Greene presiding, PRESENT. Council Members. Theodore H. Jackman Kenneth J. Miller Mayor Pro Ten Milton R. Mackaig Lyell W. Swearingen William L. Greene Mayor ALSO PRESENT. Charles W. Thompson, City Manager Royal M. Sorensen, City Attorney Ervin Spindel, Director of Community Development Martin F. Wynne, Director of Finance John T. Neavill, Director of Parks & Recreation Edwin H. Wood, Fire Chief Ruth Miller, City Librarian William A. Goggin, City Planner Howard Stup, Building Official G. Pete Stone, Police Captain Harald J. Henriksen, City Engineer John H. Saunders, Assistant to City Manager James Funk, Principal Planner Robert L. Shand, City Clerk -Treasurer Judy McDonnell, Executive Secretary Mayor Greene opened the joint hearing with the Community Development Commission regarding the Proposed Redevelopment Plan for the Downey Redevelopment Project. He asked the City Clerk if the proper notice had been mailed to property owners. Mr. Shand replied legal publication was made and notices were mailed. Councilman Miller asked about implementing the plan for the next fiscal year. Mr. DeDios of Municipal Services, Inc., replied since Proposition 13 was passed, action by the Council and Commission are not critical at this time, Councilman Miller made comparison between the 105 Freeway project and the Redevelopment Area, wherein people remaining in the Redevelopment Area will realize greater benefit by the improvement. It was moved by Councilman Jackman, seconded by Commissioner Mackaig, and passed by unanimous vote to continue the joint hearing to 7.00 p.m„ July 18, 1978. Mr, Thompson requested if those people present who have concerns will leave their names and addresses at the door, staff will contact them and answer any questions. Mr. James Santangelo asked if the property owners will receive registered notice of the continued hearing. Staff was directed to dispatch notices to all of the property owners involved. Mayor Greene recessed the meeting at 8v05 p.m. to allow the Community Development Commission to continue with its printed agenda. The meeting resumed at 8323 pane with all Council Members present. The Invocation was delivered by Councilman Jackman, followed by the Flag Salute led by Councilman Mackaig. Mr. Neavill presented a plaque to Mrs. Leona Aldridge for her service on the Recreation & Community Services Commission from June 30, 1973, to June 30, 1978. on 1978-79 Municipal Budget and General Revenue Mr. Thompson reported the Budget has gone through many revisions as necessitated by information the City has secured regarding revenues it may receive during the coming year, The Budget originally presented totaled $14,664,040, and with a reduc- tion of $2,915,000 now leaves a revised recommended Budget figure of $12,663,125. He said the fund balance is reduced to approximately $203,000, and the Budget Council Minutes 6/27/78 -1- incorporates liability insurance as well as reinstatement of two ID Technicians in the Police Department and two additional Firemen, which would be provided for by the additional funds expected from the State Assistance Fund for this year, and also in- cludes reinstatement of the street sweeping on a bi-weekly basis, Mayor Greene inquired if there was anyone present who wished to speak regarding the Budget. Mr.. Richard Me Jennings, 7435 Stewart & Gray Road, former Mayor and Councilman, inquired whether the Council intends to close the public hearing and then make changes in the Budget, He was told by the City Manager that the Council would want to hear public input prior to making any Budget Changes. Mr, Jennings also made in- quiries regarding removal of co -sponsored groups from the Budget and said he does not feel the Chamber of Commerce should be left in the Budget if cultural groups are removed He asked about travel for Management and the City's membership in League of California Cities and SCAG. Mr., Thompson replied some travel items have been left in the Budget, and the memberships have not been removed as of this time. Mr,, Frank Perez, 9104 Gainford, indicated there are ten gentlemen who would be willing to help the City Council make Budget cuts,. Mr, Thompson said he would be willing to meet with them at any time, Mr.. James Santangelo, 8426 Dacosta, commented on services provided to the community by the Downey Chamber of Commerce. He said the Budget amount requested would be to repay the Chamber for services expended on behalf of the City, but noted the Chamber is not asking to be "co -sponsored" by the City, Mrs, Mike Hadley, President of the Downey Police Officers' Association, read a portion of Senate Bill 154 concerning funds distributed to Police and Fire programs, He pointed out the Police Department is short three officers and feels it will be difficult for the Department to carry out its projected programs. Mr,, Dick Raabe, 11627 Downey Avenue, said cuts should be made but not for Police, Fire, or co -sponsored groups, Dorothy Levin, 9624 Gainford Street, treasurer and member of Board of Directors of the Downey Museum of Art, requested the City Council give serious consideration to maintaining the fine arts in the City. Mr„ Bob Emirhanian, President of the Board of Directors of Downey Museum of Art, commented on the asset of having a museum in the community and Southeast area. Mr. Santangelo suggested that in regard to the Chamber of Commerce Budget request for $10,,000, the Council might want to consider allocating $7,000-$8,000 and giving the $2,000m$3,000 to the other organizations. Mr., Wendell Wiser, 10921 Paramount Boulevard, suggested the Council follow the mandate of the voters to cut expenses and not raise new funds. He also favored keeping the Downey Community Theatre open until next year. Thelma Sill, 12230 South Horley, complained about the dog license fee of $20 and no fee for cats. Helen Burns, 12720 Parrot Avenue, mentioned she is an animal control volunteer and cited ways the City could raise money rather than increasing dog license fees, Mrs. Waters, 10710 Horley Avenue, also objected to the $20 dog license fee. Mr, Ralph Desimone, consultant to the Downey City Employees' Association, com- mented -the DCEA has a two-year contract with the City which provides for a pay increase July lst, He asked what the City's intention would be with regard to Senate Bill 154. Mr. Sorensen responded the money from Sacramento provides that a City is not entitled to receive funds unless it agrees not to give wage increases in excess of the wage increases provided for State employees, He said a number of questions have been raised as to whether this legislation abrogates a contract between the City and its employees, but he does not know what the total impact of this legisla- tion is. Mr. Desimone said he would appreciate the Council taking an action on this and suggested the Council consider an agreement with the proviso that if Senate Bill 154 is found unconstitutional, the City would mandate moneys back for that purpose and avoid the possibility of a suit, Council Minutes 6/27/78 m2® GS S Councilman Miller suggested possibly employee associations could bring pressure on the legislature to include this in the "clean up bill." There being no one else wishing to speak, it was moved by Councilman Jackman, seconded by Councilman Mackaig, and passed by unanimous vote to close the hearing. It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by unanimous vote to introduce the Ordinance, ORDINANCE N0, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY REPEALING SECTIONS 3300 THROUGH 3332 OF THE DOWNEY MUNICIPAL CODE AND ADDING SECTIONS 3300 THROUGH 3332 AND SECTIONS 3352 THROUGH 3359 ADOPTING THE UNIFORM FIRE CODE, 1976 EDITION OF THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS AND WESTERN FIRE CHIEFS ASSOCIATION AND PROVIDING FOR ADDITIONS, DELETIONS AND AMENDMENTS TO SAID CODE The Ordinance was read by title only, It was moved by Councilman Miller and seconded by Councilman Jackman to waive further reading, it was moved by Councilman Jackman, seconded by Councilman Miller, and passed by the following vote to introduce the Ordinance, Chief Wood explained the ordinance requires automatic sprinkler systems in newly constructed buildings of wood frame construction exceeding 22,000 square feet and in masonry buildings exceeding 50,000 square feet. He said this was inserted in the code because the City will be limited to the manpower it can provide to fight fires and would be a built-in fire protection for the community. He stated there is also a provision for spark arresters on fire places. Councilman Mackaig stated when the Council first began its review of the Budget it was his hope there would be some reduction "at the top," and he can see no reason to add on service charges. Mayor Greene indicated it was his understanding the City has been contemplating this service charge for about a year in view of increasing the City°s water system. RESOLUTION NO. 3569 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING PROCEDURES AND CRITERIA FOR SPECIAL DOG LICENSE FEES FOR SENIOR CITIZENS AND HANDICAPPED PERSONS The Resolution was read by title only. It was moved by Councilman Jackman and seconded by Councilman Miller to waive further reading. It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by the following vote to adopt Resolution No. 3569, Councilman Swearingen said he would like to eliminate the dog license increase altogether, Councilman Mackaig concurred, Mayor Greene stated the Animal Control is not paying its own way, and by in- creasing some of the fees it will become more solvent, Councilman Swearingen indicated the dog license fee is too high and should be reconsidered. Councilman Jackman pointed out that up to now, the City has been taking money out of the General Fund for the Animal Control. Mr. John Dimmick, 9365 Otto Street, commented on the Animal Control operation. Mr. Dick Raabe, 11627 Downey Avenue, suggested the Animal Control cut spending the same as the City is doing. Jackman, Miller, Mackaig, Swearingen, Greene RESOLUTION NO. 3570 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO GRANT A FRANCHISE TO SOHIO TRANSPORTATION COMPANY OF CALIFORNIA The Resolution was read by title only. it was moved by Councilman Jackman and seconded by Mayor Greene to waive further reading. It was moved by Councilman Jackman, seconded by Mayor Greene, and passed by unanimous vote to adopt Resolution No, 3570 It was moved by Councilman Jackman, seconded by Councilman Swearingen, and passed by unanimous vote to accept the Environmental Impact Report for the SOHIO Transportation Company Pipeline. Mr. Sorensen advised that representatives of SOHIO have requested two changes be made in the proposed ordinance, which he would consider to be substantive changes: In Section 2(a), a request to change the wording of "90 days from the date of notice" Council Minutes 6/27/78 -5- to 1190 days from receipt of notice." In Section 2(b), requested change be made to eliminate finding by the Council and leave it as a question of fact to be proven. He said he would recommend these changes not be made, but he is submitting them for information at this time prior to the hearing scheduled for July 2$tho CASH CONTRACTS It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by unanimous vote to reject the bids received on Cash Contract #420 Western Avenue Catch Basin and Connector Pipe (Account #21-13944). It was moved by Councilman Miller, seconded by Councilman Jackman, and passed by unanimous vote to reject the bid received on Cash Contract #411 Parks and Recreation Offices, and grant authority to advertise for bids on a new contract for construction of partitions in the existing building only (Account #21=13937)0 It was moved by Councilman Jackman, seconded by Councilman Swearingen, and passed by unanimous vote to award Cash Contract #429•-A, Miscellaneous Repairs for Fiscal Year 1977-78, in the amount of the unit prices bid, to West Coast Paving Company, the lowest and best bidder (Account #10-4-•5428). It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by unanimous vote to award Cash Contract #SS-331, Inductive Loop Vehicle Detectors, in the amount of the unit prices bid, to Signal Maintenance Inc, of Anaheim, the lowest and best bidder (Account 426-16195). It was moved by Councilman Jackman, seconded by Councilman Miller, and passed by unanimous vote to award Cash Contract #431, Golden Park Activity Lighting, to Martin Electric of Placentia, the lowest and best bidder (Account #21-17120). MISCELLANEOUS COUNCIL ACTIONS It was moved by Councilman Miller, seconded by Councilman Jackman, and passed by unanimous vote to authorize payment to property owner for acquisition of real pro- perty on S,S, Project #328 Fifth Street Widening, Downey Avenue to Brookshire Avenue (Account #26-16191). Recuest of Property Owners for Removal of Magnolia Trees, 7800 Block of Brookmill Road Mr, Spindel explained it is recommended if the trees are to be removed, they should be removed at the expense of the property owner under permit, with new trees planted of a type approved by the City, and the trees can only be removed if the adjacent: property owner is in agreement, Mr. Ed Menager, 7835 Brookmill Road,, commented on the unsightly condition created by the dropping leaves of the Magnolia trees, He said the trees are in the parkway and should be the City°s responsibility. It was moved by Councilman Swearingen that the City remove the Magnolia trees at City expense. Councilman Jackman did not concur with the motion and feels the property owners should pay for removal of the trees and planting new ones, Councilman Mackaig inquired regarding the cost for removal and replanting, Mr„ Spindel replied the average City cost for tree removal is $130, plus $30 to plane: a new 15-gallon tree, Mr, Michael J. Hanna, 7843 Brookmill Road, commented on the unclean condition created by the leaves, Mr. Spindel further stated that in view of the proposed Budget cuts in tree trimming and removal, this might set a precedent, Mr. Menager said all but three property owners have agreed to the tree removal, and the trees are a public nuisance to the property owners on the north side of the street. Mr. Spindel indicated he would be willing to meet with the property owners to discuss this and come to a better understanding, Councilman Jackman asked Mr. Spindel to investigate and see if the property owners would be willing to pay for the tree removal. This matter was taken under submission, Council Minutes 6/27/78 -6- Safer Off --System (S.O.Se) Project Locations 1978--79 Fiscal Year Speaking to the property on the east side of Downey Avenue between Stewart & Gray Road and Cole Street, Mr. Goggin explained Mr. Tibbets, the developer,, has re- quested modification of the required street improvement. The Planning Commission required the developer to do the work at the same time the City makes the improvements under the SOS Project, but if the City is not going to do the work,; then the developer would have relief from this until a future assessment_ district or some other arrangement is made, Mr, Re Bo Tibbets, 8509 Donovan Street, said he does not feel he should be required to pay $4,000m$5,000 for approximately 100 feet of street improvements while the City pays for the rest of the improvements. Mr. Gcggi.n explained the policy of the Planning Commission regarding development of property and the requirement for full street improvements. He said Section 8100 of the Downey Municipal Code also requires full street improvements for any type of development other than R-l� Councilman Miller said he would like to take this under submission so that he can view the location. Mr, Claude Powell, 9235 Stamps Avenue, stated he is the building contractor of the Downey Avenue property, and it is his understanding all he would be required to do is improve the catch basin and corner, but he does not feel he should have to make further improvements, He said he has complied with the other requirements. This matter was taken under submission, Keep Downey Beautiful Program Mr, Spindel explained at a meeting of the Health & Environmental Sanitation Committee a request was made for the City to supply office space at the Heliport site there is no financial support requested from the City. It was moved by Councilman Jackman, seconded by Councilman Swearingen, and passed by unanimous vote to approve the motion of the Citizens Health. & Sanitation Committee to continue with the Keep Downey Beautiful Program, with no budget, It was moved by Councilman Jackman, seconded by Councilman Swearingen, and passed by the following vote the appointment of Mayor Greene as delegate and Mayor Pro Tem Miller as alternate to the SCAG General Assemblk Committee AYES, 3 Council Members, NOES, 1 Council Members ABSTAIN,. 1 Council Member, ORAL COMMUNICATIONS Jackman, Mackaig, Swearingen Greene Miller Councilman Miller commented on riding as an observer in a police vehicle and observing a response to a 415 call, He inquired about charging fines to persons who disturb the peace. Captain Stone replied the City adheres to the Penal Code, and the matter of fines is a Court function. Mr. Thompson explained that some inequities have developed in the Fireworks Ordinance. He said three groups have not been able to find locations for a fire- works stand because of the problem with the C-2 zoning, He stated if the Council will authorize the locations to be allowed this year, staff will bring back an appropriate ordinance. It was moved by Councilman Mackaig, seconded by Councilman Swearingen,, and passed by unanimous vote to allow the three locations for Fireworks Stands, Mr. Thompson commented on a proposalby the County for Consolidation of all Munic�al Courts, which he said would work a considerable hardship on the citizens of Downey and create additional cost. Also, he said a change has been recommended in the allccaticn of fines, which would result in Downey receiving 11 percent in stead of 89 percent of the fines for cases that are brought into Court by the City°s Police Department, Mr, Thompson suggested the Council voice opposition to this and call upon the League and Independent Cities to resist such an action, It was moved by Councilman Mackaig, seconded by Councilman Jackman, and so ordered that staff draft a resolution for transmittal and a letter to be signed by the Council, Council Minutes 6/27/78 -7- Signi VanHoeven, expressed appreciation to the Council for approving the Grant for the Senior Citizen Drop -In -Center. She said the Committee on Aging will be the governing body for the Center and keep an accounting of all moneys raised. At 10:42 p.m., Mayor Greene recessed the meeting to executive session to discuss pending litigation. The meeting resumed at 10:59 p.m. with all Council Members present.
