MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
AUGUST 27, 1974
The City Council of the City of Downey held a regular meeting at 8:00 a.m.,
August 27, 1974, in the Council Chambers of the Downey City Hall, Mayor Richard M.
Jennings presiding.

The Invocation was delivered by Reverend Ken Peterson, Christ Lutheran Church,
followed by the Flag Salute led by Fire Chief Edwin Wood.
Mayor Jennings declared that this is the time and place for the public hearing
on Downey City Lighting District Annexations 74/2 through 74/12 and Concurrent
Withdrawal of a Portion of the Downey County Lighting District. He inquired if the
City Clerk had the Affidavit of Posting of Notice and Affidavit of Publication, to
which the City Clerk responded in the affirmative.
It was moved by Councilman Temple, seconded by Councilman DiLoreto, and so
ordered to receive and file the Affidavits.
Mayor Jennings inquired if the City Clerk had received any written protests or
objections, and the City Clerk replied he had not.
Mayor Jennings inquired if there was anyone present who wished to speak in
protest to the Annexations, and there was no response.
It was moved by Councilman Temple, seconded by Councilman DiLoreto, and so
ordered to close the hearing.
RESOLUTION NO. 3005
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONCURRENTLY WITHDRAWING A PORTION OF THE DOWNEY COUNTY
LIGHTING DISTRICT AND ORDERING ANNEXATION OF CERTAIN
AREAS TO THE DOWNEY CITY LIGHTING DISTRICT AND TO
MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET
LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES
WITHIN THOSE AREAS UNTIL JANUARY 31, 1983 (ANNEXATIONS
74/2 THRU 74/12)

Communication from Gus Giannikas, owner of Village Restaurant, regarding
est to appear before City Council to discuss Section 6507-6 of the Downe

Discussion followed regarding a proposed ordinance that will be presented at
the next Council meeting.
Mayor Jennings said he will set Mr. Giannikas' letter aside and allow him to
speak at the next meeting if he is present.
Communication from Public Utilities Commission regarding Application of
Southern California Edison Company on Special Fuel Cost Adjustment. Filed.
Communication from Public Utilities Commission regarding Application of
Southern California Edison Company for Authority to Increase Rates (Application
Communication from Southern California Rapid Transit District regarding Annual
Meeting, September 5, 1974. Filed.
City Clerk Shand called attention to the need to appoint an alternate repre-
sentative to fill the vacancy created by former Councilman, Thomas Morton.
Communication from State Senator Joseph M. Kennick acknowledging receipt of
Downey's Resolution supporting Assembly Bill 3792 pertaining to Transit Districts.
Filed.
Communication from Public Utilities Commission regarding Application of
Southern California Gas Company for Authority to Increase Revenues to Offset
Increased Costs (Application #55117). Filed.
Communication from Mr. Michael Betor requesting Hearing on Appeal, Zone
Exception Case #1182, 8509 East Imperial Highway.
Councilman Temple noted that the September 9th hearing calendar is quite heavy
and asked if the hearing might be set for a later date.
Discussion followed regarding setting the hearing for October 14th. The Mayor
requested the applicant be notified.
City Attorney Sorensen stated that while there is a code restriction of 40 days,
it is not a jurisdictional matter; it is simply a directive to the City Council, and
if the Council wants to set it beyond the 40-day period, the Council does not lose
jurisdiction to hold the hearing.
It was moved by Councilman DiLoreto, seconded by Councilman Temple, and passed
by the following vote to set a hearing on Appeal, Zone Exception Case #1182, for
7:30 p.m., October 14, 1974, in the Council Chambers of the Downey City Hall.

RESOLUTION NO. 3007

PROHIBITING PARKING AT CERTAIN TIMES ONCE EACH WEEK ON
THE EAST SIDE OF MONTGOMERY STREET BETWEEN ORANGE STREET
AND CONRAD STREET AND THE SOUTH SIDE OF ORANGE STREET
FROM MONTGOMERY STREET EASTERLY 270 FEET, FOR STREET
CLEANING

Mayor Jennings questioned the weekly parking restriction when sweeping is
every other week.
Community Development Director Spindel indicated it would be difficult to sign
otherwise.

--. Mayor Jennings commented he would appreciate the aid of the newspapers in
publicizing the City's new policy, whereby any City block that wishes to have
restricted parking to enable the street sweeper to work more efficiently can obtain
the restricted parking signs by submitting a petition of more than half the owners
in the block through the Public Works Department and Traffic Committee for trans-
mission to the City Council for consideration.
RESOLUTION NO. 3008

ESTABLISHING A TWO-HOUR PARKING LIMITATION ON THE WEST
SIDE OF DOLAN AVENUE FROM IOWA STREET NORTHERLY 75 FEET

Mayor Jennings commented that since this is the area where there was a recent
street assessment, why is two hour parking required now, whereas it was not re-
quired before.
Community Development Director Spindel said the two-hour parking has been
requested by the business owners to give them some turnover in parking.

Cash Contract #SS-274, Downey Avenue - Imperial Highway to Gardendale Street
Explaining the costs involved, City Engineer Henriksen said the original esti-
mate used for budget purposes was done in February -March while the project was
still in the preliminary stages. However, he said, since that time, additional
surveys made by a consultant indicate the need to reconstruct rather than resurface
a large portion of Downey Avenue, and this has increased the cost considerably in
view of the fact that excavation costs have risen probably more than any other item
in construction.

by the following vote to approve plans and specifications and grant authority to
advertise for bids on Cash Contract #SS-274, Downey Avenue - Imperial Highway to
Gardendale Street.

It was moved by Councilman Temple, seconded by Councilman DiLoreto, and passed
by the following vote to approve plans and specifications and grant authority to
advertise for bids on Cash Contract #367 Susan Avenue north of Via Amorita.

Following a summation of bids, it was moved by Councilman Temple, seconded by
Councilman DiLoreto, and passed by the following vote to award Cash Contract
#SS-292, Washburn Road (Bellflower Boulevard/Woodruff Avenue); Dunrobin Avenue
(Washburn Road/Imperial Highway), in the amount of the unit prices bid, to Griffith
Company of Long Beach, the lowest and best bidder, and to reject all other bids.

It was moved by Councilman Temple, seconded by Councilwoman Scotto, and passed

City Engineer Henriksen reported Laura Street is hazardous for vehicular and
pedestrian traffic, and owners in the general area have complained for many years.
He stated to date, a written commitment from a substantial majority of the owners
has not been obtained, however, responses by telephone have indicated that over
50 percent of the owners in the area are in favor of improving the street. Mr.
Henriksen requested the City Council to affirm the contributions as outlined in the
report so that individual owners' costs can be estimated in the proposed informal
hearing with the people.
Discussion followed concerning Streets d Highways Code requirements, drainage,
and City contributions.
It was moved by Councilman Temple, seconded by Councilwoman Scotto, and passed
by the following vote to direct the City Engineer to prepare the necessary pre-
liminary plans and estimates for the purpose of discussing an Assessment District
for people in the area, and that it would be the intent of the City to make a
contribution for engineering and incidentals, favoring reconstruction and
resurfacing, the amount to be estimated by the City Engineer for preliminary
discussion.

Appeal, Zone Exception Case #1176 8020 DePalma Street
Mayor Jennings informed those present that the hearing on August 12th was
closed and decision by the Council was held because of the lack of attendance of
two Council members.
Councilman DiLoreto stated he has listened to the tape of the hearing, has re-
viewed all of the correspondence on this matter, has seen the property involved, and
is acquainted with what has transpired.
Mayor Jennings declared a recess at 9:15 a.m. The meeting resumed at
9:20 a.m., with Councilmen Temple, DiLoreto, Scotto, Jennings present; Councilman
Winton absent.
City Planner Goggin reviewed the proposed layout for the apartment
construction. He answered questions of the Council pertaining to zoning of the
property and lot size.
It was moved by Councilman Temple, seconded by Councilwoman Scotto, and passed
by the following vote to deny the Appeal to Zone Exception Case #1176, and uphold
the decision of the Planning Commission.
Councilman DiLoreto asked that before an occupancy permit is issued, the City
be very careful to see that all of the landscaping is adequately completed.
Councilwoman Scotto asked if the Traffic Committee could review the traffic
situation since it was apparent at the public hearing that it is a great problem.

Mayor Jennings pointed out that Warren High School and Downey High School are
instituting a four-year program with an increase of 700 to 800 students. He asked
if the Traffic Committee has taken into consideration the possibility of the in-
crease in traffic that might be generated by this.
City Engineer Henriksen said the Committee is aware of the situation, and as
soon as school starts, the matter will be looked into and reviewed.
City Manager Thompson reviewed the Productivity Improvement Agreement, pointing
out merits of utilizing techniques to insure the best job that can be done reason-
able is being done to assure effective and efficient services to the community.
Discussion followed regarding financial aspects of the program.
It was moved by Councilwoman Scotto to enter into the Productivity Improvement
Agreement.
Mr. Thompson mentioned several surrounding cities that have entered into
similar agreements and suggested perhaps those cities be watched to see if results
are forthcoming before entering into an agreement.
Further discussion ensued.
The motion to enter into the Productivity Improvement Agreement was seconded
by Councilman DiLoreto.

Councilwoman Scotto requested the City Manager keep the Council informed of
reports from other cities that have entered into similar agreements.
City Manager Thompson reported at the request of the City Council, the
Sidewalk Matching Fund Policy was revised July 23, 1974, in an attempt by Staff to
put together a policy indicating a desire to incorporate some of the most recent
actual decisions of Council. He pointed out there is a statement in the policy,

whereby construction of sidewalks in all other land use areas (other than R-1 or
R-2) may be eligible for Matching Funds in special cases only, when requested by
the City for purposes of pedestrian safety. Mr. Thompson stated this statement
was included as a result of a policy the City established under a grant completed
one and one-half years ago which started out as a Safe Route to School Program;
that where there was an indication of a need for sidewalks in those areas, they
were classified as either Zone 1 or Zone 2; and if one of those came up, Council
could on its own initiative decide to utilize Matching Funds regardless of the
land use.
It was moved by Councilman Temple and seconded by Councilman DiLoreto that
Council approve the Policy on Sidewalk Matching Funds revised July 23, 1974, with
the change that it read only R-1 owner -occupied and not any R-2 property.
Councilman DiLoreto qualified his second to the motion indicating that he is
satisfied with the policy as it is enunciated.
Councilwoman Scotto pointed out that since there is so much spottiness in the
sidewalk system, she would like to see what the Staff recommends as the best kind
of program before deciding and not just a policy on what Council opinion is.
The matter was taken under submission. The motion and second were withdrawn.
Non -sale Use of wine in the Downey Theatre -Community Center Complex
Following discussion, it was moved by Mayor Jennings and seconded by Councilman
DiLoreto to approve for a period of one year on a trial basis the use of champagne
or champagne punch in the Green Room, Patio, and Recreation Center of the Downey
Theatre, on the basis that it must not be sold but supplied by the host at no charge
to the people present. The Director of Parks & Recreation shall
report back to Council after one year so that the Council can at that time make a
decision requiring an annual report every year.

Referring to the Report, Meals on Wheels, Mayor Jennings indicated he had
requested and received an agreement written similar to the ones used for
co -sponsored groups. He further requested that it be taken out of the Revenue
Sharing category and put into the co -sponsored groups.
Mrs. Winifred Spracher, 7312 Rio Flora Place, answered questions by the
Council regarding food preparation, eligibility of subscribers, contributions to
the program, and how the program is financed in other cities.
It was moved by Councilman Temple and seconded by Councilwoman Scotto that
Council approve the Agreement with the organization, Downey Meals on Wheels, with
the change from Revenue Sharing Funds to Special Projects Funds, and authorize the
Mayor to sign.
Mayor Jennings commented he would favor approval of funds to Meals on Wheels
if,a£ter their corporation is formed, the people will show sincerity by raising
money and then coming back to Council and indicating they have done so.

Commenting on the Request from Downey Symphonic Society for reconsideration of
Budget for the additional amount of $1200, Mayor Jennings stated since the last
Council meeting he has consulted with County Supervisor Pete Schabarum and was in-
formed these funds cannot be made available until next year since the County's
co -sponsored budget has already been set and cannot be changed.
Councilwoman Scotto asked if Downey has its request in for next year.
Mayor Jennings responded in the affirmative, mentioning a study will be made
and submitted, based on the area population served by this symphony.
Councilman DiLoreto observed that a great amount of participation comes from
all ends of the County because Downey is the only City providing this kind of
function.
It was moved by Councilman DiLoreto, seconded by Councilman Temple, and passed
by the following vote to approve allocation of an additional $1200 for disbursal to
the Downey Symphonic Society on a matching fund basis of dollar for dollar of money
generated by the Society's fund-raising activities.

ORAL COMMUNICATIONS
Mr. H. L. Brady, 8503 Luxor Street, protested conditions of Underground Utility
District No. 7 pertaining to front yard setback.
Mayor Jennings explained there is no right-of-way being taken, and Mr. Brady's
property line will not be reduced.
Mr. Deichman, 8459 Luxor Street, opposed the widening of Brookshire Avenue in
connection with Underground Utility District No. 7.
Discussion followed.
Mr. Ken Miller, 7336 Cleargrove Drive, commented on the Lighting District Tax
Rates and raised questions regarding the levying of the tax rates.
The Council set Friday, September 6, 1974, 5:30 p.m., for study session on the
Proposed Dissolution of the County Lighting District and Annexation to the Citywide
Lighting District.
Community Development Director Spindel gave a report on the Cost of Renting a
Street Flusher. He said two areas have been investigated: One, being a commercial
rental company that would rent a 2,000 gallon tank at $900 per month,plus fuel and
maintenance at $250 per month, or a total of $1150; the second being the City of
Santa Fe Springs which has al,500 gallon street flusher used only two days a week;
that they would lease it to the City of Downey on the other three days each week,
if desired, for $40 per day plus fuel; and this would be a considerable savings.

by the following vote to rent a Street Flushing Machine from the City of Santa Fe
Springs for a period not to exceed 30 days.

flusher is being used.

City Planner Goggin announced the Planning Commission will be conducting its
first study session on the New Zoning Ordinance tonight at 5:00 p.m. in the Planning
Department.
Finance Director Patton thanked the Council for its indulgence of the photo-
graphers during the Council meeting. He said the pictures are expected to beautify
the Annual Report.
Councilman Temple inquired about the water behind Albertson's Market.
Building Official Lake said plans are being prepared between Albertson's and
the Southern Pacific Railroad for a drain that will handle the entire area.
Councilman Temple questioned the problem of noisy mufflers on motor bikes.
Police Chief Morgan said bikes without mufflers can be cited, but bikes manu-
factured that way would require State legislation.
Councilman DiLoreto directed a remark to Mrs. Spracher of Meals on Wheels,
stating that if within the next 30 days or so the organization starts functioning
and is able to operate on the same basis as some of the other co -sponsored groups
operate with sharing expenses, and if the Council knows there is actual participa-
tion, he would be in favor of adding the group to the City's co -sponsored
arrangement. Also, he said, if they have pledges, this would be adequate reason to
go ahead and ask that Meals on Wheels be placed on the Council Agenda again for
consideration.
Councilman DiLoreto called attention to the exhibit of Western Art at the
Art Museum and complimented Beverly Inman on an outstanding exhibit.
Councilwoman Scotto pointed out the one difference she sees in the Meals on
Wheels and the other co -sponsored groups is that the others are recreational and
Meals on Wheels is strictly a volunteer program.
Councilwoman Scotto reported she has met with an R.T.D. consultant who was
hired to recommend intra and inter -city bus service covering Cerritos and other
areas. She said the Assemblyman Gonzalves Amendment, which allows funds to return
to cities from Municipal Bus Service if the one -cent sales tax passes in November,
has passed the Legislature and Governor Reagan has signed it.
Mayor Jennings read a letter written on the back of one of the Notices of
Improvement posted in connection with the Lighting District and inquired if the City
might make some improvements in the wording to make the notices more descriptive.
City Manager Thompson replied Staff is working with the City Attorney on this
problem to see if additional information can be added to the legal notice.
There being no further business to come before the City Council, the meeting
was adjourned at 11:25 a.m. to 5:30 p.m., September 6, 1974, in the Council Chambers
of the Downey City Hall for study session on the proposed Lighting D,�stricts.
