farming activity has awakened him early in the
morning on weekends and holidays.
Dale Weaver, 7215 Irwingrove Drive, feels the chc-i :c fGr farming
has had an effect on the health of his son.
There being no one else to speak in opposition, rebuttal time was granted
to the applicant.
Mr. Diep rebutted comments of the previous speakers and discussed the pro-
cedures he uses to conduct a farming activity that will not be detrimental to
the neighborhood. He responded to questions of the Council.
Mr. Moore was asked if there are any conditions that might have been
overlooked to make this matter more acceptable, and he replied no.

Councilwoman Boggs indicated she does not want to go against what the resi-
dents want, but she does not object to the Department of Water & Power utilizing
land for another purpose.
Councilman Cormack said homeowners have a right to live in the environment
in which they purchased their homes, and it is up to the Council to protect that
right.
Mayor Davila indicated that if citizens have a complaint the Council should
listen, and he will vote against the permissive conditional use permit.
Councilman Santangelo favored the viewpoint of the residents.

APPROVING PERMISSIVE CONDITIONAL USE PERMIT NO. 4

Santangelo and seconded by Councilwoman Boggs to waive further reading and to
adopt.

Mr. Newton indicated it will be necessary for staff to bring back a resolu-
tion with findings to carry out denial of the permissive conditional use permit.
Mayor Davila declared a recess from 9:35 p.m. to 9:45 p.m. The meeting
resumed with Council Members Santangelo, Boggs, Cormack, Davila present; Council
Member Barb absent.
Mayor Davila opened the hearing on Zone Change Case No. 226, 8732-40
Firestone Boulevard, 8711-40 McCahill and 11214-38 Nash Avenue. He asked if the
City Clerk had the Proof of Publication, and the response was yes.
It was moved by Councilman Santangelo, seconded by Councilwoman Boggs, and
so ordered to receive and file the Proof.
Councilman Santangelo asked the City Attorney about his eligibility to vote
on this matter.
Mr. Newton responded it is his understanding this property is west of
Lakewood Boulevard, and he feels it is sufficiently remote from Councilman
Santangelo's property so that there would be no disqualification problem.
Mr. Cutts reported on the request to change the zone from R1-5000 (single
family residential) to C-2 (general commercial). A request for zone change was
originallly received from property on the northwest corner of the intersection
of McCahill and Nash Avenue, but after a review of the area and the City's
General Plan land use element, the request was expanded to include all of the
properties fronting on Nash Avenue for a total of 17 lots. He narrated a slide
presentation of the ar.� .-z:;poriding to questiui,s, FL. Cutts explained this
area will be included in proposed Redevelopment Amendment No. 4. When asked if
the properties would be subject to eminent domain, he replied the Council pre-
viously made decision to not use eminent domain on properties owner -occupied.
Mayor Davila inquired if the City Clerk had received any correspondence,
and the response was no.
Mayor Davila then asked if anyone wished to speak in favor.
Alfred Crescenzi, 844 Reed Drive, Claremont, applicant and owner of
property at 11215 Nash Avenue and 8732, 8734, 8736, 8740 Firestone Boulevard,
mentioned a portion of his property on the corner of Nash and McCahill has been

used since 1962 for parking purposes. He outlined his request for zone change
from R-1 to C-2 to extend the parking and use the property as temporary storage
for a body shop business, which would make the vacant lot useful and eliminate
weeds and other debris. Also, the zone change would increase the value of
properties in the area.
Dr. Jordan Phillips, 9489 Ravi 1ler Drive, commented on the properties he
owns on Lakewood Boulevard and 11220, 11224, 11226, 11228, 11230 and 11238 Nash
Avenue and favors a major development in this area and change of zone to C-2.
There being no one else to speak in favor, Mayor Davila asked if anyone
wished to speak in opposition.
Mr. Elton Parham, 8712 McCahill, said he has lived at this location for 20
years and urged the Council to not change the zone. The zone change would make
his residence a non -conforming use, and the C-2 zone would allow the automobile
painting and repair shop to store vehicles on the lot that are waiting to be
refurbished and restored.
There being no one else to speak in opposition, rebuttal time was granted
to the applicant.
Mr. Crescenzi agreed cars will be waiting for refurbishing but noted that
demand for the vehicles would not allow them to be stored for a long period of
time, particularly where insurance is involved. There will be a seven foot wall
built around the property used as a storage area, so that the stored vehicles
should not be an eyesore to the residents. He responded to questions of the
Council.
Mr. Cutts noted that in the C-2 zone, the body shop would have to obtain a
conditional use permit in order to expand the business, and a requirement would
be a seven foot wall.
Mr. Parham was asked if he would be agreeable to have his property left as
R-1 and the other property being required to install a block wall, and his
response was yes.
Dr. Phillips indicated he had no concerns about the body shop and it would —
not be detrimental to his property. He would be combining his Lakewood Boule-
vard property with the Nash Avenue property in any future plans for development.
Sharon Newberg, 8725 McCahill, said if only two lots are rezoned, she does
not want to be stuck in the middle of commercial property. She would rather see
all of the properties re -zoned.
It was moved by Councilman Santangelo, seconded by Councilman Cormack, and
so ordered to close the hearing.
Councilman Santangelo expressed disappointment the proposal is to allow the
corner lot on McCahill and Nash to become a storage area for a body repair shop,
and he hopes consideration will be given to developing the site for a benefit of
the community.
Mr. Cutts is concerned about eliminating one property from the proposed
zoning and does not consider it good planning practice.
Councilman Cormack feels owner -occupied homes should be protected.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE ZONING MAP ADOPTED BY SECTION 9106.06 OF
THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 928,
ZONE CHANGE CASE NO. 226)
The Ordinance was read by title only. It was moved by Councilman
Santangelo, seconded by Councilwoman Boggs, and passed by the following vote to
waive further reading and to introduce.
Discussion was held regarding eliminating the one property so that it will
remain R-l.

Mr. Parham was asked if he would object to his property being re -zoned and
he replied he would withdraw his request and not object since his property is
the only one.

and Gray Road. He inquired if the City Clerk had the Proof of Publication, and

It was moved by Councilman Santangelo, seconded by Councilman Cormack, and
so ordered to receive and file the Proof.
Mr. Cutts reported on the request to change the zone from R-3 (medium
density multiple family residential) to M-2 (general manufacturing) and noted
the General Plan designation is heavy industrial. The proposed zone change
would bring the zoning of the property in conformance with the General Plan. He
narrated a slide presentation.
Mayor Davila inquired if the City Clerk had received any correspondence,
and the response was no.
Mayor Davila then asked if there was anyone present to speak in favor.

passed by the following vote to authorize staff to prepare an Ordinance
requiring Street Vendors to provide the City with a Certificate of Insurance.
When asked about the minimum amount required, Mr. Powell said that will be
set during discussion of the Ordinance and can be established by Resolution so
the amount can be changed in subsequent years by Resolution without having to
re -adopt an Ordinance. It would only affect vendors who do retail sales within
the public right-of-way.

Chief Martin gave an update on the Police activity during the month of May
regarding the number of arrests, citations issued, and truants picked up.
OTHER BUSINESS - City Council
Councilman Cormack inquired why the City discontinued disking and turning
over weeds on vacant lots rather than mowing.
Mr. Ralph replied it was due to economics and the dust from disking.
Councilwoman Boggs asked whether Adams Ambulance has ambulances located in
the City.
Mr. Davis replied yes, they are located on Firestone Boulevard.

Councilwoman Boggs commented on receipt of a memo regarding harrassment of
a Department Head's family by citizens in the community. She requested a
policy, whereby at any time a department head or employee's family is harrassed
by a citizen that there be a legal procedure to obtain a restraining order to
stop the harrassment.
It was moved by Councilwoman Boggs, seconded by Councilman Cormack, and so
ordered to authorize the City Manager and City Attorney to prepare a policy to
automatically obtain a restraining order at any time a department head or
employee's family is harrassed by a citizen.
Mayor Davila mentioned there is unpainted wood around the Cardono project,
and inquired about having it painted. He was told the wood will be removed.
CLOSED SESSION
Mayor Davila announced the City Council will be recessing to closed session
for the purpose of discussing pending litigation under provisions of Section
54956.9 - Government Code, Subdivision (a) matter, Downey CARES vs. City of
Downey, et al.
The meeting was then recessed to closed session from 10:58 p.m. to 11:09
p.m. and resumed with Council Members Santangelo, Boggs, Cormack, Davila
present; Council Member Barb absent.
Mayor Davila indicated there was no action taken in closed session required
to be announced.
ADJOURNMENT: 11:09 p.m.
The meeting was adjourned to 2:00 p.m., June 11, 1986, in the Council
Chamber of Downey City Hall, for continued study on the City of Downey Budget
for fiscal Year 1986-87.
