AUGUST 12, 1974
The City Council of the City of Downey held a regular meeting at 7:30 p.m.,
August 12, 1974, in the Council Chambers of the Downey City Hall, Mayor
Richard M. Jennings presiding.

The Invocation was delivered by Reverend Ivan York, Downey Tabernacle
Church, followed by the Flag Salute led by Assistant City Manager Donald Robison.
Mayor Jennings declared that this is the time and place for the public
hearing on Downey City Lighting District Annexation 74/14 Downey Avenue. He
inquired if the Deputy City Clerk had the Affidavit of Posting of Notice and
Affidavit of Publication, to which she responded in the affirmative.
It was moved by Councilman Temple, seconded by Councilwoman Scotto, and so
ordered to receive and file the Affidavits.
Mayor Jennings inquired if the Deputy City Clerk had received any written
protests or objections, and she replied she had not.
Mayor Jennings inquired if there was anyone present who wished to speak in
favor or in opposition to the Annexation, and there was no response.

RESOLUTION NO. 2992
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING ANNEXATION OF A CERTAIN AREA TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON
STREETS AND PUBLIC PLACES WITHIN THAT AREA UNTIL
JANUARY 31, 1983 (ANNEXATION 74/14)
The Resolution was read by title only. It was moved by Councilman Temple,
seconded by Councilwoman Scotto, and so ordered to waive further reading.

passed by the following vote to adopt Resolution No. 2992.

RESOLUTION NO. 2993
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR CHAPTER 27 PROCEEDINGS
FOR DOWNEY IMPROVEMENT PROJECT NO. 650, NORTH SIDE OF
STEWART AND GRAY ROAD BETWEEN OLD RIVER SCHOOL ROAD AND
POMERING ROAD
The Resolution was read by title only. It was moved by Councilman Temple,
seconded by Councilwoman Scotto, and so ordered to waive further reading.

Councilman Temple inquired why the costs for Site 1 were greater than

Community Development Director Spindel replied the estimate did not include
driveway, plus the costs have gone up.

Development to proceed with construction on Downey Improvement Project Nos. 643A

Mayor Jennings declared that this is the time and place for the public
hearing on Appeal, Zone Exception Case No. 1176, 8020 DePalma Street. He
inquired if the Deputy City Clerk had the Affidavit of Publication, to which
she responded in the affirmative.
It was moved by Councilwoman Scotto, seconded by Councilman Temple, and so
ordered to receive and file the Affidavit.
City Planner Coggin displayed a land use map, plot plan, and zoning map and
commented on the zoning of the surrounding properties. He stated there was no
opposition at the Planning Commission hearing, however, at the continued hearing,
there was opposition with a petition presented, and after determination, the
Planning Commission recommended approval of the 16 units.
Councilman Temple inquired regarding the number of guest parking spaces.
Mr. Coggin said there are three for the 16 units, and if necessary, another
is available. He mentioned the General Plan adopted in 1963 and revised and
adopted in 1973 indicates development for this area as R-3 with commercial to
the south. He stated the hope has been to entice R-3 development to keep the
commercial from extending north to the residential on DePalma.
Responding to an inquiry regarding traffic in the area, Mr. Coggin said it
was felt traffic was not a major problem. He commented the Traffic Department
found nothing damaging in the additional cars, and there would be very little
conflict with the school in the area.
Mayor Jennings inquired if the Deputy City Clerk had received any
correspondence on this matter, and she replied she had not.
Mr. Coggin indicated his office has received a letter from a property owner.
Mayor Jennings advised this hearing is out of the normal in that those pre-
sent wishing to speak in favor of the appeal would be in opposition to, the
Planning Commission's decision to approve the Zone Exception; anyone wishing to
speak in opposition to the appeal would be in favor of the Planning Commission's
decision.
Mayor Jennings inquired if there was anyone present who wished to speak in
favor of the appeal.
Mr. Russell Cormack, 7978 DePalma Street, said the driveway of the proposed
development is on one of the crooks in the road.
Mr. Coggin stated the driveway is in the straight portion of the road.
Referring to Sections of the Downey Municipal Code, Mr. Cormack said the
development would not be in harmony with surrounding property in the neighbor-
hood, and there are no R-3 zones on DePalma. He indicated, however, he would
not object to C-1 on DePalma. Mr. Cormack submitted photographs to the Council
showing the parking in front of apartments on Downey Avenue and vacancy signs.
Again, he stated, the development would not be in harmony with the other buildings
on DePalma, it would depreciate the other properties, and it would be setting a
precedent and create spot zoning.
Responding to Mr. Cormack's remarks, Mr. Coggin pointed out the property
would not be orientated for normal commercial use because it is on a side
street and, therefore, would be orientated to the school for food sales.

ordered to receive and file the photographs submitted by Mr. Cormack, which are
on file in the office of the Planning Division.

Mr. George Allison, 8226 DePalma Street, discussed the traffic problems on
DePalma particularly during the school year and said he is in favor of the appeal.
Mr. Leo B. Erlich, 8258 DePalma Street, commented on the parking and said he
would prefer duplexes over apartments.
Mr. Bob Thompson, 7973 DePalma Street, spoke in favor of the appeal.
Mrs. Maeta Goodwin, 11829 Morning Avenue, speaking in favor of the appeal,
stated her opposition to the construction of apartments and asked if there was a
possibility of commercial going in.
Mr. Goggin replied that if anyone wants to build for commercial purposes on
the portion of the property zoned C-1, a permit would have to be issued, and
this property was zoned prior to the City's incorporation. He discussed pro-
cedures involving a zone change.
Mr. Salvatore Domenici, 11825 Samoline Avenue, said his property is directly
west of Paramount at DePalma and indicated traffic is an impossible situation.
He expressed his opposition to the encroachment of apartments in residential areas.
Mr. Goggin explained when the General Plan was adopted in 1963 and revised
in 1973, there were prolonged public hearings before the Planning Commission and
City Council, and no objections were stated to the R-3 proposed use of thie
property.
Mrs. Ann Keener, 8278 DePalma Street, spoke in favor of the appeal and dis-
cussed the traffic problems and parking problems along DePalma.
Mr. Joe Renard, 8128 DePalma, discussed the traffic on DePalma and stated
his opposition to construction of apartments.
Mrs. Frances Cormack, 7978 DePalma, said she is in favor of the appeal.
Mayor Jennings inquired if there was anyone present wishing to speak in
opposition to the appeal.
Mr. Richard C. Roehl, 7950 Springer Street, Downey, representing the appli-
cant for zone exception, said he is the proposed builder under this project and
the people on DePalma do have a traffic problem. He submitted photographs of
the subject property.
It was moved by Councilman Temple, seconded by Councilwoman Scotto, and so
ordered to receive and file the photographs, which are on file in the office of
the Planning Division.
Mr. Roehl remarked the property is now a thoroughfare for students of
Warren High School traveling to the business facilities on Stewart and Gray Road.
He mentioned the majority of the people signing the petition in this matter re-
side on the west side of Paramount Boulevard and should not be effected. Mr.
Roehl commented on the proposed project, stating he does not feel there will be a
problem with residents and visitors parking on DePalma. He further indicated a
study was performed by the City to find out the apartment vacancy factor, and it
was determined the factor was a low 1.3 percent.
Mr. Goggin stated the percentage was determined within the last month and
was 1.39 percent.
Mr. Roehl mentioned that the Downey Traffic Department conducted a traffic
study on DePalma in front of the proposed project, and the 24-hour average of
3419 vehicles is quite high. He pointed out that he never would have proposed
this project if he had not done some studying to see the area was master planned
for R-3.
Mr. Vernon Blythe, 2658 Summit Drive, Escondido, owner of the property, said
the majority of his assets and income are coming from the properties on two sides,
and he would not do anything that would destroy property or values in the area.
He discussed the zoning and stated he has dedicated portions of his property for
street and sidewalk improvements, put in at his expense. Mr. Blythe commented on
the close proximity of the high school and said the property owner to the east is

highly in favor of this project. He said if he has to, he will develop the pro-
perty as commercial and put in a driveway and generate more commercial traffic
onto DePalma.
Mrs. Orleda Moore, owner of the adjoining property to the east, indicated
the proposed development would be an improvement to the street, and she does not
see how the traffic could be more congested.
Mr. Robert Irvin, 9131 Florence Avenue, said he is employed by the Hoag
Company as a commercial property salesman and his firm has listed this property.
------ He discussed development of the property and described its present condition.
Mr. Irvin noted he had seen a design of the proposed development and feels it is
architecturally designed, attractive, it will be welt built, it complies with
every requirement of the Planning Commission, and should attract good tenants.
Mr. Keith Moore, 8028 DePalma, commented the property is used as a thorough-
fare by the high school students, and there is quite a bit of debris as a result.
He said he is in opposition to the appeal.
Mr. Frank P. Evola, 10612 Paramount Boulevard, discussed the design of the
building and pointed out the driveway is not in the crook of the street. He
said a wide buffer strip is planned against the east side of the property, there
will be a wide driveway, and 17 to 18-foot setbacks. Mr. Evola stated there is
a required number of parking spaces, and there is more recreational area than is
required by the City. He said one more guest parking space could be added, if
necessary.
Mayor Jennings inquired if there was anyone else present wishing to speak in
opposition to the appeal, and there was no response. He offered rebuttal time to
the appellant.
Mr. Russell Cormack, 7978 DePalma, said he lives on the west side of
Paramount and was notified of the Planning Commission hearing through a notice in
the mail.
It was moved by Councilman Temple, seconded by Councilwoman Scotto, and so
ordered to close the hearing.
Mayor Jennings mentioned in consulting with the City Attorney, he has been
advised that it takes a majority of the Council in this case to rule one way or
the other. He said one vote against a motion could defeat, and this would not be
fair to either the appellant or opposition. Mayor Jennings indicated he would
take this matter under submission until the next Council meeting to allow one of
the Councilmen who are absent to listen to the tape of this hearing, read the
Minutes of the Planning Commission, and look at the pictures.
Mr. Goggin presented a Letter from Mrs. Moore received prior to the meeting.
The Letter is on file in the office of the City, Clerk.

passed by the following vote to take Appeal, Zone Exception Case No. 1176, under
submission to 8:00 a.m., August 27, 1974.

Mayor Jennings informed those present that there will be no more testimony
from the public on this matter, but there will be discussion among the Council.
He requested that the newspapers publish the results of the Council vote so that
everyone will know what happened on both sides.
Mayor Jennings declared a recess at 9:08 p.m. The meeting resumed at
9:16 p.m. with Councilmen Temple, Scotto, Jennings present; Councilmen DiLoreto,
Winton absent.
Mayor Jennings introduced Councilman Moses of LaMirada.
It was moved by Councilwoman Scotto, seconded by Mayor Jennings, and passed
by the following vote to approve the Minutes of the City Council Meeting of
July 23, 1974.

Mayor Jennings inquired if the City Planner plans to send a reply, and Mr.
Goggin said yes.
Councilwoman Scotto asked that the letter be circulated prior to being
transmitted.
Petition from 29 residents on Second Street regarding No Parking at Specific
Time on Second Street between Paramount and Smallwood for Street Cleaning.
Community Development Director Spindel informed the Council that if it
wishes to go along with the petition and prohibit parking on Second Street between
Paramount and Smallwood for street cleaning, a resolution has been prepared for
Council action.
Councilman Temple commented on the problems in this area and said he is in
favor of the resolution.
RESOLUTION NO. 2994
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
PROHIBITING PARKING AT CERTAIN TIMES ONCE EACH WEEK ON
BOTH SIDES OF SECOND STREET BETWEEN PARAMOUNT BOULEVARD
AND SMALLWOOD AVENUE FOR STREET CLEANING

Mr. Sorensen suggested upon recommendation of the Police Chief and
recommendation of the insurance carrier the claim should be denied. He said this
does not preclude further discussion of the matter of the claim with the proper
official or proper insurance carrier and would be an appropriate matter for
executive session relating to pending or threatening litigation. He advised the
claims can be acted on altogether or separately, however, the carrier has
recommended all the claims be denied.
During discussion, Mr. Sorensen stated the present carrier has requested all
claims be denied, and this will give them the opportunity to discuss and investi-
gate but does not preclude settlement if the final analysis determines it should
be settled. He commented each of the insurance carriers may have a different
procedure to follow, and the Council may want to consider following the recommenda-
tions of the carrier, or run the potential risk of having the policy terminated.
Assistant City Manager Robison indicated the procedure set up under the
Administrative Regulation is now in the process of being revised to conform to
the new procedure, and it will be circulated to the department heads.
Mayor Jennings suggested the City Manager's office put out a procedure plan
for department heads to use in submitting claims --a standard form recommending
action.

Police Chief Morgan explained these funds have been made available for
departments in the entire County and State to upgrade their planning capabilities,
and applications were solicited by the Criminal Justice Planning Board for this
purpose. He said the Police Department has a Lieutenant assigned to many de-
tails, one of which is planning and research, however, he cannot devote full
time to that area because of other demands. Chief Morgan indicated this applica-
tion will provide one additional civilian personnel required to have a degree in
job administration in a comparable area who would be assigned to the research
and planning function under the Lieutenant. He said the funding is for one year,
it can be continued and renewed again for each year for three years, and after
the three years, that person can be absorbed by attrition. Chief Morgan further
explained the amount to apply for the funding will come out of the Police
Department budget.

Responding to questions, Finance Director Patton said although this is not
his program, he has been somewhat involved, and it is his understanding since
there are CETA funds available to cover what the City budgeted for, the
budgeted money would not be required.
Mayor Jennings suggested this matter be taken under submission.
Police Chief Morgan explained this is only a resolution establishing a
records retention system.
City Attorney Sorensen advised that Resolution 1932, which is an older
resolution, does provide for certain other things which are permitted by other
sections of the Government Code. He suggested in the proposed Resolution that
Section 2 be modified to add to the first part thereof, "Subject to the
provisions of Section 34090.5 of the Government Code,".
Mayor Jennings inquired regarding the annual cost of the program.
Mr. Patton replied he cannot speak to the cost, but it is his understanding
the Resolution would bring the City's resolutions on capabilities into line with
the new State laws. He said the basic changes are it does not require the City
Attorney's approval for all destruction, and secondly, microfilm can be used.
Mr. Sorensen commented on Sections 34090 and 34090.5 of the Government Code
which provide for the destruction of certain records under certain conditions.
He said if the City Council adopts both sections, flexibility will be provided
for determining which records will be microfilmed and which will be destroyed
with the consent of the City Attorney and City Council without being microfilmed.
Mayor Jennings again raised questions regarding annual cost for this pro-
gram and whether there will be a continuing cost and ongoing program in one year.
The matter was taken under submission for further information.
Mayor Jennings asked the City Manager to report back with original cost
for this year and cost for the next and ensuing years of the program.

Report on Street Cleaning
Speaking to the street flushing process, Community Development Director
Spindel said it is his recommendation to consider renting a flusher for approxi-
mately a month to see how it works and then make arrangements for a demonstration
on vacuum sweeping. He indicated if a demonstration is set up, he would want
the Council to be present. Mr. Spindel commented on the flushing of flat
streets as well as methods used by other cities. He stated very few cities do
the entire city with flushing --if they are flat, they only do the downtown areas.
He indicated Downey does not have a sufficient storm drain system with enough
catch basins in the corners to pick up the water, and in many cases, the water
would have to travel a distance before coming to a catch basin.
Councilwoman Scotto remarked she would like to see the vacuum sweeper
demonstration. She asked if recommendation two on Page 4 of the Report includes
the posting of signs. Mr. Spindel replied yes.

passed by the following vote to adopt a policy that any group of residents on a
particular block by majority petition can request and the Council will consider
the adoption of a parking restriction for street sweeping, and that this policy
be publicized throughout the City.
Mayor Jennings mentioned one of the biggest problems will be prohibiting
parking on both sides of the street the same day, because there are many areas
where people have three and four cars. However, he said, he feels strongly that
one side of the street should be posted for a certain time.

Mr. Spindel indicated he can bring back a report on the alternate day
scheduling.
Mayor Jennings commented on several items contained in the report. He
noted that unless the no parking for street sweeping restriction is diligently
endorced by the Police Department, the streets will not be any cleaner with a
vacuum sweeper than they are now.
Mr. Spindel said in his observation, many parking restrictions are self -
enforcing, and most people are law-abiding and try to obey the signs.

Reconsideration of Downey Symphonic Society 1974-75 Budget Request
Mayor Jennings advised he had written a letter to Supervisor Schabarum and
received a response listing all of the cities in which the County donates to a
symphony with the city matching the funds. He mentioned several cities and the
amounts they receive from the County. Mayor Jennings said the City of Downey
donates $12,000 to its symphony with the County donating $7500; that the purpose
in writing the letter was to request the County to increase its expenditure to
$10,000, and he did not receive a reply to that request.

Councilman Temple indicated he would like to take this matter under sub-
mission for further investigation.
Councilwoman Scotto suggested sending another letter.
Parks & Recreation Director Ruth said with the approved amounts from the
City and the County and the additional money the symphony raises itself, he is
sure it would be sufficient until such time as this matter is investigated
further. He commented that Supervisor Schabarum's letter in effect suggested
the Downey Symphony pursue other fund-raising means in addition to coming back
to the City for an additional appropriation. He said it is the Park &
Recreation Commission's position it would reconsider this matter if the County
did deny the request; that although the Commission felt there were other possi-
bilities the Symphony could pursue, it is recommending an increase in the
budget to the City Council, providing the Symphony also demonstrated initiative
to raise any amount of money on its own.
Discussion followed.
Councilman Temple inquired if the City increased the budgeted amount $1200,
would the Symphony have to raise a like amount.
Mr. Ruth replied yes, in the Symphony's budget, it identified what the pro-
jected incomes were for the year.
Councilman Temple stated his desire to contact the County once more in an
attempt to obtain a definite answer to the request.
Councilwoman Scotto concurred.
The matter was taken under submission.
Parks & Recreation Director Ruth requested the Productivity Improvement
Agreement be carried over to the next meeting, inasmuch as there is some concern
regarding Section 9 pertaining to Reimbursement. He said if this matter were
deferred to the next meeting, it would give the City Attorney sufficient time to
review this particular provision and it would not have a detrimental effect on
the contract for September 2nd as proposed.
Mayor Jennings asked if this is to be funded out of Revenue Sharing.
Finance Director Patton replied it was the City Manager's recommendation
that it be funded from the Revenue Sharing Funds. He said it is a legal use of
those funds.
Mayor Jennings mentioned when Revenue Sharing became a fact on October 6,
1972, the Council received a memo from the City Manager as of that date regard-
ing the Revenue Sharing Program. He said on page 2 of that memo, it was noted
these funds would be in addition to the City's present Capital Outlay funds, and
it was designated where the Revenue Sharing Funds would go from 1972 through 1976.
Mayor Jennings reminded the City Council that the previous Council has gone on
record stating all Revenue Sharing Funds are going to be for capital improvement
only, and the suggestion to take $30,000 to $50,000 out of Revenue Sharing for a
survey and $5676 for another purpose is not the intent of the use of Revenue
Sharing Funds in the City.
Councilwoman Scotto indicated Revenue Sharing Funds were discussed during
budget sessions, and it was her understanding that at any time it was so
determined, the funds could be used for whatever purpose.
Councilman Temple stated it is his recollection the funds were not
necessarily for capital projects but were not to be spent for ongoing projects.
Following discussion regarding the savings that would result from productivity
program, this matter was taken under submission.
Appraisal Services of City Building and Improvements
Finance Director Patton explained it is imperative from an accounting stand-
point and possible Loss standpoint to maintain proper depreciated values for
insurance and Legal purposes. He said the service is nominal in cost especially

on an on -going basis once the original appraisal is done to maintain it each year.
Mr. Patton further explained if the Council gives approval to this original apprai-
sa] then it will be necessary to get approval to have it done on an annual basis
at a nominal $200 to $300, which would be built into the budget for further
Council approval.

CITY MANAGER'S REPORT
Request for Revenue Sharing Funds - Downey Meals on Wheels
Mayor Jennings reminded the Council that he is against using Revenue
Sharing Funds for an ongoing project, and he suggested the money be appropriated
out of the balance in the Decorating and Promoting Fund.
Councilwoman Scotto said this is a pilot program to determine the need. She
indicated it would be a one-time allocation with an evaluation at the end of the
year.
Mrs. Eileen Holman, 9856 Pangborn Avenue, Downey stated letters are being
sent to all of the women's organizations and church organizations requestingthey
write this program into their budget. She said they have approval from the
Downey Community Hospital, and the meals will be served from there.
Councilman Temple commented he has not received any correspondence and
would like to take this matter under submission.
Mrs. Holman explained the program is for anyone incapacitated who cannot get
out to shop for themselves and prepare their own meals. She said the meals are
supplied at food cost only and all of the help is volunteer. Mr. Holman men-
tioned this budget takes into consideration serving 50 clients, and it is believed
within 12 months they will be serving between 95 and 100.
Councilwoman Scotto commented on other Meals on Wheels programs in the
County and said she feels this area should be explored to see if there is a need.
Mrs. Holman further discussed the program and mentioned they are presently
waiting for the return of their incorporation papers.

without a recommendation or study by the City Manager. He requested that the
City Manager provide a more detailed report and that the Council hold this matter

ORAL COMMUNICATIONS
Mrs. Claire Yonan, 10002 Lesterford, Downey, commented on how the Meals on
Wheels Program can be of benefit to a few elderly citizens of Downey who live
alone and have no outside contact, and to handicapped and disabled persons.
Discussion ensued.
Mrs. Holman responded to questions of Councilman Temple.
Mr. Kenneth Miller expressed his views regarding contact with the property
owners concerning zone exceptions and General Plan hearings. He indicated he
feels people should be individually advised by mail of any change that would
effect their neighborhood.

City Planner Coggin informed the Council and those present in the Chambers
that the City Planning Commission will hold its first public hearing September 18th
on the Zoning Ordinance, including all segments. He said there will be
publicity, however, there is no way of notifying every property in the City, so
they are relying on the newspapers. Responding to remarks of Mr. Miller, Mr.
Coggin stated during General Plan hearings, questionnaires were given to all of
the service clubs in the City, questionnaires were displayed at banks, and there
was notification in the newspapers. He pointed out there was less than a two
percent reply.
Mrs. Ida Wilkins, 12210 Rives Avenue, indicated people are not usually
aware of what is occurring within the City unless they become personally involved.
Councilman Temple noted a week problem located at property on the west side
of Paramount Boulevard between Fourth Street and Fourth Place.
Councilwoman Scotto reported that she, Mr. Thompson, and Mr. Spindel
attended the R.T.D. Corridor Meeting, and it was the consensus of all cities
except Whittier that the Santa Ana Freeway was the most travelled and should be
the corridor. She said she did voice opposition to anymore property being used
for the Freeway.
Councilwoman Scotto also reported on her attendance at a SCAG Executive
Meeting on the Solid Waste and Water Program.
Mayor Jennings stated he was opposed to the Bicycle Trail signs on Rives
Avenue but did agree they could be posted until September 1973. He indicated he
would like to see the signs removed.
Councilman Temple said a bicycle route study is about to be culminated, and
he cannot see any advantage to removing the signs. He mentioned the route was
originally proposed to extend from Furman Park to Golden Park, however, it was
changed. He said if the route had extended to Golden Park perhaps it would have
presented a true picture.
There being no further business to come before the City Council, the meeting
wasadjourned at 11:09 p.m.
