The City Council of the City of Downev held a regular meeting at 7:30 p.m.,
September 23, 1980, in the Council Chamber of the Downey City Hall, Mayor

The Invocation was delivered by Councilman Mackaig. The Flag Salute was led
by Councilman Quinn.
Mayor Jackman and Mrs. Ruth Miller presented plaques to Gloria Beer and
Catherine Walker for their service on the Library Advisory Board.
Mayor Jackman and Mr. William Ralph presented plaques to Warren Beer and
Mark Morris for their service on the Water Advisory Board.
HEARINGS
Mayor Jackman explained the hearing on Zone Change Case #163, 11105 Old River
School Road, was held and closed at the meeting on September 9th. Final action
was held over to this meeting.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE ZONING MAP ADOPTED BY SECTION 9106.06 OF
THE DOWNEY MUNICIPAL CODE (ZONE CHANGE CASE NO. 163)
The Ordinance was read by title only. It was moved by Councilman Mackaig and
seconded by Councilman Swearingen to waive further reading.
It was moved by Councilman Cormack and seconded by Councilman Swearingen to
introduce the Ordinance.
Councilman Mackaig commented on zoning of the surrounding properties and said
he does not want to take one single family home out of the middle of other resi-
dences for building an apartment complex. He thinks it would be a tremendous
project to do the entire block, but at this time he recommends turning down the
zone change.
Councilman Quinn agreed but said he would be in agreement if the entire block
was changed.
Mr. Goggin pointed out the property to the south is zoned for commercial use.
Councilman Cormack and Mayor Jackman concurred with approving the Planning
Commission's recommendation for approval.

Mayor Jackman asked if the City Clerk had received any written protests or
objections.
Mr. Shand read a letter from Mr. Emil S. Cox, 7048� Dinwiddie, protesting the
amount assessed to his property for the improvements.
Mr. Henriksen explained Mr. Cox is actually complaining about the difference
between the estimated and actual quantities, but he will only pay for the actual
quantities built. He pointed out that Mr. Cox owns title to land over which there
is a power easement, and since power companies are reluctant to install any improve-
ments, it falls on the title owner of the land to put in the improvements.
Mr. Henriksen then narrated the Engineer's Report outlining the cost to each
property involved. A copy of the Engineer's Report is on file in the office of the
City Clerk.
It was moved by Councilman Swearingen, seconded by Councilman Quinn, and so
ordered to accept the Engineer's Report.
There being no one present to speak in protest, it was moved by Councilman
Swearingen, seconded by Councilman Mackaig, and so ordered to close the hearing.
RESOLUTION NO. 3870
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENTS FOR CHAPTER 27 PROCEEDINGS
FOR DOWNEY IMPROVEMENT PROJECT NO. 705, SITES 1, 2, 3,
4, 5 AND 6, SOUTH SIDE DINWIDDIE STREET BETWEEN RIO HONDO
DRIVE AND RYERSON AVENUE
The Resolution was read by title only. It was moved by Councilman Mackaig and
seconded by Councilman Swearingen to waive further reading.
It was moved by Councilman Swearingen, seconded by Councilman Quinn, and
passed by the following vote to adopt Resolution No. 3870.
During discussion regarding Mr. Cox's property, Mr. Henriksen stated in view
of the fact that the driveway is used only by heavy trucks and the driveway
approach should have been designed as a six inch rather than four inch, the con-
tractor agreed to install a six-inch driveway for the cost of the four inch, which
was a savings to Mr. Cox.

ORAL COMMUNICATIONS - Items not on Agenda
Mr. Edwin H. Wood, 9318 True Avenue, Chairman of the Downey Recall Committee,
questioned the manner in which the City's law suit against Southern California
Edison Company was withdrawn. He distributed to the Council copies of a letter

written by Mayor Pro Tem Mackaig addressed to the Edison Company requesting its
position toward resolution of the matter. He expressed concern over this intru-
sion into a legal matter which was placed in the hands of the City Attorney by a
majority vote of the City Council on October 11, 1977. Mr. Wood stated the letter
was written prior to former Mayor Jennings' request that the law suit against
Edison be dropped. He requested the City Council set the time and place for a
full inquiry into this matter.
Mr. W. E. White of the Norwalk Citizens Action Council cited an incident,
wherein he made a request to see Southeast Animal Control Authority records on
file in the City's Procurement office and was refused access to those records.
Mr. Thompson stated the matter has been corrected and he has already advised
Mr. White that the records would be available to him.
Tape Recordings of Council Meetings and Retention of Tapes
Mr. Shand reviewed his memo dated September 16, 1980, regarding Council Meeting
Minute Tapes, noting the systems used by the following cities:
Inglewood - No tape; has a fulltime Minute Clerk who records and transcribes
minutes.
Santa Monica - Has tape; retains tapes forever.
Pasadena - Has tape; retains for three years.
Torrance - Has tape; retains tapes forever.
Whittier - Has tape; retains tapes two years.
Norwalk - Has tape; retains tapes forever.
Lakewood - Has tape; retains tapes forever.
Huntington Park - Has tape; erases after minutes are approved.
Garden Grove - Has tape; retains tapes for one year.
Anaheim - Previously erased tapes upon approval of Minutes; has recently
adopted resolution repealing erasure method a enacted new policy
whereby tape transcriptions shall be available to the public.
Councilman Cormack raised a question regarding tape retention time for the
cities of Torrance and Whittier.
Mr. Sorensen explained the Government Code provides a public record shall not
be destroyed until after two years and then by resolution of the City Council and
consent of the City Attorney. He has been unable to find any judicial declaration
or determination as to when a tape used for the purpose of assisting the Clerk in
preparing minutes becomes public record. Mr. Sorensen stated it is his opinion
that if tapes are used solely for the purpose of assisting the Clerk in preparing
minutes, and after the minutes are approved those tapes are disposed of, then under
those circumstances the tape would not be public record: However, he does believe
a tape containing a recording of a public hearing should be kept and is public
record. He thinks the longer tapes are kept they would then become public record.
Mr. Ken Miller, 7336 Cleargrove Drive, discussed the change of procedure in
the City of Anaheim regarding destruction and retention of tapes. He said tape re-
cordings are conduct of the people's business and as such are public record that
the public is entitled to listen to.
Mrs. Pauline Hume, 7827 Cole Street, commented on her experience in being able
to listen to the tape of a Council Meeting to review what she felt was the intent
of the Council regarding a matter she had spoken to. She expressed pride in her
City at being able to sit down and listen to the tapes, and she feels the tapes
should be made available to the public and retained.
Marjorie Barning, 10257 Vultee, President of the Downey League of Women Voters,
cited the principals of the League. She asked that the tapes not be destroyed and
that people be given access to those tapes.
Mr. Ken Miller said it is the Anaheim City Attorney's opinion that all public
records, including tape recordings, must be kept for a minimum of two years and
then can be destroyed upon approval of the City Council by resolution and written
consent of the City Attorney.
Mr. David Ray, 7338 Nada, mentioned it has already been stated by the City
Clerk that there is no problem with storing the tapes and the cost factor for re-
trieving the tapes is negligible.
Mayor Jackman asked how many people present would like to see the tapes kept,
and a majority of the audience raised their hands.

Councilman Cormack stated it was the intent in 1962 that the tapes be used to
assist the Clerk in making sure the minutes were accurate and then to re -use the
tapes. Be hopes the Council passes the resolution to qualify what the tapes are
for, use them for what they were intended, and then retain them for possibly 90
days for people to listen to at the convenience of the Clerk's office.
Councilman Quinn mentioned Resolution No. 3359 adopted in 1976 states it is
not the intent for the tapes to be a permanent record.
Councilman Swearingen feels strongly the tapes should not be kept forever, so
the time limit is what the Council should make a decision on.
Mr. Sorensen said tapes of any public hearing or revocation of permit should
be kept for the two-year period prescribed for keeping public records. Those tapes
kept solely for the purpose of assisting the. Clerk in preparing minutes and kept
for an additional 30 days after the minutes are approved, then those tapes can be
destroyed. He feels tapes kept longer then 30 days would fall within the category
of being public record and would need to be kept for two years and then destroyed
after that upon action of the City Council and consent of the City Attorney.
Councilman Mackaig said the tapes have proven the accusations against him are
false, and he will vote for retention of the tapes so that people will know he has
nothing to hide.
Mr. Shand commented on the current practice of tape retention, pointing out
that when tapes get beyond a certain age they become garbled and brittle.
Mayor Jackman indicated in view of the fact that there has not been a problem
of storing the tapes, he feels they should be retained.
Discussion followed.
It was moved by Councilman Cormack, seconded by Councilman Quinn, and passed
by the following vote to either amend the current Resolution or prepare a new
Resolution stating the tapes are a tool to the Clerk and will be retained for only
30 days after approval of the minutes. The City Attorney will prepare the appropri-
ate document for Council consideration. The public will be able to listen to the
tapes at the convenience of the City Clerk.
Councilman Cormack indicated that if one or more members of the Council decide
something is important on a particular tape, they can ask for the tape to be held.
Mr. Sorensen stated this could present a problem of the Council having to act
on each tape.

RESOLUTION NO. 3869

ESTABLISHING A REIMBURSEMENT COMPENSATION FOR THE
COMMUNITY DEVELOPMENT COMMISSION

CASH CONTRACTS
It was moved by Councilman Swearingen, seconded by Councilman Cormack, and
passed by unanimous vote to award Cash Contract #472 (Assessment District #122),
Orizaba Avenue south of Orange Street, in the amount of unit prices for the basic
bid totaling $17,077.78, to Sully Miller Contracting Company, Inc., of Long Beach,
the lowest and best bidder (A/C 440-14438).
It was moved by Councilman Mackaig, seconded by Councilman Swearingen, and
passed by unanimous vote to authorize the transfer of Gas Tax Funds in the amount
of $15,400 from Account #26-16217, Miscellaneous Street Improvements, to Account
#26-16233 for use on Cash Contract 4472 (Assessment District #122), Orizaba Avenue
south of Orange Street (A/C #40-14438).
It was moved by Councilman Swearingen, seconded by Councilman Cormack, and
passed by unanimous vote to award a unit price contract on S.S. Project #353,
Citywide Slurry Seal for Fiscal Year 1980-81, totaling $61,170 to Ted R. Jenkins,
the lowest and best bidder (A/C #26-16229, 10-4-5428, & 10-4-3311).
MISCELLANEOUS ACTIONS
It was moved by Councilman Swearingen, seconded by Councilman Quinn, and
passed by the following vote to approve the Cooperative Agreement between the City
of Paramount, Nationwide Theatres Corp., and the City of Downey for construction
of street improvements under S.S. Project #340 Century Boulevard between Lakewood
Boulevard and Rosecrans Avenue (A/C #26-16210).
Mr. Henriksen explained the City of Paramount City Council has approved the
agreement, and Downey staff is in the process of finalizing plans and specifications

to be brought back the first meeting in October so that the project can go out to
bid. He further explained the right-of-way question at the corner of Century and
Rosecrans was resolved in that the property owner dedicated right-of-way to the
City in exchange for improvements of curb, gutter, and driveway. However, Mr.
Henriksen said, at the Lakewood end of Century, staff is asking for initiation of
Chapter 27 proceedings to install curb, gutter and sidewalk. Discussions have
been held with the property owner in an attempt to resolve problems that will be
created when the curb and gutter level is raised on both sides of the street.
Further negotiations will be held to resolve these problems.

It was moved by Councilman Swearingen, seconded by Councilman Quinn, and
passed by unanimous vote to authorize the Department of Community Development to
initiate Chapter 27 proceedings for the construction of curb, gutter and sidewalk
improvements on the north side of Century Boulevard at Lakewood Boulevard under
S.S. Project #340 (A/C ,".26-16210).
Fire Hydrant Agreement between the City of Downey and Southern California
Water Company
At the request of the City Attorney, the agreement was amended as follows:
On page 4, under item 12, second line, strike the words "to insure that said" and
insert "and use its best efforts to advise whether."
It was moved by Councilman Mackaig, seconded by Councilman Swearingen, and
passed by unanimous vote to approve the Fire Hydrant Agreement.
It was moved by Councilman Swearingen, seconded by Councilman Quinn, and passed
by unanimous vote to authorize the expenditure of $7500 from the appropriated funds
in the 1980-81 Community & Neighborhood Enhancement Budget under Fund 28-4-5640-0120
for the purpose of meeting anticipated expenditures in the coming November 4, 1980,
General Election.
Proposed Ordinance amending the Downey Municipal Code regarding Conditional
Use Permits
Mr. Sorensen advised that following discussions with the Planning Division
concerning the development contract relating to mini -storage, he felt it would be
appropriate to have an ordinance. It will require a hearing before the Planning
Commission and then it will be presented to the Council.
Mr. Goggin said this has already been advertised for the next Planning Commis-
sion meeting.
It was moved by Councilman Cormack, seconded by Councilman Swearingen, and so
ordered to refer the proposed ordinance to the Planning Commission.
It was moved by Councilman Mackaig and so ordered to set a hearing on
Revocation of Police Permit at Jammer's Junction for 7:30 p.m., October 28, 1980,
in the Council Chamber of the Downey City Hall.
CITY MANAGER'S REPORT
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE REIMBURSEMENT OF CERTAIN MINIMUM EXPENSES
INCURRED BY EACH MEMBER OF THE CITY COUNCIL AND REPEALING
ORDINANCE NO. 529
Mr. Thompson said this Ordinance is the result of a survey made of comparable
cities, and a copy of the survey was previously submitted to the Council. The
Ordinance would bring the reimbursement more in line with the survey cities and
raises the Mayor's reimbursement to $162.50, not to exceed two meetings per month,
and the Council's reimbursement to $137.50, not to exceed two meetings per month.

seconded by Councilman Swearingen to waive further reading.
It was moved by Councilman Swearingen, seconded by Councilman Cormack, and
passed by the following vote to introduce the Ordinance.
It was stressed by Mr. Sorensen that under the City Charter, this is not com-
pensation as such, but the Charter provides an Ordinance can be adopted establishing
a fixed reimbursement for expenses.

Mr. Thompson advised that as a follow-up on the Anti -Graffiti Program, staff
has been in touch with a number of other communities regarding their activities;
there is a meeting tomorrow in Lynwood which Councilman Quinn has been advised of;
and staff expects in the next few meetings to bring back a report to the Council.
STAFF REPORTS
Mr. Goggin stated because of time constraints on adoption of the Condominium
Ordinance, he is requesting that when the Planning Commission approves of it that
staff be permitted to immediately advertise it for hearing for the following
Council Meeting. There being no objections, it was so ordered.
Mr. Thompson asked the Council to set a study session regarding HCD requests
concerning the City's housing requirements. He said the City's answer to HUD
should be made by September 30th.
Councilman Mackaig suggested the adjourned meeting scheduled for tomorrow
night, September 24th, regarding the Sign Ordinance be cancelled and incorporated
with the study session on HCD. He said he has submitted to the City Manager a
list of his proposed changes to the Sign Ordinance.
Mayor Jackman requested a copy of the proposed changes.

1980, to be held in either the Council Chamber or the Green Room of the Downey
Community Theatre.

The following appointments were made to the Cable TV Committee:
Councilman Mackaig appointed Mr. Paul Lambrose.
Councilman Swearingen appointed Mr. Dale Hardiman.
Councilman Quinn appointed Mr. Joe Sarabia.
Councilman Cormack appointed Mr. Bruce (Rick) Lively.
Councilman Mackaig commented on the formation of a group called "Victims"
(Voting Initiative Concerning Tougher Imprisonment for Molestors and Sex Offenders)
It was moved by Councilman Mackaig and seconded by Councilman Quinn to autho-
rize preparation of a Resolution in support of Victims.
Councilman Mackaig mentioned he has been requested by the Downey Elks to have
the Council and Mayor sign a Proclamation for Hostage Remembrance Week for the week
of October 26th to November 2nd. A proclamation will be prepared.
Mayor Jackman appointed Mr. Ray E. Lockhart to the Water Facilities Corpora-
tion. So ordered.
Mr. Goggin requested the Council appoint two additional members to the Design
Review Board, inasmuch as they are having difficulty in getting a quorum of three
to attend the meetings. He was requested to bring back names of qualified people
for appointment by the Council.
Mayor Jackman stated 1981 has been declared the Year of the Handicapped, and
he requested the Council to support this as much as possible, noting it would not
be financial support. More information will be provided later as to the support
that would be requested. There were no objections.
Councilman Swearingen submitted the name of Mr. Gene Boutault, of Downey
Savings & Loan, who has indicated a willingness to serve on one of the City's
boards or committees.
Mayor Jackman then appointed Mr. Gene Boutault to the Cable TV Committee

Ms. Vartanian, 8603 Lubec, inquired if a procedure has been established as a
follow-up reminder to the Council to either account for advance travel expenses or
return what was not spent.

Mr. Thompson replied notification would come from the Finance Department, who
keeps records of all expense accounts, allowances, and advances. He mentioned to
his knowledge, there have not been any recent advancements made.
Ms. Vartanian then complimented the Council and thanked Mr. Shand for his
honesty in saying he has never observed anything concerning Councilman Mackaig's
actions at Council Meetings.
Mr. Whittington, 8542 Manatee, referred to the work being done to close the
Police wing in City Hall and asked if consideration has been given to putting in
another drinking fountain and restroom for the public to use during Council Meet-
ings. He was informed that the public will still be able to pass through the Police
Department and use the restroom and drinking fountain in City Hall.
The meeting was then adjourned at 9:50 p.m. to 4:30 p.m., September 29, 1980,
to be held in either the Council Chamber of the Downey City Hall or Green Room of
the Downey Community Theatre.
