ADMINISTRATIVE REPORTS It was moved by Councilman Barb, seconded by Councilman Cormack, and passed by the following vote to receive and file the report on Firestone Boulevard Right -of -Way Acquisitions. AYES: 4 Council Members: Boggs, Cormack, Barb, Davila ABSTAIN: 1 Council Member: Santangelo It was moved by Councilman Barb, seconded by Councilman Santangelo, and passed by unanimous vote to deny the request for Vending Permit on Lakewood Boulevard North of Meadow Road at South Middle School and direct Engineering and Police staff to conduct additional studies on the feasibility of prohibiting public street vending within the City. Councilman Barb mentioned for the record that letters have been included in the Council packet on this matter from PTA's and schools throughout the commu- nity, as well as records of 19 traffic accidents involving children and street vendors in the last four years. Council Minutes 11/26/85 -3- It was moved by Counilman Barb, seconded by Councilman Santangelo, and passed by unanimous vote to award a unit price contract totaling $84,987 to Gosh Construction Corporation for construction of improvements under Cash Contract No. 500 - Relief Sewer, Luxor Street/Downey Avenue. It was moved by Councilman Santangelo, seconded by Councilman Barb, and passed by unanimous vote to approve Change Orders Nos. 1, 2 and 3; accept the improvements constructed under SS Project No. 359 (FAU), Brookshire Avenue - Storm Drain, Imperial Highway to Eucalyptus Street; and accept responsibility for maintenance (Account No. 26-16241). General Plan Amendment 85-1 and Specific Plan 85-1, Rancho Los Amigos Councilwoman Boggs referred to the November 20th letter from Mr. Larry Marks and expressed concern the Council did conduct a public hearing on every- thing in the specific plan presented for adoption. Mr. Cutts said he feels all of the areas mentioned in Mr. Marks' letter have been covered. Mr. Newton asked if it is correct that all issues raised in Mr. Marks' letter were the subject of public hearing before the Planning Commission and City Council in one or the other proposed specific plan, and Mr. Cutts replied yes, he feels all matters were discussed. Councilwoman Boggs commented on the need for a buffer between this project and residential properties. Mr. Cutts explained this would be included in the master plan to be approved by both the Design Review Board and Planning Commission. Permitted uses would go through the conditional use permit process, and notices would be mailed to property owners within 300 feet of the existing site. Mr. Newton mentioned the County will be subject to its own environmental review, and the citizens and City will have the opportunity to provide input. During discussion, Mr. Cutts said it is anticipated the lease on the property will be at least 66 years. Mr. Newton mentioned he has requested information on details of the transaction, which he has not received. Once he receives the information, he will report to the Council. RESOLUTION 4668 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ENTERING INTO AGREEMENT WITH THE COUNTY OF LOS ANGELES TO INDEMNIFY AND HOLD HARMLESS THE CITY OF DOWNEY IN REGARDS TO THE ENVIRONMENTAL REVIEW FOR GENERAL PLAN AMENDMENT 85-1 AND SPECIFIC PLAN 85-1 The Resolution was read by title only. ORAL COMMUNICATIONS - Staff Members Mr. Davis reported on a request by the Sister City Association requesting financial assistance for the visitations by delegates from Guadalajara and San Quintin. Mrs. Rae Haynes, 7111 Dinwiddie, and Mr. Leslie Olsen, 8129 Florence Avenue, were present to answer any questions. Mrs. Haynes mentioned there will be additional dancers from San Quintin who will be participating in the Parade. It was moved by Councilman Barb, seconded by Councilman Santangelo, and passed by unanimous vote to approve the request for funds. RESOLUTION NO. 4671 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CALLING FOR FORMATION OF A PROJECT AREA COMMITTEE FOR AMENDMENT NO. 4A AND 4B TO THE DOWNEY REDEVELOPMENT PROJECT The Resolution was read by title only. It was moved by Councilman Barb, seconded by Councilman Cormack, and passed by the following vote to waive further reading and to adopt. AYES: 4 Council Members ABSTAIN: 1 Council Member: ORAL COMMUNICATIONS - Audience Boggs, Cormack, Barb, Davila Santangelo Mr. Larry Marks, 7808 Borson, questioned whether all items were covered in public hearing on the specific plan for the Rancho project. He also said all people must be notifed if there is a change. He filed an objection to adoption of the plan because there were three items that were never discussed. He will meet with staff on this matter. Mr. Clarence Murphy, 7931 Borson Street, cited traffic difficulties and accidents on Imperial and Smallwood near the Rancho project, noting they increase as development occurs in the area. Mr. Lennie Whittington, 8542 Manatee, commented regarding his study of restrooms in gas stations and mentioned an ordinance was passed on free air, water, and restrooms. He noted since that time many stations have added pay machines and the City has not enforced the ordinance. Council Minutes 11/26/85 -5- Mr. Cutts said staff did discuss Mr. Whittington's list with him, and he indicated that all new stations are subject to a conditional use permit. The City has only had one Code Enforcement Officer for the last six months who operated on complaint basis. However, there are now three Code Enforcement Officers, who should be able to better enforce the ordinances. Mr Whittington indicated it was his understanding the Building Division would take his list and see that stations provided restrooms to the public and removed their pay machines. Also some stations do not have restrooms. Staff was directed to notify all stations on Mr. Whittington's list to comply with the Ordinance. Mr. Whittington cited his previous complaint regarding the unscreened fan at the Coca Cola Bottling Company. Mr. Cutts said staff has met several times with people from Coca Cola and they have pulled the permit. He will check into this further. Mr. Whittington questioned whether under State law the City can sell Police vehicles to Baja without first advertising them for sale. Mr. Newton explained Downey is a Charter City, and many provisions of the Government Code do not apply. Downey is entitled to deal with its property as it considers appropriate and in the best interest of the City. It is his understanding the sale was considered to be of public benefit to the City. Mr. David Ray, 7338 Nada, commented on the public hearing regarding Adams Ambulance, during which it was indicated the ambulances would be parked on the back of the property, and he noted there is an ambulance parked on Iowa Street. Mr. Ray then commented regarding the Ordinance allowing 90 days for storage containers on property and questioned whether the Downey Community Hospital obtained the permits for their containers. Also, the Hospital was granted an extension of time for the trailers during construction, and there are new two additional trailers on the property. Referred to staff for report back. Mrs. Lavonne Marks, 7808 Borson Avenue, referred to the Rancho Los Amigos Project and questioned the 300-foot requirement for notifying adjacent property owners of a proposed zoning matter. It was moved by Councilwoman Boggs, seconded by Councilman Santangelo, and passed by unanimous vote to notify people within 500 feet of the Rancho property line when the conditional use permit hearings will be held for Parcel A. Mrs. Marks then requested a general plan for the entire 212 acres of the Rancho Los Amigos property. Mr. Raymond Breaux, 7802 Adoree, compared the vote for approval by five Council Members on the Rancho Los Amigos Project to the 600 signatures in opposition. ORAL COMMUNICATIONS — City Council Councilman Cormack expressed concern regarding the lack of enforcement of the City's Ordinances. Councilwoman Boggs transmitted to the Director of Community Services a newspaper article regarding a toy library and suggested this be looked into as a possible need in the City. Councilwoman Boggs noted the screening of School District property and suggested screening a City water well site across the street. Councilwoman Boggs commented regarding California Association of Library Trustees and Commissioners award to Joyce Lawrence and the Assistance League. Councilwoman Boggs requested a update on the graffiti program, noting the complaints she has received in her district. Councilwoman Boggs called for routine Code enforcement instead of waiting for complaints and that enforcement begin on Elm Vista. Referred to staff. Council Minutes 11/26/85 -6- Councilwoman Boggs noted that approximately one week ago an ambulance was parked on the street in front of Adams Ambulance Service. Mayor Davila commented regarding apparent removal of the "no parking" signs on Burns Avenue near Paramount Boulevard, and he requested Public Works staff look into this matter.
