Young, Messiah Lutheran Church, followed by the Flag Salute led by appointed Councilman William L. Greene. The City Clerk administered the Oath of Office to William L. Greene as Councilman for District 3. Newly appointed Councilman Greene was seated with the Council body at this time. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 8200, 8202, 8204, 8205, 8207, 8209, � 8210, 8211, 8218, 8219'1220, 8222, 8223, 8224, 8228, 8229, 8230, 8238, 8239, 8243 & 8248 OF THE DOWNEY MUNICIPAL CODE, REPEALING SECTION 8240, ADDING SECTIONS 8202.1, 8214.1, 8214.2, 8215.1, 8217.1, 8217.2, 8221.1, 8221.2, 8241.1, 8243.1, 8250, AND 8251 AND ADOPTING BY REFERENCE THE 1973 UNIFORM BUILDING CODE The Ordinance was read by title only. It was moved by Councilman Jennings, seconded by Councilwoman Scotto, and passed by the following vote to introduce the Ordinance with the change (eliminating the last paragraph in Section 8221.2, as stated in the memorandum of August 25, 1975). Council Minutes 8/26/75 -1- P 5Z216 Community Development Director Spindel pointed out this section was removed at the request of the Police Department and Fire Department for further study, and if found to be worthwhile it will be brought back at a later date. AYES: 4 Council Members: Scotto, Jennings, Greene, DiLoreto ABSENT: 1 Council Member: Winton Mayor DiLoreto noted that both items concerning inspection of residential property and commercial property and the fee charges connected therewith have been removed from this Ordinance. ORDINANCE NO. 491 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 4201.3, 4201.4, 4230, 4231, 4232(b), 4236, 4239, 4246, 4262, 4266, 4267, 4268(c), 4269, 4274(b), 4276, 4277, 4280, 4283 OF THE DOWNEY MUNICIPAL CODE ADDING SECTIONS 4254.1 AND 4291 AND REPEALING SECTION 4233, ALL OF WHICH SAID SECTIONS RELATE TO ANIMAL CONTROL The Ordinance was read by title only. AYES: 4 Council Members: Scotto, Jennings, Greene, DiLoreto ABSENT: 1 Council Member: Winton RESOLUTION NO. 3162 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SETTING NECESSARY REVENUE FROM PROPERTY TAXES/ASSESSMENTS FOR FISCAL YEAR 1975-76 The Resolution was read by title only. AYES: 4 Council Members: Scotto, Jennings, Greene, DiLoreto ABSENT: 1 Council Member: Winton RESOLUTION NO. 3163 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING THE GENERAL PROPERTY TAX FOR FISCAL YEAR 1975-76 The Resolution was read by title only. It was moved by Councilwoman Scotto, seconded by Councilman Jennings, and so ordered to waive further reading. It was moved by Councilwoman Scotto, seconded by Councilman Jennings, and passed by the following vote to adopt Resolution No. 3163. Councilman Jennings explained he and Councilman Temple served on the Budget Committee and agreed after much study that the most adoptable method of raising addi- tional revenue was to increase the Utility Users Tax one cent, and this was stated in their letter to the rest of the Council. However, he said, Councilman Temple recanted his signature on the letter and requested the Council to increase Property Tax rather than increase the Utility Users Tax. Councilman Jennings stated for the record that although this is not his preferred method of raising revenue, he will vote "aye". Mayor DiLoreto concurred and said the budget which has been adopted is predicated upon the increase. He pointed out that originally the City Council at its budget session adopted an increase of 16c, however, the assessed valuations have increased Council Minutes 8/26/75 -2- Pe S.^ 2 A in the City, and the Council is now adopting a 12C increase rather than a 16G increase. During discussion on safety lighting, Mr. Robert Griffin, Manager of Financial Systems, indicated in previous years portions of the safety lighting service were funded out of the Street Lighting District, but now it is being funded out of the General Fund. Councilman Greene stated Mr. Claiborne is interested in the community and is a well -qualified person for the position. RESOLUTION NO. 3167 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE APPOINTMENT OF MAYOR JOSEPH E. DiLORETO AS DELEGATE AND COUNCILMAN RICHARD M. JENNINGS AS ALTERNATE DELEGATE TO THE CITY SELECTION COMMITTEE OF THE SOUTHERN CALIFORNIA RAPID TRANSIT DISTRICT The Resolution was read by title only. It was moved by Councilman Jennings, seconded by Councilwoman Scotto, and so ordered to waive further reading. AYES: 4 Council Members: Scotto, Jennings, Greene, DiLoreto ABSENT: 1 Council Member: Winton It was moved by Councilwoman Scotto, seconded by Councilman Jennings, and passed by the following vote to approve Leasing 80 acre feet of Water Rights from the City of Pico Rivera at a price of $25 per acre foot. Responding to questions, Community Development Director Spindel stated the City's present pumping system has the capacity to pump the extra 80 feet of water. He explained it has been the City's policy to buy or lease all the water rights it can because it saves in operation costs. He said in this case the City of Pico Rivera offered the water rights at a good price. AYES: 4 Council Members: Scotto, Jennings, Greene, DiLoreto ABSENT: 1 Council Member: Winton It was moved by Mayor DiLoreto, seconded by Councilman Jennings, and passed by the following vote to appoint Councilman Richard Jennings to serve as an alternate to the County Sanitation District through and including the Council Meeting of September 10, 1975. AYES: 4 Council Members: Scotto, Jennings, Greene, DiLoreto ABSENT: 1 Council Member: Winton Mayor DiLoreto commented the City is presently without a Mayor Pro Tempore as a result of the transfer and resignation of former Councilman Temple, and following the usual rotation of the City Council, he would request Councilman Donald H. Winton be appointed as Mayor Pro Tempore to fill the unexpired term. It was moved by Councilman Jennings and seconded by Mayor DiLoreto to nominate Councilman Donald H. Winton to fill out the term of Mayor Pro Tempore held by former Councilman Temple. Roll call vote to elect Councilman Donald H. Winton as Mayor Pro Tempore of the City of Downey: AYES: 4 Council Members: Scotto, Jennings, Greene, DiLoreto ABSENT: 1 Council Member: Winton Mayor DiLoreto announced before adjourning the meeting the Council will recess to executive session. Council Minutes 8/26/75 -4- 5225 ORAL COMMUNICATIONS Mr. Ken Miller, 7336 Cleargrove Drive, Downey, thanked the Council Members for the ratification of the increase in property tax which he said will be less of a burden on the taxpayers. Mrs. Betty Rupp, 12724 Barlin Avenue, Downey, stated as a member of the Health & Evironmental Sanitation Committee she is extending a welcome to Councilman Greene. Mr. Ken Miller welcomed Councilman Greene. Councilwoman Scotto stated she is pleased with Mr. Greene's appointment to the Council. She commented on a letter from a woman in Bell Gardens regarding Norwalk Transportation to the Airport, asking cities to provide a depot for citizens in the area to use the service. Councilwoman Scotto commented that she has contacted Norwalk regarding the possibility of a bus stop in Downey. Councilman Jennings requested the press to state what occurred at the Council meeting this morning in the introduction of the Uniform Building Code Ordinance, in that the Council did not introduce the Ordinance with the two sections on inspections. He stated further that as far as he is concerned the two sections were left out on a temporary basis because he is not satisfied that no inspection is the answer. Councilman Jennings mentioned at the last Council meeting he submitted proposals on how inspections should or could be made, and he requested Community Development Director Spindel and the City Manager to follow up on this to see if something can be worked out in the future. He welcomed Councilman Greene. Mayor DiLoreto recessed the meeting to executive session at 8:38 a.m. to discuss matters of litigation. The meeting resumed at 9:25 a.m. with Council Members Scotto, Jennings, Greene, DiLoreto present; Council Member Winton absent.
