The City Council of the City of Downey held a regular meeting at 7-30 p.m.,
April 24, 1979, in the Council Chamber of the Downey City Hall, Mayor William L.

by Reverend Edward Ullrich, Moravian Church of Downey.
REORGANIZATION OF CITY COUNCIL AND ELECTION OF MAYOR
Mayor Greene discussed the achievements of the Council during the past year
he has served as Mayor and stated his pride in serving the City, He extended his
thanks to each Council Member for his support and then resigned as Mayor.
It was moved by Councilman Jackman, seconded by Mayor Greene, and passed by
unanimous vote to accept the Resignation of William L. Greene as Mayor,
The City Clerk then declared the office of Mayor open,
It was moved by Councilman Jackman and seconded by Councilman Greene to
nominate Councilman Kenneth J. Miller as Mayor of the City of Downey.
It was then moved by Councilman Jackman and seconded by Councilman Greene
that nominations be closed,

-Mayor Miller thanked each Council Member for the privilege and honor to serve

Councilman Theodore H. Jackman as Mayor Pro Tempore of the City of Downey.

Mr. Spindel explained the primary developer of the Plan is the South Coast
Air Quality Management District, and the plan is a culmination of two years work
with all of the local agencies providing input. The plan was approved by most
local agencies, including SCAG, and he said it is felt it would be a workable
Plan, which would not create too much economic hardship on the area. There is a
hearing scheduled April 26 and 27 to go over some Plan amendments proposed by the
State air Resources Board, which is felt would make the Plan unworkable,
Mr. Thompson also commented on the Plan, which he said would have to be
approved by the State and is mandated as a portion of the Clean Air Act,
Councilman Jackman asked that someone conversant with the problems involved
attend the meeting on the City°s behalf, He suggested, and Councilman Greene
seconded, passing the Resolution and have staff appoint someone to deliver it in
person at the hearing,

VEHICLE FUEL TO IMMEDIATELY POST A SIGN INDICATING THE
PRICE OF EACH GRADE OF SUCH GASOLINE OR FUEL AND PRO-
HIBITING ANY SUCH PERSON FROM ADVERTISING PRODUCTS WHICH
ARE NOT IMMEDIATELY AVAILABLE FOR SALE, DECLARING THE
URGENCY THEREOF, AND THAT THIS ORDINANCE SHALL TAKE
IMMEDIATE EFFECT (EMERGENCY)

Responding to questions, Mr. Goggin explained the requirements for.pole signs.
Mr. Thompson said this Ordinance is similar to the County Ordinance.

Mayor Miller asked if gas stations are exempt from price fixing and who the
Council could appeal this to.
Mr. Sorensen replied gas stations are not exempt and an appeal can be made to
the State Attorney General.
Mayor Miller requested permission of the Council for staff to prepare a letter.
Mr. Thompson suggested sending the letter to Independent Cities and the
League, requesting them to also enter into this matter.

RESOLUTION NO. 3668
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE FARE STRUCTURE FOR THE DOWNEY ELDERLY AND
HANDICAPPED TRANSIT SERVICE
The Resolution was read by title only. It was moved by Councilman Jackman
and seconded by Councilman Mackaig to waive further reading.
Mr. Spindel explained 65 people who ride the bus were interviewed, and 60
indicated they had no objection to the 25$ fare. He pointed out that as a condi-
tion to the grant, it'is necessary to show some fare revenue. He said the fare
is a token charge only and the program would have to be discontinued if the grant
is not received. CETA funds pay for the drivers' salaries,
Councilman Jackman objected to the County Transportation Commission and SCAG
telling the City it has to charge a fare in order to receive the grant.
Mrs. Signe Van Hoeven, 8533 E. Donovan Street, said several years ago a survey
was conducted, and at that time no one objected to paying a fare. She suggested
possibly a waiver could be available in hardship cases.

RESOLUTION NO, 3671
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE APPLICATION FOR GRANT FUNDS UNDER THE
ROBERTI-Z°BERG URBAN OPEN -SPACE AND RECREATION PROGRAM

by the following vote to adopt Resolution No, 3671,
Councilman Swearingen questioned using the funds for lighting basketball
courts at Furman Park and asked if they could be used for another purpose,
Mr. Neavill replied the designated uses of these funds are for expanding or
developing new facilities in highly impacted urban areas, and there are a number
of projects that would qualify, He said this particular project was proposed
several years ago when young people using the park pointed out the existing court
area was inadequate and hazardous. He indicated the lights would also cut down on
vandalism,
Mr. Thompson stated the lights would be used for other type activity played
on the same courts.

CASH CONTRACTS
It was moved by Councilman Greene, seconded by Councilman Swearingen, and
passed by unanimous vote to approve specifications and grant authority to advertise
for bids on S.S. Project #339, Slurry Seal for Fiscal Year 1978-79 (Account
#26-16207 and #10-45428).
It was moved by Councilman Greene, seconded by Councilman Swearingen, and
passed by unanimous vote to appropriate $6500 to Account #26-16211 from Gas Tax
Fund Balance (Fund 26) for use on Cash Contract #435, Unit II, East side Downey
Avenue, Stewart and Gray Road to Cole Street,

MISCELLANEOUS COUNCIL -ACTIONS
It was moved by -Councilman Swearingen and seconded by Councilman Greene to
adopt a revised green fee and cart rental schedule for the Rio Hondo Golf Course
effective May 1, 1979,
Mr, Thompson commented on proposed plans for improvements to the Golf Course
facility, the cost for which could only be offset by some increase in the fec..
Utilization of these funds from the fee, along with funds currently available,
would allow the City to provide additional bonds or notes to pay for the improve-
ments. It is estimated the improvements would generate around $8,000-$9,000 a
yearn and the fees should generate an additional $35,000 annually
Councilman Jackman questioned whether increasing the fee would affect the
amount of play at the Golf Course.
Mr. Thompson responded this would have to be monitored very closely.
Councilman Greene suggested waiting on this until it is known whether the
County is going to raise its fee at the Los Amigos Golf Course,
Councilman Jackman indicated he would be willing to approve the fee for the
period of May and June to see if any play is lost,
Councilman Mackaig concurred,
Mayor Miller said this matter has not been presented to the Recreation &
Community Services Commission.
During discussion, it was noted the Commission meets May lst,
Councilman Greene suggested waiting until it is known what the commission's
recommendation will be,
it was moved by Councilman Jackman, seconded by Councilman Mackaig, and so
ordered to take the revised green fee and cart rental schedule under submission
to the Council Meeting of May 8tha
it was moved by Councilman Mackaig, seconded by Councilman Jackman, and
passed by unanimous vote to approve the revised By -Laws of the Downey Theatre
Foundation, Inc,
It was moved by Councilman Mackaig, seconded by Councilman Greene, and passed
by unanimous vote to approve Carol Stewart and Art McCullough as Acting Directors
June 11, 1979,
It was moved by Councilman Mackaig and seconded by Mayor Miller to approve
the Planning Commission's request for increase in remuneration per meeting from
$15 to $25,
Councilman Jackman stated that if the Commissioners can show the Council
where their expenses exceed $15, he would consider an increase. However, he feels
the Council should review what the other Commissions receive,
Councilman Swearingen indicated he could not vote for this,
Mayor Miller withdrew his second to the motion and requested staff to come
back with a report on what the other Commissions receive and for how long,
Councilman Mackaig stated for the record he made the motion to approve, and
he feels his Commissioner is worth the increase.

Mr, Thompson presented to Council for consideration a Resolution supporting
Senate Bill 522, which would allow a City to have a different Retirement Plan for
new employees after a certain date. This, he said, would in no way effect or
impact current employees or change any current retirement,

It was moved by Councilman Jackman, seconded by Councilman Mackaig, and
passed by unanimous vote to adopt Resolution No, 3672,
Mr, Thompson commented on contacts made with various taxi cab companies in
an attempt to provide the City with Taxi Cab Service since Southeast Taxi ceased
its operation due to illness of the owner. He will bring back further report to
the Council,
Mr, Goggin requested Council direction on Zone Change Case No, 140, 8422
Alameda Street, so that an ordinance can be prepared. He mentioned the Council
approved the applicant's revised request to zone the property Rm2 with a
transitional overlay, but the Planning Commission approved its original
recommendation that the property be zoned Rm2 with a PUD.
During discussion, Mr. Goggin pointed out that with a PUD, the applicant
would have to apply for a variance in order to build what he wants on the property.
Mr. Booker Everett, 10714 Horley Street, requested a decision on this so he
will know what he can do with the property. He voiced no preference for the PUD
or transitional overlay.
It was moved by Councilman Swearingen, seconded by Councilman Mackaig, and
passed by unanimous vote to approve Rm2 zone with a PUD on Zone Change Case No, 140,
ORAL COMMUNICATIONS
At the request of Councilman Mackaig, Mr. Thompson will set up a meeting
between the Planning Commission and City Council,
Councilman Mackaig stated the Chamber of Commerce is having a golf tournament
anquet with dinner at the Rio Hondo Golf Course, He requested the Chamber be
approval of a 15 percent discount for the dinner.
Mr. Neavill commented on the lease agreement with Marmac°s Rio Hondo Food
Service, which provides the City may approve of particular functions where the
lessee must provide 15 percent reduction; but, the lease also provides the lessee
will not pay the City any percentage on that particular function,
Mayor Miller feels if this is approved for the Chamber, it should also be
approved for other groups.
It was moved by Councilman Mackaig and seconded by Councilman Swearingen to
grant the Chamber of Commerce the opportunity of using the Rio Hondo Golf Course
banquet facility at 15 percent reduction on July 13, 1979,
Mayor Miller feels the Chamber should strive to increase its membership,
Councilman Greene suggested it might be easier and better for the City to
give a reduction on the price of green fees rather than the price of food,
Councilman Mackaig concurred,

Councilman Swearingen voiced his objection to the Police Department radar
system of giving tickets. He requested a report from the Police Chief regarding
the number of radar units on patrol in the City and the cost,
Chief Martin will report back next meeting,
Councilman Swearingen asked if it is possible that repair of City streets
could be done one at a time rather than two or three at a time,
Mr. Spindel replied that quite often, more than one street is included in the
same contract,

Mr, Thompson said if a contractor were required to do only one street at a
time it could mean a higher bid for the work because of the higher costs involved.
He said attempts are made to coordinate the work,
Councilman Jackman stated he feels that closure of the intersection of
Brookshire and Imperial for five days is completely out of line,
Mr. Spindel mentioned that if the intersection was left half open and closed,
it would have prolonged the work because of pouring concrete,
Councilman Swearingen requested for the record that the City Manager dili-
gently look into the possibility of setting up a trust fund to collect fire
_ insurance premiums from each property owner in the City of Downey. He feels that
in a short time, the property owners would then be free of paying fire insurance,
Mr. Thompson said this would have to be a plan, whereby the City through its
Fire Department would provide through tax money a fire service, where rather than
paying fire insurancep the property owner would pay into a trust fund which the
City would undertake for insuring against fire loss. The trust fund would be
built to a point where the interest income exceeds the annual fire loss, and then
the fire insurance could be discontinued. Because of the staff time now involved
with budgeting, he will report back to the Council around the middle of June,
Councilman Greene questioned the effectiveness of the Skateboard Ordinance
as it relates to people on roller skates,
Chief Martin suggested perhaps the pedestrian and bicycle program in the
schools should be expanded to include roller skating.
To be presented to the Traffic Committee,
Mayor Miller called for continued effort on the Neighborhood Watch Program
and noted other cities have formed a board to provide ongoing direction. He
requested a staff report back and a recommendation,
Chief Martin mentioned this program was successful in two cities where their
boards were set up as nonprofit corporations in order to be eligible for grant
funds.
There being no further business to come before the City Council, it was then
moved by Councilman Mackaig to adjourn the meeting at 10200 p.m. to 4030 p.m.,
May 7, 1979, in the Council Chamber of the Downey City Hall, for a joint meeting
with the Community Development Commission,
