The Flag Salute was led by Councilman Cormack. PRESENTATIONS Mayor Mackaig, assisted by Mr. Henriksen, presented a Registered Civil Engineer Certificate to Alfredo Brillantes. HEARTNr,q Mayor Mackaig opened the hearing on Zone Change Case No. 176, 12415 Woodruff Avenue. He inquired if the Deputy City Clerk had the Proof of Publication, and the response was yes. It was moved by Councilman Swearingen and seconded by Councilman Jackman to receive and file the Proof. There being no one present to speak in favor or in opposition, it was moved by Councilman Swearingen and seconded by Councilman Quinn tc close the hearing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9106.06 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 459, ZONE CHANGE CASE NO. 176) The Ordinance was read by title only. ORDINANCE NO. 661 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3130.1 OF THE DOWNEY MUNICIPAL CODE RELATING TO ONE-WAY STREETS, BY ADDING SUBSECTION (b) (BROOKPARK ROAD) The Ordinance was read by title only. ORDINANCE NO. 662 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY ENACTING A MORATORIUM WHICH PROHIBITS THE DEVELOPING OF MANUFACTURED/FACTORY BUILT HOUSING ON LOTS IN DOWNEY UNTIL STANDARDS REGULATING SUCH DEVELOPMENTS ARE ENACTED The Ordinance was read in its entirety. It was moved by Councilman Jackman, seconded by Councilman Quinn, and passed by unanimous vote to adopt urgency Ordinance No. 662. ORDINANCE NO. 663 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADDING SECTION 29,16 TO THE DOWNEY MUNICIPAL CODE RELATING TO PEACE OFFICER STATUS OF AUXILIARY POLICE OFFICERS The Ordinance was read in its entirety. It was moved by Councilman Jackman, seconded by Councilman Quinn, and passed by unanimous vote to adopt urgency Ordinance No. 663. RESOLUTIONS RESOLUTION NO. 3998 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING ZONE VARIANCE NO. 169 (10225 OLD RIVER SCHOOL ROAD) The Resolution was read by title only. It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed by the following vote to waive further reading and to adopt Resolution No. 3998. AYES: 4 Council Members: Swearingen, Quinn, Cormack, Mackaig NOES: 1 Council Member: Jackman Council Minutes 7/14/81 -3- 6 �4r CASH CONTRACTS: None MISCELLANEOUS ACTIONS It was moved by Councilman Jackman, seconded by Councilman Cormack, and so ordered to set a hearing on zone Change Case No. 177, 12709-19 Lakewood Boulevard, for 7:30 p.m., July 27, 1981, in the Council Chamber of the Downey City Hall. CITY MANAGER'S REPORT: None STAFF REPORTS Refuse Destruction and Conversion to Energy Mr. Ralph stated information has been received from the Los Angeles County Sanitation Districts that they have approached North American Rockwell with possi- bilities of a project. He suggested the Council might want to go on record as to whether or not it is in favor of a project that would convert refuse to energy in the City of Downey on North American Rockwell property. Councilman Cormack said he would be willing to work with the County Sanitation Districts but pointed out Downey is an independent city, not a contract city. Mr. Ralph mentioned the County Sanitation Districts have indicated they would be happy to work with the City in any manner it desired. It was moved by Councilman Cormack, seconded by Councilman Swearingen, and passed by unanimous vote to instruct the Director of Public Works to continue nego- tiations; that the City of Downey seek assistance of the County Sanitation Districts with the City being in charge of the project; and that the Mayor be authorized to send a letter to NASA indicating the City's desires of becoming involved. ORAL COAfMUNICATIONS - City Council Councilman Swearingen referred to a report on the firing range and indicated with Council's approval he would like staff to contact Mr. Engels concerning establishing a range in the City. Mr. Morgan stated staff has contacted Mr. Engels, and it appears the request is for donated park property. Staff will need direction on how to proceed. Councilman Swearingen said this is very necessary for the City, and he made a motion to approve a firing range. Councilman Cormack seconded the motion and moved the motion be amended to in- clude "exploring a program of satisfactory revenue to the City either from Sales Tax or a form of rent --the property cannot be loaned or given away." Councilman Jackman stated his opposit )n to locating a firing range on City or public property. Councilman Cormack suggested a lease arrangement be explored, with the City having a voice on how any building will be constructed. Also, this should develop revenue. The amendment was seconded by Councilman Swearingen and passed by the follow- ing vote: AYES: 4 Council Members: Swearingen, Quinn, Cormack, Mackaig NOES: 1 Council Member: Jackman The original motion as amended was passed by the following vote: AYES: 4 Council Members: Swearingen, Quinn, Cormack, Mackaig NOES: 1 Council Member: Jackman Councilman Swearingen mentioned he is in receipt of a pamphlet from the Small Business Advocate regarding Assembly hearing on SB 325 for easing bad check identity rule. He requested staff write a letter for the Mayor's signature in support of this bill. Councilman Cormack inquired if the City's ordinances are strong enough to keen vehicles from parking on lawns where they can be seen from the street. If the ordinances are not strong enough he would like to move they be strengthened. Council Minutes 7/14/81 -4- Mr. Morgan replied past Councils have also struggled with the problem, and unless something has been done in the last 321 years he would have to say the ordinances are probably not strong enough. He inquired regarding the status of recreational vehicles parking in driveways. Mr. Carter explained in 1978 the ordinance was amended to allow parking of a movable recreational vehicle in the driveway so long as it does not block access to the garage. Mr. Morgan will report back on status of the ordinances as they are today. Councilman Cormack suggested contacting the City's service clubs, particularly the more youthful group4, encouraging them to clean-up a blighted area in the City on a regular basis and that proper recognition be given. The Acting City Manager was requested to contact Dr. Gallegos of the Downey Unified School District and report back. Councilman Swearingen mentioned some of the service clubs that sponsor school organizations. ORAL COMMUNICATIONS - Audience Mr. Charles Jones, 7848 Brookmill Road, requested consideration be given to the size of signs on small businesses on the north side of Florence Avenue east of Paramount. He said it creates a hardship for the businesses, and they have re- ceived a weeks notice to get the signs reduced to size. Mr. Jones stated with the setbacks that exist it is difficult to see any sign. He noted his office is located at 8041 Florence Avenue. Mayor Mackaig explained there is a new Sign Ordinance in effect and Mr. Jones could apply for a variance on his sign. Councilman Swearingen said he has received many telephone calls this past week regarding the signs on Florence Avenue. One of the signs was expensive and now the business is being forced to remove it. Speaking as Chairman of the Library Advisory Board, Mr. Jones requested that in any bond issue proposed, the Library be considered as a much needed improvement or as a new facility. Mr. Morgan stated the architect is working on a sketch diagram of where the Library might be located and a cost estimate. A report will be forthcoming to the Council before the next meeting. Mr. Rodney B. Tibbetts, 8509 Donovan, speaking on behalf of the Optimist Club, inquired if the service. club street signs along City thoroughfares are being removed. Referred to staff for .report.
