OF THE CITY OF DOWNEY
JULY 8, 1974
The City Council of the City of Downey held a regular meeting at 7:30 p.m.,
July 8, 1974, in the Council Chambers of the Downey City Hall, Mayor Richard M.
Jennings presiding.

The Invocation was delivered by Reverend Percival Henkelman, Moravian Church,
followed by the Flag Salute led by Finance Director Patton.
With the assistance of Roseanna Castillo, Mayor Jennings presented Honorary
Citizen Cards to visiting students from Downey's Sister City of Guadalajara.
Mr. Scott Temple, president of the Sister City Committee, commented on the
Youth Exchange Program.
It was moved by Councilman Winton and seconded by Councilman Temple to approve
the Minutes of the City Council Meetings of June 10, 1974 and June 25, 1974. (See
amended motion.)
Councilwoman Scotto pointed out the vote on the top of Page 5 of the Council
Minutes of June 10, 1974, should read: AYES: Temple, DiLoreto, Winton, Jennings;
NOES: Scotto.
Councilwoman Scotto noted the action contained on Page 2 of 2 of the Table
of Minute Actions of the Council Minutes of June 25, 1974, for R/w Acquisitions,
Woodruff n/o Firestone, should read: Taken under submission.

by the following vote to amend the motion to approve the Minutes of the City Council
Meetings of June 10, 1974 and June 25, 1974, to include the corrections noted.

In regard to Item G2c on the Agenda pertaining to Zone Exception Case #1176,
it was noted the public hearing will be held on August 12th. The hearing procedure
was explained to the people in the audience who were present to appear on this
matter.

Communication from the United States District Court, Northern District of
Illinois, regarding Purchase of Motor Vehicles by Government Entities.
City Manager Thompson advised if the Council takes no action, it would be
deemed the City will become part of the action, and it was his suggestion the
Council do this. No action was taken.
Communication from Los Angeles County Chief Administrative Officer regarding
Renewal of General Services Agreements. Filed.
Discussion followed regarding the services utilized by the City under the
Agreement.
Communication from Downey Chamber of Commerce regarding Quarterly Report,
April 1 - June 30, 1974.
It was moved by Councilman DiLoreto, seconded by Councilman Temple, and so
ordered to receive the Quarterly Report for the period of April 1st through
June 30th and make the allocation of $2250 per the agreement.
Councilman Winton requested a report from the Chamber to the City Council
relative to its efforts to recruit additional companies or additional businesses
into the City in the last year.
The City Manager was directed to send an excerpt of the Council Minutes to
the Chamber of Commerce prior to the next quarterly request for funding.
Communication from Charles W. Thompson, City Manager, regarding Downey's
Opposition to Southern California Edison Company's request for Rate Increase.
Communication from Los Angeles County Facilities Department regarding Jury
Assembly Room Facility.
Community Development Director Spindel noted this location is next door and
to the south of the Meralta Theatre, and there is a large parking lot to the rear
of the building.
The City Manager was requested to send the written statement of approval
required by the County.

Community Development Director Spindel reported on the lights to be installed

Mr. Spindel indicated the charge for maintenance and operation is estimated
for the next fiscal year and is based on the current assessed valuation because
of the increased cost in electricity.

Finance Director Patton explained there are similar entry levels of clerk
positions in his department, and there is a difference in the entry level pay
between those positions. He said it is his feeling the 122 classification is a
proper level for this kind of clerical work.

RESOLUTION NO. 2979

AUTHORIZING PARTICIPATION IN REGIONAL APPLICATION TO
CALIFORNIA COUNCIL OF CRIMINAL JUSTICE FOR YOUTH SERVICE
SYSTEM

City Manager Thompson explained it is a youth -orientated service system to
offer to those who may be appearing before the criminal justice system a referral
service for counseling or other services that might be available. He said the
deadline is July 15th, and it was necessary to bring this resolution at this time
indicating the City's willingness to participate in the program. Mr. Thompson
noted the program was received at City Hall last Wednesday.
Police Chief Morgan stated this is a multi -jurisdictional program and
directed toward diverting youths from the criminal justice system for one-time
offenders and those who seem to be runaways and having home problems. He commented
there would be a staff established to determine good referral agencies and

follow up on the kinds of agencies accepting referrals and measure and evaluate
their success. Chief Morgan indicated staff of this particular group would
consist of a sheriff, a Downey police officer, a school representative, a cleri-
cal person, and an analyst for the evaluation of the function of this youth
diversion staff. He pointed out moneys have been set aside in the amount of
$240,000 for the cities of Artesia, Bellflower, Cerritos, Downey, Hawaiian
Gardens, Lakewood, and Paramount, and of that amount, based upon juvenile
population, Downey's portion would amount to $3733. Chief Morgan commented that
looking at the services that would be obtained, Downey would be getting about
$46,000 worth of services of that funded amount.
Responding to questions, Chief Morgan said the referral service would be
centrally located among the cities involved.
Mr. Thompson mentioned under this program, the City of Downey would act as
the prime sponsoring City, in that it would receive moneys and disburse them, and
the City would be reimbursed for any overhead expenses.
Chief Morgan stated this would require one additional sworn personnel for
the Police Department, which would be funded out of this money. He said it is a
one-year grant which could be extended to two years.
Discussion followed.
Councilman Winton pointed out the resolution simply authorizes participation
to apply for a grant for a juvenile diversion project, and there is no assurance
that Downey is going to receive it. He stated further that the Council should be
able to rescind the resolution immediately by another resolution if administration
of the program is more than the City wants to undertake.

RESOLUTION NO. 2980

TO MAKE USE OF COMPREHENSIVE EMPLOYMENT TRAINING ACT
FUNDS,

City Manager Thompson explained the objective of the program is to hire
unemployed persons, provide on-the-job training with the Federal Government pro-
viding all of the funds, and then the City is to do its best to try to place a
minimum of 50% of the people that are hired under this program by the end of that
year, or place them with another agency or private employer that might be
available.
Councilman DiLoreto inquired about fringe benefits.
Mr. Thompson said the people hired are required to be covered by Workmen's
Compensation, Social Security, etc., and would not be employees of the City but
would be employees of the program.
Commenting further on the program, Mr. Thompson stated every attempt will be
made to secure residents of the City who are unemployed; that if someone is hired
from outside the City, it could be on an exchange basis with the City in which
that person lives.
Mayor Jennings made inquiries regarding the hiring of an unemployed graduate
honor student of Downey High School.
Mr. Thompson explained the purpose of the program is to try to take people
who do not have employable skills and teach them employable skills.
Councilwoman Scotto asked about filling the need for a Planner under this
program.
Mr. Thompson replied that a Planner must be someone who has had previous
experience and formal education in Planning.

Councilman Temple asked that the people be Downey residents or in exchange
with another City.

At the request of the City Manager, Cash Contract #350 Tennis Courts,
Bellflower Boulevard, was deferred to the next meeting to allow further time for

Right-of-way Acquisitions in Exchange for Improvements at 11026, 11102 and
11108 Woodruff Avenue
City Planner Goggin drew an outline on the chalk board of the area involved.
He said the improvements are a condition under a zone exception case.
Community Development Director Spindel explained the three lots involved were
included in the zone exception, and previous to the zone exception being applied
for, the rest of the lots included in this development had voluntarily dedicated
right-of-way in return for agreements for the City to put in curb, gutter, side-
walks, and paving. He noted the zone exception was applied for on September 10,
1973, and the request for dedication of right-of-way was made several days later.
Mr. Spindel indicated the criteria in the past has been the City does exchange
for right-of-way on select system streets when it is voluntary prior to any
Planning Commission action or requirements under the Building Code.
Mr. Spindel answered questions of the City Council. He explained the posi-
tion takenby the Planning Commission regarding improvements required under a
zone exception.
Discussion followed.
Mr. Jack Robinson, office located at 8041 Florence Avenue and home located
at 8555 Gainford, Downey, adding to the sketch on the board, said there are six
additional lots to the north of the properties involved, making a total of nine
that were contacted by the City to exchange land for right-of-way for improvements,
six of which responded. The three properties that did not respond are the pro-
perties under discussion. Mr. Robinson discussed his contacts with the City's
former right-of-way agent, the conversations that took place, and his attempts to
have the deeds for right-of-way dedication signed by the three property owners
prior to the time of the zone exception case.
Mr. Spindel explained that the improvement of Woodruff Avenue was budgeted
for quite a few years and was held back pending a storm drain project. He said
the City went out to acquire the properties to get ready to widen the street.
Responding to questions, Mr. Spindel indicated that the deeds were received
prior to the ruling of the Planning Commission, but after the application for the
zone exception, and it is a question of policy. He said if the developer is to
take advantage of a zone exception, he cannot obtain a building permit until all
of the conditions of the zone exception are met, per phase.
Mr. Robinson commented on his contacts with the owners of the three properties
in question.

by the following vote to approve the request for right-of-way acquisitions in
exchange for improvements at 11026, 11102 and 11108 Woodruff Avenue.
Councilman Temple discussed the R-3 zoning of the properties along Woodruff
Avenue.
Councilman Winton commented there are four days in question relative to the
filing and submission of the deeds, and certain circumstances prevented the
filing of the deeds which cannot be verified because of the demise of the City
employee who originally handled this matter. He said he would not and never has
held with someone filing a zone exception and asking for transfer of privileges
for sidewalks thereafter, and he was one of those to help initiate a policy to
stop this when he first came on the Council. Councilman Winton indicated in this
particular instance, he believes there are certain circumstances to warrant con-
sideration of the City Council to the affirmative, and that is the reason for his
second to the motion.

CITY MANAGER'S REPORT
Speaking to the matter of the construction of the new No. 1 Fire Station,
City Manager Thompson said it has become necessary for the prime contractor to
replace the masonry sub -contractor. He said although the name of the new
sub -contractor is not known at this time, he would request authorization from the
Council to go ahead and approve the sub -contractor as brought forth by the prime
contractor, and then he will bring the name of the sub -contractor to the Council
for confirmation at its next meeting.
It was moved by Councilman Winton, seconded by Councilman Temple, and passed
by the following vote that staff be authorized to thoroughly check out the
qualities of the work record for the proposed new sub -contractor and the main
contractor and be authorized to allow them to proceed with the job if it is
proven to be consistent.

ORAL COMMUNICATIONS
Mr. William Matters, 9247 Cord Avenue, Downey, spoke to the Council regarding
the Elks Club Ecology Program for the City of Downey. He referred to a similar
program now being conducted in another City. Mr. Matters again emphasized the
program is intended to provide jobs for the youth of the community.
City Manager Thompson indicated he will have a report back to the Council
on the status of the proposed program and he will assist in arranging a meeting
between (Rio Hondo Disposal Co.) Mr. Megargee and Mr. Matters.
Police Chief Morgan inquired regarding the status of the Three Additional
Detectives requested for Police Department staff. He was informed the matter is
sti11 in abeyance.
Mayor Jennings requested the City Clerk to place this matter on the next
City Council Meeting Agenda.
Councilman Temple asked if the City has experienced any problems on its
Obsenity Ordinance for controlling newsrack material. Chief Morgan replied no
increase in such newsrack type of publications has been reported.
City Manager Thompson said attempts are being made to contact owners of
such newsracks.
Acting City Attorney Lennard reported that the U.S. Supreme Court opinion
has no effect upon the newsrack ordinance; that the newsrack ordinance might
encounter trouble in view of the Los Angeles case now before the Superior Court
and under submission.
Mr. Jack Robinson asked if there is a City ordinance as to public parks re-
garding (nude) sunbathing in parks.

Parks Director Ruth said such controls were implemented approximately three
years ago.
Councilman DiLoreto commented on serious abuse of elected authority and
elected power usurption and twisted exercise in the judicial giveaway program re-
cently experienced in Sacramento when some members of the Legislature voted
themselves a lucrative retirement program after losing out in the April elections.
He requested the City Attorney to look into the matter as to its legality.
Councilman DiLoreto urged the Council to adopt a resolution disapproving this
action and also asking the Legislature to rescind its action.
It was moved by Councilman Winton, seconded by Mayor Jennings, and passed by
the following vote that the Bellflower Boulevard Park be known as "Downey
Southeast Park".

Councilman Winton requested the City Clerk to air mail copies of the Agenda
and Council Minutes to him at his summer address.
Councilman Winton commented on the Lapse of Maintenance on the 105 Freeway
Property by the State. He said vandalism is high, and he anticipates eight or
ten more years delay before the Freeway is constructed. Councilman Winton stated
the rental rate of homes adjacent to the freeway corridor is advancing rapidly,
the deterioration of the area is increasing, and several stores have closed be-
cause of loss of residents in the area. He indicated he thinks the Council should
initiate in the near future very serious legislation to terminate the Freeway
outside the City's boundaries, and he asked the Councilmen to tour the Freeway
area.
Councilman Winton said he anticipates returning to Downey in the last part
of August.
Councilwoman Scotto asked the City Manager if Downey is a member of SCAG.
City Manager Thompson said he has asked the SCAG director for contracts, they
are in the mail, and he will execute the contracts as soon as they are received.
It was moved by Councilman Temple, seconded by Councilman Winton, and passed
by the following vote to approve the appointment of Councilwoman Scotto to serve
on the Comprehensive Transportation Committee of S.C.A.G.

Mayor Jennings requested the Director of Parks d Recreation to bring back to
the Council proposed rules and regulations for serving alcoholic beverages in the
Green Room of the Downey Theatre. He said he would like the matter voted on at
the next Council Meeting.
Mayor Jennings proposed the resumption of Weekly Street Sweeping in the summer
and fall. The City Manager was requested to submit cost figures at the next Council
Meeting for vote.
Mayor Jennings asked the City Manager to bring to the next Council Meeting a
cost report for implementing a gutter flushing program for the 'City.
Mayor Jennings reported on the Bi-Centennial Liaison Committee. He said
Councilman Temple will serve as liaison and will report to the City regarding the
Bi-Centennial plans.
There being no further business to come before the City Council, the meeting
was adjourned at 9:52 p.m.
