FEBRUARY 25, 1975
The City Council of the City of Downey held a regular adjourned meeting at
7:30 p.m., February 25, 1975, in the Council Chambers of the Downey City Hall, Mayor
Joseph E. DiLoreto presiding.

Mayor DiLoreto explained the City Council is conducting a regular adjourned meet-
ing for the purpose of the special hearing concerning the Housing and Community
Development Act and Application pursuant to this Act.
The Invocation was delivered by Frank Peters, Chaplain, Downey Community Hospital,
followed by the Flag Salute led by Councilwoman Scotto.
With the assistance of City Manager Thompson, Mayor DiLoreto presented to Finance
Director Patton a Certificate for Outstanding Financial Reporting. It was noted the
City of Downey's Financial Report for the fiscal year 1973-74 was proclaimed the winner
in the State of California, and the award was given by the California State Municipal
Finance Officers' Association.
Mayor DiLoreto declared that this is the time and place for the public hearing on
Housing and Community Development Application. He inquired if the City Clerk had the
Affidavit of Publication, to which the City Clerk responded in the affirmative.
It was moved by Councilman Winton, seconded by Councilman Temple, and so ordered
to receive and file the Affidavit.
City Manager Thompson said there has been an April 15th deadline set by the Housing
and Urban Development Department of the National Government, and prior to that submittal
it is required to go through an area or regional planning review, which will take
approximately six weeks. He commented on the series of meetings held throughout the
community and of the questionnaire mailed out in the Communicator to 30,000 households
within the City. Mr. Thompson stated a preliminary application is being presented for
Council consideration, and if approved, the intent would be to submit an application
requesting the City's entitlement of funds which will amount to approximately 1.8
million dollars over the next three years to develop a final program. He noted the
preliminary application can be completely altered after it is submitted and after a
thorough needs assessment is made. Mr. Thompson mentioned the significant elements of
the plan are: The Housing and Rehabilitation and Neighborhood Revitalization Program;
a Multi -Purpose Neighborhood Recreational and Service Center; a Housing Needs Assess-
ment; and Matching Funds under which the City would develop its information.
Mayor DiLoreto inquired if there was anyone present who wished to speak regarding
the Housing and Community Development Application.
Miss Wellman, 8113 East Phlox Street, stated she is opposed to the City accepting
this money.
Mrs. Peter Powlick, 9644 LaReina Avenue, inquired about the procedure involved for
inspecting the 431 homes allocated for rehabilitation.
Mr. Jack Robinson, 8555 Gainford Street, said he is opposed to the concept of
seeking Federal funds without knowing what the needs are and using these funds for
capital expenditures would be creating a capital asset that is going to require ongoing

taxation to support it. Referring to the need for meeting places for senior citizens,
he suggested there are sufficient locations available in the churches and schools.
However, Mr. Robinson indicated, if the funds are inevitable, he will join in some
effort to use them wisely for neighborhood rehabilitation. He said the Council should
consider:(a) Is the City going to accept Federal funds; (b) If it does accept Federal
funds, is it going to use them for non on -going expenses such as upgrading the
community in its existing facilities; or (c) Is the City going to go in competition
with other organizations in the community.
Mr. Berney Manka, 12066 Paramount Boulevard, President of the Downey Committee on
Aging, commented on the inadequate space available to accommodate the meetings for
senior citizen groups. He urged the Council to take advantage of the available funds,
and he concurred that the essentials should first be established and then the
priorities.
Mr. Frank Slonka, 9040 Lemoran Avenue, concurred with Mr. Manka and said people
are afraid of more taxes when something of a progressive nature comes along.
Mr. Arthur Hayworth, 10736 LaReina Avenue, President of the A.A.R.P., commented on
ample facilities for meeting places in neighboring cities.
Katherine Save suggested using the funds for enlarging the Downey City Library.
Mrs. Sydney Vanhoven, 8533 East Donovan Street, Secretary for the Downey Committee
on Aging, said she is in favor of a multi -purpose center as long as there is a guarantee
of a certain amount of time for the senior citizens.
Mr. Hoy Maynard, 10331 Julius Avenue, Vice President of the A.A.R.P., commented on
the inadequate space available for senior citizen meetings.
Elizabeth McKinnon, 11624 South Lakewood Boulevard, referred to the proposed
Public Works Improvements as listed in the Community Development Plan and said the
citizens need a mini -bus and a better Library. She spoke in opposition to the City
accepting the Federal funds.
Clara Miller, 7910 Third Street, indicated if the City does accept the money, she
would suggest if any public buildings are restored or built, that ramps be used instead
of stairs. Also, when replacing sidewalks, she would encourage the installation of
ramps instead of curbs.
Mayor DiLoreto declared a recess at 8:32 p.m. The meeting resumed at 8:43 p.m.,
with all Council Members present.
Continuing with the hearing on the Housing and Community Development Application,
Mayor DiLoreto inquired if there was anyone else present who wished to address the City
Council.
Mr. Paul Winslow, 7521 Dinsdale Street, said he would be in favor of a water
softening system for Downey.
Mr. Dick Raabe, 11627 Downey Avenue, spoke in favor of using the funds to pave
streets and for a water treatment plant in Downey.
Mr. Ken Miller, 7336 Cleargrove Drive, spoke in favor of housing rehabilitation
and neighborhood revitalization and a revolving loan -type of program to help people in
doing maintenance on their property that otherwise could not afford it.
Mr. Joe Snyder asked for a repeat of the recent program held in regard to crime
prevention.
Julie Bjerken, 7833 Quill Drive, suggested if the money is needed that it be
borrowed from a Downey bank to save on interest.
Mr. Roy Strain, 7802 Adwen Street, spoke in favor of using the funds to furnish
employment.
Mr. Ed Nemechek, 7816 Eighth Street, spoke in opposition to the Federal funds.
Mr. George W. Vance, 12808 Eastbrook Avenue, said although he is not in favor of
receiving the funds, if they are received, he would suggest using them for a multi-
purpose building, jobs for the unemployed, a public transportation system, and improving
the City Library.
It was moved by Councilman Winton, seconded by Councilman Temple, and so ordered
to close the hearing.

Mr. Thompson answered questions regarding results of the questionnaire mailed
City-wide. He noted out. of 30,000 questionnaires mailed, 240 responses were received.
Mr. Thompson pointed out that although transportation was listed as the high priority
as a result of the survey, transportation is not eligible under the law; that the
purpose of the Act is to provide for viable livable neighborhoods and should be
addressed to Low and moderate income neighborhoods. In further explanation, Mr.
Thompson said the basic purpose also includes improvement of neighborhoods for the
economic advancement of the community through the provision of services or facilities,
and facilities must be those which would aid or be conducive to a better neighborhood
environment or provide facilities for low and moderate income families --facilities or
services they do not have or cannot pay for or do not enjoy. He answered further
questions with regard to the proposed multi -purpose neighborhood recreational and
service center.
Councilman Jennings said he would like to make it very clear for the record that
he is not in favor of this request going ahead based on a community center; that if
money can be obtained based on general needs, he is in favor of it. He stated he is
very much against it because he is not sure that is what should be done at this point
in time, and if it can be assured the Council voting in favor will not signify a
community center will be built, then he will vote for it.
Mr. Thompson advised the City is required in essence to conduct a thorough needs
assessment before submitting a final plan, and the final plan can be entirely different
than the preliminary plan.
Councilman Jennings said he is not against or in favor of a community center, but
is against a definite plan at this time.
Councilman Temple stated his opposition to embarking on a program that would burden
the City in the future and said although a multi -purpose building is needed, he cannot
see the City committing itself, inasmuch as there are other priorities to be considered.
He suggested purchasing the Rives Avenue School for a recreational service facility on
the application and said the Council should consider the cost of the building and what
it would mean to the citizens in the future.
Councilman Winton stated he is very much in favor of use of Federal funds and would
like to see the money used for something of a permanent, long-time tax aid to the City.
Also, he suggested a reciprocal program with nominal interest that would bring back
funds into the City and establish an ongoing program.
Mayor DiLoreto commented on the Housing and Community Development Act passed by
the Federal Government and stated every person who pays taxes pays into the fund from
which the money is going to be divided among cities of the United States. He mentioned
all the City is doing is acting in the best interest of the citizens to try to get back
for the City that which the City is entitled to, and if the City does not use these
funds, the money will not go to reduce taxes but will be used for another city. Mayor
DiLoreto noted the response to the hearings and the questionnaires mailed to citizens
has not been encouraging, however, the response cannot be ignored and, therefore, the
Council is attempting to comply with the law to timely submit the City's application so
it will not be rejected.
It was moved by Councilman Winton, seconded by Councilwoman Scotto, and passed by
the following vote to adopt the Housing and Community Development Plan.
Councilman Jennings asked that the motion be changed to include the word,
"preliminary".

Councilwoman Scotto voiced disagreement with the Resolution and the statement that
local elected officials should be the primary decision -making body.
It was moved by Councilman Winton, seconded by Councilman Temple, and passed by
the following vote to adopt Resolution No. 3089.
Councilman Jennings indicated any delegate to any function should vote the wishes
of the City Council, inasmuch as the delegate is there at the wishes of the Council,
not individual pleasure.

Councilman Winton reviewed the City`s withdrawal from SCAG in 1969-70 and said if

Following a summation of bids, it was moved by Councilman Winton, seconded by

Following a summation of bids, it was moved by Councilman Winton, seconded by

of the unit prices bid, to Copp Paving of Artesia, the lowest and best bidder, and
reject all other bids.

REPORTS FOR DISCUSSION
Report on Rubbish Disposal Contract, Calsan, Inc
Mayor DiLoreto asked that this matter be placed on the next Council Agenda.

City Manager Thompson indicated the Council's previous action was to extend the
contract to March 31st. He said the system installed by the contractor appears to meet
all of the requirements set forth by the Council, but it would take one quarter to get
a true picture of the effectiveness of the system.
Councilman Jennings asked the Director of Community Development to provide each
Councilman with a copy of the breakdown of surrounding cities that was presented to the
Sanitation Committee.
The report on Rubbish Disposal Contract with Calsan, Inc., was ordered to be placed
on the March 10th Council Meeting Agenda.
Community Development Director Spindel displayed for information and Council review
a map of Proposed changes in the RTD Route through the Mid -Cities Area including the
City of Downey and Cities in the Cerritos College District. The map included the tenta-
tive routes through the City with revisions Staff would like considered. He mentioned
the backbone of the route is the service on the Santa Ana Freeway with various drop-off
points to pick up transfers from other lines. Mr. Spindel commented on the proposed
routes through the City and the Staff revisions. A copy of the preliminary map is on
file in the Department of Community Development.
During explanation, Mr. Spindel indicated that of all the major arterials east and
west in Downey, Florence Avenue is the only one that does not go all of the way through
to the west, terminating at the ocean. He also noted there is a lack of continual
service on Woodruff Avenue.
Councilman Winton stated he thinks the portion of the area which he represents and
the portion of the area Mrs. Scotto represents has been left out.

ORAL COMMUNICATIONS
Mr. George Vance cited an incident concerning a missing dog and urged the City to
consider another means of handling the dog pound situation.
Councilman Jennings requested the services of a CETA employee for janitorial work
at the Downey Elks Club, inasmuch as an employee has been assigned to the YMCA.
City Manager Thompson advised the YMCA is eligible under the CETA Act, and he will
look into it.
Councilman Jennings advised he will be absent from the next two Council Meetings.
There were no objections stated.
Councilman Jennings commented on the Watson Brothers' Election Signs in setback
areas which, he said, are against the Code, and he requested a written report from the
City Manager as to what action is taken on this.
Councilman Jennings discussed the South Gate City Council's vote to sent a letter
of intent to the County Fire Department, and he made a request for a County Survey of
Fire Services to determine what services can be obtained for the City and the cost.
Councilman Jennings commented on the Sign at the Northeast Corner of Brookshire
and Imperial with the words "liquor" three feet high and "grocery" three inches high.
Speaking further to his request for a County Survey of Fire Services, Councilman
Jennings indicated the City would tell the County what services it wants, the County
would make the survey and indicate what the costs would be, and there would be no
obligation to the City.
Councilman Winton stated he wants the request to state all of the services the City
now enjoys.
It was moved by Councilman Jennings, seconded by Councilman Temple, and passed by
the following vote to instruct the City Manager to obtain through the County Fire Marshal
a survey of the City of Downey to termine the cost through the County "services"for the
same Level of service Downey now has.
City Manager Thompson advised there is no way the City's services can be duplicated
in terms of an outside contract, and there is coordination and cooperation among depart-
ments that is carried on which cannot be duplicated in the same manner.

Councilman Temple discussed the problems with regard to Parking of trailers,",
railers, cars,
and recreational vehicles. He said he has received complaints and he asked why something
has not been done to enforce the Code.
City Manager Thompson indicated he would come back with a report.
Councilman Temple inquired about the News Rack Ordinance.
City Attorney Sorensen commented briefly on the City of Los Angeles' recent action
and noted the City of Santa Monica has an Ordinance similar to Downey. He said he is
still awaiting information from other cities.
Mayor DiLoreto reported on a letter from Priscilla Dunnum, legal counsel for
members of the Downey Firemen's Association, requesting Reconsideration of Resolution
of Memorandum of Understanding, Paramedics. This matter was ordered to be placed on
the Agenda for the first Council Meeting in April.
Discussion ensued.
Mayor DiLoreto stated from the preliminary financial reports received concerning
projected income for next year, he would request all department heads, along with their
budgetary considerations, to also include in their request a brief summary of ways in
which they feel the expenses in their department can be reduced,and this should be
presented to the Budget Committee at the time of budget consideration. He said the
department heads should take a specific look at their departments and ways in which
existing programs might be eliminated or costs might be reduced.
City Manager Thompson said this can be reported as part of the budget submittal,
but it would be a part of the outside budget that he presents as required by the
Charter.
Councilman Winton commented the department heads' requests should go through the
Chief Administrative Officer.
Mayor DiLoreto explained his request is simply that each department head take
specific look at his department and submit a report, and he thinks the Council should
be privy to that report.

Mr. Thompson reviewed the requirements for budget submittal by the City Manager as
set forth in the Charter. He said there is no reason the Council should not have all
of the information a department is submitting, and he is in accord with that.
There being no further business to come before the City Council, the meeting was
adjourned at 10:45 p.m.
