The Flag Salute was led by Councilman Cormack. PRESENTATIONS Mayor Quinn presented a proclamation to Commander of the V. F. W. declaring May 27-28 as the Annual V. F. W. Poppy Sale. HEARINGS Mayor Quinn opened the hearing on Amendment to Downey Municipal Code Section 9158 regarding Plot Plan approvals for Second Dwelling Units. He inquired if the Deputy City Clerk had the Proof of Publication, and the response was yes. It was moved by Councilman Jackman and so ordered to receive and file the Proof. Mr. Carter explained the proposed Code amendment establishes certain design criteria and findings for the Planning Commission to make in order for a second or third unit to be built on R-1 zoned property, or third or fourth units on R-2 zoned property, and also fixes boundaries. He mentioned this also concerns Senate Bill 1534, in which the State says no city shall prevent the development of second dwelling units on R-1 zoned property, but does have the right to control location, setback, and specific areas. Mayor Quinn inquired if the Deputy City Clerk had received any correspondence on this matter, and the -response was no. There being no one present to speak in favor or in opposition, it was moved by Councilman Jackman, seconded by Councilman Cormack, and so ordered to close the hearing. ORDINANCE No. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTIONS 9158.02 AND 9158.06 WHICH RELATE TO PLOT PLAN APPROVALS The Ordinance was read by title only. It was moved by Councilman Jackman, seconded by Councilman Cormack, and passed by unanimous vote to waive further read- ing and to introduce the Ordinance. Council Minutes 5/24/83 -1- Mayor Quinn opened the hearing on Lighting District Annexation 83/1, Stam Road between Cherokee Drive and Seventh Street. He inquired if the Deputy Cit Clerk had the Affidavit of Posting of Notice and Proof of Publication, and the response was yes. It was moved by Councilman Jackman and so ordered to receive and file the Affidavit and Proof. Mayor Quinn inquired if the Deputy City Clerk had received any written pro- tests or objections, and the response was no. There being no one present to speak in protest, it was moved by Councilman Jackman and seconded by Councilman Cormack to close the hearing. RESOLUTION NO. 4230 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT AD 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THAT AREA (ANNEXATION 83/1 - STAMPS ROAD) The Resolution was read by title only. It was moved by Councilman Cormack, seconded by Councilman Barb, and passed by unanimous vote to waive further read- ing and to adopt Resolution No. 4230. CONSENT CALENDAR Mr. Ovrom explained the City Attorney will not be able to attend the joint meeting of the City Council and Planning Commission tentatively scheduled for June 7th, and he feels it is imperative the City Attorney or his representative be present at that time. The joint meeting between the Council and Planning Commission was then set for 5:00 p.m., June 6, 1983. He then made a motion that his name be removed from the list for free play at the Golf Course and to the Golf for lack of a in his place. The motion Mr. Ovrom indicated he will check the requirements to see who specifically is exempt. He would also need clarification on what is to be overseen at the Golf Course. Referred to staff for report back next meeting. ORDINANCES ORDINANCE No. 720 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9106.06 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 640, ZONE CHANGE CASE NO. 192) (10780 Fairford Avenue) The Ordinance was read by title only. It was moved by Councilman Jackman, seconded by Councilman Barb, and passed by unanimous vote to waive further reading and to adopt Ordinance No. 720. ORDINANCE NO. 721 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 2715 OF THE DOWNEY MUNICIPAL CODE RELATING TO ABOLITION OF POSITIONS, SAID ORDINANCE TO BE ADOPTED AS AN URGENCY MEASURE TO BECOME EFFECTIVE IMMEDIATELY The Ordinance was read in its entirety. It was moved by Councilman Jackman, seconded by Councilman Barb, and passed by unanimous vote to waive further read- ing and to adopt Ordinance No. 721. RESOLUTIONS Assessment District 113, Bergman Lane Mr. Newton requested confirmation from staff that there are no changes in the conditions from the time of adoption of the Environmental Impact Report. Mr. Brace replied since adoption of the Environmental Impact Report it has been discovered that a storm drain needs to be added, but it should not have an adverse impact. Council Minutes 5/24/83 -3- 7M It was moved by Councilman Cormack, seconded by Councilman Jackman, and so ordered to direct staff to file the Notice of Determination relative to the Environmental Impact Report. It was moved by Councilman Jackman, seconded by Councilman Cormack, and passed by the following vote to waive further reading and to adopt Resolution No. 4244. AYES: 4 Council Members: Cormack, Jackman, Barb, Quinn NOES: 1 Council Member: Davila For clarification, it was indicated by Councilman Davila that his "no" vote was to the adoption and not to the waiver of further reading. RESOLUTION NO. 4245 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OPPOSING CALIFORNIA STATE SENATE BILL 965 WHICH WOULD ELIMINATE EXPANSION OF EXISTING SOLID WASTE MANAGEMENT FACILITIES OR CONTROLLED SITING OF NEW FACILITIES The Resolution was read by title only. It was moved by Councilman Cormack, seconded by Councilman Barb, and passed by unanimous vote to waive further read- ing and to adopt Resolution No. 4245. RESOLUTION NO. 4246 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY URGING THE COUNTY OF LOS ANGELES TO GRANT PERMIT FOR CONTINUATION AND EXPANSION OF PUENTE HILLS LANDFILL The Resolution was read by title only. It was moved by Councilman Cormack, seconded by Councilman Barb, and passed by unanimous vote to waive further read- ing and to adopt Resolution No. 4246. ADMINISTRATIVE REPORTS It was moved by Councilman Jackman, seconded by Councilman Cormack, and passed by unanimous vote to approve extra work in the amount of $2,236.15; accept the improvements constructed under Cash Contract #496, Miscellaneous Repairs; and accept maintenance responsibility for the improvements constructed (A/C #21-13982). It was moved by Councilman Jackman, seconded by Councilman Cormack, and passed by unanimous vote to approve the recommendation of the Recreation & Community Services Commission and City staff to award a new contract to Kenneth M. Cherry Jr., for Golf Professional -Manager Services for the term of three years, July 1 1983, to June 30, 1986. It was moved by Councilman Cormack and seconded by Councilman Jackman to re- ceive and file the report concerning Downey Unified School District's intention to sell Rancho Santa Gertrudes School as Surplus Property. It was moved by Councilman Barb, seconded by Councilman Cormack, and so ordered to receive and file the report on Underground Utility District No. 11, Firestone Boulevard. Appeal, Zone Variance No. 213 12103 Downey Avenue It was noted the applicant is requesting the hearing be set for August 23, 1983, due to an extended vacation. Mr. Newton advised that the Code requires a hearing be held within 30 days. The Council can set the matter for hearing and then it can be continued. It was moved by Councilman Cormack and so ordered to set a hearing on Appeal, Zone Variance No. 213, 12103 Downey Avenue, for 7:30 p.m., June 28, 1983, in the Council Chamber of the Downey City Hall. At -that time the hearing will be con- tinued to 7:30 p.m., August 23, 1983, pursuant to the request of the applicant. It was moved by Councilman Jackman, seconded by Councilman Cormack, and passed by unanimous vote to carry over to the Budget study session a request for funds from the Southeast Council on Alcoholism and Drug Problems, Inc. Council Minutes 5/24/83 -5- 919[ It was moved by Councilman Cormack, seconded by Councilman Jackman, and passed by unanimous vote to recommend approval to the Civic Center Corporation for the contracting of the Civic Center Telephone System with Southern California Telephone, Inc., at the discount purchase price of $149,649 and recommend approval for an in- crease in the consulting contract with Communications Resources Company from $8,450 to $15,000 for providing implementation supervision. Mr. Ovrom explained staff is looking for direction from the Council for the contracting of Vehicle Towing and Storage Services and will then come back next meeting with a formal contract. It was moved by Councilman Davila to accept the proposal submitted by Denzer, who gave the highest bid. He said United towing has not complied with all of the code violations, and he does not think they should be considered as a contract bidder. The motion died for lack of a second. It was moved by Councilman Barb, seconded by Mayor Quinn, and passed by the following vote to approve the alternate of awarding a contract with United Towing Service Inc., for the western half of the City, and,Doug's Tug, Inc., for the eastern half of the City for a three-year period. RESOLUTION NO. 4247 A RESOLUTION OF THE DOWNEY CITY COUNCIL JOINING WITH CERRITOS COLLEGE IN A CONSORTIUM FOR THE DEVELOPMENT OF A SOUTHEAST LOS ANGELES COUNTY SERVICE DELIVERY AREA The Resolution was read by title only. It was moved by Councilman Davila, seconded by Mayor Quinn, and passed by unanimous vote to waive further reading and to adopt Resolution No. 4247. It was moved by Councilman Cormack, seconded by Councilman Jackman, and passed by unanimous vote to authorize the Mayor to execute a contract amendment to permit the City of Whittier to withdraw from the present Cataloging Contract. A study session on the Budget for Fiscal Year 1983-84 was set for 7:00 p.m., May 31, 1983. It was moved by Councilman Cormack and so ordered to set a hearing on General Revenue Sharing Funds and City of Downey Budget for Fiscal Year 1983-84 for 7:30 p.m., June 14, 1983, in the Council Chamber of the Downey City Hall. It was moved by Councilman Barb, seconded by Councilman Cormack, and so ordered to authorize a time extension to June 5, 1983, for Planning Commission's report and recommendations on the proposed Redevelopment Plan Amendment No. 3. Mr. Ovrom commented that in discussions with Caltrans, they have indicated their preference to have State police take over responsibility of patrolling the I-105 Freeway Corridor. He understood the Council's direction is for the Downey Police to continue patrolling the corridor area within the City until it is a finished construction site, and this information has been conveyed to Caltrans. Chief Martin explained Assemblyman Bruce Young was working with the City on this issue and introduced AS 230 requiring Caltrans to contract with local law enforcement agencies who desire to provide their own patrol. However, he has learned Assemblyman Young is no longer moving forward with that Bill but has managed to have included in the State budget language, whereby upon request of any affected City, the Department of Highways shall contract with that city to provide police services within the Route I-105 right-of-way within the city. Chief Martin said Assemblyman Young's office has been contacted indicating the City's desire to have this implemented in the State budget with that language. It was moved by Councilman Cormack, seconded by Councilman Jackman, and passed by the following vote to direct staff to take a firm stance in protecting the City's position. Council Minutes 5/24/83 -6- ?19.2 Mr. Newton explained that under the Supremacy clause, the State can assert authority to police its own property. However, he said, including in the State budget a requirement for Caltrans to contract with a local agency would be effec- tive in pointing Caltrans in that direction. Chief Martin suggested another course of action would be to contact Judge Pregerson, who originally ordered the State to do something about security in the corridor area, to see if he would not be satisfied with the State patrolling with three men. The motion died for lack of a second. ORAL COMMUNICATIONS - Audience Jan Tannehill, 11919 Pomering Road, asked if Conroy's Florist on the corner of Lakewood Boulevard and Imperial Hiqhway meets the setback reauirements. Mr. Carter replied they must meet requirements or the City will not sign off the permit. This particular property has heavy commercial zoning classification of C-2, and the setback requirement by code is five feet. Mr. David Soto, 11716 Lakewood Boulevard, commented regarding the recent nq of two-hour no parking restriction from 2.00-4.00 a.m. at the condominium project on Lakewood Buckles. He questi restriction. Buckles Street, noting many people park on one-half the block has the two-hour morning Mr. Eccleston explained it was an action taken by the Traffic Committee as a temporary measure to facilitate construction activities at the condominium pro- ject. The restriction will be rescinded on completion of the project, and notice will be delivered tomorrow to all of the residents in that area from Lakewood to Stewart & Gray Road. Councilman Davila inquired regarding the policy for noted two -to -three potholes on Neo Street at Old River 8 Mon Mr. Ralph explained the potholes from the storm have been filled, and he will check into the condition of Neo Street.
