Jennings presiding. PRESENT: Councilmen: Walter S. Temple, Joseph E. DiLoreto, Donald H. Winton, Hazel N. Scotto, Richard M. Jennings ABSENT: Councilmen: None ALSO PRESENT: Charles W. Shand, City Clerk -Treasurer Judy McDonnell, Executive Secretary The Invocation was delivered by Dr. Harold Adams, First Baptist Church, followed by the Flag Salute led by Girl Scout Cadet Troop #1560. Mayor Jennings presented to members of the Downey Junior Womens' Club a proclamation, proclaiming November as Junior Month. Mayor Jennings declared that this is the time and place for the public hearing on Downey City Lighting District Annexation 74/16, Lemoran Avenue. He inquired if the City Clerk had the Affidavit of Posting of Notice and Affidavit of Publication, to which the City Clerk responded in the affirmative. It was moved by Councilman Winton, seconded by Councilwoman Scotto, and so ordered to receive and file the Affidavits. Mayor Jennings inquired if the City Clerk had received any written protests or objections, and the City Clerk replied he had not. Mayor Jennings inquired if there was anyone present who wished to speak in opposition to the Annexation, and there was no response. It was moved by Councilman Winton, seconded by Councilman Temple, and so ordered to close the hearing. Upon recommendation of the City Attorney, the matter was taken under submis- sion pending review of the application of Senate Bill 90. Mayor Jennings declared that this is the time and place for the public hearing on Downey Improvement Project No. 662, West side of Lowman Avenue north of Allen - grove Street. He inquired if the City Clerk had the Affidavit of Posting and Mailing, to which the City Clerk responded in the affirmative. It was moved by Councilman Winton, seconded by Councilman Temple, and so ordered to receive and file the Affidavit. Mayor Jennings inquired if the City Clerk had received any written protests or objections, and the City Clerk replied he had not. Community Development Director Spindel reported this hearing is on the construction of sidewalks at three properties on Loman Avenue, and he requested authorization to proceed. It was moved by Councilman Winton, seconded by Councilman Temple, and so ordered to accept the Engineer's Report as written. Council Minutes 11/11/74 -1- Mayor Jennings inquired if there was anyone present who wished to speak in opposition to the improvements, and there was no response. It was moved by Councilman Winton, seconded by Councilman Temple, and so ordered to close the hearing. It was noted by Mayor Jennings that according to the Ordinance establishing the Board of Building Appeals, the Board's decision is final. The correspondence was withdrawn. At the request of Councilwoman Scotto, the Resolution regarding Revision of FHWA/UMTA Guidelines - Administration of Urban Funds, was removed from the Consent Calendar. AYES: 5 Councilmen: Temple, DiLoreto, Winton, Scotto, Jennings RESOLUTION NO. 3051 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING REVISIONS IN THE FHWA/UMTA DRAFT GUIDELINES FOR A TRANSPORTATION DEVELOPMENT PROGRAM AND URGING FHWA/UMTA TO WORK WITH THE INDIVIDUAL URBANIZED AREAS TO DEVELOP A PROGRAM APPLICABLE TO THAT PARTICULAR AREA The Resolution was read by title only. It was moved by Councilman Winton, seconded by Councilman DiLoreto, and so ordered to waive further reading. It was moved by Councilman Winton, seconded by Councilman DiLoreto, and passed by the following vote to adopt Resolution No. 3051. Councilwoman Scotto discussed her attendance at a SCAG Transportation meeting and indicated it was the Committee's feeling that it needed further information on this matter. She requested the Resolution be taken under submission. Community Development Director Spindel explained the FHWA drafted and cir- culated guidelines to all of the cities for comments. He said he thinks the problem is one of local jurisdiction. Discussion followed. It was moved by Councilman Winton, seconded by Councilman Temple, and passed by the following vote to approve the appointments to the Rose Float Association, as recommended. AYES: 5 Councilmen: Temple, DiLoreto, Winton, Scotto, Jennings At the request of Mayor Jennings, Community Development Director Spindel read memorandum dated November 8, 1974, concerning Report on Traffic Collision at Bellflower Boulevard and Foster Road and recommended denial of Legal Claim Ref. #205 (denied under Consent Calendar, Page 2). City Attorney Sorensen reported on a class action filed by Charles Barrios - Gonzales, Sam Wesley Berry, and Henry Lee Battle through their attorneys. He said in order to protect the City's interest, he would request the City Council direct the City Clerk to forward a Notice of Insufficiency of Claim to the claimants' attorneys. It was moved by Councilman Winton, seconded by Councilman Temple, and passed by the following vote to direct the City Clerk to give Notice of Insufficiency. He said the annual operating cost is estimated to be $157.20, annexed into Zone I at the estimated rate of 23C per $100 assessed valuation. RESOLUTION NO. 3053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO ANNEX A CERTAIN AREA TO THE DOWNEY CITY LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO STREET LIGHTING FIXTURES ON THE STREETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL JANUARY 31, 1983. (ANNEXATION 74/21 WEST SIDE PARAMOUNT BOULEVARD AT SUVA STREET) The Resolution was read by title only. It was moved by Councilman Winton, seconded by Councilman Temple, and so ordered to waive further reading. AYES: 5 Councilmen: Temple, DiLoreto, Winton, Scotto, Jennings Following a summation of bids, it was moved by Councilman Winton, seconded by Councilman Temple, and passed by the following vote to award Cash Contract #364, Miscellaneous Repairs, in the amount of the unit prices bid, to Damon Construction Company, the lowest and best bidder, reject all other bids, and waive the Bid Bond irregularity. AYES: 5 Councilmen: Temple, DiLoreto, Winton, Scotto, Jennings Downey Community Hospital Mid -Year Salary Adjustment Councilwoman Scotto asked for Staff recommendation on this matter. Councilman DiLoreto suggested this matter be held to the next Council meeting, inasmuch as Mr. Keller, the Hospital Administrator, would like to be present in case there are any questions. He further suggested that Mrs. Scotto direct any questions to Mr. Keller. Following further discussion, the matter was taken under submission. It was moved by Councilman Winton, seconded by Councilman Temple, and passed by the following vote to appropriate necessary funds for reimbursement of expendi- tures by the Downey Unified School District in connection with the joint development of the Alameda School Mini -Park (out of Fund 40 balance). Council Minutes 11/11/74 -4- Parks & Recreation Director Ruth commented on the costs incurred for the irrigation system. AYES: 5 Councilmen: Temple, DiLoreto, Winton, Scotto, Jennings CITY MANAGER'S REPORT City Manager Thompson reported on a survey of cities for a comparison of Fees to Citizen Boards. He said based upon the comparison, he would recommend that no change be made at this time, however, this could be considered with the budget, beginning the new fiscal year. Discussing the new Tennis Court Facilities, Mr. Thompson indicated with the new pro shop to be located at the facility, that it should be the responsibility of a pro which could be selected on a competitive basis as a lessee to the City. He said the pro could give lessons and instructions, take care of the court maintenance, and schedule operation of the court facility. Also, Mr. Thompson stated, since some of the facilities will be lighted, time will be made available daily for free play. Parks & Recreation Director Ruth explained this has been reviewed by the Parks & Recreation Commission and is recommended for favorable consideration. He noted there would be no cost to the City for actual supervision of the facility, and there would be a competent, qualified professional on the facility at all times. Mr. Ruth said the City would expect a guaranteed monthly rental for use of the facility and/or percentage of gross receipts, which would be open in a bid process. He indicated this would give the City a revenue base, provide competent, qualified personnel at all times,and provide a fine, overall tennis program for the City of Downey. It was moved by Councilman DiLoreto, seconded by Councilman Temple, and passed by the following vote to proceed on a temporary basis, subject to Council changes on any matters that do not appear workable. Councilman Winton asked that the bid include the right of Council to review those hours scheduled, should there be an adequate need for a differential of more hours of free play. Discussion followed. AYES: 5 Councilmen: Temple, DiLoreto, Winton, Scotto, Jennings Mayor Jennings indicated after the tennis courts open, he would like to have a monthly report of what occurs Saturday and Sunday and the number of children that do not get to play tennis without paying 25c. Reporting on the 911 Emergency Dialing System, Mr. Thompson explained the State has mandated that the entire State be serviced by this system by 1982 with a preliminary plan being submitted by January of 1975,Qand this has been re- viewed by Staff with the County and the State Communications Department. He said it is unanimously recommended that the City's plan call for a jurisdictional selective routing system, and this would mean that anyone within Downey dialing 911 would be put into direct contact with the City dispatching office for dispatching of any emergency vehicle. Mr. Thompson noted the alternative to this is to go into a public safety answering point, which is being set up by the County and.. would serve from six to sixteen cities in each group as a referral over to the City dispatching office. He pointed out that although the costs have not been established, they will not be greatly significant in terms of large capital expenditures, and the State has included in the act a provision to appropriate funds in the next Legislature sufficient to cover the program; that if they fail to do so, the program will be postponed for a year and each subsequent year until Legislature provides for funds. Mayor Jennings questioned giving approval without knowing the costs involved. Discussion ensued. Councilman Winton suggested the City prepare its own cost factor and present it to the State Legislature relative to being reimbursed and placed on the system. Police Chief Morgan explained the costs are unknown at the present time, and the plans are tentative and can be changed at any time. He said it appears more Council Minutes 11/11/74 -5- feasible for the City to have a 911 system based upon a jurisdictional basis, rather than having emergency calls relayed from a public safety answering point in another city. Chief Morgan noted the purpose of submitting a tentative plan to the State is so that the Division of Communications can make recommendations of costs to the State Legislature. It was moved by Councilman Temple, seconded by Councilwoman Scotto, and passed by the following vote to approve a jurisdictional selective routing system for Downey, which will be the basis for tentative plans to be submitted in January, 1975. Mayor Jennings said he does not want this City committeed to something when the costs are not known. Further discussion ensued. AYES: 4 Councilmen: Temple, DiLoreto, Winton, Scotto NOES: 1 Councilmen: Jennings Memorandum from City Clerk regarding Form Letter for Denial of Legal Claims. Taken under submission for redrafting by the City Attorney. ORAL COMMUNICATIONS Mr. Gordon Strahan, 12359 Gneiss Avenue, president of the Warren High School Band Booster Club, extended an invitation to the Council to the Winter Concert of the Warren High School Band to be held on December 17th. Mr. Earl Berry, 8536 Eucalyptus Street, spoke regarding the Downey Community Hospital Mid -Year Salary Adjustment and asked the Council to take a hard look at the proposed increase. Pursuant to the request of Mayor Jennings, City Planner Goggin reported on the status of the Comprehensive Zoning Ordinance. He said the Planning Commission has been holding regular meetings and study meetings and is still waiting for input from the Chamber of Commerce and the B.I.A. (Building Industry Association, Southeast Chapter). Mr. Goggin noted very little input has been received from -- the general public. He mentioned the Commission has indicated it would like to have the wording cut down, there are some minor changes to be made, and there will probably be three more meetings before the Commission will send it to the Council. Councilman DiLoreto asked if the Zoning Ordinance considers changes in the areas where zone exceptions have been granted, so that zoning will conform to the present use of the land. Mr. Goggin replied the Zoning Ordinance will not change the zoning of any properties, however, it will bring the code up to a standard where in those areas there is a commercial development in an R-1 zone, it will make it possible for the Council to rezone the property to commercial that would permit those uses and any other new uses to come in on the same standards of development. Responding to further questions, Mr. Goggin noted that although the Zoning Ordinance will not be in conformance with the General Plan, the Zoning Maps will. Councilman Temple noted questionable paving on Cecilia Street between Wiley Burke and Rives and asked that this be checked out. Councilman DiLoreto commented on recent resurfacing of pavement on Imperial Highway. Councilman DiLoreto stated after further consideration on the Widening of Brookshire Avenue, he is not in favor of widening an additional eight feet, inasmuch as it will not increase the flow of traffic considerably. Councilman DiLoreto asked the City Manager to meet with the City Librarian to discuss Use of Library on Saturday and Sunday and the cost to the City for better utilization of the Library prior to any expansion. Councilman Winton said he would oppose any motion to utilize the Library on Saturday and Sunday until such time as Budget session would approve adequate personnel. Council Minutes 11/11/74 -6- .2 Councilman Winton commented on the inadequate paving of Stewart and Gray Road between Lakewood Boulevard and Patton Road. Councilman Winton indicated that since there is a redevelopment agency in the City, a serious look should be given to the 105 Freeway corridor and anticipate in the future that there is going to be a need to establish a redevelopment plan throughout the entire corridor. Commenting on the Council packets for the Library and Press, Councilwoman Scotto expressed a desire to have the packets include the City Manager's Report and Correspondence. She further inquired if there would be public hearings on the 105 Freeway deletion. Discussion was held regarding the procedure for distributing Library and press packets. The Council concurred with Mrs Scotto. It was moved by Councilwoman Scotto, seconded by Councilman Temple, and passed by the following vote that the City Manager's Report and Correspondence be made available to the press and Library on Friday morning with the rest of the Council Packet. It was noted that letters from the City Attorney to the City Council and City Manager are to be excluded, as well as Personnel matters. AYES: 5 Councilmen: Temple, DiLoreto, Winton, Scotto, Jennings Councilwoman Scotto again inquired if there would be public hearings on the 105 Freeway deletion. City Manager Thompson replied the question of deletion would be before the Legislature. Councilman DiLoreto requested that before a Bill is proposed to any member of the Legislature or Assembly, that it be submitted to the Council for approval and citizen input. During discussion it was noted there would not be any public hearings before the City Council. ---- Mayor Jennings stated Federal Revenue Sharing Funds were earmarked for Purchase and Removal of the Tin Shed at Dolan and Firestone. He requested Council approval for the City Manager to proceed with negotiations to purchase and remove the shed. Councilman Winton concurred. Discussion ensued. Councilman Temple inquired about the status of Revenue Sharing and the plans for other projects earmarked before approving a minute action of this type. Councilman DiLoreto said there are other projects he would consider as higher priority, but would not object to exploring the possibility of acquisition. It was moved by Councilman Winton, seconded by Councilman Temple, and passed by the following vote to authorize the City Manager to investigate the possibility and price of purchasing the tin building at Dolan and Firestone.
