Approved 3 Referred back to Parking Place Commission 3 Staff to apply for State & Federal Funding 3 Approved 3 4 Discussion 4 4 Page 2 of 2 9/0 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECEMBER 22, 1981 The City Council of the City of Downey held a regular meeting at 7:30 p.m., December 22, 1981, in the Council Chamber of the Downey City Hall, Mayor Milton R. Mackaig presiding. PRESENT: Council Members: Milton R. Mackaig Mayor - Lyell W. Swearingen Mayor Pro Tem James T. Quinn Robert G. Cormack Theodore H. Jackman ALSO PRESENT: John W. Donlevy, City Manager Royal M. Sorensen, City Attorney Dudley Lang, Assistant City Manager Don Davis, Fire Chief William A. Goggin, City Planner Harald J. Henriksen, City Engineer Charles G. Eccleston, Traffic Engineer Donald Wagner, Assistant to City Manager Robert L. Shand, City Clerk -Treasurer Jeanne Cook, Deputy City Clerk -Treasurer INVOCATION AND FLAG SALUTE The Invocation was delivered by Reverend John Wetzel, Christ Lutheran Church. The Flag Salute was led by Councilman Swearingen. PRESENTATIONS: None HEARINGS Mayor Mackaig opened the hearing on proposed Amendments to Downey Municipal Code regarding Garages in R-1 and R-2 Zones. He inquired if the City Clerk had the Proof of Publication, and the response was yes. It was moved by Councilman Swearingen and seconded by Councilman Quinn to re- ceive and file the Proof. Mr. Goggin reported that as requested by the Council, staff prepared an ordinance for consideration by the Planning Commission concerning garages in the R-1 and R-2 zones. The ordinance would provide for garage parking spaces when they are visible from the street. When the area is screened from the street, then the residence could have a carport. Mayor Mackaig inquired if the City Clerk had received any correspondence on this matter. Mr. Shand replied a letter of opposition was received from Violet Caroline, 8129 Gardendale Street. There being no one present to speak in opposition or in favor to the proposed amendment, it was moved by Councilman Jackman and seconded by Councilman Swearingen to close the hearing. It was so ordered by the Mayor to authorize staff to prepare an ordinance for the next Council Meeting. CONSENT CALENDAR A correction was noted in the Council Minutes of December 8, 1981, on Page 1 under Hearings. The first hearing should read, "Amendments to the Downey Municipal Code regarding Floor Area of R-1 and R-2 Dwellings." Agenda Item VIII-F-1, Resolution concerning Destruction of certain Obsolete Records, has been amended to include that any records in the Police Department de- clared obsolete for destruction would be subject to approval of the City Attorney. It was moved by Councilman Jackman, seconded by Councilman Swearingen, and so ordered to approve the Consent Calendar with the appropriate changes: Minutes: Regular Meeting of December 8, 1981, as corrected. PLY FOR HIS SERVICE AS A MEMBER OF THE CITY OF DOWNEY PERSONNEL ADVISORY BOARD ORAL COMMUNICATIONS - Items not on Agenda: None ORDINANCES ORDINANCE NO. 682 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTION 9110.12(g) AND SECTION 9112.10(g) WHICH RELATES TO RESIDENTIAL FLOOR AREAS (CHAPTER 1, ARTICLE IX) The Ordinance was read by title only. It was moved by Councilman Jackman, seconded by Councilman Swearingen, and passed by unanimous vote to waive further reading and to adopt Ordinance No. 682. RESOLUTIONS RESOLUTION NO. 4055 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF PARCEL MAP NUMBER 14879 (HOMETEL/CIVIC CENTER) The Resolution was read by title only. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to waive further reading and to adopt Resolution No. 4055. It was 'moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to waive further reading and to adopt Resolution No. 4056. RESOLUTION NO. 4057 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXPRESSING CONCERN REGARDING THE OFFENSE OF DRIVING UNDER THE INFLUENCE OF ALCOHOL The Resolution was read by title only. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by the following vote to waive further reading and to adopt Resolution No. 4057. Mr. Donlevy explained the resolution originated from both his office and Chief Martin's office, and they feel it is time for citizens to stand up and indicate to the Judges that they want tougher sentences for these offenses. With the death of the Downey Police Officer and possible outcome on the case, it is felt everything should be done to make an example of this type action. Staff will be present at the time of sentencing and will notify Council of the date. AYES. 5 Council Members: Swearingen, Quinn, Cormack, Jackman, Mackaig CASH CONTRACTS: None MISCELLANEOUS ACTIONS It was so ordered to set a hearing on General Plan Amendment 81-2 East side Paramount Boulevard from Albia Street to Conrad Street and 7952 and 7955 Cole Street, for 7:30 p.m., January 12, 1982, in the Council Chamber of the Downey City Hall. It was so ordered to set a hearing on Zone Chancre Case #180, 7955 Cole Street, for 7:30 p.m., January 12, 1931, in the Council Chamber of the Downey City Hall. CITY MANAGER'S REPORT It was moved by Councilman Swearingen, seconded by Councilman Commack, and passed by unanimous vote to award bid on Aerial Ladder Truck Vehicle to Mack Trucks, Inc., the low bidder, in the amount of $291,303 (to be funded through the Equipment Fund) . STAFF REPORTS It was so ordered to refer the Kinci's/Navlor's Lease Assignment for Parking Lot #12 at the southwest corner of Firestone Boulevard and Dolan Avenue back to the Parking Place Commission for further consideration. Mr. Donlevy reported staff has checked into a Nutrition Program for Senior Citizens, noting there is the Meals on Wheels program, plus a nutrition program pro- vided on Mondays through adult education. If it is a desire of the Council to get involved in a nutrition program like other surrounding cities, which is both State and Federally funded, staff will proceed to make application and have it effective by July 1st of next year. The only obligation on the part of the City would be to provide a site location, which could be at Apollo Park. The Council concurred. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by unanimous vote to accept the high bid for 'Sale of Excess Property - Old Fire Station No. 1; authorize staff to enter into an escrow to complete the sale of property; and authorize the Mayor to sign deeds and other documents necessary to conclude the sale transaction. ORAL COMMUNICATIONS - City Council Councilman Swearingen referred to Resolution No. 4054 regarding Support of Recent Superior Court Decision - City of Los Angeles vs. County of Los Angeles, Council Minutes 12/22/81 -3- 6 9i3 and asked if the Council should contact the County Board of Supervisors. He was informed staff will follow through on this. Councilman Swearingenstated he has been asked to chair the 22nd annual Seminar of the Independent Cities in San Diego April 15-18, 1982, and he requested the back- ing of each Council Member, which he verbally received at this time. Mayor Mackaig referred to Keep Downey Beautiful program and mentioned it was suggested by Mr. Ned Young, President of the Second Century Foundation, that the Foundation might possibly be willing to take over the program. Councilman Cormack mentioned the Health & Sanitation Committee has been trying to get the program moving again. Mr. Donlevy stated information was received today that all back reports and — records will be delivered to City Hall tomorrow. Councilman Cormack said he and Councilman Swearingen will communicate with the Health & Sanitation Committee regarding the Foundation's interest. ORAL COMMUNICATIONS - Audience Mr. Ted Love, representing King's Restaurants, questioned why the Assignment of Lease Agreement had been referred back to the Parking Place Commission. He said he presented an Estoppel Certificate and Consent to Assignment, which was revised by the Commission apparently on the basis of legal counsel. He indicated they are in- terested in having this matter taken care of within the next ten days.
