The Invocation was delivered by Reverend David M. Liddle, First Presbyterian Church, followed by the Flag Salute led by City Manager Charles Thompson. With the assitance of Community Development Director Ervin Spindel, Mayor Richard Jennings presented Zero Defects Quarterly Award to Barbara Walker of the Community Development Department. Councilman. Thomas Morton inquired if the proposed condominium meets all of the re- quirements of the Apartment House Study Committee, as well as the General Plan. Mr. Coggin replied yes. He said it also meets all of the other requirements, and the applicant is aware and has read the Apartment House Study Committee's report and is agreeable to all of the conditions contained in the report. It was moved by Councilman Thomas Morton, seconded by Councilman Walter Temple, and passed by the following vote to approve the submitted plan as requested. LEGAL CLAIMS (for information only) Ref, de143, Rachel Edna Cabrera and Josephine Lorraine Cabrera LEGAL CLAIMS ;for Council Action) Ref, #120, Beverly Boand Jones City Clerk Robert Shand indicated the carrier has recommended the Council accept the claim, however, he has found out that the carrier has indeed paid the claim, even though it is a small amount, without having the claim first processed through the Council. Mr, Shand suggested the Council deny the claim per the recommendation of the department head, and then he will press the carrier that the City's reserve is not to be charged for this item. AYES: 3 Councilmen: Temple, Morton, Jennings ABSENT: 2 Councilmen: DiLoreto, Winton RESOLUTION NO. -2-89"7- a�'�� P/"` A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING A COOPERATIVE AGREEMENT 'BETWEEN THE CITY OF DOWNEY AND THE STATE OF CALIFORNIA FOR IMPROVEMENTS AT THE INTERSECTION OF OLD RIVER SCHOOL ROAD AND FIRESTONE BOULEVARD The Resolution was read by title only. It was moved by Councilman Thomas Morton, seconded by Councilman Walter Temple, and so ordered to waive further reading. Councilman Temple asked if there will be an improved crossing for pedestrian and bicycle traffic at this intersection, Community Development Director Ervin Spindel replied yes, pedestrian distance across Firestone Boulevard will be less, and "walk" lights with push -buttons will be installed, AYES: 3 Councilmen.: Temple, Morton, Jennings ABSENT: 2 Councilmen: DiLoreto, Winton The following changes were made in Resolution. No. 2898: In the first WHEREAS, first Line, the last two words "has come" was changed to "came". In the fourth WHEREAS, second line, the word "these" was eliminated and the word "importance" was changed to "concern". AYES: 3 Councilmen: Temple, Morton, Jennings ABSENT: 2 Councilmen: DiLoreto, Winton CITY MANAGER'S REPORT City Manager Charles Thompson reported. Section 2754 of the Downey Municipal Code requires organizations desiring to meet and confer with the City Administration to file annually a list of their officers and various other information as set forth, He said this year the Downey City Employees' Association, Downey Firemen's Association, and Downey Police Officers' Association have transmitted the information to his office, it has been checked, and it is recommended they be recognized for meeting and conferring purposes. It was moved by Councilman Thomas Morton, seconded by Councilman Walter Temple, and passed by the following vote to Recognize the Downey City Employees' Association., 'Downey Fireman.'s Association, and Downey Police Officers' Association for meeting and conferring purposes. AYES: 3 Councilmen: Temple, Morton, Jennings ABSENT: 2 Councilmen: DiLoreto, Winton Council Minutes 1/22/74 -4- ORAL COMMUNICATIONS jiQ -LC Councilman Walter Temple stated he has asked the City Attorney to prepare for the next meeting an Ordinance setting the physical location of various news stands and limiting what type of pictures could be shown.on them. He said with Council concurrence he would like to have the City Attorney draft an Ordinance for the next meeting for introduction. City Attorney Royal Sorensen indicated he can prepare an Ordinance that will get by under the present state of the law. Councilman Thomas Morton stated in reports to the Council regarding Extra Work on Cash Contracts, the only statement ever made in the increase of costs is the result of extra work authorized during construction, and the Council is not told what the extra work was or whether it was authorized. He asked the Director of Community Development if the files reflect a written change order procedure showing what the extra work was and why it was necessary. Community Development Director Ervin Spindel replied yes. There being no further business to come before the City Council, the meeting was adjourned at 8:50 a.m. �Ll X - Robert L.
