OF THE CITY OF DOWNEY
SEPTEMBER 22, 1981
The City Council of the City of Downey held a regular meeting at 7:30 p.m.,
September 22, 1981, in the Council Chamber of the Downey City Hall, Mayor Milton R.
Mackaig presiding.

INVOCATION AND FLAG SALUTE
The Invocation was delivered by Reverend Michael Winstead, Downey United
Methodist Church. The Flag Salute was led by Councilman Cormack.
PRESENTATIONS: None
HEARINGS
Mayor Mackaig opened the hearing on Cable TV Franchise Agreement. He in-
quired if the City Clerk had the Proof of Publication, and the response was yes.
Mayor Mackaig said in view of the absence of Councilman Swearingen this
meeting and the absence of Councilman Jackman next meeting, the hearing will be
continued to October 27, 1981.
It was moved by Councilman Quinn, seconded by Councilman Jackman, and so
ordered to continue the hearing on Cable TV Franchise Agreement for 7:30 p.m.,
October 27, 1981, in the Council Chamber of the Downey City Hall.
Mayor Mackaig opened the hearing on Appeal to Zone Variance No. 180, 7753
Arnett Street. He inquired if the City Clerk had the Proof of Publication, and
the response was yes.
Mayor Mackaig said a letter has been received from the applicant's counsel
requesting a continuation of the hearing.
It was moved by Councilman Quinn, seconded by Councilman Jackman, and so
ordered to continue the hearing on Appeal, Zone Variance No. 180, to 7:30 p.m.,
October 27, 1981, in the Council Chamber of the Downey City Hall.
CONSENT CALENDAR
_ Mr. Sorensen commented regarding changes made to the Permit Agreement
authorizing the County to use 26 undesignated parking spaces.
It was moved by Councilman Jackman, seconded by Councilman Quinn, and so
ordered to approve the Consent Calendar:
Minutes: Regular Meeting of September 8, 1981.

Cash Contract #478, Manzanar Avenue north of Gallatin Road - Street
Improvements: Plans, specifications, and grant authority to advertise for

AMENDING THE ZONING MAP ADOPTED BY SECTION §106.06 OF
THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 472,
ZONE CHANGE CASE NO. 172) (11744 ADENMOOR AVENUE)
The Ordinance was read by title only.
Mr. Goggin explained an 8-inch water line is required on the property but
the applicant has not posted the money or taken out a permit to do the work.
He requested the Ordinance be tabled until the work is completed.
It was moved by Councilman -Jackman, seconded by Councilman Quinn, and so
ordered to table the Ordinance.
ORDINANCE NO. 668
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADDING SECTION 9135 TO THE DOWNEY MUNICIPAL CODE TO
REGULATE THE PLACEMENT OF FACTORY -BUILT HOUSING ON
RESIDENTIAL LOTS IN THE CITY OF DOWNEY
The Ordinance was read by title only. It was moved by Councilman Quinn,
seconded by Councilman Jackman, and passed by the following vote to waive further
reading and to adopt Ordinance No. 668.

ORDINANCE NO. 669
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADDING SECTION 8246.1 TO CHAPTER 2 OF ARTICLE VIII OF
THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTION RELATES
TO SWIMMING POOLS
The Ordinance was read by title only. It was moved by Councilman Quinn,
seconded by Councilman Jackman, and passed by the following vote to waive further
reading and to adopt Ordinance No. 669.

The Ordinance regarding Compact Parking Requirements was removed from the
Agenda. Mr. Goggin mentioned this has been advertised for hearing before the
Planning Commission and will then be referred to the Council for hearing.
ORDINANCE NO. 670
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DOWNEY PROHIBITING THE ISSUANCE OF BUILDING PERMITS FOR
THE CONSTRUCTION OF SINGLE-FAMILY DWELLINGS OR DUPLEX
UNITS HAVING LESS THAN 1000 SQUARE FEET OF FLOOR AREA
The Ordinance was read in its entirety.
For clarification, in Section 1 (a), the second line was amended to read,
"zone and single family dwellings or each unit of a duplex in the R-2 zone."
It was moved by Councilman Jackman, seconded by Councilman Quinn, and passed
by the following vote to adopt urgency Ordinance No. 670, as amended.

ORDINANCE NO. 671
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DOWNEY REQUIRING THAT A PRIVATE GARAGE AS DEFINED IN
SECTION 9104.102 OF THE DOWNEY MUNICIPAL CODE SHALL BE
PROVIDED FOR ALL NEW RESIDENTIAL CONSTRUCTION IN THE R-1
AND R-2'ZONES
The Ordinance was read in its entirety.
Councilman Cormack said the Ordinance does not specify "two -car garages." He
was informed this requirement is contained in Sections 9104.102 and 9150.06.
Councilman Cormack then requested both Sections be referenced in the Ordinance.
It was moved by Councilman Jackman, seconded by Councilman Cormack, and
passed by the following vote to adopt urgency Ordinance No. 671, as amended.

LATING THE SALE OF AEROSOL SPRAY PAINT AND DYE
The Ordinance was read by title only. It was moved by Councilman Quinn,
seconded by Councilman Cormack, and passed by the following vote to waive further
reading and to introduce the Ordinance.
Councilman Jackman questioned how the Ordinance will be enforced.
Mr. Donlevy replied notice will have to get out to the community. Also, this
will be part of the code enforcement program.

AMENDING SECTION 8904, SUBSECTION (b) AND (d), WHICH
SAID SECTION RELATES TO SUBSTANDARD PROPERTIES
The Ordinance was read by title only. It was moved by Councilman Quinn,
seconded by Councilman Cormack, and passed by the following vote to waive further
reading and to introduce the Ordinance (see amendment).
Following discussion, it was moved by Councilman Commack, seconded by
Councilman Quinn, and passed by the following vote to amend the Ordinance to say
"12 inches" instead of "3 inches."

CASH CONTRACTS
It was moved by Councilman Jackman, seconded by Councilman Quinn, and passed
by the following vote to award Cash Contract #480, Citywide Slurry Seal for Fiscal
Year 1981-82, in accordance with the unit prices bid totaling $77,347.60, to Ted R.
Jenkins, the lowest the best bidder (A/C #26-16237, 10-4-5428 10-4-3310, and
10-4-4220).

It was moved by Councilman Jackman, seconded by Councilman Quinn, and passed
by the following vote to waive the minor bid bond irregularity and.award S.S. --
Project #357, Florence Avenue, in accordance with the unit prices bid totaling
$37,117.00, to Vernon Paving Company of Cerritos, the lowest and best bidder
(A/C #26-16239).

MISCELLANEOUS ACTIONS
It was so ordered to remove Downey Community Hospital - Financing for
Expansion from the Agenda pending a full Council (October 27th).
It was moved by Councilman Quinn, seconded by Councilman Jackman, and passed
by the following vote to approve Senior Citizen Trash Refunds to qualified appli-
cants in the amount of $11.70, which is the amount of the current quarterly billing.
It is estimated this would amount to a total of approximately $4700 if the same
number of applicants apply.

STAFF REPORTS: None
ORAL COMMUNICATIONS - City Council
Councilman Cormack expressed concern regarding an RTD park and ride parkin
lot at Fourth Street and Downey Avenue.
Mr. Lang explained staff has reviewed this and learned RTD was not involved.
Approximately two years ago Caltrans signed a lease with the property owner for 12
spaces to be used as a park and carpool situation. The lease has expired, and if
there is any parking, it is on a verbal basis.

Councilman Cormack said there is an article in the Communicator regarding the
park and ride lot. He was informed the article was in error.
