CITY COUNCIL/COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF DOWNEY
ADJOURNED REGULAR.MEETING
JULY 16, 1979
The City Council/Community Development Commission of the City of Downey held
an adjourned regular meeting at 5:00 p.m., July 16, 1979, in the Council Chamber
of the Downey City Hall, Mayor/Chairman Kenneth J. Miller presiding.
PRESENT: Council Members/Commissioners:
Theodore H. Jackman Mayor Pro Tem/Vice-Chairman
Lyell W. Swearingen
William L. Greene -

ABSENT: Milton R. Mackaig (arrived at 5:04 p.m.)

COMMUNITY DEVELOPMENT COMMISSION
Chairman Miller recessed the Community Development Commission Meeting and
called the Council Meeting to order at this time.
CITY COUNCIL
Councilman Mackaig arrived at the meeting at 5:04 p.m.
Mr. Jeff Salisbury, President of the Downey Firemen's Association, extended
the Association's request for the Council to consider changing the effective date
of the Association's Memorandum of Understanding from July 9, 1979, to July 1,
1979, which he said occurred through a honest misunderstanding during negotiations
on the MOU.
At 5:06 p.m., Mayor Miller recessed the meeting to executive session to dis-
cuss the Firemen's Association MOU. The meeting resumed at 5:29 p.m, with all
Council Members present.
It was moved by Councilman Greene, seconded by Councilman Jackman, and passed
by the following vote that the effective date of the Firemen's Association MOU be
changed to July 1, 1979.
AYES: 3 Council Members: Jackman, Greene, Miller
NOES: 2 Council Members: Mackaig, Swearingen
Mayor Miller stated it is his understanding the Downey City Employees
Association has agreed to approve the pay package as originally presented.
It was moved by Councilman Jackman, seconded by Councilman Greene, and passed
by the following vote to accept the Downey City Employees Association YOU, as
written. (See Resolution No. 3703 adopted, Page 2.)

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO SECTION
6618 WHICH SAID SECTION RELATES TO AUCTION SALES
Mr. Neavill explained the Downey Theatre Association has two auction pro-
grams scheduled, one in August and one in September. The one in August will be a

Theatre Association sponsored fund raiser, and the auctioneer will turn over a
portion of the proceeds to the Association. The September auction is more commer-
cial and will deal with the auction of antique dolls. The profit from this auction
would be from individuals who have submitted their merchandise on consignment
basis. He said as the new Ordinance now reads, in order for the second auction to
conform to the proposed amendment is that the Downey Theatre Association should be
asked to discuss this with the auctioneer to see if he would pay a rental plus a
small percentage of the gross to the Association or some other local non-profit
organization.
The Ordinance was read by title only. It was moved by Councilman Jackman
and seconded by Councilman Greene to waive further reading.
It was moved by Councilman Jackman, seconded by Councilman Greene, and passed
by the following vote to introduce the Ordinance.
Councilman Mackaig asked if the Council shouldn't be the one to have the
power of suspension rather than the City Manager as stated in Section II.
Mr. Thompson replied the City Manager can suspend and report to the Council,
but the Council will take the final action.

RESOLUTION NO. 3703
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE MEMORANDUM OF UNDERSTANDING WITH THE
DOWNEY CITY EMPLOYEES' ASSOCIATION FOR THE FISCAL YEARS
1979-80 AND 1980-81
The Resolution was read by title only. It was moved by Councilman Jackman
and seconded by Councilman Greene to waive further reading.
It was moved by Councilman Jackman, seconded by Councilman Greene, and passed
by the following vote to adopt Resolution No. 3703.
AYES: 3 Council Members: Jackman, Greene, Miller
NOES: 2 Council Members: Mackaig, Swearingen
Mayor Miller recessed the Council Meeting at this time and called the
Community Development Commission Meeting to order.
COMMUNITY DEVELOPMENT COMMISSION
At 5:42 p.m., Chairman Miller recessed the meeting to executive session to
discuss contractual obligations and possible litigation in regard to redevelopment.
The meeting resumed at 6:45 p.m, with all Commissioners present.
There being no further business to come before the City Council/Community
Development Commission, the meeting was adjourned at 6:45 p.m.
