Shand, City Clerk -Treasurer Judy McDonnell, Executive Secretary INVOCATION AND FLAG SALUTE The Invocation was delivered by Reverend Ed Ullrich, Moravian Church. The Flag Salute was led by Councilman Davila. PRESENTATIONS: None HEARTN( S Mayor Quinn opened the hearing on Lighting District Annexation 82/4, Earnsha Avenue between Century Boulevard and Golden Avenue. He inquired if the City Cler had the Affidavit of Posting of Notice and Proof of Publication, and the response was yes. It was moved by Councilman Jackman, seconded by Councilman Cormack, and so ordered to receive and file the Affidavit and Proof. Mayor Quinn inquired if the City Clerk had received any written protests or objections, and the response was no. There being no one present to speak in protest, it was moved by Councilman Jackman and seconded by Councilman Barb to close the hearing. RESOLUTION NO. 4168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT AD 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS (ANNEXATION 82/4 - EARNSHAW AVENUE) The Resolution was read by title only. It was moved by Councilman Jackman, seconded by Councilman Davila, and passed by unanimous vote to waive further read- ing and to adopt Resolution No. 4168. CONSENT CALENDAR Mr. Shand announced a Resolution appointing a member to the Board of Building Appeals/Design Review Board has been added to the Consent Calendar. PRIETO AS A MEMBER OF THE BOARD OF BUILDING APPEALS -DESIGN REVIEW BOARD FOR COUNCILMANIC DISTRICT ONE AYES. 5 Council Members: Cormack, Jackman, Barb, Davila, Quinn ORAL COMMUNICATIONS - Items not on agenda Mr. Richard Mittleman, 7737 Otto Street, commented on removal of the bus stop at Lubec and Paramount Boulevard and said he has submitted two petitions to the City and RTD to have the bus stops reinstated. He mentioned he was informed City staff is recommending the 460 bus line be taken out of the City and trying to get a park -and -ride system by the Santa Ana Freeway. Mr. Mittleman requested the bus stop at Lubec and Paramount be reinstated and that the bus line 460 not be removed from the City. He submitted a petition signed by 85 people who use the 460 line. Councilman Cormack mentioned he requested RTD to remove the bus stop at Lubec and Paramount across the street in front of commercial property and that RTD elected to remove it. He indicated he would be willing to support any petition to re-establish the bus stop across the intersection in front of commercial property. Mayor Quinn said as a voting delegate to RTD, he will check to see if the bus stop can be reinstated. Councilman Cormack said the City is actively working on better use of tax funds to have a more thorough bus system within the City to tie-in with RTD at the park -and -ride. Mr. Mittleman asked if the Traffic Commission is recommending the line 460 be taken out of the City. Mr. Eccleston replied no, that the City Council would have to review the park - and -ride proposal, and the decision on this is at least a year away. ORDINANCES ORDINANCE NO. 706 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING SECTION 3368 AND AMENDING SECTION 3362 OF THE DOWNEY MUNICIPAL CODE, ALL OF WHICH SECTIONS RELATE TO THE UNIFORM FIRE CODE Council Minutes 10/26/82 -2- The Ordinance was read by title only. It was moved by Councilman Jackman, seconded by Councilman Davila, and passed by unanimous vote to waive further read- ing and to adopt Ordinance No. 706. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 8100.4 WHICH SAID SECTION RELATES TO RIGHT-OF-WAY DEDICATION The Ordinance was read by title only. It was moved by Councilman Jackman, seconded by Councilman Barb, and passed by the following vote to waive further reading and to introduce the Ordinance. Councilman Cormack requested that anytime property markers are removed, they should be replaced. AYES: 5 Council Members: Cormack, Jackman, Barb, Davila, Quinn RESOLUTIONS RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING TIME LIMIT PARKING AND NO STOPPING RESTRIC- TIONS ALONG FIRESTONE BOULEVARD AND RESCINDING RESOLUTION NO. 3802 The Resolution was read by title only. Mr. Eccleston commented on the proposed resolution which restricts parking from 4:00-6:00 p.m, on the south side of Firestone Boulevard between Downey and Brookshire; a tow -away provision on the south side of Firestone between Downey and Lakewood; and no stopping anytime on the north side of Firestone between Brookshire and Dolan. Each of the businesses between Brookshire and Downey have been con- tacted and signed a petition acknowledging that the restriction would not be a hardship on those businesses. Councilman Cormack questioned whether this would have any effect on Simpson Buick, noting the closing of the Datsun dealer. He feels Simpson would be reluctant to give up street parking. Mr. Eccleston replied Mr. Simpson signed the petition without any coercion whatsoever. Councilman Cormack cited the need to keep automobile agencies in the City. At the request of the City Manager, the Resolution was held over to the next meeting for further review. CASH CONTRACTS: None MISCELLANEOUS ACTIONS: None CITY MANAGER'S REPORT Mr. Cano stated at the request of employee groups, the City's Health Care Benefits were reviewed by a Medical Benefits Committee comprised of representatives from each of the employee groups, as well as the City Manager's office. The City's medical benefits plan is a good plan but there was a problem with how it is pre- sented in the brochure, as well as problems concerning medical claims submitted and obtaining answers to questions. Mr. Cano indicated the plan has been rewritten, and with the approval of the City Manager, he has appointed someone from his office as coordinator of medical benefits claims. The presidents of all the employee groups have signed a statement concurring with the Medical Benefits Committee that its efforts were beneficial. Mr. Donlevy explained the I-105 Century Freeway plans are now in final dis- cussion with Caltrans, and if there are any major items of disagreement or concern by the Council, they should be passed on to staff. Mr. Eccleston stated caltrans intends to submit their new agreement by the end of the calendar year. Councilman Barb indicated that before a final decision is made, he would like to have time set aside for Council study and notify people this will be discussed. Council Minutes 10/26/82 -3- Mr. Donlevv said this can be placed on the agenda for a short presentation and have Caltrans present. Mayor Quinn mentioned he has met with people on Angell and Adoree Streets, and they are aware of the new map of the Freeway. He said a sound barrier wall is pro- posed for Adoree Street at the approach to the Freeway. Mr. Donlevy stated a meeting will be scheduled either the last meeting in November or the first meeting in December. Mr. Donlevy mentioned discussions with the School District regarding the proposed Downey High School Aquatic Park are going very well and staff has met with the District on several occasions. He hopes by the next meeting or meeting after that a financial analysis and status report can be presented to the Council. Mr. Newton explained he has distributed a confidential report to the Council containing research on the power of the Council to adopt ordinances controlling the sale of alcoholic beverages within the City. He suggested the Council review and report and inform the City Manager's office as to which, if any, of the proposed ordinances referred to should be prepared for consideration. STAFF REPORTS Mr. Donlevy requested a short closed session at the end of the meeting to discuss litigation. ORAL COMMUNICATIONS - City Council Councilman Cormack commented on the necessity for portable restrooms along the Christmas Parade route. Mr. Donlevy responded that portable restrooms will be provided. Councilman Barb referred to the report and update on the Commercial Revitali- zation Program and requested clarification as to what the Council authorized. Mr. Lang explained the Council instructed staff to develop the architectural guidelines, proceed with the commercial loan program, and to bring them back to the Council for consideration. There will be no action taken on the program until _ final approval of the Council is given. Councilman Barb recalled discussing that the designs could also fit into the entire Redevelopment Program and be used for other things if the Council decided not to proceed with the revitalization program. Mr. Donlevy said there will be no action until the Council has approved it. Councilman Davila said he will not be attending the Downey Community Hospital Retreat because nothing has been resolved with the Hospital on its pending claim against the City. He feels the Council should go on record and indicate publicly how it feels about the retreat. Mayor Quinn said he has read the agenda of the Hospital and it has nothing to do with the City. The Council Members are ex-officio members of the Board of Directors at the Hospital, and he feels it is his job as Councilman and Mayor to learn about what the Hospital is doing. Councilman Cormack said the people involved are his friends and neighbors, and he associates with them as such. He does not feel it is a matter of choosing sides but keeping on top of what is happening with the hospital. Mr. Newton indicated he will have some advice for the Council relative to the conference, the pending claim, and lease negotiations, which he will provide under the attorney -client priviledge. ORAL COMMUNICATIONS - Audience Eleanor Lindenfeld, 8846 Manzanar, referred to the lack of sidewalks near the Santa Ana Freeway and Lakewood Boulevard or space for pedestrians. She requested consideration be given to including sidewalks in the plans for the I-105 Freeway. Rose Sanfelippo, 9549 Adoree Street, stated she is opposed to the I-105 Freeway on -ramp at Bellflower Boulevard, in that they face flush against the on -ramp. She requested consideration on this and mentioned there are approximately six or seven homes involved. Council Minutes 10/26/82 -4- �7a6 9 CLOSED SESSION The meeting was recessed to closed session from 8:32 p.m. to 10:05 p.m. to discuss litigation. The meeting resumed with all Council Members present. MISCELLANEOUS ACTION Following the closed session, Mr. Donlevy resigned his position as Citv Manager effective January 31, 1983. He stated that a written resignation would be prepared and signed on Wednesday, October 27th. The City Council accepted the resignation and acknowledged that the City Manager would be on a leave of absence with compensation status until the effective date of his resignation.
