The City Councilof the City of Downey held a regular meeting, at 7:45 p.m.,
July 11, 1978,, in the. Council Chamber of the Downey City Hall, Mayor William L. Greene

The Invocation was delivered by Councilman Jackman, followed by the Flag Salute led
by Councilman Swearingen.
PRESENTATIONS

Councilman Jackman, on behalf of the City Council, commended Mrs. Betty F.uRa very
highly for many years of public service to the City of Downey, and presented to her a
plaque in appreciation of this service.
HEARINGS
Mayor Greene declared that this is the time and place for the public hearing on
Zone Change Case No. 129, 10,000 Lakewood Boulevard north of Florence Avenue. He in-
quired if the City Clerk had the Affidavit of Publication, and the City Clerk responded
in the affirmative.
Mr. Coggin reported the Zone Change concerns the northerly 200 feet of property
owned by California Federal Savings & Loan Association. The property is presently zoned
PB (Parking), and the request is to zone to C-2. After hearing by the Planning Com-
mission, the Commission recommended the change in zone to C-1 rather than C-2, and if
the Zone Change is granted by the Council, the applicant will be granted all of the uses
permitted under the zone granted. Mr. Coggin commented on the differences in develop-
ment between C-1 and C-2 and pointed out the Commission approved C-1 as more conducive
to the surrounding area. He responded to questions concerning proposed development for
the property and ingress and egress from Lakewood Boulevard.
Mayor Greene inquired if the City Clerk had received any correspondence on this
matter, and the City Clerk replied he had not.
Mayor Greene then inquired if there was anyone present who wished to speak in favor
of the Zone Change.
Mr. Jim Mears, 4050 Metropolitan Drive, Orange, representing California Federal
Savings & Loan, said an agreement has been entered into with a developer to purchase the
property and develop it, with California Federal retaining control over the development
and to get better ingress and egress into the property. The proposed development is a
shopping area._ He said a separation of the median along Lakewood is requested for
ingress and egress to the property and for better circulation.
Mr. Goggin noted the property owner would be required to vacate access rights to
the service road.

Mr. ..Jim Rcundtree, 4770 (,'amous Drive, Newport Beach, stated he has entered into a

study of the area there a demand for small shops, which he said will enhance the
area.

there was anyone present to speak in opposition.
Ms. Vartanian, 8603 Lubec Street recommended the Council postpone its action on.
the Zone Change and analyze the traffic pattern and impact on the area.
Mrs. Findley, 9905 Arrington Avenue opposed a C-2 zoning for the property. She
noted the residents do not want the service road opened to Arrington Avenue.

mous vote to close the hearing.

RESOLUTION NO. 1.92, ZONE CHANGE CASE NO. 129)

seconded by Councilman Jacl=an to waive further reading.
It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by
the following vote to introduce the Ordiance based on the C-1roning.
Mr. Thompson noted the Ordinance states vehicular ingress and egress rights to the
service road shall be vacated.

Mayor Greene declared that this is the time and place for the public hearing on
Zone Change Case No. 130, 7326-38-44-46 Stewart and Gray Road west of Old River
School Road. He inquired if the City Clerk had the Affidavit of Publication, to which
the City Clerk responded in the affirmative.
Mr. Coggin reported the request is to change the present zoning of the property
containing, four lots from R-1-5000 to R-2 in conformance with the City's General Plan.
Mayor Greene inquired if the City Clerk had received any correspondence on this
matter, and the City Clerk replied he had not.
Mayor Greene then inquired if there was anyone present who cashed to speak in
favor of the Zone Change.
Mr. Hugh Lasater, 7604 Fontana Street, representing three people involved for the
Zone Change, said the property contains an older home in very bad condition, and he
feels the Zone Change would help all of the surrounding properties.
There was no one else present wishing to speak in favor of the Zone Change.
There were no speakers in opposition.
It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by
unanimous vote to close the hearing.

ORAL COMMUNICATIONS (Items not on Agenda)
Mrs. Dorothy Rosenthal, 10013 Tristan Drive, inquired regarding enforcement of
the Zoning Ordinance concerning the sign at Standard Brands and upkeep of the property.
Mr. Goggin responded the property will be inspected to see if it is in violation;
also, under the new Zoning Ordinance, the sign would be a non -conforming use, and
there is an abatement period based on valuation. At that time, Standard Brands would
then have to comply with the new code which would be a reduction in size and shape of
the sign.
Ms. Millie Bacalja, 8555 Eleventh Street, speaking on behalf of the Downey Senior
Citizens Recreation Club, asked about the City's refusal to publish the CLub's Newsette
in the future.
Mr. Neavill explained cuts were made in the Budget as a result of Proposition 13,
which included services rendered to the co -sponsored groups and senior citizens. How-
ever, he said if the organizations can provide volunteers to type and run-off the
material, City staff will train these people. He pointed out that most of the organ-
izations have been able to provide volunteers to do the work.
Ms. Bacalja indicated the people are elderly and it would be difficult to find
someone to donate their time.
Mr. Neavill estimated the City's cost for doing the Newsette is approximately
$60-$70 a month.
Ms. Ella Mae Fallon, 10505 Arrington .Avenue, also requested Council consideration
for allowing the City to prepare the Newsette for the senior citizens.
Mrs. Margaret Fillet, 9904 Bir.chdale Avenue, inquired regarding the posting of
street signs prohibiting trucks on certain streets weighing over 8500 pound.
Mr. Spindel replied the posted weight includes the gross weight of a truck and
its load. He pointed out the weight was increased to allow for 3/4-ton pickups with
large campers, and motorhomes.
Mr. Joe Snyder, 8715 Fifth Street, stated other cities have nutrition programs
for senior citizens, and he asked about Downey being included. He noted the nutrition
centers are Federally funded.
Mayor Greene asked staff to look into this and then contact Mr. Snyder.

RELATE TO PERIdIT FEES

It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by
the following vote to introduce the Ordinance.
Mr. Jack Robinson, 8555 Gainford Street, stated he totally supports the concept of
increased fees proposed to make the Building Division self-supporting and to pay for
its functions. He favored the enforcement of ordinances dealing with maintenance of
structures, erection of signs, and illegal parking, a task he said is covered by two
building inspectors; with one about to retire. Mr. Robinson suggested the addition of
a ten percent surcharge on all Building fees and a 'get tough" attitude on ordinance
infractions. He cited a blight condition on the southeast corner of La Reina and
Firestone.
Mr. Stup commented on a comparison made of rates in other cities and noted the
City of Downey is slightly above Los Angeles County and City; however, they are
expected to raise their fees. He feels Downey is in line with its fees.
Mr. Spindel suggested staff review the suggest<.on of a ten percent surcharge and
report back to the Council.
Mayor Greene inquired regarding the fee for a zone variance and the cost to the
Planning Division for the work involved.
Mr. Coggin replied the fee is $25, but the cost to the Planning Division is
approximately $160. He anticipated there will be an average of three=to-four cases at
every Planning Commission meeting.
Mayor Greene said the variance fee should be investigated. ,
Councilman Jackman suggested staff bring back a study of the points raised by
Mr. Robinson.
The Council Members concurred.
Mr. John Dimmick, 9365 Otto Street, agreed with a surcharge and fees to make the
Building Division self-sufficient. He called for more enforcement in the licensing of
contractors.
A discussion was held regarding unlicensed contractors.
Mrs. Katherine Dimmick, 9365 Otto Street, suggested a provision be included to
raise fees concurrently with cost of living increases.
Mr. Sorensen advised that the changing of fees should be done by Ordinance and
feels this provides the Council and community with better control when changing fees

Mr. Spindel discussed the fact that staff has received corrected information con-
cerning the discernible dB dlf`_ercn& al. He said a bulletin of the U.S. Department of
Commerce indicates 3 Q UII is barely distinguishable, whereas 5 dB(A) is noticeable;
also, the effect of landscaping is worthless unless it is 100 feet thick.
Mr. L^onard r'hittingtcn, 8542 Manatee, raised questions regarding the proposed
Ordinance and stated he feels raising the noise level is solely for the benefit of the
Doimey Community Hospital.

.. Mr. Spindel explained that per Council instruction, these Street Lighting District
Resolutions are being presented as a method of raising funds to continue having street
lights. He said the recommended method is abandonment of the existing 1919 Act District
and formation of a new lighting district under the 1972 Lighting Act of the Streets and
-- Highways Code.
Councilman Jackman asked if through Proposition 13 the Ad Valorem Tax is now null
and void.
Mr. Sorensen replied it appears it is, in that under the Jarvis Amendment and
SB 154 it becomes a tax not voted upon by the people. He commented on the difference
between the 1919 Act and 1972 Act and noted he has recommended the 1972 Act because it
has a simpler procedure for establishing a district and spreading the assessments. Mr.
Sorensen noted the Council can levy a benefit assessment, which is a lump sum assessment,
each year, and next year if the Councildecided to finance lighting and maintenance, and
new assessment will be spread and new hearings held, with the Council acting on it at
that time.
Councilman Jackman asked about turning the lights off.

low density of three or less dwel15ng units; Zon•a IT, commercial and industrial; Zone
III, safety lighting; Zone IV, holding zone; Zone V, regional shopping centers, and
Zone VI, high density apartments of four or more. Mr. Spindelsaid this would allow .for
spreading the assessments more equitably.
My. Sorensen mentioned if the Council desires to finance expenses of lighting by
assessment method, the assessments must be confirmed and submitted to the County Auditor
no later. than August 1st, but he did point out that adopting the proposed resolutions
and approving the report would not commit the council to a final action which would levy
an assessment.
Discussion followed
Responding to questions, Mr. Spindel stated the costs for preliminary work done by
staff would be included in the assessment district. He pointed out if safety lights
are to be paid out of the General Fund, he would suggest forming Zone III and placing a
zerc assessment, and if at any future date the Council wishes, it can thenplace an
assessment.

APPROVING THE ENGINEER'S REPORT FOR ASSESSMENT DISTRICT
NO. 121

Councilman Jackman raised questions regarding the Engineer's Report concerning
proposed improvements under the Lighting District and the fee schedule as compared to
the Ad Valorem Tax. -
Mr. Spindel said the amount assessed would be close to what the property owner is
now paying under the Ad Valorem Tax.

unanimous vote to adopt Resolution No. 3574.

INCOME HOUSING NEEDS
The Resolution was read by title only. It was moved by Councilman Jackman and
seconded by Councilman Miller to waive further reading.

unanimous vote to adopt Resolution No. 3578.
CASH CONTRACTS
It was moved by Councilman Miller, seconded by Councilman Jackman, and passed by
unanimous vote to authorize the removal of property from action of Eminent Domain and
approval for acquisition by negotiation on S.S. Project No. 328, Fifth Street Widening,
Downey to Brookshire, Right -of -flay Acquisition 4356 (Account No..26-1-6191).
MISCELLANEOUS COUNCIL ACTIONS
It was moved by Councilman Jackman, seconded by Councilman Swearingen, and passed
by the following vote to approve locations of improvements under the Safer Off -System
(S.O.S.) Program for 1978-79 Fiscal Year (Account No. 26-16196).
Councilman Jackman voiced concern that the City would use grant money to improve
streets Gas Tax money will not pay for and yet insist some people pay for their own
improvement of the streets and then dedicate them.
Mr. Spindel explained that in the past the City has not had funds available to do
this type of construction. He pointed out this is an unusual case.

It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by
the following vote to authorize the Department of Community Development to prepare a
--- petition for the improvement and dedication under Assessment District No. 120, Leeds
Street, East of Paramount Boulevard.
Mr. Spindel. stated Mr. Allensworth, who owns approximately 30 percent of the
property on the street, informed the City's Real Estate Officer he has an agreement
from most of the property owners amounting to about 65 percent. This, he said, is a
Neighborhood Conservation Area, and if the assessment district is formed, some or
possibly all of the engineering could be paid out of the Housing and Community Develop-
ment Funds.

Mr. Shand discussed the City Clerk's Association support of -Assembly Bill 3793
for reducing legal publication of ordinances. He said the Bill has passed through ..
the Assembly, is now in Committee for Local Government in the Senate, and the Bill has
been listed as an urgency "do pass." Mr. Shand stated as soon as the Bill is signed,
it will become law immediately.
Mr. Sorensen, noted this would require a Charter amendment in the City of Downey.
It was moved by Councilman Miller, seconded by Mayor Greene, and so ordered.to
authorize the City Clerk to submit a letter to Senator Campbell that the City Council
continues to endorse this legislation.
It was moved by Councilman Jackman, seconded by Mayor Greene, and passed by unani-
mous vote to appoint Pars. Leona Aldridge to the Health d Environmental Sanitation
Committee.
CITY MANAGER'S REPORT
Mr. Thompson advised he has reviewed all of the applicants for position of Fire
Chief, and he recommends Council confirm the appointment of Mr. Don Davis to the position
of Fire Chief for the City of Downey, effective July 16, 1978.
It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by
unanimous vote to confirm the appointment of Mr. Don Davis as Fire Chief for the City
of Downey.

Cognni.lman Snewringen requested Council approval to have staff review the possi-
bility of reducing by 50 percent the doh; license increase.
Councilman Jackman indicated staff can check the cost of the budget to the City
of Downey for operation of the Authority, as well as the revenue, and place this on the
Agenda of the next Council Fleeting. He also requested staff review whether it would be
a problem to make refunds to those people who have already paid their fees.
No objections to this matter were stated.
Mayor Greene inquired if a response has beenreceived from Supervisor Schabarum to
the City's letter concerning, Consolidation of the Municipal. Courts.
Mr. Thompson replied no.
Mr. Spindel reported on the current status regarding the removal of homes in the
105 Freeway Corridor. He said he received word today that it will be recommended to the
Judge that Mr. Ted Watkins be permitted to acquire all of the 99 homes for removal. It
may take six months to a year to remove these homes.
At 10:35 p.m., the meeting was adjourned to 7:00 p.m., July 18, 1978, in the
Council Chamber of the Downey City Hall. The meeting was also adjourned in memory of
Mrs. Lillian Carr, employee of the City of Downey.

Page 6, third paragraph is changed to read:
Councilman Miller inquired if we continue to pay for Safety Lights out of the
General Fund, would it still be necessary to do what we are going to do in order to
recover the money to provide the electricity for the neighborhoods for street lighting.
Mr. Spindel said formation of Zone III with a zero rate could be done so that
rate could be applied at future date.
