The City Council of the City of Downey held a regular meeting at 8:00 a.m.,
April 24, 1973, in the Council Chambers of the Downey City Hall, Mayor Thomas H. Morton

The Invacation was delivered by Mayor Thomas Morton, followed by the Flag Salute
led by Mr. Lyell Swearingen, President of the Downey Chamber of Commerce.
With the assistance of Public Works Director Ervin Spindel and Miss Public Works,
Sharon Ringo, Mayor Thomas Morton presented Zero Defects Quarterly Awards to Sam Kouri,
Junior Engineering Aid, and Robert Robuck, Maintenance Man.

and so ordered to approve the Minutes of the City Council Meeting of April 9, 1973.

Communication from Brent Bergh & Associates requesting a hearing on Appeal, Zone
Exception Case #1116, 9220 Telegraph Road.
It was moved by Councilman Joseph DiLoreto, seconded by Councilman Donald Winton,
and passed by the following vote to set a hearing on Appeal, Zone Exception Case #1116,
9220 Telegraph Road, on the basis of the Environmental Impact Report, for 7:30 p.m.,
May 14, 1973, in the Council Chambers of the Downey City Hall.
Councilman Richard Jennings asked if the communication requesting the hearing
fulfilled the requirements for an appeal. He also inquired if the Planning Department
has a form letter for distributing to applicants that contains points to be discussed in
a request for appeal.
Planning Director William Goggin replied the applicants are referred to a section
of the Code which spells out what they are supposed to show in their appeal, wherein the
Commission erred in its findings. He pointed out that the applicant in this case is an
expert in land use planning, re -zoning, and subdivision matters; that he should under-
stand the Code and what is required more readily than an average citizen. Mr. Goggin
stated under the Code, the communication requesting the hearing is adequate for an appeal.

Mayor Thomas Morton inquired if the Downey Chamber of Commerce still reviews re-
quests for rate increases. Mr. Lyell Swearingen, President of the Downey Chamber of

STATING OPPOSITION TO THE ROUTE 90 (SLAUSON FREEWAY)
AND OPPOSING ANY FUTURE FREEWAYS THROUGH THE CITY
The Resolution was read by title only,
Mayor Thomas Morton indicated the Council had previously taken similar action, but
since that time there have been some changes in. Sacramento. He said there are one or
two cities working hard to have both of the southern routes adopted, and both routes
would cut into a portion of the island in the City of Downey. Mayor Morton stated the
Resolution will be filed directly with the State.

Discussing the Wilderness Park project, Councilman Richard Jennings asked about the
funds to cover the three projects now before the City Council. City Manager Charles
Thompson explained moneys were budgeted both in the Capital Improvement Fund and Revenue
Sharing Budget. He said the moneys combined will cover these projects. It was noted
that the funds in the Capital Improvement Fund Budget included $150,000 for the project--
$100,000 for the development and $50,000 for the acquisition.
Responding to Councilman Jennings' inquiry regarding the engineer's breakdown on.
excavation, Public Works Director Ervin Spindel stated there are two types of excavation
involved --lake excavation and stockpile excavation, and he explained the difference
between the two.
Discussion followed.
Councilman Jennings asked about the installation of a hydraulic water system. as
opposed to electric. Parks & Recreation Director James Ruth replied it was the opinion
of the architect to use an electric water system instead of hydraulic; that the tremendous
number of shrubs and rolling topography at the park would require a more sophisticated
system. Mr. Ruth commented that the lines will be laid under the proposed walkways before
the irrigation system is installed.

Councilman Richard Jennings voiced his disagreement to installing an electric water
system when a hydraulic system was used at the Rio Hondo Golf Course. Parks & Recreation
Director James Ruth replied that a sophisticated water system was not required at the
golf course because it does not have the shrubs and topography that Wilderness Park will
have, and he commented on the functions of the electric water system. He explained that
he would still recommend a hydraulic system for the golf course.

for sidewalk and driveway.

CITY MANAGER'S REPORT
City Manager Charles Thompson stated pursuant to discussions and studies with the
Downey City Employees Association and Memorandum of Understanding of last year, it is
requested the City Council approve a two-year advance notice to withdraw from Social
Security, beginning the end of this fiscal year. He said in the interim, studies will
be conducted to see if the same coverage can be received under additional insurance at
considerable reduction in cost to both the employee and the City, with particular
emphasis placed on disability coverage.

SURVIVORS, DISABILITY, AND HEALTH INSURANCE) AGREEMENT
BETWEEN THE CITY OF DOWNEY AND THE STATE OF CALIFORNIA

ORAL COMMUNICATIONS
Mayor Thomas Morton reviewed his comments at the last Council meeting regarding the
Downey Centennial, and he introduced Mr, Lyell Swearingen, Chairman of the Centennial
Committee.
Mr. Lyell Swearingen spoke of the once -in -a -lifetime event of the Downey Centennial
celebration, and he said it will be necessary to have interim funds to cover expenses
during the period of forming the organization to plan the Centennial. He stated inasmuch

as most of the activities are fund raising, it is expected the organization will be
able to pay back most, if not all, of the funds advanced by the City. Mr. Swearingen
noted some of the planned events, and he mentioned a blue ribbon guest list could
include Governor Reagan, legislators, and people from Downey of name,
Councilman Richard Jennings explained there are two or three definite projects for
raising revenues, and through these projects, it is expected the City will be refunded
the total amount advanced to the committee, He said the projects include commemorative
coins, plates, programs, and souvenirs.
It was moved by Councilman Richard Jennings, seconded by Councilman Joseph DiLoreto,
and passed by the following vote that the City Council set up a fund of $5,000 to be
advanced as needed to the Second Century Committee, and that there be an agreement
between the City and the association covering the payment of funds and disbursement of
funds.
It was noted the funds would be from the Fund Balance of the General Fund.
Councilman Joseph DiLoreto stated although the City should try to recoup the amount
of money it puts into the Centennial, it should not lose sight df the fact that the
initial objective is for enhancement of the City.

Mayor Thomas Morton added that Councilman Walter Temple advised he is in accord
with the Centennial program.
At 8:50 a.m. and with Council concurrence, Mayor Morton adjourned the meeting to
executive session with the City Attorney to discuss a legal matter. He asked the
Chief of Police and City Manager to be present.
The meeting resumed at 9:27 a.m., with Councilmen Joseph DiLoreto, Richard Jennings,
Donald Winton, and Thomas Morton present; Councilman Walter Temple absent.
Ms. Barbara Bradley, 23135 Madison, Torrance, stated she is secretary of the
Rancho Chapter of the California Association of the Physically Handicapped, which is
conducting a wheel-a-thon planned for May 12th through the streets of Downey. She said
the route will be from Apollo Park to the First Baptist Church, and the purpose is to
demonstrate mobility barriers to the handicapped. Ms. Bradley extended an invitation
to the Council to participate, and she distributed a map of the route and a publication
of the California Association of the Physically Handicapped. She answered questions of
Mayor Morton.
Councilman Donald Winton suggested the County Board of Supervisors be asked to
observe the wheel-a-thon. He referred to the Imperial Highway underpass for Rancho Los
Amigos, which has raised curbs leading to Rives Avenue. He said the southern section
of Rancho also has raised curbs.
Councilman Richard Jennings spoke regarding County Supervisor Pete Schabarum's
recognition of senior citizens who will be honored for their contributions in an Older
American Recognition Day ceremony April 28th at the Hall of Administration.. He said
the honorary citizens were selected by the Mayors of 77 cities in the County and by 15
Councilmen of Los Angeles. He requested that through the Mayor a senior citizen be
selected from Downey.
Mayor Thomas Morton informed Councilman Jennings that Mr. Donald Riggs was chosen
from Downey, and it was handled through the Mayor's office.
Councilman Richard Jennings stated his disagreement to the special ad hoc citizens
committee to aid in the preparation of necessary elements in the General Plan, which
he said is the result of the joint meeting between the Planning Commission and City
Council. He pointed out that $20,000 was appropriated by the City Council for develop-
ment of a precise zoning plan, and now the sum is being used for the purpose of the
General Plan, specific elements as required by the State, and also for the Comprehensive
Zoning Plan. Councilman Jennings requested rather than going through the appointment of
committees and intensive study of the various elements of the General Plan, that the
elements be given a broad brush treatment with only the necessary ingredients as re-
quired by State Law and then go on to the Comprehensive Zoning Ordinance.

Councilman Donald Winton indicated he agreed with Councilman Jennings and that he
would be appointing people to the ad hoc committee. He said the committee should touch
only the areas required to the minimum standards of State law, inasmuch as State law
could change several months from now.
Councilman Winton requested, if possible, through coordination with the Mayor's
office, City Manager, and appropriate staff, that a time and date be set during the day
for the Council to make a field trip of the Century 109 Freeway area. He said there
are significant problems that are not being taken care of.
Mayor Thomas Morton stated the comments of Councilmen Jennings and Winton regarding
the environmental study should be listened to. He said the committee was set up to
give some assistance toward meeting the State requirements for a certain date. Mayor
Morton concurred that the real thrust of employing the consultants was to come up with
an ordinance that implements the General Plan. He recommended the consultants spend
their time on getting the ordinance on the General Plan adopted, inasmuch as that was
the reason he voted in favor of their employment.
There being no further business to come before the City Council, the meeting was
adjourned at 9.38 a.m. in memory of William Stickle, former Park & Recreation Department
employee.
