HomeMy WebLinkAboutMinutes-08-30-77-Adjourned Regular Meeting6037 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADJOURNED REGULAR MEETING AUGUST 30, 1977 The City Council of the City of Downey held an adjourned regular meeting at 6:30 p.m., August 30, 1977, in the Council Chamber of the Downey City Hall, Mayor Richard M. Jennings presiding. PRESENT: Council Members: William L. Greene Mayor Pro Tem Theodore H. Jackman Hazel N. Scotto Richard M. Jennings Mayor ABSENT: Kenneth J. Miller (arrived approximately 7:05 p.m.) ALSO PRESENT: Royal M. Sorensen, City Attorney Ervin Spindel, Director of Community Development John T. Neavill, Director of Parks & Recreation Edwin H. Wood, Fire Chief Terence Middlebrooke, Manager of Revenue Robert L. Shand, City Clerk -Treasurer Mayor Jennings announced the Council is meeting at this time for the purpose of recessing to Executive Session to discuss personnel. The executive session was held from 6:35 p.m. to 7:15 p.m., during which time Councilman Miller arrived at the meet- ing. The meeting resumed with all Council Members present. It was moved by Councilman Greene, seconded by Councilwoman Scotto, and passed by the following vote that the City of Downey enter into negotiations with golf a 44-month October 1, 1977, with a 30-day cancellation clause. It was noted the contract will come back to the Council for approval. ---... AYES: 5 Council Members: Miller, Greene, Jackman, Scotto, Jennings Mayor Jennings then recessed the meeting from 7:18 p.m. to 7:30 p.m. The meet- ing resumed with all Council Members present. The Invocation was delivered by Councilman Greene, followed by the Flag Salute led by Betty Kilpatrick. Par. Sorensen stated that as requested, he has prepared two ordinances: One is establishing a zero tax rate and the other is repealing the Utility users' Tax. He said any change affecting the Utility Users' Tax revenue will require the adoption of an ordinance after a first and second reading --the Council may introduce the ordinance this evening, have the second reading seven days later, and then 30 days following adoption the ordinance will become effective. He responded to questions of Councilman Miller concerning Section 514 of the City Charter and how it would re- late 'to changing the Utility Tax rate. Mr. Sorensen did state concern that setting a tax rate to zero would constitute setting a tax rate, and in that case, he would recommend the Council adopt the ordinance repealing the Utility Users' Tax ordinance. He pointed out that to avoid confusion, the following wording should be added to the beginning of Section 3: "This Ordnance shall take effect 30 days after the date of its adoption, and..." it was moved by Councilman Miller, seconded by Councilwoman Scotto, and passed by unanimous vote that the Council consider introducing the ordinance repealing the Utility Users' Tax. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY REPEALING SECTIONS 6180 THROUGH 6196 OF THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTIONS RELATE TO UTILITY USERS' TAX The Ordinance was read by title only. It was moved by Councilwoman Scotto, seconded by Councilman Miller, and so ordered to waive further reading. It was moved by Councilwoman Scotto, seconded by Councilman Greene, and passed by the following vote to introduce the Ordinance. (See later action beginning on Page 2.) Council Minutes 8/30/77 (adjourned) -1- AYES: 3 Council Members: Miller, Greene, Scotto NOES: 2 Council Members: Jackman, Jennings Property Tax Rate 1977-78 Fiscal Year The Council then discussed an analysis of the General Fund, and the Business License Tax. .It was moved by Councilman Jackman and seconded by Councilman Greene to set the Property Tax Rate for fiscal year 1977-78 at $1.00 and Parks & Recreation at 11C. Mr. Sorensen stated these amounts as indicated should be included in the resolu- tion to be adopted by Council. tax. :Further discussion followed regarding the revenue generated from the proposed RESOLUTION NO. 3451 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SETTING NECESSARY REVENUE FROM PROPERTY TAXES/ ASSESSMENTS FOR FISCAL YEAR 1977-78 The amount of $2,739,135 was established by the Council as the amount of direct revenue from property taxes upon assessable property. That amount was inserted at the end of the fourth line in Section 1. Then, another paragraph was added to Section 1 to read: "That the amount of direct revenue from Property Taxes upon assessable property within the City of Downey necessary to assist in the support of Parks & Recreation for the fiscal year commencing July 1, 1977 is: $281,362 00." The Resolution was read by title only. It was moved by Councilman Greene, seconded by Councilman Jackman, and so ordered to waive further reading. It was moved by Councilman Greene, seconded by Councilman Jackman, and passed by unanimous vote to adopt Resolution No. 3451. RESOLUTION NO. 3452 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING ASSESSMENT RATES OF THE DOWNEY CITY LIGHTING DISTRICT FOR FISCAL YEAR 1977-78 The Resolution was read by title only. It was moved by Councilwoman Scotto, seconded by Councilman Jackman, and so ordered to waive further reading. It was moved by Councilman Miller, seconded by Councilwoman Scotto, and passed by unanimous vote to adopt Resolution No. 3452. RESOLUTION NO. 3453 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING THE GENERAL PROPERTY TAX FOR FISCAL YEAR 1977-78 In Section 1, the amount of $1.00 was inserted on the third line. In Section 2, the amount of llC was added on the third line. The Resolution was read by title only. It was moved by Councilman Greene, seconded by Councilwoman Scotto, and so ordered to waive further reading. It was moved by Councilman Greene, seconded by Councilman Jackman, and passed by unanimous vote to adopt Resolution No. 3453. Mr. Sorensen stated that on the Ordinance pertaining to the Utility Users' Tax, he would request the Council to consider a change in Section 3 to read: "This Ordinance shall take effect and be operative 30 days after the date of its adoption, and the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner required by law." ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY REPEALING SECTIONS 6180 THROUGH 6196 OF THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTIONS RELATE TO UTILITY USERS' TAX The Ordinance was read by title only. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 6240, 6242, 6247, 6248.1, 6250, 6254, 6255, 6256, 6266 AND 6267 OF CHAPTER 2, ARTICLE VII, OF THE DOWNEY MUNICIPAL CODE RELATING TO BUSINESS LICENSING A discussion was held regarding Section 6248.1. The wording in the second para- graph was changed to read: "For four (4) rental units $20.00, and $6.00 per unit for each unit over four in number." Then, as stated in the present ordinance, the following wording will be included in this ordinance as another paragraph under Section 6248.1: "For the purpose of com- puting the fee required to be paid by this section, the provisions of Section 6204 notwithstanding, a person shall include in the measure of the tax the number of units from all businesses licensed by this section engaged in by him within the City, whether at one or more than one location. A rental unit, when owner -occupied, shall not be included in such computation." Further discussion ensued. The Ordinance was read by title only. It was moved by Councilwoman Scotto, seconded by Councilman Miller, and so ordered to waive further reading. It was moved by Councilwoman. Scotto, seconded by Councilman Miller, and passed by the following vote to introduce the Ordinance. AYES: 4 Council Members: Miller, Greene, Scotto, Jennings NOES: 1 Council Member: Jackman Councilman Miller commented on the revenue that will be received from the City's tax rate. Councilwoman Scotto said information concerning the Commuter Computer Program has not been submitted in time for the current issue of the Communicator, and she re- quested a supplemental mailing be made to the residents. She indicated the special mailing has been estimated at approximately $600-$1200. It was moved by Councilwoman Scotto that the Council send a letter to the community containing information regarding the Commuter Computer Program. Councilman Jackman suggested the information be included in the following Communicator. The motion died for lack of a second. It was also suggested this matter be brought back at the next Council Meeting. Mayor Jennings stated the Sister City official visit to the City of Downey is between Christmas and New Years. He requested Council approval to have him discuss with the Rose Float Association and Sister City Committee the possibility of changing the official date of the visit to the first week in December so that the Mayor of Guadalajara can attend and the Guadalajara queen can ride in the Downey parade. Councilman Miller and Councilwoman Scotto consented. However, Councilwoman Scotto pointed out she feels the Sister City Committee should do more of the enter- taining during that time. Mayor Jennings said he will meet with the committees and report back. At 9:28 p.m., it was moved by Councilman Miller and seconded by Councilman Greene to adjourn the meeting. Robert L.
