MARCH 25, 1975
The City Council of the City of Downey held a regular meeting at 8:00 a.m.,
March 25, 1975, in the Council Chambers of the Downey City Hall, Mayor Joseph E. DiLoreto
presiding.

The Invocation was delivered by Reverend Bill Embree, Christ Lutheran Church,
followed by the Flag Salute led by Councilman Temple,
Mr. Henry Oberndorf, Chairman of the Downey Community Flag Day Committee, 7810
Stewart & Gray Road, presented a proclamation for Mayor DiLoreto°s signature proclaiming
June 8th through June 14th as Flag Week in the City of Downey. He commented on some of
the activities to be held at Stonewood Shopping Center.

Communication from John W. Kitley regarding Resignation from Parking Place Commission

Councilman Temple emphasized some of the committees meet at noon, and this creates a
hardship for the members. He pointed out that Mr. Kitley is resigning from the Parking
Place Commission because he cannot attend the noon meetings.
It was moved by Councilman Temple, seconded by Councilman Winton, and so ordered to
accept the resignation of John W. Kitley from the Parking Place Commission, with regret.
Councilman Temple commented on a communication from A. A. D'Alessandro regarding
Change in Name of Health & Environmental Sanitation Committee to Beautification, Health &
Sanitation Committee.
Mayor DiLoreto requested the City Manager to address a letter to the Committee
indicating that the Council has selected the name, Health & Environmental Sanitation
Committee, and it is the official name.
Communication from Southern California Edison Company requesting Extension for
Completion of Undergrounding of Facilities on Brookshire Avenue until the 1st of.. -May, due
to an extraordinary amount of rain during the month of March.
It was moved by Councilman Temple, seconded by Councilman Winton, and so ordered to
approve the request of Southern California Edison Company.

RESOLUTION NO. 3097

Information Management and Referral Systems (IMARS) Program.

CITY MANAGER'S REPORT
City Manager Thompson reported under provisions of the Board of Supervisors, any
activity desiring to be a recipient of County Revenue Sharing Funds requires they have
in -kind services for matching of County Revenue Sharing Funds. He said the Downey Area
Counselling Center has applied for the funds, is seeking use of a meeting room for
purpose of in -kind matching, and if approved would allow them the use of the West
Conference room as that in -kind service for the year 1975-76.
It was moved by Councilman Winton, seconded by Councilman Temple, and so ordered
to approve making a meeting room available to the Downey Area Counselling Center for
three hours per week during 1975-76, and to notify the Center to that effect.
Mayor DiLoreto indicated he has been contacted by Judge Emerson on behalf of the
Downey Area Counselling Center regarding the possibility of leasing the Old Number One
Fire Station for use as a counselling and de-intoxification center. He suggested the
City Manager meet with Judge Emerson to discuss rental of that facility.
Mr. Thompson indicated he has been contacted by several people concerning the Old
Fire Station facility, and he is in receipt of a written proposal for rental. He
commented the Council should decide whether to sell or lease the property, and he will
report back next meeting and seek determination of the Council as to what the City's
policy will be. Mr. Thompson mentioned one group has expressed an interest in purchas-
ing the property, and he will report back to the Council.
Appointment of Parks & Recreation Director
Mr. Thompson expressed appreciation for cooperation from the Park & Recreation
Commission and Personnel Advisory Board in reviewing and screening candidates and
interviewing applicants with him. He said as a result of that selection process, he
is submitting for Council confirmation the appointment of John Neavill to the position
of Parks & Recreation Director at a salary of $2,000 per month, beginning April 1, 1975.

following vote to approve the appointment of John Neavill, as Parks & Recreation
Director.

Mr. Thompson submitted for information a report on Violations of Vehicles in the
Front Yard Setback Area and said 25 violations have been noted, there has been compliance
in theseinstances, and follow-up is continuing.
Mr. Thompson stated as a follow-up to the original request of Mr. Bill Matters for
a Recycling and Ecology Program for the City of Downey, he has subsequently had
discussions with people involved, and several presentations have been made to the
Council on this .subject. He said there is a request to the City Council to approve or
adopt in concept a program which has been recommended by the Health & Environmental
Sanitation Committee, Mr. Thompson indicated if the Council is in favor of the program,
a specific contract will be developed with the Sessler Company and brought back for
final approval. Also, he mentioned, the refuse contractor has been contacted and has
verbally indicated he will work with the program.
Commenting further on the proposed pilot program, Mr. Thompson said Wednesday
would be designated collection day in an area south of Firestone Boulevard up to
around Fifth or Sixth Street, and that section is selected because it provides a variety
for collection process. He discussed the materials to be separated and said the pro-
gram will also entail a door-to-door contact of every person in that area.
Councilman Temple mentioned Mr. Matters brought this to the Council with the idea
of providing jobs for the youth, and now the City is going to conduct the program. He
asked that Mr. Matters be allowed to speak on this.
Mayor DiLoreto indicated the way the draft is prepared he is not in favor of it.
He said the program was envisioned as a program based on volunteerism to stimulate
work for young people, and this undertaking is a completely different concept,

Mr. Thompson stated this program was selected primarily as a pilot test program to
see what different problems there might be and see if there is merit in the program.
Referring to Paragraph 9, Page 2, of the Sub -committee's recommendation, Councilman
Temple said he objects to the Police Department and Public Works Department patroling
the area for scavengers.
Councilwoman Scotto indicated she is in favor of the program and stated the Sessler
Company will be picking up the cost of public relations work. She said she sees this as
a program that will save money for taxpayers, as well as valuable land used for land
fills,
Discussion followed.
Mr. Bill Matters reviewed his presentation to the City Council regarding a recycling
program that would create jobs for the youth. He mentioned the Pitch -in Crew of the
Downey Elks is currently involved in a recycling program that is working very well, and
he commented on the materials picked up. Mr. Matters answered questions of the City
Council.
Councilman Winton said the proposed program deviates from the original concept of
community effort.
Mr. Thompson stated there is a question and some doubt as to whether running a pro-
gram based on the.original idea would be a lasting or permanent kind of operation, and
there are also questions of liability, bonding, etc., that have to be considered. Also,
he indicated there was a question relative to the original idea of storing material to
be picked up. Mr. Thompson mentioned the rubbish contractor has expressed concern that
any delay in picking up recyclable material might cause a delay in the rubbish collection
time.
Councilman Temple said he would like to see the public involved in the program.
Councilman Winton indicated he would like to see a graphic outline of exactly what
the requirements would be relative to bonding, and that an amatuer organization not be
operating trucks without adequate insurance coverage for personnel, public liability,
and property damage.
Mr. Matters assured the Council that the program is working,, and it pays for
itself°
Mayor DiLoreto said he would assume this matter would be referred to the City
Manager for review of the Council'.s comments and a report back as to how the program
would operate. He suggested that the City Manager speak to Mr. Lawrence of the Sessler
Company°
Discussion followed.
Councilwoman Scotto suggested the program be started before school lets out for
the summer.
ORAL COMMUNICATIONS
Mr. Lawrence of the Sessler Company, 1800 North Highland Avenue, Los Angeles 90028,
reviewed the successful source separation program that existed in the City of Los
Angeles for 25 years. He said with the energy crisis and shortage of raw materials, a
recycling program has more importance than ever, and if organized efficiently and
economically, can be successful and produce savings for the City of Downey.
Mr. Ken Miller, 7336 Cleargrove Drive, discussed adoption of the Utility Users Tax
and commented on the change in property tax assessments for senior citizens, their
eligibility, and Utility Tax refunds given to senior citizens and handicapped. He pre-
sented to the City Council a chart comparison of the Utility Tax vs. Property Tax as a
source of revenue, a copy of which is on file in the office of the City Clerk. Mr.
Miller said because of changes in the law, the City will be scratching bottom for more
revenue, and he hopes when looking for more money, the City will Look to a more
effective, less burdensome means of raising the revenue it needs.
Responding to comments, Mr. Miller stated every year the City continues with this
it will be throwing away over $160,000, and it would be money taxpayers could save.
Discussion followed.
Councilman Winton noted there is a Budget Committee established, and he would like
to see the Budget Committee, City Manager, and Finance Director meet with Mr. Miller to
go over the figures presented for a thorough review and a committee report back to the
Council.

Referring to the Minutes of the Health & Sanitation Committee regarding a comment
that the members did not know how long they were appointed for, Councilwoman Scotto
indicated from discussions held by the Council, it was stated the committee members
would be appointed annually on July 1st. She said it was intended to be included with
the policy of committees, and she feels it should be included in Item 4, under Terms.
Councilwoman Scotto mentioned this past week she has met with the Cerritos
Transportation Committee, and it was.brought out that Supervisor Schabarum is not in
favor of anymore funding. She said if the funding does not go through, the mid -cities
study proposal of the RTD Route will not be able to go into effect, and she suggested a
letter be written to Supervisor Schabarum stating the City of Downey knows the need for
transportation; that although this proposal will not provide the needed local service,
it is a decided improvement.
During discussion, Councilwoman Scotto mentioned if Supervisor Schabarum's ideas
go through, it will cut the funds so that this particular program would not go into
effect.
Councilman Temple suggested that the City Manager write the letter for the Mayor's
signature to be circulated to the City Council for its comments.
Councilman Temple inquired about the negotiations regarding the excess water on
the parking lot at Albertson's Market.
Building Official Lake replied the drain is in the process of being built, the
plans have been completed, and the contract has been let.
Mayor DiLoreto advised at the end of the meeting he will call a recess for
executive session to discuss a personnel matter at the request of the City Manager.
Referring to a request by Councilman Jennings for a County Survey of Fire
Protection for the City of Downey and subsequent approval by the City Council, Mayor
DiLoreto stated certain matters have been brought to his attention which, in his
opinion, are detrimental to the negotiations with City employees, especially the
Firemen's Association, if the survey is made at this time.
It was moved by Mayor DiLoreto and seconded by Councilman Temple to delay the
survey until such future date as may be appropriate. (See revised motion.)
Councilman Temple indicated he would rather the motion be to reconsider the former
vote.
Councilwoman Scotto said she would have no objection to tabling this matter.
Councilman Winton stated his concern that many cities are going to find themselves
facing total unity, backed by a labor organization in the matter of public safety. He
commented he does not want to be part of having -the City he helps to represent become
involved in something of that nature. He said he sees no reason for a delay in the
study, nor does he see any reason for the study.

following vote to revise the motion and that there not be a County Fire Survey made at
this time.

Mayor DiLoreto discussed the CETA Employees with the City of Downey and noted the
money used for their employment basically comes from tax dollars. He said he envisions
a program of using some of the CETA employees to do some direct work with the community
in areas where there are a vast number of senior citizens financially and physically
unable to maintain their property as it should be maintained, and who are at the poverty
level, and for persons who are unemployed as a result of the recession and have to cut
back on other items in their family budget. Mayor DiLoreto suggested the City prepare
some form of guidelines, whereby CETA personnel would be sent into the community to do
clean-up work and painting work for people whose homes are deteriorated. He further
suggested that this not become a complete give-away program, but a program of self-help,
and the only cost to the recipient would be the supplies. Mayor DiLoreto requested the
City Manager to review this matter as suggested and bring back a report to the City
Council as to whether such a program is feasible.
Councilman Winton mentioned several parkways along Gardendale and Woodruff could
use CETA employees.

City Manager Thompson reminded the Council of the hearing on the Environmental
Impact State presented by the State Highway Department to be held this evening at
Excelsior High School in Norwalk on the proposed 105 Freeway. Also, he said, there is
a Design hearing to be held March 27th, and he noted there are three or four changes
to be presented by the State Highway Department at the Design hearing.
Traffic Engineer Eccleston displayed a map of the approved freeway design as it
extends through the City, as well as another map of the freeway with proposed changes,
and commented on the reduced number of freeway lanes from ten to eight; the elimination
of certain structures and ramps; reduction in the length of bridge structures; and a
streamlined design of frontage roads. A copy of the freeway designs and a copy of the
I-105 Freeway Report (File No. 1627.13.00) are on file in the office of the Engineering
Division of the Community Development Department.
Councilman Winton expressed opposition to any change and asked the Council to also
oppose any changes.
Mr. Eccleston discussed traffic signal controls for the various freeway access
points and proposed structure changes to conform with updated design changes leading
to reduced costs. He also pointed out a possible angle change on the freeway at the
vicinity of Adoree Street, Woodruff Avenue:, and Bellflower Boulevard.
Mr. Thompson mentioned at the Environmental Impact Statement hearing and the Design
hearing, the Council could make comments regarding the freeway design.
Councilman Winton stressed the following points:
That portion of the freeway between Bellflower and Woodruff on the revised issue
showing nine homes eliminated would be acceptable and in confirmation with the
Agreement the City has had over a period of time with the State;
He can see no problem with revising the fly -ways over the 605 Freeway;
In the vicinity of Lakewood Boulevard, he would oppose very strongly the use of
the diamond off -ramps because there were attempts made to protect the residential
property near Priscilla Street in that area where there is no buffer zone, and he
would oppose any change in that area.
Councilman Temple concurred and suggested Council give a directive to Staff
regarding its intentions.
Mayor DiLoreto also concurred and said there are certain advantages to the State's
changes, He noted that Downey has the highest concentration of industry in the
southern section of town, and he asked for the Council's feelings regarding reduced
number of lanes.
Councilman Winton pointed out the City has a Street Closing Agreement with the
State, however, the State mentioned at the time of the Agreement that the only reason
it was able to get Federal approval was because of the ten -lane rapid transit median,
and now suddently they can have approval with only eight and possibly six lanes. Also,
he mentioned during that period of time the State projected there would be a 30 percent
increase in air freight traffic at Los Angeles Airport proposed by 1990, which would be
justification for the ten lanes, and now suddenly they are saying by some magic formula
these miles will be reduced because the Legislature has passed a Law saying they are
going to reduce these miles.
Councilwoman Scotto concurred with the changes mentioned.
Mayor DiLoreto asked if the changes are in the form of a motion, and Councilman
Winton replied yes. Councilman Temple seconded the motion.
Mayor DiLoreto said he assumes Mr. Eccleston will appear at the hearings and go
over, from an engineer's point of view, the reasons why the City of Downey is taking
this position.

Mayor DiLoreto recessed the meeting to executive session at 10:15 a.m, to discuss

There being no further business to come before the City Council, the meeting was
adjourned at 10:44 a.m.
