APRIL 8, 1986
The City Council of the City of Downey held a regular meeting at 7:37
p.m., 1986, in the Council Chamber of the Downey City Hall,,Mayor Bob Davila
presiding.

INVOCATION AND FLAG SALUTE
The Invocation was delivered by Reverend Ullrich, Moravian Church of
Downey. The Flag Salute was led by Lynn Fisher, President - Friends of the
Downey City Library.
PRESENTATIONS
Mayor Davila presented to Judith Starbuck, representative of the Downey
Adult School, a Proclamation recognizing April 13, 1986, as Downey Adult School
Day.
Mayor Davila presented to Anthony Domenick, President, and Pat Grover,
First Vice -President and Past President, of the Association for Retarded
Citizens (ARC), a Proclamation on the 30th Anniversary of the Association for
Retarded Citizens.
Mayor Davila presented to Marie Da Hetrojay, representative of the Downey
Board of Realtors, a Proclamation recognizing April 13-19 as American Home
Week.
Mayor Davila presented to Marilyn Evans, President of the Downey Library
Board, a Proclamation recognizing April 6-12 as National Library Week.
Mrs. Evans invited everyone to celebrate Library Week by attending tours
at the Library and a special open house of the Literacy Center at Apollo Park.
HEARINGS
Mayor Davila opened the hearing on Lighting District Annexation 86/03,
Brookmill Road from Old River School Road easterly 850 feet. He inquired if
the City Clerk had the Affidavit of Posting of Notice and Proof of Publication,
and the response was yes.
It was moved by Councilwoman Boggs, seconded by Councilman Santangelo, and
so ordered to receive and file the Affidavit and Proof.
Mayor Davila inquired if the City Clerk had received any written protests
or objections, and the response was no.

There being no one present to speak in protest, it was moved by Councilman
Cormack, seconded by Councilwoman Boggs, and so ordered to close the hearing.
RESOLUTION NO. 4719
A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A
CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND
TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET
LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN
THOSE AREAS (ANNEXATION 86/03 - BROOKMILL ROAD FROM OLD RIVER
SCHOOL ROAD EASTERLY 850 FEET)
The Resolution was read by title only. It was moved by Councilman
Santangelo, seconded by Councilwoman Boggs, and passed by unanimous vote to
waive further reading and to adopt.
Mayor Davila opened the hearing on Lighting District Annexation 86/04,
Lowman Avenue from Telegraph Road to Brookpark Road. He inquired if the City
Clerk had the Affidavit of Posting of Notice and Proof of Publication, and the
response was yes.
It was moved by Councilman Santangelo, seconded by Councilwoman Boggs, and
so ordered to receive and file the Affidavit and Proof.

RESOLUTION NO. 4720
A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A
CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND
TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET
LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN
THOSE AREAS (ANNEXATION 86/04 - LOWMAN AVENUE FROM TELEGRAPH
ROAD TO BROOKPARK ROAD)
The Resolution was read by title only. It was moved by Councilman
Cormack, seconded by Councilwoman Boggs, and passed by unanimous vote to waive
further reading and to adopt.
Mayor Davila opened the hearing on V-149, Vacation of Second Street and
New Street, which was continued from the regular meeting of March 25, 1986.
Mr. Ralph understands the reciprocal agreements have still not been
received, but are on the verge of being completed. He requested continuance to
the next meeting.
It was moved by Councilman Cormack, seconded by Councilwoman Boggs, and
passed by unanimous vote to continue the hearing to 7:30 p.m., April 22, 1986,
in the Council Chamber of Downey City Hall.
Mayor Davila opened the hearing on Proposed Amendment to Downey Municipal
Code regarding Service Station Amortization Schedule. He inquired if the City
Clerk had the Proof of Publication, and the response was yes.
It was moved by Councilman Santangelo, seconded by Councilman Cormack, and
so ordered to receive and file the Proof.
Mr. Cutts commented on an Ordinance previously adopted regarding combined
service stations and convenience markets, which established locational require-
ments for these uses, as well as requiring separate restrooms for men and
women, air, water, and windshield wiping materials. A subsequent Ordinance was
adopted that these items be provided free of charge but there was no provision
for an amortization schedule, and the proposed Ordinance establishes an
amortization schedule of not exceeding two. years commencing at the time of
effective date of the Ordinance. The Ordinance allows service stations con-
structed prior to April 9, 1985, to bring their stations up to Code. There is
provision for reasonable extension of time from the Planning Commission based
upon certain findings contained in the Ordinance.

Mayor Davila inquired if the City Clerk had received any correspondence,
and the response was no.
Mayor Davila then asked if anyone wished to speak in favor of the proposed
Code Amendment.
Mr. Lennie Whittington, 8542 Manatee, said when the Ordinance was adopted
in 1985 no action was taken to enforce it until such time as the Council
directed a letter be sent out to gas stations in December 1985. Also a survey
of gas stations showed that 85 percent did not offer restrooms, nor did they
offer air and water. A large number of stations have installed meters, and an
18-month amortization would give more time for stations to install them. Mr.
Whittington said when the survey was done most stations had two restrooms, many
of which are still in place but were boarded over when the stations were
converted.
There being no one else to speak in favor, Mayor Davila asked if anyone
wished to speak in opposition.
Mr. Stan Sackler, business address 9706 Telegraph Road at the corner of
True, said he has been at that location since 1960. He feels the Ordinance as
it pertains to operators of gasoline stations is unfair legislation, and he
noted that stations have changed to self-service, which means fewer employees
on duty to maintain facilities, they are automated, and they work on lower
margins that full -service stations. Mr. Sackler distributed photos to the
Council of restroom vandalism at his station and pointed out that 85 percent of
the people who want to use his restrooms are not patrons, they are transients.
He mentioned he is located near other cities that do not have such an Ordinance
and commented on the extensive remodeling that would be necessary to provide
restrooms for the handicapped. He also opposed providing free air, water and
windshield service for vehicles and suggested before implementing an.amortiza-
tion that the City provide a way for maintaining these facilities. Mr. Sackler
suggested alternatives of differentiating between self and full -service
stations and requiring full -service stations to provide the services for free;
eliminating the word "free" from the Ordinance; or providing City funds and
manpower to maintain the facilities and supplies.
Mr. Al Johnson, construction coordinator for Thrifty Oil Company, feels
the oil industry is being discriminated against in providing free restrooms and
questioned why they are being singled out of other retail businesses in the
City. He noted historically this was part of the service station business but
that times and the way of doing business have changed and suggested designat-
ing public areas in the City for restrooms since it is a public problem. Mr.
Johnson then commented on the family operation of Thrifty Oil, with its main
office in the City of Downey, and mentioned at the time they remodelled their
stations would have been the time to include restrooms. It is a liability and
security problem to patrol this type of facility. He distributed photos of
Thrifty Oil stations in the City, as well as some of their vandalized
facilities, and requested reconsideration of the Ordinance with regard to the
retroactive requirement. Responding to questions, he explained their stations
have one restroom each.
Mr. Gordon Klemmer, operator of service station at 7539 Firestone
Boulevard, said when he restored his station in 1984 he was not advised to have
two restrooms, but there is one restroom in the center of the building which is
available to the public. He does provide free air and water, but objects to a
retroactive provision for providing another restroom.
Mrs. Glendon, 9733 Guatemala, cited an incident involving a service
station near her home in which the restrooms were used by drug addicts and said
requiring restrooms is not necessarily a service to the community.
Mr. Michael Lofti, operator of the Mobil Station at 9000 Telegraph Road,
mentioned he was the subject of attacks by people using his restrooms. He
feels gas stations are being singled out because the restaurant next door to
his business does not have a public restroom.
There being no one else to speak in opposition, Mr. Whittington was
granted time to speak in rebuttal.
It was moved by Councilman Santangelo, seconded by Councilman Barb, and so
ordered to close the hearing.

Councilman Santangelo concurs with a service station being allowed to
operate its business at a profit and for the safety of the owner and his
employees, but he does not feel government should tell a station operator how
to operate his business. He is not in favor of telling a station it must
provide free water, air and public restrooms.
Mr. Cutts responded to questions and was asked whether a variance proce-
dure would be available if the Ordinance is adopted, to which he replied yes.
When asked about the stations already having restroom facilities, Mr.
Newton stated those facilities would have to be made available to the public
without the amortization period being operative. The amortization would only
be for those stations that did not have facilities present and they would have
to comply with providing facilities, including reconstruction if necessary.
Councilwoman Boggs indicated her concurrence with Councilman Santangelo in
that the City would be asking the private sector to solve a public problem,
although there is a problem that must be addressed. She does not favor passing
the Ordinance but taking another look at how to solve this particular public
problem.
Mayor Davila suggested sending this back to staff for a detailed report to
see if these problems can be solved, particularly the stations that had permit
to build but not required to construct a restroom. He questioned how many
stations have restroom facilities but are locked up.
Councilman Cormack said current restroom facilities should be opened and
maintained.
Councilman Barb mentioned this is the result of requests by residents near
service stations who cited problems of people using neighboring areas for rest -
room facilities. He favors proceeding with the Ordinance and addressing the
issue of allowing stations to be built without requiring restroom facilities.
Discussion followed.
It was moved by Councilman Barb, seconded by Councilwoman Boggs, and
passed by the following vote to continue to the next regular meeting.
Councilman Santangelo objected to the two-year amortization and suggested
it be voted against and then go back and restudy the issue.

ORDINANCE NO. 817
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
CALIFORNIA, RELATING TO THE REGULATION OF THE PARKING
OF VEHICLES NEAR INTERSECTIONS
The Ordinance was read by title only. It was moved by Councilman Barb,
seconded by Councilwoman Boggs, and passed by unanimous vote to waive further
reading and to adopt.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
CALIFORNIA, RELATING TO THE REGULATION OF VENDORS ON
PUBLIC STREETS
The Ordinance was read by title only. It was Councilman Barb and seconded _
by Councilwoman Boggs to waive further reading and to adopt.
Councilwoman Boggs requested the Ordinance be continued to the next
meeting so she can obtain some answers from staff. She mentioned the Ordinance
addresses only areas of parks and schools from 9:00 a.m. to 2:00 p.m., and she
would like to check into time limits for residential neighborhoods.
Mr. Cormack noted the Council Members received a letter from an attorney
on this matter.

Councilman Santangelo suggested that when a letter is received on an
Agenda item that staff attach it to the material to make sure the Council has
received it.
It was moved by Councilwoman Boggs, seconded by Councilman Santangelo, and
passed by the following vote to continue the Ordinance to the next meeting.
The original motion and second were withdrawn.

RESOLUTIONS
RESOLUTION NO. 4733
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
REGULATING PARKING ON THE WEST SIDE OF PARAMOUNT BOULEVARD
FROM A POINT 300 FEET SOUTH OF PHLOX STREET SOUTHERLY
270 FEET (TOW -AWAY ZONE)
The Resolution was read by title only. It was moved by Councilman Barb,
seconded by Councilman Santangelo, and passed by unanimous vote to waive
further reading and to adopt.
It was moved by Councilman Cormack and seconded by Councilman Barb to make
an exception inasmuch as a large number of people are present regarding Agenda
Item VIII-G-6 that this item be heard at this time.
Mayor Davila declared a recess from 9:20 p.m. to 9:30 p.m. The meeting
resumed with all Council Members present.
RESOLUTION NO. 4734
RESOLUTION OF THE CITY COUNCIL, CITY OF DOWNEY,
APPROVING THE APPLICATION FOR STATE MONEYS
PROJECT: OLYMPIC SWIMMING POOL - RECREATION CENTER
Councilman Santangelo asked for the record whether the pool will have a
shallow end for learning and non -swimmers and if it will be the proper size.
Mr. Jarrett replied the pool as presently conceived will contain a shallow
end and will be an olympic size pool.

Santangelo, seconded by Councilman Cormack, and passed by the following vote to
waive further reading and to adopt.
Councilwoman Boggs pointed out for the benefit of people present in the
audience that the Council is approving the City's application for $500,000 from
the State.

Mr. Dan Rivers, 8223 East Suva Street, thanked the Council for moving this
matter forward on the Agenda, commented on the need for the swimming pool, and
expressed hope that the Council will reach an agreement with the School Board
to build the pool. He also made suggestions for funding the pool from certain
City funds.
Mayor Davila declared a recess from 9:42 p.m. to 9:44 p.m. The meeting
resumed with all Council Members present.
RESOLUTION NO. 4735
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING AND DECLARING A PUBLIC AREA TO BE A
PUBLIC PARK/PUBLIC FORUM
The Resolution was read by title only. It was noved by Councilman
Santangelo, seconded by Councilman Cormack, and passed by unanimous vote to
waive further reading and to adopt.

ADMINISTRATIVE REPORTS
It was moved by Councilman Santangelo, seconded by Councilwoman Boggs, and
passed by unanimous vote to approve enhancing the current level of service for
seniors and handicapped and authorize staff to solicit bids for purchasing two
vehicles for the Downey Transit Service estimated to cost $44,000 per vehicle
to be funded from available Prop A Funds.
It was so ordered to place the Employee Suggestion Plan on the regular and
closed session Agendas for the next Council Meeting.
It was moved by Councilman Barb, seconded by Councilman Santangelo, and
passed by unanimous vote to receive and file the report pertaining to Vending
Regulations on Public Streets.

OTHER BUSINESS - City Council
Mayor Davila inquired regarding status of repairing raised sidewalks on
Brock Avenue and Paramount Boulevard.
Mr. Ralph will check into it and report to Mayor Davila.
Councilman Barb commented on the Ordinance on the last Agenda regarding
Commercial Vehicle Parking on Public Streets, which was referred to staff for
checking into vehicle weight ratings. He is in receipt of information from the
Director of Public Works dealing with commercial vehicles, which he requested
be distributed to Council and placed on the next Agenda and noted it addresses
his concerns.
Councilman Cormack mentioned a street light is out at 9635 Downey Avenue.
Mayor Davila mentioned he has received a letter from Rockwell Inter-
national requesting submittal of the name of a business person in the City to
be recognized for an award. Staff has recommended the name of Mr. Jim Flora of
the Southern California Edison Company.
It was moved by Councilman Cormack, seconded by Councilman Santangelo,.and
passed by the following vote to approve submitting the name of Mr. Jim Flora.
CouncilmanBarb feels someone should be recommended from the Downey
community.
Chief Martin noted the event is sponsored by Rockwell International and
that last year about half of the nominees were not from Downey.

Staff will prepare a letter for the Mayor's signature.
