ADJOURNED REGULAR MEETING
APRIL 18, 1977
The City Council of the City of Downey held an adjourned regular meeting at
5:30 p.m , April 18, 1977, in the Council Chamber of the Downey City Hall, Mayor
Hazel N. Scotto presiding.

Mayor Scotto announced the first item on the Agenda will be consideration
of the Tennis Contract negotiation at Independence Park.
Mr. Thompson gave a brief report on the status of the Tennis Contract
negotiations and referred the matter over to the Director of Parks & Recreation
Mr. Neavill presented a written report consisting of charts as follows:
Pro Shop Sales; Group and Private Lessons; Food Vending Miscellaneous Sales;
Reservations; Projected City Revenues; and a Digest of Reservations Hours
Classified. The charts were broken down to the three bidders: Tennis Today;
Racquet Company; and Bushman's. For comparison, a column consisting of present
contract status was included.
Discussion followed regarding the minimum $5400 cash guarantee quoted by
Bushman's as compared to no proponent's guarantee minimum by Tennis Today and
Racquet Company.
Councilman Jennings commented on a recent matter, wherein the City Council
agreed to give a gift of the taxpayers' money to the pro shop at the Golf Course.
The point in question was relieving a person of contractual obligations. He
then stated as a matter of record that whoever gets the contract for the
Independence Park Tennis facility shall live up to every portion of the contract.
NIr. Thompson reviewed the various elements of the contract, pointing out
that the quotation submitted by Tennis Today would assure the greatest revenue
for the City.
It was moved by Councilman Jennings, seconded by Councilman Greene, and
passed by the following vote to authorize the City Manager to enter into a con-
tractual agreement with Tennis Today based on the figures presented.
Councilman Miller inquired if the bid submitted by Tennis Today is indeed
the same enterprise who held the former contract also known as "Tennis Today."
Mr. Thompson explained the Tennis Today bidder is one individual. The
prior operator of the tennis court known as Tennis Today consisted of two
bidders, one of whom has since left and formed a separate company known as
Racquet Company.
.8. discussion then followed, wherein the net worth of the various bidders on
the Tennis Contract was reviewed.

ABSENT: 1 Council Member: Jackman
Mr. Thompson informed the Council that the Cancer Society has available
volunteer workers who desire to clean up a portion of Apollo Center over the
next two weeks with the intention of moving in. He asked if the Council would
object; to the Cancer Society doing the work prior to finalization of the contract.

Mr. Thompson feels such a move would be advantageous to the City as a means of
minimizing vandalism in the Recreation Center. He commented the Art League is
currently performing a similar program prior to moving into the Apollo
Recreation Center.
Discussion followed regarding proposed occupancy of the Apollo Park
Recreation Center.
'here being no further discussion, the Mayor so ordered that the Cancer
Society volunteer workers be allowed to proceed with their project at the
Apollo Park Recreation Center.
Continued Study on the Comprehensive Zoning Ordinance
Mr. Spindel commenced with Section 9134. On page 190, he recommended
eliminating Sub -section 9134.18 - Drainage, and replacing this section with the
subject "Fireworks Stands." He also recommended adding Sub -section 9134.19 -
On -premise Sale of Liquor" and changing Sub -section 9134.20 - Public Address
System, by inserting a reference to the Noise Ordinance code.
Mr. Spindel indicated Sub -section 9134.24 - Radio Antennas, has been
approved and is being rewritten.
Councilman Jennings said he had requested a chapter on enforcement of radio
antenna regulations and he had a copy with him. He stated he does not recall
what the Council's decision was on radio antennas regarding height and width
dimensions. Councilman Jennings indicated he would like to read the chapter on
radio antennas again prior to its submittal to the Planning Commission.
Mr. Bob Wartenbe said he has seen the radio antenna resort and _pointed out
some corrections.
Mayor Scotto requested Mr. Wartenbe to turn his notations over to the City
Planner.
Sub -section 9134.40 - Standards for Convalescent Hospitals, Homes, and the
like. On page 190k, line 7, delete "Lakewood Boulevard" and insert "to any
street." On page 190h, line 6, insert the words "as amended."
Sub -section 9142.06 - Performance Standards. On line 22, delete the words
"of the following." On line 25, add "health and safety" prior to the word
"welfare."
Sub -section 9142.06(1) - Solid Waste Disposal. On line 3, change to "30
miles per hour" instead of 70."
Sub -sections 9142.06(2), (3), and (4) were eliminated.
Sub -section 9142.06(6) - Vibration. A possible change, reference M-1 and
M-2 regarding ".003 of one inch," might be made.
A discussion was held regarding Sub -section 9142.06(9)(b), radio interference.
Councilman Greene questioned radio and television transmission interference.
A discussion was held regarding obligation as to who should be responsible
for eliminating radio or television interference.
Mr. Thompson commented experience indicates most transmitter operators will
voluntarily place filters in radios or television sets encountering interference
Mr. Wartenbe pointed out the prime obligation lies with manufacturers of
radio or television equipment to have sufficient filtering circuits capable of
blocking interference.
Councilman Jennings suggested the Council consider having a final clean-up
meeting after reviewing the Comprehensive Zoning Ordinance, at which time items
such as radio interference and antenna heights would be included for any final
discussion.
Sub -section 9142.08 - Unsightly Conditions and Neighborhood Protection.
Delete Sub -section (16).
Sub -section 9153.04 - Commission Action. On lines 17 and 18, delete the
words, "being prepared for the City."

Discussion followed regarding Sub -section 9153.08 - Appeal to Commission.
Councilman Greene indicated a preference for word consistency, wherein the
"Commission" would either be defined as "Planning Commission" or some reference
made that this word indeed is the "Planning Commission."
Sub -section 9154.06 - Procedure for Hearings and Appeal Therefrom. In Sub-
section (2)(a), lines 17 and 18, delete words "and two additional signs within
500 feet of the parcel being advertised."
Discussion followed regarding possible errors that might exist in this
Sub -section. A question existed regarding the posting of notice on property
under discussion. The entire paragraph to be reviewed and referred to the City
Attorney for checking.
Sub -section 9160.06 - Application (for Conditional Use Permits). In Sub-
section (5), delete on lines 6 and 7, "but not limited to market studies, design
studies, engineering studies, and."
Referring back to Sub -section 9158.08 - Application (for Variances), in
Sub -section (5), on lines 23 and 24, delete "but not limited to market studies,
design studies, engineering studies, and."
Sub -section 9160.24 - Voiding of Conditional Use Permits. In Sub -section
(3) the wording was changed to read: "The periods of time set forth in (1) and
(2) have been extended by the Commission upon written request by the applicant
showing cause why said extension is necessary. In no case shall the extension
exceed one year."
Sub -section 9164.06 - Application. In Sub -section (5) delete words
"including but not limited to market studies, design studies, engineering studies,
etc."
Sub -section 9104.110 - Grade, finished, was changed to read, "Means the
completed paved or graded elevation of a lot."
--- Sub -section 9136.16, Lot Fill. On line 26, delete the words "finished grade"
and substitute the words "curb line."
Sub -section 9136.18 - Lot Grading, was deleted.
Sub -section 9136.32 - Street Right -of -Way Dedication and Improvement. On
line 25, "and structural sections of the streets" should be changed to "and cross
sections of the streets." Line 1 on page 195: The words "and plans" should be
deleted." Page 195, line 3: "City Planning Division" should be changed to
"Department of Community Development."
This concluded the study session of the Comprehensive Zoning Ordinance.
The Council decided to include the "clean-up meetine'at a regular meeting
in the near future.
Councilman Jennings expressed a wish that the final report for the clean-up
meeting be submitted to the Council Members in advance.
Councilman Greene addressed the Council Members regarding the Health Syste:
Agency for Los Angeles County and the Sub -Area Council Criteria Committee. He
said the enrollment period for citizens within the first Supervisorial District
has been extended for fifteen days.
Mr. Thompson said he has been in contact with Mr. Allen Korneff, Downey
Community Hospital Administrator, regarding the developments on the Sub -Area
Council Criteria Committee. He explained the structure regarding candidates for
various slots to be filled by election in the program. Mr. Thompson then called
upon Mr. Spindel to review notes taken at the Health & Sanitation meeting held
during the noon hour on April 18th.
Mr. Spindel's report included the demographic profile of the subject
committee and Los Angeles County. Eighteen thousand persons have registered in
the five sub -areas of which 4400 are from Sub -Area One (Downey). The report
explained the election procedures for membership on the Criteria Committee and
the free time expected to be served by the committee members. Mrs. Gloria Heer
was named as a possible committee candidate. It is the concensus of the Health &
Environmental Sanitation Committee that direction on this subject is needed from
the City Council.

Councilman Greene commented on the thorough organization of the Sub -Area
Council group.
Discussion followed, wherein it was suggested the Health & Environmental
Sanitation Committee should pursue the questions of the Criteria Committee by
keeping in touch with the Downey Community Hospital.
Mr. Thompson said he told Mr. Korneff the City will await word from his
office about the Criteria Committee.
Mr. Robert Wartenbe personally thanked the City Council for its attention
regarding the Comprehensive Zoning Ordinance, antenna sub -section, et al.
Mayor Scotto thanked the RACES group for the work they have devoted toward
eliminating the radio interference in the Council Chamber public address system.
There being no further business to come before the City Council, the meeting
was adjourned at 7:58 p.m.
