Morton presiding. PRESENT: Councilmen: Joseph E. DiLoreto, Richard M. Jennings, Walter S. Temple, Donald H. Winton, Thomas H. Morton ABSENT: Councilmen: None ALSO PRESENT: Charles W. Thompson, City Manager Mark Allen, Jr., Acting City Attorney Ervin Spindel, Director of Community Development Richard D. Patton, Director of Finance James D. Ruth, Director of Parks & Recreation William A. Goggin, City Planner Ray Lake, Building Official Edwin H. Wood, Fire Chief G. Pete Stone, Captain, Police Department Harald J. Henriksen, City Engineer Robert L. Shand, City Clerk -Treasurer Judy McDonnell, Executive Secretary The Invocation was delivered by Reverend John Ashcraft, Trinity Baptist Church, followed by the Flag Salute led by Community Development Director Ervin Spindel. Mayor Thomas Morton introduced Mr. Michael Spandaw, teacher of Mathematics and Engineering, of Assen, the Netherlands. With the assistance of City Manager Charles Thompson, Mayor Morton presented five, ten, and fifteen year awards to the following employees and extended appreciation of the City Council for their service to the City. Reinhold Gitersonke, Public Works Jerry Michalla, Public Works Mayor Thomas Morton declared that this is the time and place for the public hear- ing on Weed Abatement Assessments. He inquired if City Clerk Robert Shand had the Proof of Publication, to which Mr. Shand responded in the affirmative. Mayor Morton inquired if the City Clerk had received any written protests, and the City Clerk replied he had not. Mayor Morton inquired if there was anyone present who wished to speak in protest to Weed Abatement Assessments,and there was no response. It was moved by Councilman Richard Jennings, seconded by Councilman Joseph DiLoreto, and so ordered to close the hearing on Weed Abatement Assessment. Ordered filed. Diversion Counselor Communication from Planning Commission regarding Request for Guidelines relative to Emergency Ordinance No. 435. City Planner William Goggin explained the Planning Commission is requesting clarification relative to density, whether incentives are to be entertained, and if so, to what extent. Discussion followed regarding recommendations of the Apartment House Survey Committee. Speaking to the three questions contained in the correspondence, Councilman Joseph DiLoreto stated in answer to the first question, it was his understanding the emergency ordinance applied to existing R-3 properties and any other property that was to be re -zoned or brought about by way of zone exception to be used for R-3. In answer to the second question, he said the purpose of the guidelines with respect to density was to allow flexibility in design and that the density would range from 26 to 29 units per acre, depending upon the design. Councilman DiLoreto stated regarding the third ques- tion, it was his impression an interpretation of incentive would depend on what is presented in the plans, such as the amount of open space available, amount of recreational facilities provided, underground parking, quality of construction, landscap- ing, security devices, etc. Mr. Goggin indicated the density proposed in the case before the Planning Commission is greater than what is recommended in the Apartment House Survey Committee's report. After further discussion, it was noted the Council's answer to the three questions contained in the communication are as follows: (1) Yes; (2) The emergency ordinance speaks for itself; (3) The emergency ordinance speaks for itself with regard to the guidelines that have been adopted to date. RESOLUTION NO. 2829 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY INITIATING PROCEEDINGS FOR THE TRANSFER OF CERTAIN UNINHABITED TERRITORY FROM THE CITY OF NORWALK TO THE CITY OF DOWNEY, PURSUANT TO THE PROVISIONS OF ARTICLE 4.5 OF CHAPTER 1, PART 2, DIVISION 2, TITLE 4 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA The Resolution was read by title only. It was moved by Councilman Donald Winton, seconded by Councilman Walter Temple, and so ordered to waive further reading.
