Shand, City Clerk -Treasurer Judy McDonnell, Executive Secretary INVOCATION AND FLAG SALUTE The Invocation was delivered by Councilwoman Boggs. The Flag Salute was _ led by the Campfire Girls Group of the Blue Birds. PRESENTATIONS Mayor Davila presented to the Campfire Girls Group of the Blue Birds a Proclamation declaring March 15 - 21, 1986, as Campfire Birthday Week. The Campfire Girls Group presented gifts of Campfire candy to each Council Member. HEARINGS Mayor Davila opened the hearing on V-149, Vacation of Second Street and New Street, which was continued from the regular meeting of February 11, 1986. Staff recommends the hearing be continued. It was moved by Councilman Santangelo, seconded by Councilwoman Boggs, and passed by unanimous vote to continue the hearing to 7:30 p.m., March 25, 1986, in the Council Chamber of Downey City Hall. Mayor Davila opened the hearing on Vacation No. 150, Alley between Second Street and Third Street Easterly from Paramount Boulevard. He inquired if the City Clerk had the Affidavit of Posting of Notice, and the response was yes. It was moved by Councilman Santangelo, seconded by Councilman Cormack, and so ordered to receive and file the Affidavit. Mr. Ralph explained the vacation was requested by one of the adjacent property owners and concerns an alley that was dedicated to the County without improvements prior to the City's incorporation. The alley cannot be used, there is a fence across it, and it does not fit within the orderly development of the adjacent land. Mayor Davila inquired if the City Clerk had received any written corres- pondence, and the response was no. Mayor Davila then asked if anyone wished to speak in opposition to the Vacation. Council Minutes 3/11/86 -1- Mr. Donald W. Lucart, 8036 Third Street, said the fence belongs to him. He asked about the easement the City will require on the rest of the alley and questioned whether there will be fences and gates so that he cannot use the alley at all or whether the City have access through the side streets at Second and Third. Mr. Ralph replied that owners of property will have access to their pro- perties only from Second, Third, Paramount, and Myrtle. When the City vacates an alley easement it totally vacates the public's right to use it for vehicular pedestrian access ingress or egress and will only retain a utility easement to cover the existing utilities. There being no one else wishing to speak in opposition and no one to speak in favor, it was moved by Councilman Santangelo, seconded by Councilman Cormack, and so ordered to close the hearing. Councilwoman Boggs said she assumes that the property owners present on this matter understand what is happening and have no objections. Mr. Pardella, business at 11103 Paramount Boulevard, owns a house on Second Street and has no objection to closing the alley. RESOLUTION NO. 4703 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF THE 20.00 FOOT WIDE ALLEY BETWEEN SECOND STREET AND THIRD STREET EASTERLY OF PARAMOUNT BOULEVARD The Resolution was read by title only. It was moved by Councilman Santangelo, seconded by Councilwoman Boggs, and passed by unanimous vote to waive further reading and to adopt. Mayor Davila opened the hearing on Lighting District Annexation 86/02, Verdura Avenue between Gardendale Street and Golden Avenue. He inquired if the City Clerk had the Affidavit of Posting of Notice and Proof of Publication, and the response was yes. It was moved by Councilman Santangelo and so ordered to receive and file the Affidavit and Proof. Mayor Davila asked if the City Clerk had received any written protests or objections, and the response was no. There being no one present to speak in protest, it was moved by Councilman Santangelo, seconded by Councilwoman Boggs, and so ordered to close the hearing. RESOLUTION NO. 4704 A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS (ANNEXATION 86/02 - VERDURA AVENUE BETWEEN GARDENDALE STREET AND GOLDEN AVENUE) The Resolution was read by title only. It was moved by Councilman Cormack, seconded by Councilman Barb, and passed by unanimous vote to waive further reading and to adopt. TWO AND RESCINDING RESOLUTION NO. 4700 RESOLUTION NO. 4712 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING A LETTER OF AGREEMENT BETWEEN THE CITY OF DOWNEY AND THE DOWNEY PUBLIC SAFETY AUXILIARY UNIT AYES: 5 Council Members: Santangelo, Boggs, Cormack, Barb, Davila ORAL COMMUNICATIONS - Items not on Agenda Mr. Jerome Lewis, 9232 Garnish Drive, requested the City carry through its plan to build a new swimming pool and feels the City should accept the $500,000 subsidy offered by the State while the funds are still available. Also, the pool would offer youth a positive means of involvement as a deterrent to drugs and alcohol. Council Minutes 3/11/86 -3- ORDINANCES ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 9136.28 OF THE DOWNEY MUNICIPAL CODE 'WHICH RELATE TO SATELLITE DISH ANTENNAS (CHAPTER 1, ARTICLE IX) The Ordinance was read by title only. It was moved by Councilman Barb to waive further reading and to introduce. Mr. Leon Emerson, 7607 Yankey, said he has some problems with the pro- posal on this matter and mentioned he has been in contact with Mr. Joel Lubin, who has submitted some additional comments. He then requested changes on behalf of the Downey Amateur Radio Club in Section 3 (e) - correction of interference; and Section 3 (a), prohibiting satellite dish antennas in the front yard or street side yard (corner lots) building and landscape setback or closer than 50 feet to the front property line. He also commented on Mr. Joel Lubin's recommendations to the Ordinance submitted in a letter dated March 10, 1986. The motion to waive and introduce was seconded by Councilman Santangelo. It was moved by Councilman Santangelo to amend the Ordinance as follows: On Page 3, Section 3 (a), that "50 feet" be changed to "30 feet;" in Section 3 (d) delete Items 1, 2, 3, 4 and 5 and add as per the suggested change of Mr. Lubin; in Mr. Lubin's Item No. 2 to add (d) (1) and (2) as outlined with the following change in (d) at the end to read "the Design Review Board, except as exempted by Subsection 3 (d) (2) or Subsection 4;" and Subsection 4, replace the words "except for subsection....." with "however, must comply with subsection 3 (a)"; and remove Subsection (3) (e). (Amendment later withdrawn.) During the stating of the motion, Councilman Barb indicated he has not seen Mr. Lubin's letter but feels strongly the Ordinance should be adopted as written. The Chair accepted the amendment. Councilwoman Boggs concurred with most of the changes, but prefers to direct staff to bring the Ordinance back with the suggestions incorporated that Councilman Santangelo has introduced as an amendment to the motion. Councilman Cormack offered an amendment to the motion to refer the Ordinance to staff for rewriting purposes. Mr. Newton mentioned there is a time problem since the moratorium will expire, and he recommended an Ordinance be introduced this evening. Councilman Santangelo said since the moratorium is about to expire he would prefer adopting the proposed Ordinance and request staff to come back with suggested changes covering the areas of the Council's concern. He then withdrew his amendment. The motion to waive and to introduce was passed by the following vote: AYES: 4 Council Members: Santangelo, Boggs, Cormack, Barb NOES: 1 Council Member: Davila Councilman Santangelo expressed his concern on Page 3, Section 3 (a), regarding "50 feet. He favors Mr. Lubin's suggestion regarding Subsection 3 (d): and requested deletion of Subsection 3 (d) (e) on Page 3. It was so ordered to refer the proposed changes back to staff. Councilman Barb raised concern regarding the proposed changes. Mr. Leonard Braun, 8332 Albia, said any antenna can be a receiving or sending antenna, particular with a VCR. ORDINANCE NO. 815 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 9124.04 AND 9124.06 OF THE DOWNEY MUNICIPAL CODE WHICH RELATE TO HOTELS AND MOTELS (CHAPTER 1, ARTICLE IX) Council Minutes 3/11/86 -4- The Ordinance was read by title only. It was moved by Councilman Barb, seconded by Councilman Cormack, and passed by the following vote to waive further reading and to adopt. AYES: 4 Council Members: Boggs, Cormack, Barb, Davila ABSTAIN: 1 Council Member: Santangelo RESOLUTIONS RESOLUTION NO. _ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING REDEVELOPMENT SURVEY AREA NO. 4 AND WOODRUFF INDUSTRIAL PROJECT SURVEY AREA FOR STUDY PURPOSES AND RESCINDING RESOLUTION NO. 4613 The Resolution was read by title only. It was moved by Councilman Barb and seconded by Councilman Cormack to waive further reading and to adopt. At the request of Councilwoman Boggs, the meeting was recessed to closed session from 8:32 p.m, to 8:50 p.m. for the purpose of engaging in attorney - client communication. The meeting resumed with all Council Members present. Mayor Davila stated there was no action taken required to be announced. Mr. Newton indicated it was his understanding there is a desire to modify the area, and he suggested the motion and second be withdrawn. Councilman Barb said he understands the Resolution removes residential property from the survey area, and he favored voting in favor of doing that. He expressed his feeling that redevelopment is taking money out of the General Fund when it could be used for services for the rest of the taxpayers. He would like to have an opportunity to speak to the property owners to see if they want redevelopment. Councilman Barb said this is only a survey area, not a redevelopment area, and the only purpose is to discuss the possibility with people in the area and establish a citizens committee. Discussion followed. Mr. Newton said a substitute resolution has been prepared designating as a survey area only that property which is designated as Amendment No. 4. The prior resolution has been modified in order to accomplish that action. RESOLUTION NO. 4713 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING REDEVELOMENT SURVEY AREA NO. 4 FOR STUDY PURPOSES The Resolution was read by title only. It was moved by Councilman Barb, seconded by Councilman Cormack, and passed by the following vote to waive further reading and to adopt. It was moved by Councilman Cormack, seconded by Councilman Barb, and passed by unanimous vote to waive further reading and to adopt. RESOLUTION NO. 4715 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING THE COMPENSATION PAYABLE TO CLASSIFICATIONS WITHIN THE MIDDLE MANAGEMENT SERVICE The Resolution was read by title only. It was moved by Councilman Santangelo, seconded by Councilman Cormack, and passed by unanimous vote to waive further reading and to adopt. ADMINISTRATIVE REPORTS Proposed Procedures (Revised) concerning Public Participation During City Council Meetings It was moved by Councilman Santangelo, seconded by Councilman Barb, and passed by the following vote to approve as presented. Councilwoman Boggs feels there may be the possibility of using cards in the future, noting that they are used by the School District. She suggested keeping this option open. Councilman Cormack feels Item No. 6 will discourage citizens from talking to their Council person Mr. Paul Sarvis, 13603 Barlin, said that when people take an item off the Consent Calendar they usually have a simple question, and it does not need to be carried over to the end of the meeting or voted on separately. He suggested allowing time for people to ask questions about the Consent Calendar so that they would not have to wait until the end of the meeting. Mr. Ken Miller, 7336 Cleargrove Drive, said this is a step in the right direction but feels people should be able to address items removed from the Consent Calendar earlier in the meeting. He referred to proposed Agenda Item XIII, Other Business, wherein staff and Council may bring up an issue and asked whether the public would be able to speak to an item on which the Council proposes to take an action. Mayor Davila replied it is his understanding that if the Council is going to take any action on an item brought up it would be determined by the Mayor or Council whether to receive input, and it is his intention to allow people to speak to an item whether or not it is on the Consent Calendar. Discussion followed. Mr. Miller recommended that the Agenda Item - Other Business should be brought up to Oral Communications earlier in the meeting where the public will be fully aware of the business to be transacted rather than have to wait to the end of the meeting. Mayor Davila recommended not approving the procedures. Mr. Miller requested an opinion from the City Attorney, but Council Members Barb and Cormack indicated the Chair makes the rules governing City Council Meetings, not the City Attorney. It was moved by Councilman Santangelo and seconded by Mayor Davila to amend Item No. 6 of the Procedures to change the third line should read, "All items that have been removed will be considered by the Council at the end of the Consent Calendar." Roll call vote on original motion: AYES: 4 Council Members: Santangelo, Boggs, Cormack, Barb NOES: 1 Council Member: Davila Council Minutes 3/11/86 -6- It was moved by Councilman Santangelo, seconded by Councilman Barb, and passed by unanimous vote to authorize refunds to properties so entitled on Assessment District A.D. 121 - Zone III, Safety Lighting Refunds 1985-86. It was moved by Councilman Barb, seconded by Councilman Cormack, and passed by unanimous vote to approve Change Order Nos. 1, 2, 3, and 4; assess liquidated damages in the amount of $3,000; accept improvements constructed under Cash Contract No. 493A, Apollo Activity Building; and accept maintenance responsibility for improvements. ORAL COMMUNICATIONS - Staff Members Mr. Ralph reported on receipt of a letter from the County regarding National Pollution Discharge System which requires permits for every storm drain connection to both rivers in the City and would be extremely expensive. He requested Council authorization to send a letter to the Federal Senators suggesting implementation be delayed for two years in order to allow more input. It was moved by Councilman Cormack, seconded by Councilman Barb, and passed by unanimous vote to authorize preparation of a letter for the Mayor's signature. ORAL COMMUNICATIONS - Audience Joyce Lawrence, 9627 Cheddar, thanked the Council and staff for their work on Council Meeting Rules and Procedures. She is happy with the outcome and it guarantees people the opportunity to speak. ORAL COMMUNICATIONS - City Council Councilman Cormack commented on the health hazard created by use of blowers by gardeners and feels they should be outlawed. Councilman Barb has received petitions from people who are unhappy about the use of blowers. Councilman Cormack asked if a response had been received from the Department of Water & Power regarding construction of a wall along the Rio Hondo Channel. Mr. Ralph replied yes, they have refused to build a wall in that area, and he is unaware of any legal means available requiring them to do so. Councilwoman Boggs noted the possibility of Downey Jaycees and Downey Chamber of Commerce co -sponsoring the Downey Christmas Parade this year. Councilwoman Boggs requested a report back on the items she addressed last meeting. She also commented on receipt of requests for a Child Care Program in the City and would like to discuss the options with staff. Councilwoman Boggs questioned the fairness of Code Enforcment in the City noting that a gentleman in her district has been cited for having a recreational vehicle parked on his driveway in the setback area but has seen similar violations in other areas of the City. She requestd review of the enforcement procedure. Mr. Cutts commented regarding the enforcement of this particular violation. Mayor Davila questioned the manner of monitoring objectional material sold in newspaper racks. Mr. Ralph mentioned the newsracks have been reviewed, and enforcement is being performed per direction of the City Attorney. Mr. Newton said the change in the Ordinance allowed for an alternative, which would be to modify the container so that the contents could not be seen from the outside. The other limitations in the Ordinance are being enforced to the extent the Courts have allowed. Mr. Ralph noted staff responds to complaints on this matter. Council Minutes 3/11/86 -7- Mayor Davila reported he has been asked by the City of Santa Fe Springs to receive the Red Ribbon in the Drug and Alcohol Abuse Program. Mr. Davis said staff will be bringing a plan to Council, and he will be attending the presentation with Mayor Davila. He noted the Red Ribbon plaque is passed from one city to another to promote the Drug and Alcohol Abuse Program, and Santa Fe Springs will be presenting it to Downey to institute a program, who will then pass it on to another city in the area.
