Adams, First Baptist Church, followed by the Flag Salute led by Police Chief Loren Morgan. Mayor Thomas Morton declared that this is the time and place for the public hearing on Lot Cleaning Program - 1973 Season. He inquired if City Clerk Robert Shand had the Affidavit of Mailing, to which Mr. Shand responded in the affirmative. It was moved by Councilman Walter Temple, seconded by Councilman Joseph DiLoreto, and so ordered to receive and file the Affidavit. Mayor Morton inquired if City Clerk Shand had received any written protests, and Mr. Shand replied he had not. Mayor Morton inquired if there was anyone present who wished to speak in protest to the matter, and there was no response. It was moved by Councilman Joseph DiLoreto, seconded by Councilman Walter Temple, and passed by the following vote to close the hearing on Lot Cleaning Program - 1973 Season. Council Minutes 3/27/73 -1- Mayor Thomas Morton mentioned there are one or two lots on Telegraph Road west of Paramount Boulevard in District Three that need to be looked into. It was moved by Councilman Donald Winton, seconded by Councilman Walter Temple, and so ordered to approve the Minutes of the City Council Meeting of March 12, 1973. Communication from City of Los Angeles regarding Emergency Computer Relief Act. Ordered filed. Communication from City of Cudahy regarding txpenditure of Gas Tax Money. It was moved by Councilman Donald Winton to authorize a letter from the Mayor, indicating Downey's opposition to a resolution of this nature. After discussion and there being no objections, the City Manager was authorized to draft a letter for the Mayor's signature. Communication from League of Women Voters regarding Public Transportation Service. It was noted that there would be some financial commitment on the part of the City if such a project is undertaken. There being no objections, the matter was referred to Budget Study. Councilman Donald Winton suggested Staff research the matter and make recommenda- tion to the Budget Committee for consideration. Mayor Thomas Morton stated consideration should be given as to what effect there would be on the finances of the City, as well as the franchise taxi service in the City. Communication from Dorothy H. Chadwick regarding Appeal, E.I.R. Adde Zone Exception Case #1121,, Southwest Corner Orange and Montgomery Street. Responding to questions by Councilman Temple, Public Works Director Ervin Spindel stated that on all underground construction such as this the specifications are written to minimize the inconvenience to businesses and residences,. Parks & Recreation Director James Ruth explained it is necessary to complete the fire grading; that the next phase will be to put in the irrigation system and parking lot„ He said it is hoped these elements will be well under way by July 1st. Councilman Walter Temple asked the City Attorney if he should abstain from voting on this matter since the work was done by Sully -Miller, a subsidiary of his employer. City Attorney Royal Sorensen replied that an abstention would only be necessary on awarding the contract. AYES: 5 Councilmen: DiLoreto, Jennings, Temple, Winton, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mayor Thomas Morton mentioned the water problem near the railroad tracks at the intersection of Firestone and Old River School Road on the access road and requested it be looked into, Council Minutes 3/27/73 -3- Councilmau Walter Temple inquired about the water behind Albertson°s market on Firestone and Rives Avenue that builds up when it rains and stands for long periods of. time. Public Works Director Ervin Spindel explained inasmuch as this is private property, it would be up to the property owner to take care of the problem. He said he will con- tact the property owner to see if this problem can be alleviated. It was moved by Councilman Donald Winton, seconded by Councilman Richard Jennings, and passed by the following vote to approve the extra work and contract revisions at a net increase of $2,358.12 and accept the improvements completed in conjunction with Cash Contract #327 Rio Hondo Golf Course Sprinkler System, and the responsibility for maintenance thereof. Imperial Highway. AYES: 5 Councilmen: DiLoreto, Jennings, Temple, Winton, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes 3/27/73 -4- Resolution ct ReDorts Revised Guidelines Relative to the Pre of Environmental Planning Director William Goggin explained the Guidelines have been prepared and reviewed by the City Attorney, and they include everything the State requires, He said the Guidelines follow the example prepared by the State. In further explanation of the proposed Guidelines, Mr, Goggin stated this will make it easier for an applicant to file an EIR because there are a large number of categori- cal exemptions. He said there is also a large amount of negative declarations which will not require an EIR to be made by the applicant, Mr. Goggin explained that the proposed Guidelines reduce the number of lengthy filings for applicants, and he referred I o the burden that will be placed on the Planning Department with sending out notices and re -writing the EIR's in final form for presentation to the Planning Commission. Referring to the short and long forms for EIR's, Mr. Goggin stated the short form is termed a negative declaration, and an EIR would be considered a long form, Councilman Joseph DiLoreto requested the Council consider at a later date a review of the filing .fees on the basis of the amount of work precipitated on the Planning Department. Mr. Goggin explained that in July or August the Resources Board will send a review for any corrections or changes they feel should be made, which will give the Planning Department time to make a determination of what the costs will be. Councilman. Richard .Jennings inquired if the proposed Guidelines contained any addi- tions to the State requirements, Mr. Goggin stated several additions have been made, including an appeal procedure, Councilman. Jennings requested that he receive in writing the City's additions to the State -prepared form. RESOLUTION NO. 2778 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING REVISED GUIDELINES RELATIVE TO THE PREPARATION OF ENVIRONMENTAL IMPACT REPORTS The Resolution was read by title only. It was moved by Councilman Donald Winton, seconded by Councilman Walter Temple, and so ordered to waive further reading. AYES* 5 Councilmen: DiLoreto, Jennings, 'Temple, Winton, Morton NOES* 0 Councilmen: None ABSENT: 0 Councilmen: None Appeal, Zone Exception Case #1108, 7302 Hannon Street, Planning Director William Goggin reviewed the subject zone exception case. He said the Council indicated at the public hearing that it might approve the enclosure of the porch area; that the side yard pad and recommendations as to landscaping were left in abeyance.. Mr. Goggin stated during the public hearing it was mentioned that the Planning Commission had considered the possibility', of modification of up to 30 percent of the landscaping for rock and plant materials., Councilman Walter Temple commented that the property owner has put in planters; that the landscaping does not consist entirely of rock. Discussion followed. Questions were raised regarding reference to a revised landscaping and building plot plan.dated February 21st and what the special plan would be should Council decide to make a determination on this matter. Mr. Goggin explained all of the maps', submitted are dated February 21st, inasmuch as that is the date the case was received; that any map used will be updated to meet what- ever Council approves, Council Minutes 3/27/73 -5- City Attorney Royal Sorensen stated the proposed condition pertaining to the revised landscaping and building plot plan should be changed to provide approval subject to the Council's approval of a revised landscaping and building plot plan. Mr. Goggin described the previous plot plan. Discussion followed regarding construction of a parking pad in the corner side yard setback area which was constructed in violation of the Code. Councilman Richard Jennings stated he does not feel the zone exception should be considered until the violation is corrected. Mayor Thomas Morton requested the City Manager to obtain a copy of the previous Council meeting to determine exactly what happened regarding this zone exception appeal. Mayor Morton adjourned the meeting to executive session at 8:55 a.m. for the City Attorney to brief the Council on current litigation regarding the Century Freeway. The meeting resumed at 9:30 a.m. with all Councilmen present. Further discussion resumed regarding Appeal, Zone Exception Case ,$1108.. Planning Director Goggin displayed maps submitted by the property owner. It was moved by Councilman Walter Temple, seconded by Councilman Donald Winton, and passed by the following vote to approve Appeal, Zone Exception Case #1108, 7302 Hannon Street, subject to the conditions of the City of Downey Planning Commission. AYES: 3 Councilmen: DiLoreto, Temple, Morton NOES: 2 Councilmen: Jennings, Winton ABSENT: 0 Councilmen: None Clarifying his "no" vote, Councilman Richard Jennings stated that he will never vote in favor of a zone exception when the applicant is in violation of the conditions as set forth in a previous zone exception. Councilman Donald Winton concurred. MANAGER'S REPORT City Manager Charles Thompson reported on a request to utilize (on an evaluation basis through the summer months) the State Job Bank Program for assistance in the Youth Employment Service (YES) office. He said if approved, this would be done on an informal basis whereby the State would provide an employee to work in the YES office, to be under the supervision of the YES supervisor. Mr. Thompson stated the Program is new with the State and is a computerized arrangement whereby jobs are listed and print-outs made on the jobs within the area and State for use in all Human Resources Development (HRD) offices, He said inasmuch as there is now only one person in the YES office, this would enable the office to remain open longer hours than is currently being done. Mr, Thompson remarked that since the program would run through the summer months, this would enable Staff to make a report on the advisability of any further use of the HRD employee. He noted that the Job Bank Program would not conflict with the Downey Youth Employment Service. Mr, Thompson answered questions of the City Council. He commented that the nearest location for placing an application with the Job Bank Program is in Norwalk. Discussion followed. Councilman Donald Winton requested the matter be taken under submission for addi- tional research. Mayor Thomas Morton commented on the additional office space that would be required within space now allocated to the Downey Historical Society, which has been one of Downey°s most concientious groups. He said they have met constantly and have had an on -going program, and he would not concur with diluting their area. The matter was taken. under submission. City Manager Charles Thompson spoke regarding a report pertaining to consideration on the Impact of the Proposed 105 Century Freeway, which is not an impact report as such. In brief, he said, the report addresses itself to land use; traffic and neighborhood circulation problems; design standards in the performance agreement; effect on the area with regard to noise, pollution, and cost to the City; impact with regard to the delay Council Minutes 3/27/73 -6- occasioned by the present Court case; effect on property values and recreation; state- ments with regard to an alternate route possibility or elimination of the Freeway entirely; and., overall indications with respect to a transportation system as implemented by the 105 Freeway. It: was moved by Councilman Richard Jenningsy seconded by Councilman Donald Winton, and passed by the following vote to approve forwarding to the State the Report pertaining to considerations on Impact of the Proposed 105 Century Freeway. AYES: 5 Councilmen: DiLoreto, Jennings, Temple, Winton, Morton NOES: 0 Councilmen.: None ABSENT: 0 Councilmen: None City Manager Charles Thompson requested Council consideration regarding the Employment of Mr. Mike Testis on a trial evaluation basis as Drug Diversion Counselor, for the remainder of the fiscal year. He explained that Mr. Testi would be contacting all the junior high and high schools and he would have assignments meeting with various groups, youth organizations,, talking to parents, and contacting people as a result of referrals made through the Police Department pertaining to drug use. .. Discussion.•followed. Councilman Joseph DiLoreto stated he agrees the program has worthwhile value, however, it would be adding another employee. He said the matter should be properly brought up at Budget time, Police Chief Loren Morgan explained Mr. Testi would be involved with the following: Counseling persons arrested for drug offenses or offenses prompted by drug use; contact- ing persons referred by Police officers; counseling parents of juveniles with drug problems; trying to 'work out a meaningful kind of communication between the parent and youngste.-;and responsibility for conducting a, drug education program in the schools. He commented that Mr. Testa has been used by the Police Department during the last year because of his knowledge and experience with the drug problem., Chief Morgan spoke of Mr'. Testi's effectiveness in the high school program and that the program has been authorized 'by Dr, Gallegos, School Superintendent. Connerr,ing further, Chief Morgan stated it is expected Mr. Testi would be conducting other commuatv droag programs; that his office would temporarily be at the Youth Employ- ment office and would be coordinated with the Police Department. He said it is important to evaluate tGi.s Type of` program and he urged approval, inasmuch as there are funds dvai.latle in the current budget for paying Mr. Testi's salary. Cbiet Morgan answered questions of. the City Council, It was moved by Councilman Donald Winton., seconded by Councilman Richard Jennings, and passed by the following vote to approve the Employment of Mr. Mike Testi, as Drug Diversion Counselor, and to authorize the expenditure of $2,115 to pay Mr. Testi. for tue remaining 1972-7s fiscal year. AYES: 4 Councilmen: Jennings, Temple, Winton., Morton NOES: 1 Councilmen.: DiLoreto ABSENT: 0 Councilmen: None It was requested that a. complete report. on Mr. Testis services be received prior to approving the Budget for the 1973-74 fiscal year, and it was noted by Mayor 'Thomas Morton that in no event is Mr, Testi to be considered officer status or assigned or permitted to carry a weapon, ORAL COMMUNICATIONS Councilman Walter Temple inquired regarding the status of a report on Abandoned iervice Stations. He was informed by Mayor Thomas Morton that the report will be forthcoming. Councilman Donald Winton introduced his sister, Ravenal Hendrix, from Napa, California, Councilman Joseph DiLoreto reported the Apartment House Survey Committee will be meeting next 'Tuesday for the finalization of its report. He said the report will be transmitted to the Council for its perusal and scrutiny. Council Minutes 3/27/73 -7- Mayor Thomas Morton reported that the Cable TV Committee had its second session which was very well attended. He said it is proving out in the two sessions that the City Council has made a wise decision in forming a study committee, inasmuch as other Cities have moved ahead on the basis of adopting ordinances and preparing franchises on their own and have been in serious difficulties. Mayor Morton commented on the stations proposed for Cable TV for use in the home, schools, teaching of specialized classes, medicine, etc. He said the Committee will be meeting the fourth Monday night of each month, and he invited the Council and citizens to attend. Councilman Richard Jennings and Mayor Thomas Morton discussed the communication regarding Public Transportation Service from the League of Women Voters. Mayor Morton indicated there are implications of City funds involved, and the City has other priorities. Councilman Donald Winton was excused from the meeting at 10:10 a.m. Councilman Walter Temple mentioned the matter of Setting a joint meeting between the Planning Commission and City Council. Mayor Thomas Morton requested this be held over to the next meeting. Mrs. Hazel Scotto, League of Women Voters, addressed the City Council regarding Public Transportation Service. She asked if referring the matter to Budget Study would include a study on the need for such a bus service. She also requested information on reference made to a franchise taxi service. Mayor Thomas Morton explained a survey made by another City may not be apropos to the City of Downey; that the City Manager will be expected to take a look at what other Cities have done. He said the City of Downey has granted a franchise for taxi service; that he would be interested in knowing whether or not the Public Transportation Service would be undermining private enterprise; and if the service is so vital, why hasn't private enterprise undertaken such a venture. Mayor Morton referred to the Helicopter Program undertaken by the City. He said studies initially indicated it would be well used, however, such was not the case, and with that background experience, he would want to take a good hard look at Public Transportation Service. Mrs. Scotto commented further on favorable developments of the Public Transporta- tion Service in Orange County. Planning Director William Goggin stated that VTN Consolidated, Inc., who has con- tracted with the City for the Environmental Resources Management Element for the Cit 's Comprehensive General Plan, has set up a tentative schedule for this matter to be before the City Council for adoption by the end of June. He said it is requested that there be a joint meeting between the Planning Commission and City Council early in the program to discuss all the necessary City goals. Mr. Goggin mentioned it is requested April 25th or 26th be set aside for the joint meeting, inasmuch as it is important to have the meet- ing prior to the public hearings. He stated a complete chart of the program will be sent to the Council sometime in the next week, and a memo will be transmitted concerning appointments to committees. The Mayor and City Council indicated they would have to check their calendars prior to scheduling a joint meeting.
