The Flag Salute was led by Councilman Jackman. PRESENTATIONS: None HEARINGS Mayor Mackaig opened the hearing on Lighting District Annexation 82/2 Stoakes Avenue between Gallatin Road and Vista Del Rio Drive. He inquired if the City Clerk had the Affidavit of Posting of Notice and Proof of Publication, and the response was yes. It was moved by Councilman Jackman, seconded by Councilman Swearingen, and so ordered to receive and file the Affidavit and Proof. Mayor Mackaig inquired if the City Clerk had received any written protests or objections, and the response was no. There was no one present to speak in protest to the Annexation. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and so ordered to close the hearing. RESOLUTION NO. 4073 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT AD 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS (ANNEXATION 82/2 - STOAKES AVENUE) The Resolution was read by title only. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to waive further reading and to adopt Resolution No. 4073. Mayor Mackaig opened the hearing on Appeal to Zone Variance No. 200, 9550 Firestone Boulevard. He inquired if the City Clerk had the Proof of Publication, and the response was yes. It was moved by Councilman Jackman, seconded by Councilman Swearingen, and so ordered to receive and file the Proof. Mr. Goggin reported on the location of the property and the request for two signs 8' x 161 located in front of the building, one facing east and the other Council Minutes 2/23/82 -1- 6 t3 y facing west. He said the Code only permits 32 square feet, and the request for larger signs was based on traffic, and staff does not feel traffic is justification for increasing the size of a sign. Also, it is felt the sign can be reduced and meet code requirements. Mayor Mackaig inquired if the City Clerk had received any correspondence, and the response was no. Mayor Mackaig asked if anyone wished to speak in favor of the Appeal. Mr. Jerry McCue of Republic Development Company believes the size of the sign is important to advertise the magnitude of the work being performed in the Firestone area by Republic Development Company. There is a picture of four build- ings to be placed on the sign, and he does not feel the picture can be reduced to meet the sign size required by the City. He commented on the importance of needing exposure for the redevelopment project and feels the City is also part of the project. — There being no one else to speak in favor and no one to speak in opposition, it was moved by Councilman Swearingen, seconded by Councilman Jackman, and so ordered to close the hearing. During discussion, Mr. McCue was asked how long it would take to construct the four buildings, and he replied it would probably be less than a year. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by the following vote to approve the Appeal with a one year maximum time on the sign. Mayor Mackaig opened the hearing on Zone Change Case No. 183, 7940 Stewart & Gray Road. He inquired if the City Clerk had the Proof of Publication, and the response was yes. It was moved by Councilman Jackman, seconded by Councilman Quinn, and so ordered to receive and file the Proof. Mr. Goggin reported on the location of the property, noting the original appli- cation for zone change was expanded to include properties located at 7930 and 7936 Stewart & Gray Road because the area is used or proposed for R-3, but the owners of the two added properties requested they not be included, and the Planning Commission approved a zone change only for 7940 Stewart & Gray Road. Mayor Mackaig inquired if the City Clerk had received any correspondence, and the response was no. Mayor Mackaig asked if anyone wished to speak in favor of the Zone Change. Mr. Jim Mall, 7930 Stewart & Gray Road, requested his property remain zoned R-1 and said he would not object to the zone change at 7940 Stewart & Gray Road. Mr. Tony Chirco, owner of property at 7940 Stewart & Gray Road, requested the zone change to R-3 and commented on his plan to build six units on the property. There being no one else to speak in favor and no one to speak in opposition, it was moved by Councilman Swearingen, seconded by Councilman Jackman, and so ordered to close the hearing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9106.06 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 522, ZONE CHANGE CASE NO. 183) The Ordinance was read by title only. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to waive further reading and to introduce the Ordinance. CONSENT CALENDAR It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by the following vote to approve the Consent Calendar: Council Minutes 2/23/82 -2- 6 9 -5 Minutes: Regular Meeting of February 9, 1982. Correspondence from Downey Arts Council regarding Appointments of Harriett Paine and Elizabeth White. General Warrants: #208980 - 208996; #301552 - 301812: $862,592.75. 1982-83 Elderly and Handicapped Transit Grant: Authorize submittal of an Application with the understanding that a minimum of ten percent of the operating costs would be contributed from farebox revenues and local contri- butions; that Commission -allocated funds would be restricted to a maximum of 82.5 percent of the operating costs; and that the City would make up any shortfalls in farebox revenue, local contribution or program revenues. RESOLUTION NO. 4074 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROPOSING TO ANNEX A CERTAIN AREA INTO THE LIGHTING MAINTENANCE DISTRICT AD 121 AND ORDERING THE CITY TRAFFIC ENGINEER TO PREPARE AND FILE A REPORT PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 (ANNEXATION 82/3 - BERGMAN LANE W/O ORIZABA AVENUE) RESOLUTION NO. 4075 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE CITY TRAFFIC ENGINEERIS REPORT FOR THE ADDITION TO LIGHTING MAINTENANCE DISTRICT AD 121 OF ANNEXATION 82/3 - BERGMAN LANE W/O ORIZABA AVENUE RESOLUTION NO. 4076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ANNEX A CERTAIN AREA INTO THE LIGHTING MAINTENANCE DISTRICT AD 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC PLACES (ANNEXATION 82/3 - BERGMAN LANE) (Sets the hearing for March 9, 1982) AYES: 5 Council Members: Swearingen, Quinn, Cormack, Jackman, Mackaig ORAL COMMUNICATIONS - Items not on Agenda Joan Moeller, 10056 Pangborn Avenue, protested the way animals are put to sleep at the Southeast Animal Control facility. Mayor Mackaig requested a show of hands of the people present to speak regard- ing the animal control. He then said the Council will allow one speaker five minutes. Ms. Moeller continued that she inquired regarding the report from SEAACA but learned the report has not been started. In the meantime, she said, animals are being put to sleep with equipment that is obsolete and will eventually have to be replaced. Also, SEAACA is one of the finest, qualified animal control facilities and she feels there must be adequate funds to use the injection method. Ms. Moeller requested a time limit on when the report will be received so this matter can be placed on the agenda. Mayor Mackaig said Ms. Moeller was informed at the SEAACA meeting that she would be notified when a public hearing is set, and there will be a hearing as soon as information is available. ORDINANCES ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3153 OF THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTION RELATES TO PARKING OF VEHICLES Council Minutes 2/23/82 -3- 6 r3 6 The Ordinance was read by title only. It was moved by Councilman Quinn, seconded by Councilman Jackman, and passed by the following vote to waive further reading and to introduce the Ordinance. Responding to questions, Mr. Donlevy explained the ordinance does not pertain to recreational vehicles but is directed at large trucks and trailer rigs that are parked on the streets during the weekend and for indefinite periods of time, which cause traffic problems and hazards. AYES: 5 Council Members: Swearingen, Quinn, Cormack, Jackman, Mackaig Mayor Mackaig declared a recess from 7:53 p.m. to 8:02 p.m. The meeting re- sumed with all Council Members present. ORDINANCE NO. 686 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING AND AUTHORIZING THE EXECUTION OF A SITE LEASE AND A FACILITY LEASE WITH CITY OF DOWNEY CIVIC CENTER CORPORATION TO FINANCE THE CONSTRUCTION OF A CIVIC CENTER AND IMPROVEMENTS TO ITS LIBRARY TO HOUSE THE OFFICES AND SERVICES OF THE CITY OF DOWNEY The Ordinance was read by title only. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to waive further reading and to adopt Ordinance No. 686. ORDINANCE NO. 687 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTION 9150.06 (a) (1) AND (2), WHICH RELATES TO RESIDENTIAL AUTOMOBILE PARKING The Ordinance was read by title only. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to waive further reading and to adopt Ordinance No. 687. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY REPEALING SECTION 8246.1 OF THE DOWNEY MUNICIPAL CODE - WHICH SAID SECTION RELATES TO SWIMMING POOLS The Ordinance was read by title only. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to waive further reading and to introduce the Ordinance. RESOLUTIONS RESOLUTION NO. 4077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING ZONE VARIANCE NO. 195 (7355 FLORENCE AVENUE) The Resolution was read by title only. It was moved by Councilman Jackman, seconded by Councilman Cormack, and passed by unanimous vote to waive further read- ing and to adopt Resolution No. 4077. CASH CONTRACTS It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to award a contract totaling $216,600 to Excel Paving Company for construction of improvements under Cash Contract #488, Rio Hondo Golf Course - Phase III, and approve supplemental appropriation of $270,000 to complete all scheduled improvements (Account #52-17520). MISCELLANEOUS ACTIONS Appeal to Zone Variance No. 196 7840 Firestone Boulevard Mr. Donlevy stated as requested by Council, staff met with the applicant to work out a compromise on the requested sign but was unable to come up with some- thing acceptable. It is brought back to the Council at this time with the same recommendation that no signs identifying a single business be permitted on the street side of a building. Council Minutes 2/23/82 -4- 6937 It was moved by Councilman Jackman and seconded by Councilman Quinn to deny the Appeal to Zone Variance No. 196. Councilman Cormack said he was informed by the applicant that he is willing to discuss this further with staff. Mr. Bruce Swartz said they would be willing to have a reduction in size of the sign but they cannot put in an "emergency" sign because it is not a 24-hour facility. He requested the words "medical group" so that people traveling west on Firestone Boulevard can locate the facility. He said they do treat emergency cases and have a large industrial practice. Removed from the Agenda for two weeks and referred back to staff. The motion and second were withdrawn. A hearing on Appeal to Zone Variance No. 201, 8129 Gardendale Street, was set for 7:30 p.m., March 9, 1982, in the Council Chamber of the Downey City Hall. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by the following vote to authorize City staff to advertise for bids using normal procedures for the City Hall and Police buildings, and to take all steps necessary to accomplish said advertising. Mr. Donlevy explained the final stage is set for proceeding with the City Hall and Police facility. Plans for expansion and remodeling of the Library will follow shortly. It is anticipated the total plans will be availabe for respective bidders this week or next; the bid opening to take place the latter part of March or early April; and the bond sale following right after. The entire amount of the bond sale will be between $10 million and $11 million, and it is anticipated the annual debt service will be between $1.3 million and $1.5 million. A detailed report was sub- mitted in September, indicating the sources of funds for payment of the bonds, and the sources have not changed. The project is now ready to go. Mr. Don Gibb, architect, introduced Mr. Bill King and Mr. Bob Wielage, and proceeded to review plans of the City Hall and Police buildings AYES: 5 Council Members: Swearingen, Quinn, Cormack, Jackman, Mackaig CITY MANAGER'S REPORT Mr. Donlevy reported on the Senior Citizens Nutrition Program, noting the Human Services Association services surrounding cities of Artesia, Bellflower, Bell Gardens and Commerce, which has contracts with the Los Angeles County Area Agency on Aging. He said there is a location at the Rio San Gabriel Park that could serve between 75 and 100 meals a day, Monday through Friday, for senior citizens 60 years of age or older. The only involvement of the City would be to provide a location. Mr. Donlevy stated $3,000 would be needed to remodel the facility, which would be available from Block Grant Funds. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to proceed with the Senior Citizens Nutrition Program. STAFF REPORTS: None ORAL COMMUNICATIONS - City Council Councilman Swearingen suggested each Council Member send a letter to the State Legislators concerning fees and taxes proposed in Governor Brown's Budget for 1982-63. The Budget also includes funds for 2,276 additional State employees and continued documented waste practiced in the State government. Councilman Jackman requested this be extended to include the Chamber of Commerce so that businessmen and citizens can send letters. Mayor Mackaig requested staff prepare a letter for all Councilmen to sign and that a copy of the letter be transmitted to the Downey Chamber of Commerce through Councilman Quinn, the Council liaison. Councilman Swearingen commented on a request of the Central Basin Water Association for the Council to communicate with its citizens to encourage the Peripheral Canal Project. The City Manager was requested to place an article in the Communicator and to draft a letter for the Council Members to sign. Council Minutes 2/23/82 -5- f Councilman Cormack requested staff come up with something that will give the City some influence over narcotics paraphernalia, porno racks, and electronic games. Councilman Cormack then suggested the Second Century Foundation be given the project of improving the City's Christmas decorations and the Christmas Parade. Mayor Mackaig requested the City Manager and Councilmen Jackman and Swearingen, who serve on the Second Century Foundation, propose this at the next meeting to see if the Foundation would be willing to undertake the projects. ORAL COMMUNICATIONS - Audience Mr. Jerry McDonald, 8518 Manatee Street, spoke regarding the Ordinance concern- ing parking of unattached trailers and raised questions regarding the definition of trailers and the parking time allowed on the street. He then referred to areas in the City where property owners have donated land for street improvements, leaving them little room to park vehicles. Also, he requested consideration be given to out-of-state visitors who have to park their recreational vehicles on the street. Marilyn Kennedy, 12018 Brookshire Avenue, commented it will be difficult for the Police Department to tag trailers every two hoyrs. Mr. Lennie Whittington, 8542 Manatee Street, feels the City should take a stand regarding vehicles parking on the front lawn. Hazel Cal, 8503 Cavel Street, said she owns a motor home which is her trans- portation, and she has to park on the street. Charles Hoag (inaudible street address) commented on the cost of storing recreational vehicles and agreed with the ordinance concerning parking of semi- trailers. He feels when recreational vehicles have to be on property.they should be stored. Raymond Hammond, 8508 Manatee Street, said he parked his recreational vehicle in a storage lot but had approximately $200 worth of items stolen from the vehicle. ADJOURNMENT - 8:40 p.m. Robert L.
