OF THE CITY OF DOWNEY
NOVEMBER 9, 1976
The City Council of the City of Downey held a regular meeting at 7:30 p.m., November
9, 1976, in the Council Chambers of the Downey City Hall, Mayor Hazel N. Scotto presiding.

Rev. Jeff Johnson, Calvary Chapel, led the Flag Salute and delivered the Invocation.
Mrs Ellen Peterson,President of the Downey Historical Society, distributed a Bicen-
tennial Guide to Historic Sites in the City of Downey and said the Rives home is the last
structure in the City that would be eligible to be placed on the National Historical
Registry. She stated it is hoped space at the Rives Avenue School will be allotted for
exhibiting historical artifacts.
With the assistance of Fire Chief Wood, Mayor Scotto presented a proclamation to
Captain Gharst of the United States Marine Corps, proclaiming November 9 through Decem-
ber 20, 1976 as the Toys for Tots Program in the City of Downey.
Mayor Scotto declared that this is the time and place for the public hearing on
Downey Improvement Project #687, Site 1, North Side of Orange Street between Glynn Avenue
and Dolan Avenue. She inquired if the City Clerk had the Affidavit of Posting and Mail-
ing, to which the City Clerk responded in the affirmative.
It was moved by Councilman Jennings, seconded by Councilman Greene, and so ordered
to receive and file the Affidavit.
Mayor Scotto inquired if the City Clerk had received any written protests or objec-
tions, and the City Clerk replied he had not.
Mr. Spindel reported on the costs for improvements as follows:
Site 1 - 12268 Glynn Avenue
Total Cash Assessment $110.60
Interest, 1-year Assessment 6.91
Release of Lien Fee 6.00
Total Amount to be Collected $123.51
It was moved by Councilman Jennings, seconded by Councilman Greene, and so ordered
to receive and file the Engineer's Report.
Mayor Scotto inquired if there was anyone present who wished to speak in protest to
the improvements, and there was no response.
It was moved by Councilman Jennings, seconded by Councilman Jackman, and so ordered
to close the hearing.
RESOLUTION NO. 3347
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR CHAPTER 27 PROCEEDINGS
FOR DOWNEY IMPROVEMENT PROJECT NO. 687, SITE 1, NORTH
SIDE OF ORANGE STREET BETWEEN GLYNN AVENUE AND DOLAN AVENUE.

onded by Councilman Jackman, and so ordered to waive further reading.

unanimous vote to adopt Resolution No. 3347.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE

Mayor Scotto declared that this is the time and place for the public hearing on

Alameda Street to Single Residential. She inquired if the City

affirmative.
It was moved by Councilman Jennings, seconded by Councilman Greene, and so ordered
to receive and file the Affidavit.
Mr. Goggin reported on the current zoning of the property of C-3 and "P", and
stated in reviewing this matter with regard to a zone change for residential develop-
ment, a negative declaration has been developed. He said the Planning Commission,
after its public hearing, has recommended the amendment be made to the General Plan
which would make this property an R-1 zone.
Mayor Scotto inquired if the City Clerk had received any correspondence on this
matter, and the City Clerk replied he had not.
Mayor Scotto inquired if there was anyone present who wished to speak in favor of
the Proposed Amendment to Comprehensive General Plan, and there was no response. She
inquired if there was anyone present who wished to speak in opposition, and there was
no response.
It was moved by Councilman Jennings, seconded by Councilman Greene, and so ordered
to close the public hearing.

Mr. Sorensen outlined the procedure to be followed before the property can be re-
zoned and said City Council consideration at this time is not for a specific develop-
ment or plan but is to determine the use of this property.
Discussion followed.
RESOLUTION NO. 3349
A RESOLUTION OF THE DOWNEY CITY COUNCIL AMENDING THE
GENERAL. PLAN OF LAND USE FROM GENERAL COMMERCIAL AND
BUFFER TO R1 SINGLE FAMILY RESIDENTIAL LAND USE FOR
THE PROPERTY LOCATED AT THE SOUTHWEST CORNER OF
LAKEWOOD BOULEVARD AND ALAMEDA STREET.
GENERAL PLAN AMENDMENT NO. 1

onded by Councilman Jackman, and so ordered to waive further reading.

by unanimous vote to adopt Resolution No. 3349.
Mayor Scotto declared that this is the time and place for the public hearing on
Dsed Zone Change Case No. 124 from Unlimited Commercial and Automotive Parking to
Le Family Residence. She inquired if the City Clerk had the Affidavit of Publica-
, to which the City Clerk responded in the affirmative.
It was moved by Councilman Jennings, seconded by Councilman Greene, and so ordered
to receive and file the Affidavit.
Mr. Goggin reported the request is to change the C-3 and "P" zoning of the property
to R-1. He commented on the concerns stated at the Planning Commission hearing and
pointed out it is hoped the subdivider of this property and the adjacent property owner
can work out a solution to correct the existing wall between the properties, which is
three feet inside the adjacent property line.
Councilman Jennings referred to the small portion of this property zoned R-3 and
asked why this is not being changed.
Mr. Goggin replied there was no request to do so.
Mr. Sorensen advised that to rezone the R-3 portion to R-1 would require a re-
processing of the entire matter before the Planning Commission and re -hearings before
the City Council on both the General Plan and Zone Change.
Mr. Goggin pointed out that the R-3 portion of the property is developed single
family and does not interfere with the integrity of the neighborhood. He suggested
this might be included at the time the Zoning Ordinance is adopted.
Mayor Scotto inquired if the City Clerk had received any correspondence on this
matter, and the City Clerk replied he had not.
Mayor Scotto inquired if there was anyone present who wished to speak in favor of
Zone Change Case No. 124, and there was no response. She inquired if there was anyone
present who wished to speak in opposition, and there was no response.

RESOLUTION NO. 3350
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE DIRECTOR OF PUBLIC WORKS TO MAKE A REPORT
PURSUANT TO THE STREET LIGHTING ACT OF 1919(ANNEXATIONS
76/39 THROUGH 76/41 AND 76/44 THROUGH 76/52).

by Councilman Jackman, and so ordered to waive further reading.

Mr. Spindel reported these street lights are required in conjunction with either
subdivisions, zone changes, or Section 8100 cases, and the current year's tax rate per
$100 assessed valuation for Zone I, 12c; for Zone II, 28c. The installation cost will
be borne by the developer.
It was moved by Councilman Jennings, seconded by Councilman Greene, and so ordered
to receive and file the Engineer's Report as written.
RESOLUTION NO. 3351
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS
INTENTION TO ANNEX CERTAIN AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND
TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON

RESOLUTION NO. 3352
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING A REDUCTION OF PARKING SPACES (8339
FIRESTONE BOULEVARD)
The Resolution was read by title only.
Mr. Spindel responded to questions regarding assessment districts, the factors
used to determine the assessments levied, and the $2500 fee to cover each parking space
- which has been waived in the downtown parking district. He said the Council waived the
fee at its last meeting.
It was moved by Councilman Greene, seconded by Mayor Scotto, and so ordered to
waive further reading.

unanimous vote to adopt Resolution No. 3352.
RESOLUTION NO. 3353
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY URGING CLASSIFICATION OF
TRANSIT WORKERS AS PUBLIC EMPLOYEES AND
SUPPORTING OPEN LABOR NEGOTIATIONS FOR
TRANSIT DISTRICTS.

onded by Councilman Miller, and so ordered to waive further reading.

unanimous vote to adopt Resolution No. 3353.
It was moved by Councilman Jennings, seconded by Councilman Greene, and passed by
unanimous vote to approve a request for Right -of -Way Exchange for Sidewalk Improve-
ments at 8443-44-49 Everest Street.
It was moved by Councilman Jennings, seconded by Councilman Greene, and passed by
unanimous vote to accept the repair and re -roofing work completed in conjunction with
Cash Contract No. 397, City Hall Roof Repairs.
It was moved by Councilman Jennings, seconded by Councilman Greene, and passed by
unanimous vote to approve the County -City Agreement for Burglary Investigator Services.
It was moved by Councilman Jennings, seconded by Councilman Greene, and passed by
unanimous vote to approve Renewal of Southeast Council on Alcoholism and Drug Problems,
Inc., Lease on Old Headquarters Fire Station.
It was moved by Councilman Jennings, seconded by Councilman Greene, and passed by
unanimous vote to set a hearing on Appeal, Zone Exception Case No. 1302, 8560 Albia
Street, for 7:30 p.m., November 23, 1976, in the Council Chambers of the Downey City
Hall.
It was moved by Councilman Jennings, seconded by Councilman Greene, and passed by
the following vote to approve recommendation of staff and Recreation and Community
Services Commission for the Downey Symphonic Society to hold a substitute concert in
the Dorothy Chandler Pavilion on March 20, 1977, which is deemed to be one of the six
performances provided for in the agreement.
Mr. H. Lee Trafford, 11017 Paramount Boulevard, President of the Downey Symphonic
Society Board of Directors, addressed the City Council regarding the proposed concert
at the Dorothy Chandler Pavilion and the proposed agreement between the Downey Symphonic
Society and the City of Downey for fiscal year 1976-77.
Mr. Neavill mentioned this agreement is not scheduled to appear before the City
Council until all of the co -sponsored groups' board of directors have reviewed their
agreements and made any suggested modifications.
Mr. Trafford said the proposed agreement calls for six concerts a year in the
Downey Theatre, and the Downey Symphonic Society would like to substitute one of those
performances for the 1976-77 year at the Music Center. He stated the Downey Symphonic
Society would like to have an agreement calling for six performances a year, but would

like "back-to-back" performances included in the six.

It was moved by Councilman Jennings, seconded by Councilman Greene, and passed by
unanimous vote to authorize advertising for bids for Sale of Building to be Moved,
8401-13 Firestone Boulevard A4212 A and B.
Parking Lot No. L3 between Second and Third Streets East of Downey Avenue.
Councilman Greene asked if a prior Council had made any obligation to purchase this
property.
Mr. Thompson replied that at the time the Council authorized the purchase of one
lot there was discussion indicating when the other lot became available it would be
considered.
Responding to questions, Mr. Spindel explained a staff appraisal was made on this
property in 1974 for $21,000, which was based on a comparison of six other lots purchased
by the City, but the appraisal did not take into account the existing easement.
Councilman Greene said he would like to have a 1976 appraisal.
Councilman Miller suggested that perhaps the permit parking should be transferred
to the westerly half of the lot, with the easterly portion owned by the Church being
available for public parking, which would save the City a considerable amount of money
over a period of years.
A discussion was held regarding lease arrangements on the Stamps and Stecklein
properties.
Mr. Spindel said the cost for taxes and maintenance per year on the easterly one-half
is $1500.
Councilman Jackman said this matter should be taken under submission until the exact
amounts are known and a new appraisal made.
It was noted the easement is for ingress and egress to the back of the lot.
Mr. Spindel stated the City°s new Right -of -Way Officer is qualified to make an
appraisal on the property.
Councilman Miller asked staff to find out what the legal ramifications would be if
the easterly portion of the lot were used for public parking and moving the permit park-
ing on the west side.

Mayor Scotto said she feels there is a need for a technical advisory committee, and
Councilman Jennings will be exploring this.
It was moved by Councilman Jennings, seconded by Councilman Greene, and passed by
unanimous vote to approve the Agreement and authorize the Mayor to sign.
CITY MANAGER'S REPORT
Mr. Thompson reported that additional information has been submitted as requested
on the Section 8 Rental Assistance Program, and after checking this information from
experience in other cities, no problems could be found. Regarding the possibility of
costs if the City were to administer the program in staff, he said it is felt the size
of the program would not justify it. Mr. Thompson pointed out that the program would
provide a housing remedy to the handicapped and elderly who would not otherwise have
that opportunity in Downey, and he recommended approval.
It was noted that ten -to -fifteen people have called regarding the program, 99 percent
of which were senior citizens.
Councilman Jackman asked for information on the people who have called and said
this could be very urgent to them.
Mr. Thompson stated the calls were received by Mr. John Saunders of the Administra-
tion Department.
Following discussion, the matter was taken under submission for further report.

ORAL COMMUNICATION
Mr. Spindel informed the Council that at the Western regional office in Seattle a
total amounting to $32 billion was received in applications for funds under the Public
Works Act.
Speaking to the City°s 20th Anniversary Program, Mr. Thompson advised that the
Second Century Foundation has voted to support the program and has allocated funds to
cover many of the costs.
A discussion was held regarding changing the December date to sometime in January.
Mr. Neavill stated the Theatre is available the evenings of January 27th and 28th,1977.
Councilman Jennings suggested that the program be named something other than the
City°s birthday program because it will not be held until a month Later than the actual
date.
Mayor Scotto also asked that an open house be considered.
The date of Friday, January 28, 1977, in the Downey Theatre, was set for the City°s
20th anniversary celebration.
Chief Morgan announced that on November 10th, at 1:00 p.m. in the Downey Theatre,
the Police Department will conduct a program on crimes directed at senior citizens. He
invited the City Council and citizens to attend.
Councilman Jackman asked the City Planner for sign information prior to the hearing
on the Comprehensive Zoning Ordinance.
Councilman Jackman also requested information on all travel expenses since July 1,
1976, and where it is allocated in the budget.
Mayor Scotto indicated her willingness to serve on the Los Angeles County Trans-
portation Commission, which is voted on by the City Selection Committee of the League of
California Cities.
Councilman Miller said he would heartily support Mayor Scotto`s appointment to that
commission.
The City Manager was asked to draft a letter.
Councilman Miller commented that Resolution No. 3087 provides that tape recordings
of Council Meetings are not required to be retained for more than a year. He said this
should be amended and the tapes kept for as long as they are serviceable. He referenced
the recent Police Department suit against the City which was dropped because of further
evidence produced through listening to a tape recording of a Council Meeting. Also,
Councilman Miller said, it would be helpful for a Council Member to be able to go back
and listen to the reasons a previous Council arrived at a conclusion.
There being no objections, the City Clerk was directed to prepare a new resolution.
Councilman Miller asked how the costs for Xerox copies of documents are being used
Mr. Shand stated the charge is $1.00 for the first sheet and 50c for each additional
sheet, which is the fee for constituents coming into City Hall and requesting copies of
documents.
Councilman Miller questioned the amount of time necessary to make the copies and
suggested that the copies could be made on one trip to the Xerox. He noted the fee for
Xerox copies of microfilmed documents in the Building and Safety Division is $2.00.
This matter was referred to the City Clerk to bring back suggestions on Xerox costs
including costs for microfilm copies in the Building and Safety Division.
Councilman Miller reported on a call from a constituent regarding obnoxious fumes
originating in the City of Santa Fe Springs.
It was moved by Councilman Miller, seconded by Councilman Greene, and so ordered
that the City Manager investigate and report back concerning the action of the Air Pollu-
tion Control District, who is the offender, and what can be done to alleviate the situation.
Chief Morgan advised that the company involved was cited by the APCD.
Mr. Thompson explained he will be submitting a skateboard ordinance.

A discussion was held regarding the hearing on the Comprehensive Zoning Ordinance.
Mr. Goggin suggested that those people wishing to speak should sign cards and indi-
cate whether they are representing themselves, groups, or organizations. He further
suggested the organizations be allowed to speak first and also a time limit can be
established.
Councilman Jennings indicated the Mayor and City Planner should meet to establish
the ground rules for the hearing.
Mayor Scotto asked the City Planner to prepare the cards for the hearing.
It was noted that Mr. Carl Newton of the City Attorney's office will be present at
the joint meeting with the Planning Commission.
Councilman Jennings stated the City Council was elected directly by the people to
act as their representatives, and he noted the citizens of Downey voted overwhelmingly
in favor of Bingo for Charity in the June election. Therefore, he said, if the Council
is going to carry out the wishes of the people, it should require the City Manager to
bring back a draft of an ordinance permitting bingo for charity in the City, and he
requested that the Police Chief be involved in the writing of the ordinance to be sure
it is workable and enforceable.
Chief Morgan indicated his opposition is not so much against bingo as it is the way
the law is written.
Mr. Sorensen advised that in preparing an ordinance, there are certain restrictions
placed upon it by the law, and in the way the bingo ordinances are drafted, there is not
much opportunity for variation. He said he will prepare an ordinance which he feels
complies with the State law.
Councilman Jackman asked how many requests have been received from charitable organi-
zations for bingo in the City of Downey.
Mr. Thompson said he has received several inquiries from people wanting to know if
the Council is going to adopt an ordinance.
Councilman Jackman and Mayor Scotto indicated they are not in favor of such an
ordinance.
Following discussion, it was moved by Councilman Jackman, seconded by Councilman
Miller, and passed by the following vote to request the City Attorney to bring back a
sample ordinance for the Council's perusal.

Councilman Jennings mentioned four new street lights have been installed along the
south side of Stewart and Gray Road east of Old River School Road which have not been
energized. He questioned whether the people are paying taxes for the lights and said if
the lights are not going to be energized they should be removed from the tax roll and
the people repaid.
Mr. Spindel replied he will look into this.
Mayor Scotto asked if the Council would object to receiving a report on the cost of
equipping the Senior Citizen Mini -buses with radios or walkie-talkies so that the buses
would be able to accommodate more riders.
Chief Wood advised that the Fire Department might be able to provide an old single
frequency radio at a much lower cost and he will check on this tomorrow.
Mayor Scotto inquired about the City's membership in the National Municipal League.
Mr. Thompson stated the City has been a member since he has been with the City; the
National Civic Review is the League's basic publication and is received by the City.
Mayor Scotto also inquired if the City will be having Community Development hearings
Mr. Thompson replied yes, for an update on the plan.
Mayor Scotto indicated she is in favor of meeting with all of the Boards and Commissions
and. asked for the Council's opinion on this.
Councilman Greene concurred but suggested waiting until after the hearing on the Com-
prehensive Zoning Ordinance.

Mr. William B. Cole, General Manager of the Downey Chamber of Commerce, stated the
Special Events Committee of the Chamber desires to sponsor a Holiday Festival Block Party
on Wednesday, December 15th, on Downey Avenue between Second and Third Streets from
5:00 p.m. to 8:00 p.m. He said the proposed block party would stimulate retail activity
in the Central Business District during the Holiday season and he commented that the
various activities include a limited beverage service. In conclusion, Mr. Cole noted
the Chamber of Commerce agrees to comply with reasonable conditions which might be
imposed.
Councilman Jackman pointed out that restrictions for street closures would elimi-
ate any alcoholic beverages.
Chief Morgan explained that it would take a number of traffic personnel to re-route
traffic for the period of three hours.
Mr. Cole suggested that in lieu of Downey Avenue,the possibility of New Street
between Second Street and Firestone Boulevard.
Mr. Sorensen said the Chamber should take out a policy that would carry a rider for
the City.
Councilman Jennings stated in the Council's consideration of this matter it should
also weigh the costs against the ever diminishing tax rates from the businesses along
Downey Avenue, and if this would be of benefit, then the cost should be considered in
that events of this type would increase the tax revenue from those businesses and also
prevent further blight in that area.
It was suggested that representatives of the Chamber of Commerce meet with the City
Manager on this prior to making a decision.
Responding to Councilman Miller's inquiry regarding the status of the committee
studying the Utility Users Tax, Mr. Thompson explained that tomorrow morning he is meet-
ing with the head of the Tax Institute from U.S.C. to go over the program. He invited
Councilman Miller to attend.'
Councilman Jennings commented on the money spent on a study of the new Civic Center
and said he thinks there should be a committee working and studying this continually.
Mayor Scotto advised she contacted Dr. Gallegos regarding a joint meeting with the
School Board but has not received a response; also, the School Board should be receiving
its annual Facilities Report around the middle of November.
There being no further business to come before the City Council, at 10:35 p.m, the
meeting was adjourned to 5:00 p.m., November 10, 1976, in the Green Room of the Downey
Theatre (for a joint meeting with the Planning Commission).
