MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY MARCH 25, 1986 The City Council of the City of Downey held a regular meeting at 7:38 p.m., March 25, 1986, in the Council Chamber of the Downey City Hall, Mayor Bob Davila presiding. The Flag Salute was led by Robert Shand, City Clerk. PRESENTATIONS Mayor Davila presented to Mr. Dirk Bohl of the American Cancer Society, a Proclamation on Cancer Awareness Week. Mayor Davila presented to Mr. Bob Weber a Proclamation declaring Tuesday, March 25th, as Bob Weber Day. Mayor Davila accepted a Photograph of the 1986 Downey Rose Float Entry from Mr. Fred Soldwedel, President of the Pasadena Tournament of Roses Association, and Mr. Jeff Smith, liaison. Also present were Cele Kimberly and Brownie Brown of the Downey Rose Float Association. HEARINGS Mayor Davila opened the hearing on Vacation No. 149, Vacation of Second Street and New Street, which was continued from the regular meeting of March 11, 1986. Commenting on the staff recommendation to table, Councilman Cormack said he has spoken to Mr. Cardono, who indicates he should have everything ready for approval by the next meeting. It was moved by Councilman Cormack, seconded by Councilwoman Boggs, and so ordered to continue the hearing to 7:30 p.m., April 8, 1986, in the Council Chamber of the Downey City Hall. ORAL COMMUNICATIONS - Items not on Agenda Councilman Santangelo commented on the Ordinance limiting number of commer- cial refuse hauling companies in the City and mentioned Tiger Systems bid on a rubbish contract at Rockwell International, won the bid, but does not have a permit. Council Minutes 3/25/86 -1- -7gGS It was moved by Councilman Santangelo, seconded by Councilman Barb, and passed by the following vote to allow the Director of Public Works to issue a permit to Tiger Systems for the purpose of commercial rubbish collecting in the City based upon the findings set forth in the Ordinance. Mr. Ralph responded to questions regarding the original purpose of the Ordinance and said he has no knowledge of the company making the request. Councilman Cormack noted the trash -to -energy project that will be commenc- ing in the City of Commerce and $1 million in revenue the County Sanitation District will receive. Downey should still continue to look at the possibility of such a project. Councilwoman Boggs is concerned about limiting competition in the City. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, RELATING TO THE REGULATION OF THE PARKING OF VEHICLES NEAR INTERSECTIONS Council Minutes 3/25/86 -2- The Ordinance was read by title only. It was moved by Councilman Santangelo, seconded by Councilman Barb, and passed by the following vote to waive further reading and to introduce. When asked about the reason for the Ordinance, Mr. Ralph explained there have been several problems with high vehicles parking near intersections, which proved to be a safety problem. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY, RELATING TO THE REGULATION OF VENDORS ON PUBLIC STREETS The Ordinance was read by title only. It was moved by Councilman Santangelo, seconded by Councilman Barb, and passed by the following vote to waive further reading and to introduce. Councilwoman Boggs would like the Ordinance to be as strict as possible. Councilman Barb indicated public streets are not made for commercial selling purposes, and it should not be allowed. Mayor Davila questioned whether catering businesses would be exempted. Mr. Newton stated he has researched provisions of the Ordinance and finds the), are consistent with the Vehicle Code. He suggested the Council consider proceeding with the Ordinance to achieve the safety factors available and refer to staff for consideration and study further limitations that might be imposed on public streets on all types of commercial vending. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3185(b) OF THE DOWNEY MUNCIPAL CODE, WHICH SAID SECTION RELATES TO TRUCK PARKING REGULATIONS Councilman Barb said the Ordinance would allow certain vehicles used by the construction industry to park on residential streets. The current Ordinance is excellent and should be enforced. He favored lowering the weight limit. Mr. Ralph noted the problem in ticketing vehicles that are locked. Captain Stone said the gross vehicle weight (GVW) is not listed on regis- tration, and commented on the problem on enforcement unless the GVW can be obtioned from information in the cab of the vehicle. The Police Department would like something definitive that would be easy to enforce and be easy for citizens to understand. This Ordinance is a step in the right direction. Councilman Barb is interested in getting the obviously commercial vehicles out of residential neighborhoods and feels 5,000 pounds would be a fair weight limit. Councilwoman Boggs told of her experience in obtaining a business license to operate a roofing company in a residential area and being informed that no materials were to be stored on the property and that the vehicle owned by the business was to be parked out of sight back in the legal setback behind gates. This, she said, would be another way of accomplishing aesthetics by requiring vehicles to be parked off the street and behind gates. Councilman Santangelo noted a prior complaint about a plumbing business with employees operating out of a residence and he asked about the status of this matter. Mr. Yoshiki replied if a business was licensed as a home occupation it would be incidental to the residence; no employees should be appearing or dispatched at the residence; and no materials can be stored on the property. ORDINANCE NO. 816 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 9136.28 OF THE DOWNEY MUNICIPAL CODE WHICH RELATE TO SATELLITE DISH ANTENNAS (CHAPTER 1, ARTICLE IX) The Ordinance was read by title only. It was moved by Councilman Santangelo, seconded by Councilman Barb, and passed by the following vote to waive further reading and to adopt. It was noted that on Page 2, Section (10), the last word on the seventh line should read "residentially" instead of "individually." Mr. Newton said it is a clerical error and does not change the substance of the Ordinance., AYES: 5 Council Members: Santangelo, Boggs, Cormack, Barb, Davila ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, AMENDING ARTICLE VIII, CHAPTERS 2 & 5, OF THE DOWNEY MUNICIPAL CODE (BUILDING REGULATIONS) The Ordinance was read by title only. It was moved by Councilman Santangelo, seconded by Councilman Barb, and passed by unanimous vote to waive further reading, to introduce, and to set the hearing for 7:30 p.m., April 22, 1986, in the Council Chamber of Downey City Hall. RESOLUTIONS: None ADMINISTRATIVE REPORTS It was moved by Councilman Barb, seconded by Councilman Santangelo, and passed by unanimous vote to award a unit price contract totaling $352,810 to _ Shawnan Corporation on Cash Contract No. SS-398, Citywide Street Resurfacing. It was moved by Councilman Barb, seconded by Councilman Santangelo, and passed by unanimous vote to approve the Safety Lighting Zone III Report for Fiscal Year 1986-87 - Assessment Methodology. Liability Insurance Councilman Santangelo asked about delaying action on this matter until after the June primary since deep pocket legislation will be on the ballot and its approvalcould change the liability insurance picture in the State. Mr. Powell explained the City has received cancellation notices that its policies will not be renewed. He has been informed by insurance people that the referendum will help but will not change an insurance company's ability to provide liability insurance to cities. Cities will still be considered an unfavorable risk, and staff recommends moving forward with this program. It was moved by Councilman Barb, seconded by Councilman Cormack, and passed by unanimous vote to approve the concept described in the Agenda memo and direct staff to continue to work on the ICRMA insurance program. Transit Survey Mrs. Duke explained as directed by Council two surveys were conducted to determine the transportation needs of the community, and the results have been submitted to Council. One consisted of a random survey throughout the City, wherein 2739 surveys were mailed with 894 responses, representing 32.64 percent. The second was a survey of 228 users of the current service. All responses have been included by district and reviewed by the the Recreation & Community Services Commission, who concurs with the recommendation. Councilwoman Boggs favors proceeding with the purchase of two new vehicles to expand the program. She pointed out there are 56.12 percent of the people in Council Minutes 3/25/86 -4- District One using the current service, whereas there is only 7.76 percent in District Two, 4.47 percent in District Three, and 4.43 percent in District Four, and the Council may want to take another look at purchasing more than the two vehicles staff recommends. Councilman Barb said a majority of the people responded "no" to the ques- tion of whether they would use a City-wide transit service, and he does not feel there should be anymore money spent than is being spent at the present time. He often sees buses operating empty, and the bus service should be limited to the current operation in meeting needs of the senior citizens and handicapped. It was moved by Councilwoman Boggs and seconded by Councilman Cormack to purchase the two vehicles as recommended by staff at this time. Councilwoman Boggs pointed out the problems in her District are not being addressed fairly, and a portion of the community is being neglected that cannot drive anymore. Also, the funds are available. Mrs. Duke responded to questions regarding the Dial -A -Ride program. Mr. Roger Lawrence, 9627 Cheddar, commended staff on the survey and said the City has no long-range or short-range plan for spending Proposition A Funds that belong to citizens of Downey for transit needs. He feels it is a dis- service to not establish a plan for accomplishing the intent of the funds. Mrs. Duke commented that the purchase of two new vehicles would accommodate the people whose needs are not being met. Joyce Lawrence, 9627 Cheddar, questioned whether Prop A Funds are slated only for use by senior citizens and handicapped and expressed her desire for a bus system that would provide service for the entire community. Councilman Cormack asked about the possibility of expanding the personnel to keep the vehicles busy. Mrs. Duke replied it is recommended to increase the hours by 20 per week. During discussion Councilman Cormack questioned whether 20 additional hours would be adequate to operate the two new buses. Mrs. Duke commented on the staff hours operating the transit system. It is intended to run maximum with the number of people and hours, and she suggested bringing back at the next meeting a schedule to show how many hours the vehicles will be operating. Councilwoman Boggs requested this matter be continued to the next meeting. The motion and second were withdrawn. It was moved by Councilman Santangelo, seconded by Councilman Cormack, and passed by unanimous vote to authorize staff to continue working with Rockwell International in develoment of a final proposal for construction of a Memorial to the Space Shuttle; approve the location as proposed for site of the Memorial (grassed area at the southwest corner of the Police Department building); and develop a budget for the project to be submitted to City Council for approval. It was moved by Councilman Barb, seconded by Councilwoman Boggs, and passed by the following vote to accept the Downey Chamber of Commerce offer to under- take primary responsibility for organizing the 1986 Downey Christmas Parade. Ms. Pat Gomez, 8254 Alameda, Vice -President of the Downey Chamber of Commerce and Chairperson for the Downey Christmas Parade, thanked the Council for its approval. She said there are 14 other organizations that are backing and supporting the parade, one of which is the Downey Jaycees. AYES: 5 Council Members: Santangelo, Boggs, Cormack, Barb, Davila OTHER BUSINESS - Staff Members Mr. Ralph commented on request of a developer for approval of Tract Map No. 44079, 11102-11108 Woodruff Avenue, which was approved by the Planning Commis- sion at its last meeting. The developer cannot sell the property until all the necessary approvals are obtained and has deposited funds for in -lieu park fees Council Minutes 3/25/86 -5- in compliance with City Code and provided sufficient assurance the off -site improvements will be completed. Councilman Barb stated that although he has no financial interest, his residence is near the property and he will abstain from discussion and the vote. Councilwoman Boggs questioned authorizing a subdivision that has not appeared on the published agenda. It was noted that no one spoke to this issue when it was on the Planning Commission agenda, and through minute action the Commission recommended Council acceptance. Councilman Santangelo cited the location of his property on Firestone to the south and easterly of the subject property and asked the City Attorney for a recommendation for his ability to vote on this matter. Mr. Newton replied that based on the facts provided he does not see any basis for disqualification. RESOLUTION NO. 4718 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF TRACT MAP NO. 44079 APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTANCE OF A LETTER OF CREDIT IN LIEU OF SURETY BONDS (11102-11108 WOODRUFF AVENUE) The Resolution was read by title only. It was moved by Councilman Cormack, seconded by Councilwoman Boggs, and passed by the following vote to waive further reading and to adopt. Councilwoman Boggs requested in the future that Planning Commission material also be provided to the Council. She will vote to approve this based on the fact that there was no opposition when this came before the Commission. Mayor Davila announced he will abstain on this matter. AYES: 3 Council Members ABSTAIN: 2 Council Members OTNER BUSINESS - City Council Santangelo, Boggs, Cormack Barb, Davila It was moved by Councilwoman Boggs, seconded by Councilman Cormack, and passed by unanimous vote to declare all of the Civic Center grounds as a park and authorize the City Attorney to bring back a resolution. Councilwoman Boggs inquired regarding status for setting a hearing for street lights on Elm Vista and was told this will be on the Agenda at the next meeting. Councilwoman Boggs said she will be taking a trip and looking at European transportation and the trash -to -energy plant in Paris. It was moved by Councilman Cormack and so ordered to authorize a City Clerk salary comparison. Mayor Davila commented on receipt of proposed State Constitution Amendment No. 9 regarding release of convicted murderers back into the community, and said Assembly approval of the measure could appear on the November ballot. The Department of Corrections has prepared a list of convicted killers that could be released next year. He requested Council give him authority as the Mayor to support Amendment No. 9 to be placed on the November ballot so people can vote on the issue. Councilwoman Boggs requested a copy of the Amendment. It was moved by Councilman Cormack, seconded by Councilman Santangelo, and passed by the following vote to authorize staff to prepare a letter for the Mayor's signature. Mr. Ralph said the crews will be on the two sites tomorrow. Councilman Cormack noted staff is looking into gardeners' use of dust blowers.
