ADJOURNED REGULAR MEETING
AUGUST 31, 1982
The City Council of the City of Downey held an adjourned regular meeting at
5:00 p.m., August 31, 1982, in the Council Chamber of the Downey City Hall, Mayor
James T. Quinn presiding.

Ordinance concerning proposed Downey Municipal Code Amendment regarding Parkin
Mayor Quinn asked if the City Clerk's office had received a petition contain-
ing 1780 names requesting reconsideration of the proposed Ordinance, and the
response was yes.
It was moved by Councilman Jackman, seconded by Councilman Cormack, and so
ordered to receive and file the petition.
Mayor Quinn indicated he has received five letters and one postcard regarding
the Ordinance.
It was moved by Councilman Cormack, seconded by Councilman Davila, and so
ordered to receive and file the letters and postcard.
Councilman Jackman indicated he has received a petition containing approxi-
mately 110 names and three letters.
Councilman Barb has received four or five letters.
Councilman Davila received about five or six letters opposing the Ordinance.
Councilman Cormack received mainly telephone calls, approximately two-thirds
of which were against the Ordinance and one-third supported it.
Mr. Donlevy explained the Council has received copies of the present code .
sections relating to residential parking, including recreational vehicles; a copy
of the Ordinance introduced on August 24th; and a scaled down proposal pertaining
to ,parking on the front lawn within the required landscape area.
It was moved by Councilman Davila and seconded by Councilman Cormack that the
Council consider an Ordinance amending Section 9150.20 of the Downey Municipal Code
prohibiting parking in a required front yard setback area or any portion of a re-
quired side yard setback area that is required to be landscaped.
For clarification, Mr. Newton asked if the proposed action would be to not
adopt the Ordinance introduced last meeting and instead to consider for introduc-
tion an Ordinance which only places a restriction upon parking in the front yard
required landscaped area.
Councilman Davila replied yes.
For further clarification, Mr. Donlevy stated this would have no effect on
existing Municipal Code Section 9110.04 as it relates to recreational vehicles.
It was moved by Councilman Cormack, seconded by Councilman Barb, and passed by
unanimous vote to not adopt the Ordinance previously introduced.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 9150.20 OF THE DOWNEY MUNICIPAL CODE
(CHAPTER 1, ARTICLE IX)
The Ordinance was read by title only. It was moved by Councilman Davila,
seconded by Councilman Cormack, and passed by the following vote to waive further
reading and to introduce the Ordinance.
An anonymous speaker from the audience asked if anyone would be allowed to
speak.
Mayor Quinn inquired if there was a representative of the people wishing to
address the Council.
Mr. David Ray, 7338 Nada, said his group was going to have an attorney speak,
but he is not present, so he will be their spokesman. He explained he represents
a group of citizens concerned about the City of Downey. He pointed out that many
years ago single car garages and driveways were allowed to be constructed. Also,
there are some areas where homes have no driveway or garage, and these people
should be given a permit to park their vehicles where they have been parking for
so many years. Mr. Ray also requested consideration be given to Police Department
recommendations that residents park their vehicles in the driveway when they are
on vacation to indicate someone is home so they will not be burglarized.
Mayor Quinn said the City cannot give a person a permit to break the law, but
attempts will be made to work something out.
For the benefit of the audience, Mr. Newton explained there is a provision in
the City Ordinances at this time which allows a variance from a zoning limitation,
and the parking limitation is a zoning limitation. He said where unusual circum-
stances exist on any specific property, a property owner can file application for a
zone variance. If there are properties that have no garage or driveway, it is
possible under the law to provide by way of a variance a special permit.
Mr. George Newman, 13047 Premiere, requested further definition of a lawn area.
Mayor Quinn and Councilman Barb explained the landscape portion of a property.
Mr. Carter drew a diagram on the chalk board to illustrate the landscaped set-
back area, excluding the driveway.

Mayor Quinn recessed the meeting to closed session from 5:22 p.m. to 5:40 p.m.
for the purpose of discussing security matters. The meeting resumed with all
Council Members present.
The meeting was adjourned at 5:40 p.m.
