The Flag Salute was led by Councilwoman Boggs. PRESENTATION Shirley Webster, in behalf of Automobile Club of Southern California and American Automobile Association, presented a plaque in recognition of Downey's outstanding Pedestrian Safety Program during 1983. She said this is the sixth Triple A award Downey has received in the last ten years. Design Review Board Case No. 82-27, 8001 Florence Avenue Mr. Ovrom explained this concerns the Winchell's Shopping Center on the corner of Florence and Paramount. He said the party that brought this matter to his attention has requested this item be taken off the Agenda because it is felt the report submitted to the Council is not accurate. The party requests a continuance for more time to 'prepare a response. It was moved by Councilwoman Boggs, seconded by Councilman Davila, and so ordered to continue Design Review Board Case No. 82-27 to the meeting of October 23, 1984. (See reconsideration of action, Page 3.) PRESENTATIONS Mayor Barb presented to ''Mr. Bob Golay a Proclamation for Rotary Club Pancake Breakfast. Mayor Barb announced the City Council is proclaiming Crime Prevention Month in Downey. Council Minutes 10/9/84 -2- Mayor Barb read a proclamation proclaiming October 15 through 19 as California Safe Schools Week. Mayor Barb presented to Juanita Skillman, Area governor of Toastmasters Clubs, a Proclamation in recognition of Toastmasters Communications Month. Mayor Barb presented Certificates of Appreciation to Downey residents who served as Official Olympic Torch Bearers or Sponsors in the 1984 Los Angeles Olympics Cross Country Relay. Mayor Barb presented Certificates to the Downey YMCA members who ran through Downey with the official torch relay on July 26, 1984. Members of the 4-H Club presented a cake to the City Council in honor of National 4-H Week from October 7th through 13th. Mayor Barb declared a recess from 7:55 p.m. for conducting the Community Development Commission meeting. The meeting resumed at 9:00 p.m. with all Council Members present. MOTION TO RECONSIDER Mayor Barb requested a motion to reconsider Agenda Item VIII-F-5, Design Review Board Case No. 82-27, 8001 Florence Avenue, inasmuch as there is someone present to speak to the motion, who was not present at the time the item was considered earlier. It was moved Councilwoman Boggs and seconded by Councilman Santangelo to reconsider Agenda Item VIII-F-5. HEARINGS Mayor Barb opened the hearing on Appeal to Zone Change Case No. 214, 11720 Adenmoor Street. He inquired if the City Clerk had the Proof of Publi- cation, and the response was yes. It was moved by Councilwoman Boggs, seconded by Councilman Santangelo, and so ordered to receive and file the Proof. RECONSIDERATION OF AGENDA ITEM VIII-F-5 Design Review Board Case No. 82-27,- 8001 Florence Avenue Mr. Neil Byram, 9813 Guatemala Avenue, owner of a business on Florence Avenue, commented regarding the Council's ruling on October 11, 1983, regarding the sign at 8001 Florence Avenue, which he said was to require the property owner to completely stucco in the west and 'east sides of the build- ing. He stated instead of complying, the property owner covered up the wiring, lights and plastic with T1-11 board, and the boards can be removed at any time. Mr. Byram mentioned this condition has existed for over a year, and it appears City staff has aided the property owner in avoiding the compliance. He feels the property owner should be forced to obey the sign laws. The Council discussed the conversations that took place during the hear- ing on this matter, wherein it was indicated stucco would be placed between the signs to meet Code requirements. When asked if the Council has the ability to change a decision made at a public hearing, Mr. Newton said it is his understanding staff and the Design Review Board approved material equivalent to the stucco, and that issue can come back to the Council on appeal of that determination. Mr. Ovrom said the question is whether the T1-1'1 is equivalent to stucco. Mr. Newton stated in view of the fact that the Council made a previous motion to continue this to the next meeting and since it is possible people who were interested may have left in view of that action, he would suggest the Council continue the matter and defer any final action until that meeting. Council Minutes 10/9/84 -3- 55q It was moved by Councilman Cormack, seconded by Councilman Santangelo, and so ordered to continue to the meeting of October 23, 1984. ORAL C01111UNICATIONS - Items not on Agenda Mr. John Gonzalez, 12350 Orizaba, said he was under the impression that his property would be discussed this evening, but it is not on the Agenda. He questioned why his property was discussed at a Council Meeting, why he was never contacted by any of the Council Members, and he then began to make accu- sations about a certain member of the City Council working against him. Mr. Gonzalez was reminded by Mayor Barb that this is not the time to air personal conflict but is time to discuss City business. When Mr. Gonzalez continued with accusations about City departments, Mayor Barb offered to have a meeting arranged with the Police Chief or someone else outside the City so that he does not feel he is being misled. Mr. Gonzalez said the City Code pertaining to the length of time an incomplete project sits idle without any activity was amended from 180 to 120 days, and he is legal in every way --he has never broken the law. He indicatedtwo Council Members are working against him. In response to Mr. Gonzalez' comments, Councilman Davila explained he was elected to the Council in 1982 and observed Mr. Gonzalez' home at that time. During his campaigning, he received numerous complaints about Mr. Gonzalez' house not being completed and under construction for two years. When he was elected he made inquiries of staff regarding the unfinished project, and the City's Code was subsequently' changed from 180 to 120 days that a project can remain incomplete without work being done. For the record, Councilman Santangelo said when he previously spoke to Mr. Gonzalez he told him that when he was running for office he attended a coffee approximately one block from his home, and when he attended the coffee, the neighbors in that area were abhorred at the fact that Mr. Gonzalez' pro- perty had been under reconstruction for four years and had no exterior finish. He also stated for the record that through all of that period until the night he spoke with Mr. Gonzalez last week, he did not know who ozned the property. He said there was no action on his part against Mr. Gonzalez. Councilwoman Boggs stated for the record that she has never talked or met with Mr. Gonzalez before. Mr. Lennie Whittington,', 8542 Manatee, expressed confusion regarding the order of conducting the City Council and Community Development Commission meetings, and said the Commission meeting was not concluded. He also inquired regarding the closed session' concerning the Shepherd development, and he was informed that neither Agenda' has been completed and there will be additional closed sessions later in the evening to conclude the meetings. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS'6200, 6215, 6226, 6227.1, 6228, 6233, 6234, 6236, 6236.1, 6239, 6240, 6241, 6242, 6243, 6244, 6245, 6246, 6247,'6248, 6248.1, 6249, 6250, 6251, 6252, 6253, 6256, 6257, 6258, 6259, 6261, 6266, 6268, 6269 AND 6270 OF THE'DOWNEY MUNICIPAL CODE ORDINANCE 34 - BUSINESS LICENSES The Ordinance was read by title only. It was moved by Councilman Cormack, seconded by Councilwoman Boggs, and passed by unanimous vote to waive further reading and to introduce. Council Minutes 10/9/84 -4- 7_ssa It was moved by Councilwoman Boggs, seconded by Councilman Cormack, and passed by unanimous vote to table the Ordinance regarding Bicycle Licensing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE 'CITY OF DOWNEY AMENDING SECTION 9148 OF THE DOWNEY MUNICIPAL CODE (CHAPTER 1, ARTICLE IX) (re Signs) The Ordinance was read by title only. Councilman Santangelo indicated he has a pole sign for his business, and he asked for the record if he is free to discuss and vote on this Ordinance since all the sections relative to pole signs have been removed. The response was yes. It was moved by Councilman Cormack to waive further reading and to introduce. The Chair accepted the motion. Councilman Davila requested that on Page 13,Sub-paragraph (6), third line, removing everything after "single tenant" so that it will pertain only to a multi -tenant complex. Mr. Ovrom explained this section pertains to a'specific tenant who had a problem. He has looked into this matter, and the sign is legal under zone exception and does not need a Code amendment. He would suggest that rather than dealing with the problem now, he will obtain' a written opinion saying this one case is solved. During discussion, Councilman Santangelo suggested where it says "multi - tenant complexes" add "the monument sign shall 'identify said complex or identify those tenants in said complex." Mr. Cutts suggested that this portion also be removed, as well as the pole signs, for further study by the Planning Commission. Councilwoman Boggs said the issue being decided is whether a monument sign should be used as a tenant board or used to identify either one or two occupants. Councilman Cormack and Mayor Barb favored adopting the Ordinance intact. Further discussion ensued. Mrs. Gloria Reed requested permission to 'speak and correct some statements. It was moved by Councilwoman Boggs and seconded by Councilman Davila to allow Mrs. Reed to address the Council. When Mayor Barb indicated the hearing is closed, Mr. Newton explained it would require a motion to re -open the public hearing and readvertising. It was moved by Councilman Davila and seconded by Councilman Santangelo to amend the Ordinance by changing Sub -section (d) (6) on Page 13 to read "except for a multiple tenant of up to four tenants, which may display up to four tenant names." The Council concurred with the Mayor's suggestion of having the Planning Commission study this paragraph further. Mr. Newton said by consent, the Council has agreed to delete this paragraph and have it referred to the Planning Commission for review. Councilman Santangelo suggested Section (d), Monument Signs, be removed in its entirety from the Ordinance. The motion to amend was withdrawn. It was moved by Councilman Davila, seconded by Councilman Santangelo, and passed by the following vote to delete Sub -paragraph (6) from the Ordinance and refer it back to the Planning Commission for further study. Council Minutes 10/9/84 -5- `755 9 AYES: 4 Council Members: Davila, Santangelo, Boggs, Barb NOES: 1 Council Member: Cormack The Ordinance as amended was introduced by unanimous vote. Mr. Cutts explained a memo attached to the Sign Ordinance indicates the Planning Commission will review possibilities of alternatives for signs of historical significance; a possible method or procedure to handle existing pole signs; a plan or procedure for enforcement; and a rebate system to help with conversion to legal signing. Councilwoman Boggs mentioned she attended the Planning Commission meeting the evening following the 'Council hearing on the Sign Ordinance, and it appeared there was a communication problem as to the actions voted on by the Council which were not conveyed to the Commission. RESOLUTIONS: None ADMINISTRATIVE REPORTS It was moved by Councilman Santangelo, seconded by Councilman Cormack, and passed by unanimous vote', to approve a Parking Citation Processing Service Agreement. Via Amorita Street Reconstruction Mr. Ralph narrated a slide presentation of alleys, streets and gutters in the City either on the 'priority list or in need of reconstruction and commented on available funding. Mayor Barb asked where Via Amorita falls on the priority list. Mr. Ralph replied it is possible gutter improvements on Via Amorita could be included in the next budget as part of the Capital Improvement Budget. Cheryl Van Rensselaer, '7309 Via Amorita, complimented the City for the fine job it did in removing the tree in front of her home and expressed her appreciation for the time the Public Works Department has put into this. She stressed the condition of her street is very bad and that the sidewalks and street are in worse condition than they were before the trees were removed. She said there are still some trees on the 7200 block of Via Amorita because the owners have opposed their removal. It was moved by Councilman Davila to receive and file. Mr. Ralph said he will make sure this project is for consideration at the Council's next Budget session. Councilman Santangelo feels there ing people in writing of the process repairs. Mr. Ralph replied the actual construction would take approximately 30-60 days, and the scope of the work would be to replace approximately 25 percent of the sidewalk and about 17'percent of the curb. Mr. Ralph narrated a slide presentation and commented regarding Off -Site Improvements along the Rio Hondo Golf Course. He explained that Section 8100 of the Downey Municipal Code does not provide for construction of off -site improvements around an entire parcel. In this particular case, the improve- ments were constructed adjacent to the structure itself and the parking lot. Lennie Whittington, 8542Manatee, said the sidewalk on Country Club Drive south of the country club was constructed westerly and then stops at the fence. He said any other property owner would not be allowed to do this. ORAL COMMUNICATIONS - Staff Members: None ORAL COMMUNICATIONS - City Council Councilman Santangelo commented regarding his meeting with Mr. Perry con- cerning the trailer parked on the concrete area of the driveway, which blocked the garage. He said at the time he visited Mr. Perry, the trailer was parked in front of the house at the curb line. Councilman Santangelo feels that if the trailer were placed back on the concrete area of the driveway, it would not block access to the garage, and he does not believe Mr. Perry's trailer is a blatant violation of the Ordinance. He has told Mr. Perry the City cannot write an Ordinance approving the location of his trailer but not the location of other trailers, and in his opinion the City's Ordinance is proper and that Mr. Perry should abide by the Ordinance. Councilman Santangelo will submit addresses to staff of locations where he has 'seen violations, and he particularly noted a motor home on Fourth Street which is the entire length of the driveway. (See later motion to delay action.) Mayor Barb said this was discussed and granted at Budget time. Councilman Cormack feels it is an unusual requirement that the automobile be housed, whereas if it is left on City property' it would be outside. He favors giving unlimited use of a vehicle so long as it is figured into the Budget and the salary. Councilwoman Boggs said it is common in the 'private sector to furnish vehicles for top department heads, and she does not see a problem with having the vehicle provided. It could create a problem if the vehicle had to be parked in a garage. Mr. Ovrom said it is only the six Department Heads who have unlimited personal use of their vehicles, and if they take the car beyond the driving range of the City's gas station, then they must put gas in it themselves. Councilman Santangelo indicated that if the car is used for a vacation and there was a problem, the City's liability would be involved since the car was being used for private business. Mr. Lennie Whittington, 8542 Manatee, said the policy was put into effect when Chief Martin served as Acting City Manager. He also expressed concern regarding the liability that would be involved if the City vehicle is used for private business. It was moved by Councilman Cormack, seconded by Councilman Santangelo, and passed by the following vote to delay action until a report is forthcoming. It was moved by Councilwoman Boggs, seconded by Councilman Santangelo, and passed by the following vote that the study on serving liquor at the Downey Theatre be expanded to include the entire Civic Center complex. AYES: 3 Council Members: Davila, Santangelo, Boggs NOES: 2 Council Members: Cormak, Barb ORAL COMMUNICATIONS: Audience' Mr. Jim Derry, 7845 Fourth Street, inquired regarding status of moving the City Election back to April. He was informed this will be deferred to the second meeting in November or first meeting in December. Mr. Derry referred to the proposed study on Use of City Vehicles and questioned the need to conduct'a study since this concerns the meet and confer process and is part of the benefit package for Department Heads. Mr. Newton said there is nothing to prevent staff from pursuing a study. However, on a policy that affects compensation, if this matter is negotiated, then it would be a proper subject matter for the meet and confer process. Joyce Lawrence, 9627 Cheddar, referred to the Sign Code Amendment pertaining to Historic Signs and inquired if the Planning Commission or City staff is looking at sample amendments from other cities.
