Hospital 5 Page 2 of 2 690 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADJOURNED REGULAR MEETING JUNE 7, 1982 The City Council of the City of Downey held an adjourned regular meeting at 7:30 p.m., June 7, 1982, in the Council Chamber of the Downey City Hall, Mayor Lyell W. Shand, City Clerk -Treasurer Judy McDonnell, Executive Secretary INVOCATION AND FLAG SALUTE The Invocation was delivered by Reverend Tim Smith, Nazarene Church. The Flag Salute was led by Councilman Mackaig. INTRODUCTIONS Mayor Swearingen introduced Planning Co dates, Randy Barb - District 4, and Bob HEARINGS and Council Mayor Swearingen stated the hearing on Appeal to Zone Variance No. 205 12072 Smallwood Avenue, was closed on April 27, 1982, and the Council has yet to take final action. He said any further action on the appeal will be continued to the meeti',g of June 22, 1982. Councilman Cormack mentioned he will not be available on that date and asked if this ma4.'ter could be continued to the next regular meeting of July 13th. Cout:ilman 11ackaig pointed out that on July 13th there will be two new Council Membe:.* who will not have heard testimony on the hearing. He asked if the hearing would �n have to be re -opened. Mr. Allen replied that if the two new Council Members listen to the recording of the hearing and are satisfied with the status of the hearing, then the five Council Members as constituted can make a decision. He mentioned that if either of the new Council Members were opponents or proponents in the proceedings, then they might be disqualified. The Council concurred that the decision on Appeal to Zone Variance No. 205 should be continued to the Council Meeting of July 13, 1982. Mayor Swearingen opened the hearing on Appeal to Zone Variance No. 206, 8509 Donovan Street. It was so ordered to continue the .hearing to 7:30 p.m., July 13, 1982, in the Council Chamber of the Downey City Hall. It was also so ordered to continue the hearings on Appeal to Zone Variance No. 209, 8646 Florence Avenue, and Street Vacation No. 139, Southeasterly from Southeasterly corner of Imperial Highway and Brookshire Avenue, to 7:30 p.m., J 13, 1982, in the Council Chamber of the Downey City -Hall. The contractor who originally put in the ramp and re- moved the fence onto the flood control right-of-way has been contacted and did promise to make corrections, but nothing has been done to date. Mr. Henriksen stated that if the contractor cannot do the work it will be done by City forces and the contractor will be billed. A work order has been prepared and work is scheduled. Mr. Ralph explained the City's earth moving equipment which is capable of doing the work is in need of repair. As soon as the parts are received and the earth mover repaired, the work will be completed. Mr. Donlevy as.=ured Mr. Grimes the work would be done in two weeks. Council Minutes 6/7/82 (adj.) -2- ORDINANCES ORDINANCE NO. 699 6 ?�v AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9106.06 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 472, ZONE CHANGE CASE NO. 172)(11744 ADENMOOR AVENUE) The Ordinance was read by title only. It was moved by Councilman Jackman, seconded by Councilman Mackaig, and passed by unanimous vote to waive further read- ing and to adopt Ordinance No. 699. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE SECTION 4251 RELATING TO DOGS, EXCEPTIONS TO THE LEASH LAWS The Ordinance was read by title only. It was moved by Councilman Jackman, seconded by Councilman Mackaig, and passed by unanimous vote to waive further read- ing and to introduce the Ordinance. RESOLUTIONS: None CASH CONTRACTS It was moved by Councilman Quinn, seconded by Councilman Mackaig, and passed by unanimous vote to approve extra work in the amount of $1,929.67 and accept the demolition work done under Cash Contract #477 -,Demolition of Site Improvements, Proposed City Hall Site (A/C #40-13919). Permit extra work on Construction Projects not to exceed $7500 Mr. Donlevy said this would only be permitted in an emergency type situation and when it would be impractical to call a special meeting of the Council. Mr. Henriksen reviewed the process of estimating construction projects. Councilman Cormack feels there should not be contract over -runs unless they are requested by the City. Councilman Jackman does not object to the $7500 so long as the Council is notified immediately and not at the time of accepting the contract. Mr. Donlevy said the Council will be informed of any changes. It was moved by Councilman Jackman, seconded by Councilman Quinn, and passed by unanimous vote that staff be authorized to permit extra work on construction projects when time is of essence, and when the cost of an item of .irk does not exceed $7500. It was moved by Councilman Jackman, seconded by Councilman QiLnn, and passed by unanimous vote to not waive the bid irregularities in the proposal submitted by All Service Construction Company; to select McAlpine and Salyer Construction Com- pany, Inc., as the lower responsible bidder; and to recommend to the City of Downey Civic Center Corporation the award of the construction contract to McAlpine and Salyer Construction Company, Inc., in the amount of $1,007,777 less Alternate Bid No. 3 for $15,479 (net bid amount of $992,298), for construction of the Downey Public Library Addition. It was moved by Councilman Mackaig, seconded by Councilman Jackman, and passed by unanimous vote to reject all bids for construction on Cash Contract #490, Temporary Parkinq Lot - City Hall Site (Account #40-13919). MISCELLANEOUS ACTIONS It was moved by Councilman Quinn, seconded by Councilman Mackaig, and passed by unanimous vote to approve a Joint Fire Communications Contract with the cities of Lynwood, Montebello, Santa Fe Springs, and Compton. 1982-83 Downey Community Hospital Budget Mr. Donlevy said the two items of concern were reviewed with the Hospital, and,staff's comments as well as a letter of the Hospital's position have been sub- mitted to the Council. Council Minutes 6/7/82 (adj.) -3- 6q�a It was moved by Councilman Mackaig, seconded by Councilman Quinn, and passed by unanimous vote to approve the 1982-83 Downey Community Hospital Budget. CITY MANAGER'S REPORT Mr. Donlevy said parking at the Jack LaLanne facility is being enforced --over 100 citations have been issued and approximately eight -to -ten vehicles have been towed away. Staff at the Jack Lanne facility have indicated they have made an offer on a lot to provide 60 additional spaces. This will come back to the Council by the first meeting in July. Status on Golden Park Improvements Mr. Donlevy stated the Golden Park project is currently at the State level forl'' approval, which consists of a 10,000 square foot building and upgrading the entire facility. This should come back to the Council by the first meeting in July. Mr. Donlevy reported on RTD Bus Stop Maintenance, noting the Public works Department has been alerted to give this matter more attention. The main area is at Lakewood and Florence, which will be improved. This will be discussed fiirther with RID. Councilman Cormack suggested RTD be informed this is their problem and not the City's. Bus StoD Relocation. Paramount Boulevard at Lubec Councilman Cormack feels the bus stop should be relocated to protect R-1 citizens. Also, he mentioned if RTD is not cooperative, he would like to see this placed back on the Agenda for Council action. Public Transit Coordination - Cities of Downey and Norwalk Mr. Donlevy indicated this will be discussed with Norwalk after receiving the guidelines on how to spend the funds. He feels this matter may not get too far, but he will come back with a full report on the distribution of funds. Mr. Donlevy then commented that regarding the State Budget, the City has been receiving mail -a -grams and information from Sacramento and the League concerning urgency and disaster if the State adopts the Budget using city subventions. He en- couraged each Council Member to personally contact Senator Carpenter and Assemblyman Bruce Young indicating they are not to take moneys from the cities to balance the State budget. He plans to be in Sacramento on June 15th and said this is the first time cities have to stand up and be noticed to their legislators to be responsible to the people who elected them. Mr. Donlevy mentioned the League has made a recommendation that if the State was to bring cigarette and liquor taxes up to the national average it could generate $500 million. Mr. Donlevy inquired if the Council would like to discuss placing a Moratorium on Video Games. Councilman Cormack expressed mixed emotions indicating he does not feel govern- ment of any form should tell people how to run their businesses. Councilman Quinn suggested possibly a tenporary moratorium might be the answer. Councilman Jackman indicated he would like to know more information and where the problem lies. During discussion, he said he does not feel the City should try to regulate private enterprise unless there is a moral problem. Mr. Donlevy said there are some pending applications for video games now befor, the Planning Commission. Neither he nor the Police Department have received any complaints. It was a concensus of the Council to take no action. Mr. Donlevy reminded the Council of the Civic Center Groundbreaking June 14th. ORAL COMMUNICATIONS - City Council Councilman Cormack reported on a complaint received from a resident at 9315 Guatemala, who feels people in a one-story neighborhood should be notified when a two-story home is built. He said apparently the way the house next door on Guatemala is designed it will be looking into the neighbor's bedroom. Council Minutes 6/7/82 (adj.) -4- 6 9 93 ORAL COMMUNICATIONS - Audience Mr. Lennie Whittington, 8542 Manatee Street, invited the Council to the first Keep America Beautiful meeting on June 15th at 1:00 p.m. A representative will be present from the national organization to explain the program. Mr. Whittington then suggested consideration be given to moving bus stops to the far side of intersections wherever possible to keep the intersections clear. Mr. Whittington commented on the parking situation at the Downey Community Hospital brought about by the improvement project construction currently under way. Mr. Lee Hopper, Associate Administrator of the Downey Community Hospital, responded to Mr. Whittington's comments and said steps are being taken to rectify the situation.
